AN ORDINANCE
VACATING PORTIONS OF CERTAIN PUBLIC STREETS AND AN ALLEY
(Water Street, Brook Street and Alley)
WHEREAS, the public interest will be served by vacating Water
Street and a portion of Brook Street and a portion of a public
alley in the City of Elgin, Kane County, Illinois, as shown in
Exhibit "A" attached hereto; and
WHEREAS, said property is not necessary to serve the public
for the purposes of public streets and a public alley.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS :
Section 1 . That Water Street and a portion of Brook Street
and a portion of a public alley in the City of Elgin, Kane County,
Illinois, legally described as follows:
Of a 16 . 50 foot wide public alley lying East of the
East line of Grove Avenue, West of the East line of Brook
Street, South of the South line of Lots 63 through 68
both inclusive and North of the North line of Lots 73
through 78 both inclusive all in Phineas J. Kimballs
Addition 2nd Addition Elgin Illinois, being a subdivision
of part of Section 14, Township 41 North, Range 8 East of
the Third Principal Meridian in the City of Elgin, Kane
County, Illinois .
Also
A 49 . 50 foot wide public street known as Water
Street lying East of the East line of Grove Avenue, South
of the South line of Lots 74 through 78 both inclusive,
North of the North line of Lots 79 through 83 both
inclusive and West of the West line of Brook Street as
platted in Phineas J. Kimballs Addition 2nd Addition
Elgin Illinois, being a subdivision of part of
Section 14, Township 41 North, Range 8 East of the Third

Illinois.

A variable width public street known as Brook Street
described as follows : Lots 68 and 73 in Phineas J.
Kimballs Addition 2nd Addition Elgin Illinois, being a
subdivision of part of Section 14, Township 41 North,
Range 8 East of the Third Principal Meridian excepting
therefrom the westerly 8 . 00 feet thereof and that part
lying North of a line described as follows : Commencing
at the northwest corner of Lot 63 in said Phineas J.
Kimballs Addition 2nd Addition Elgin Illinois; thence
South 00 degrees 00 minutes 14 seconds East, along the
West line of said Lot 63 , a distance of 62 . 56 feet for
the point of beginning of said line; thence South 89
degrees 52 minutes 12 seconds East on a line that
intersects with the East line of Lot 51 in said
Phineas J. Kimballs Addition 2nd Addition Elgin Illinois
at a point 61 . 93 feet South, as measured along said East
line, of the northeast corner of said Lot 51, a distance
of 728 . 02 feet for the terminus of said line in the City

SUBJECT: The Centre Property - Vacation & Dedication of
Public Streets and Alleys
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider the
vacation and dedication of public streets and alleys .
rft. BACKGROUND
In order to construct The Centre on the site north of City Hall,
an alley way and two streets needed to be vacated. The streets
are Brook St . between Kimball St . and Symphony Way and Water St .
between Grove Ave. and Brook St .
In addition to the vacation of the above streets, additional
right of way needs to be dedicated for Kimball St . When Kimball
St . was widened from two lanes to five lanes, the widening was
accomplished on property owned by the City to the south of the
existing right of way. The subject dedication plat will
formally dedicate this portion of The Centre site as right of
way.
The Plat of Vacation is attached as Exhibit A and the Plat of
Dedication is attached as Exhibit B.

It is estimated that the cost to record the two plats will be
less than $60, and can be charged to 010-3311-752 . 32-05, General
Engineering, Legal and Recording where the budget is $60 and $60
is available.

ALTERNATIVES
1 . Authorize vacation of the subject streets and dedication of
additional right of way for Kimball St .
2 . Do not authorize the subject street vacation and right of
way dedication.
RECOMMENDATION
It is recommended that the City Council authorize vacation of
Brook St . , Water St . and the pubic alley way within The Centre
site and dedication of additional right of way for Kimball St .
Respectfully submitted for Council consideration.
