AN ORDINANCE 24 109 449
VACATING A PORTION OF FOREST AVENUE LYING EAST OF TEFFT AVENUE
WHEREAS, Forest Avenue, a certain street platted in Oakwood Park Sub-
division and lying east of Tefft Avenue in the City of Elgin, Cook County,
Illinois, has never been improved, maintained or used as such; and
WHEREAS, said property is not necessary to serve the public; and
WHEREAS, the public interest will be best served by the vacation of
that portion of Forest Avenue hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS: C.)
Section 1. That that portion of Forest Avenue being situated within .•
the corporate limits of the City of Elgin, Cook County, ,Illinois, and being C
legally described as follows:
That part of Forest Avenue as platted in Oakwood Park Sub-
division, being a subdivision in the Northwest Quarter of
Section 18, Township 41 North, Range 9 East of the third
principal meridian described-as follows: Beginning at the
Northwest corner of Lot 1 of Block 4 of said Subdivision;

be and the same hereby is vacated for street purposes, upon payment of $10.00
per lineal foot for a total of $660.00.
Section 2. That that portion of said Forest Avenue vacated shall be
zoned "R-2 Residential" as defined in the zoning ordinance heretofore adopted
by the City Council of the City of Elgin, Illinois, and all ordinances amendatory
thereof.
Section 3. That the City of Elgin does hereby reserve to itself and to
any public utility company owning any public service for facilities in, upon
or under said right of way vacated by this ordinance full right of access for
the purpose of continuing dr extending any public service facilities and to
maintain, renew, extend or construct or reconstruct any such public service
facilities.
Section 4. That a certified copy of this ordinance together with a plat
of said vacated right of way be filed with the Recorder of Deeds of Cook
County, Illinois.
Section 5. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.

KNOW ALL MEN BY THESE PRESENTS :
THAT, THE CITY OF ELGIN, a municipal corporation, having no
facilities located thereon and anticipating no future need therefore ,
hereby disclaims all right , title and interest it may have in and to
the following described premises under and by virtue of the utility
easement set forth, granted and reserved by the City of Elgin, by
Ordinance No . S1-77 , to wit :

MEMORANDUM
TO: Mayor and Members of the City Council
FROM: City Manager
SUBJECT: Release In Interest of Vacated Right-of-Way
PURPOSE: This memorandum will provide the Mayor and Council with information to
discuss the release of the full right of access (easement) that was reserved
when a street right-of-way was vacated.
BACKGROUND: The City received a request the early part of 1977 to vacate that
part of Forest Avenue lying east of Tefft Avenue. The City Council acted favorably
in the request and passed an Ordinance (S1-77) on June 8, 1977. However, in that
ordinance the City Council reserved to itself and to any public utility the full
right of access for the purpose of continuing or extending any public service
facilities and to maintain, renew, extend or construct or reconstruct any such
public service facilities. A copy of the ordinance is attached hereto.
Immediately east of the vacated street is the Parkwood Subdivision which is served
by all necessary utilities. There are no public utilities in the vacated portion
of Forest Avenue. Public Works and Planning have reviewed development in the area
and we see no need in the future for any public facility to be installed in this
portion of the vacated Forest Avenue.
FINANCIAL IMPACT: None.
RECOMMENDATION: It is recommended that the City Council Authorize the Mayor and
City Clerk to execute the Partial Easement Disclaimer, a copy of which is attached
hereto.
