City Clerk of the City of Elgin, in the Counties of Kane and
Cook in the state of Illinois, and that as such City Clerk I
am the keeper and custodian of the files and records of said
City of Elgin and the seal thereof .
I DO FURTHER CERTIFY that the attached is a full,
true, and correct copy of Ordinance No. S1-96 entitled "An
Ordinance Vacating Kelly Circle in the Fox Bluff Corporate
Center" passed by the Elgin City Council at its meeting held

AN ORDINANCE
VACATING KELLY CIRCLE IN THE FOX BLUFF CORPORATE CENTER
WHEREAS, the City of Elgin is the owner of the property
commonly known as the Fox Bluff Corporate Center in the City
of Elgin, Kane County, Illinois; and
WHEREAS, as part of development efforts within the City
of Elgin the City recorded a plat of subdivision for the Fox
Bluff Corporate Center which included the creation and
dedication of streets therein, including Kelly Circle; and
WHEREAS, the City has agreed to a contract for the sale
of property within the Fox Bluff Corporate Center including
Kelly Circle; and
WHEREAS, Kelly Circle is no longer necessary to serve the
public and the public interests will be served by vacating
Kelly Circle.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS:
Section 1 . That the public street in the City of Elgin,
Kane County, Illinois, legally described as follows :
Kelly Circle lying within Fox Bluff Corporate
Center, being a subdivision of part of Section 27,
Township 41 North, Range 8 East of the Third
Principal Meridian, according to the plat thereof
recorded as Document No. 92K59007 , being in the City
of Elgin, Kane County, Illinois and containing 0 . 65
acre more or less .
be and the same is hereby vacated.
Section 2 . That all easements including all public
utility easements within said vacated Kelly Circle be and the
same are hereby vacated.
Section 3 . That the 20 foot public utility easement
adjacent and parallel to said vacated Kelly Circle be and the
same is hereby vacated.
Section 4 . That the 35 foot building line adjacent and
parallel to said vacated Kelly Circle and be and the same is
hereby vacated.
Section 5 . That a certified copy of this ordinance
together with a plat of said vacated right of way, easement
and building line be filed with the Recorder of Deeds of Kane
County, Illinois .

Section 6 . That this ordinance shall be in full force
and effect upon the payment of compensation by the contract
purchaser as set forth in the pending contract to purchase the
said vacated street and surrounding property.

SUBJECT: Vacation of Kelly Circle/Fox Bluff Corporate Center
PURPOSE
The purpose of this memorandum is to present to the Mayor and
members of the City Council an ordinance vacating Kelly Cir-
cle in the Fox Bluff Corporate Center.
BACKGROUND
emb. Harting Elektronik Company is purchasing 9 .72 acres of proper-
ty in the Fox Bluff Corporate Center for the purpose of con-
structing its North American headquarters and manufacturing
facility. In order to provide adequate property for the
development of the project, Kelly Circle must be vacated.
Kelly Circle currently provides access to lots 29, 30, 31, 32
and 33 . Lots 32 and 33 are now part of the Elgin Corrugated
Box property acquisition. Lots 29, 30 and 31 are part of the
Harting property acquisition and will be incorporated into
that project's overall sight design.
COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
None.
FINANCIAL IMPACT
The right-of-way to be vacated will be sold to Harting at
$2.25/sq. ft. The value of the vacated right-of-way is in-
cluded in the $960,750 sales price to Harting Elektronik. In
addition, the City will not be required to construct Kelly
Circle.

None.

RECOMMENDATION
It is recommended that the Mayor and members of the City
Council authorize the vacation of Kelly Circle.
