HomeMy WebLinkAboutS19-01 Ordinance No. S19-01 AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET (Jackson Street) WHEREAS, the public interest will be served by vacating a portion of a public street in the City of Elgin, Kane County, Illinois, as shown in Exhibit "A" attached hereto; and WHEREAS, said property is not necessary to serve the public . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS : Section 1 . That a portion of a public street in the City of Elgin, Kane County, Illinois, legally described as follows : Of that part of Summit Street (now Jackson Street) lying southeasterly of the southeasterly line of Mountain Street and lying northerly of the northerly line of Galena Street (now Highland Avenue) as platted in Elgin, being part of Sections 13 and 14, Township 41 North, Range 8 East of the Third Principal Meridian, containing 7, 328 square feet more or less . be and the same is hereby vacated. Section 2 . That the City of Elgin does hereby reserve for and to itself and for and to any public utility company owning any public utility or public service facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public utility or public service facilities, including but not limited to the City of Elgin existing sanitary sewer and storm sewer, and to maintain, renew, extend or construct or reconstruct any such public utility or public service facilities . No buildings or other permanent structures shall be constructed upon said right-of-way vacated by this ordinance . Section 3 . That a certified copy of this ordinance together with a plat of said vacated right-of-way be filed with the Recorder of Deeds of Kane County, Illinois. Section 4 . Parker, City Manager NEIGHBORHOOD VITALITY SUBJECT: Closure and Abandonment of Jackson Street between Mountain Street and West Highland Avenue PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider a recommendation to close and abandon the street and right-of-way of Jackson Street between Mountain Street and West Highland Avenue. BACKGROUND Residents approached the City concerned about the intersection of Jackson Street and West Highland Avenue. The Neighborhood Services Committee (NSC) reviewed the request and developed the idea of a more comprehensive neighborhood solution. Closing one block of Jackson Street between Highland and Mountain was recommended for a trial period. The closure was sought to 1) remove responsibility of the City for street sweeping and snow plowing on a street with a steep grade; 2) remove a traffic problem of cars cutting across both lanes of Highland Avenue when crossing Jackson Street; 3) provide more controlled access to the Near West neighborhood. After the closure, neighborhood traffic was focused onto the intersection of Mountain and Highland and Crystal and Highland. The City operating departments reported no adverse issues from the closure in a NSC meeting to discuss the trial period (no accidents or street maintenance issues) . It is important that if the road is closed, ownership be offered to the adjoining property owners . Leaving the property without clear ownership and responsibility would create potential problems for maintenance, loitering, and use of the property. As the abandonment is the City' s suggestion, it is recommended that the property be offered at no cost to the adjoining property owners and that the City remove the pavement, curb, and gutter and replace with soil and sod, and construct driveway access to the property owners' s driveways . The one-time investment will remove future rft. maintenance and reconstruction costs. ew. Jackson Street Closure June 14 , 2000 Page 2 COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED The adjoining property owners, Edward and Monica Hendrich (420 W. Highland Avenue) , and Kenneth Timke (330 W. Highland) , have been contacted and support the recommendation. Support memorandum from the neighborhood officer with the Grant Street neighborhood and from the resident officer for the Near West neighbors are attached. These officers have been in contact with the neighborhood associations including the Near West Neighborhood Association and the Grant Park Neighborhood Association. Neither group presented objections to the trial street closure nor making it permanent . J{�/,( FINANCIAL IMPACT /'�� Removal of the street pavement and sidewalk, installation of the replacement driveway, and restoration work is estimated at $32, 000 which would be funded from General Fund Contingencies, 010-6902- 719. 84-01, where a $260, 000 balance remains. Once vacated, the property becomes responsibility of the private owners for maintenance and property taxes . WLEGAL IMPACT An ordinance vacating the portion of the right-of-way will be required. The ordinance vacating the street would retain any necessary utility easements . ALTERNATIVES Alternatives include reopening the street, closing the street and leaving it as City property, or abandoning the right-of-way with easements for utilities. RECOMMENDATION It is recommended that the right-of-way of Jackson Street between Mountain Street and West Highland Avenue be abandoned, that utility easements be established, and that the City remove the pavement and road improvements and replace them with private drive accesses from Mountain Street as necessary. em. Highland Elgin,IL 60123 Mr. Clay Pearson; Per our phone conversation,we understand that we are to receive one half of the property which was formerly Jackson street,running south from Mountain to Highland Avenue. Because this property is directly adjacent to the rear(east)of our property(420 W. Highland), we are concerned as to how the property is altered as it will have considerable effect on the appearance and value of our property and our neighborhood. Within the plans to divide the property between ourselves and our neighbors to the east, we request that the city provide a driveway for each property,separated by a grassy area of 6'on each side of the modified property line. We are proposing that a driveway would start approximately 20'from the street(Mountain),and be at least 3'from the existing line of trees. The driveway should extend 65' south, and then move inward(west), and be approximately 24' wide at it's west end. Last year,while digging to plant landscaping hedges,we unearthed what we believe to be remnants of the original garage and foundation,therefore should we chose in the future to build a garage,this driveway would allow us to recreate the original design. Having unearthed two brick paths on the property, we believe the property can eventually be restored completely. The area from the end of the driveways to Highland should be grassy all the way across(see drawing-not to scale), and all sidewalks should be removed. As members of the Grant Park Neighborhood Association,our concern is not for obtaining additional property,but rather for the long term goal of improvement,beautification,and stabilization of the overall area. There have already been incidents involving loitering in this blocked off area, and damage has been sustained by city property(reflective barricades). Removal of the sidewalks would help to discourage loitering and the disposal of refuse in the area(on several occasions we have found broken beer bottles on our property which could endanger our three year old, one year old, and dogs). Herdrich a 931 A TO: Deputy Chief James Lamkin FROM: Officer Chris Jensen SUBJECT: Jackson Street Closing DATE: May 12, 2000 I have received a positive response from several residents, and property owners regarding the Jackson Street closing. I myself believe that closing Jackson Street will help with traffic accidents in that area. In the past I have been fearful of driving down Jackson Street due to the lack of visibility and steepness of the intersection. I encourage Clay Pearson to move ahead with this project. • • r To: D/C Lamkin From: S/P Hartman Subject: Jackson Street Closing Date: May 15, 2000 I am extremely excited to see NSC permanently close Jackson at Highland. I find the intersection to be quite dangerous and see the positive effects in has on the neighborhood. One being, stopping cut through traffic trough both neighborhoods. T also see the measure as a cheep way to try traffic calming. The only negative I can see about the proposed change is having to travel 2 extra blocks when crossing Highland at Jackson to back up fellow officers.
