Helwig, City Manager SUBJECT: Vacation of Most Center Street between Lincoln Avenue and Slade Avenue PURPOSE The purpose of this memorandum is to provide information for the Mayor and members of the City Council to consider vacat- ing the majority portion of the Center Street right-of-way between Lincoln Avenue and Slade Avenue to Sherman Hospital . BACKGROUND In 1983, Sherman Hospital, the Northeast Neighborhood, and the City entered into a long-range planning exercise for the area adjacent to the Hospital . This planning effort resulted in the designation of development areas for the Hospital in the neighborhood. Park Development Development of a park for the neighborhood was envisioned as a part of this planning exercise. Since parking lot improvements and vacation of most of Center Street is now ready to move forward, Sherman Hospital is willing to develop the neighborhood park now. The park will be approximately 1/4 acre in size (equal in size to one lot) . The park will be deeded to the City for public use and maintenance. This action is occurring nearly ten years earlier than anticipated. Vacation of Center Street In accordance with the above plan, Sherman Hospital will consolidate their parking lots and construct the park when eme.- the City vacates most of the Center Street right-of-way (see attached graphic) . Vacation of Center Street September 19, 1996 Page 2 In addition to the advantage of having additional passive open space in the neighborhood, the park serves as a buffer between the Hospital and the residential area. Moreover, Sherman Hospital will close Center Street to through traffic once vacated, using decorative bollards across the former street. This measure will improve traffic calming in the neighborhood, eliminating cut through traffic to the Hospital and the parking lot on this route. Public utilities in the right-of-way Access to public utilities will be retained in easements (see attached memorandum dated August 15, 1996 ) . The vacation ordinance will include the necessary easements . A plat of vacation is being prepared. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED Representatives of Sherman Hospital and the Northeast Neigh- bors have been contacted regarding the proposed right-of-way vacation and are supportive of the proposal. Please see the attached letter from the Northeast Neighbors . As an additional neighborhood and Hospital initiative, Sherman Hospital will be acquiring and maintaining a buffer of residential properties on Cooper Avenue and Prospect Avenue. The Hospital is committed to maintaining these properties in the excellent standard of the neighborhood. FINANCIAL IMPACT The estimated cost of preparing a plat of vacation is $500 to $600. There are sufficient funds in the Planning Department budget (010-1504-715-32-05) to cover the costs of obtaining the plat of vacation. In 1984, the City Council adopted an ordinance (G52-84 ) providing a fee of $670 for vacating any property owned by the City. Although the City will be receiving no monetary compensation for the easement, the project is another in a series of cooperative ventures among the City, the neighborhood, and Sherman Hospital. Moreover, Sherman Hospital will be deeding the park land to the City, providing consideration for the easement in lieu of the payment of $670. LEGAL IMPACT None. Vacation of Center Street September 19, 1996 Page 3 em- ALTERNATIVES The first alternative is to proceed with the vacation. Alternatively, although the Long Range Concept Plan includes the vacation of the Center Street right-of-way, the Plan does not reference a specific date for the proposed action. Therefore, the City could delay the vacation at this time. RECOMMENDATION Since representatives of Sherman Hospital and the Northeast Neighbors have expressed support for this action, now is the appropriate time to process the proposed right-of-way vacation. Helwig City Manager RKD/DL/sll Attachment Northeast Neighborhood Association of Elgin Sept. 2, 1996 Elgin, Illinois 60120 Dear Members of the City Council : The North East Neighborhood Association has observed some of the recent site improvements at Sherman Hospital . The street lighting along Slade Ave. aswell as the corner flower beds are an attractive addition to the streetscape. We have also observed some parking lot improvements which we believe will further enhance Sherman Hospital's appearance. With these improvements in mind we would like to voice our support for one of the improvement mentioned in the concept plan of 1983 . We believe that the city has an agreement with Sherman Hospital to abandon the use of Center Street between Lincoln Ave. And Slade Ave. The purpose in doing this was to provide additional parking space without the demolition of more homes in a confined setting. Sherman Hospital was then required to deed the city a small piece of land bordering Lincoln Ave and Center Street to create a buffer between its business and the residential area south of Lincoln Ave. It is our understanding that Sherman Hospital wants to execute this arrangement since they are doing parking lot improvements at this time. This makes very good sense to us since it will minimize future demolition of an area of their south parking lot. We also feel that the abandonment of one block of Center Street makes good sense as Sherman anticipates the addition of a Doctor's office building. It is also part of the plan to block off the end of parking on the abandoned section of Center Street. We believe this is an intelligent way to confine traffic within the parking lot and minimize hospital traffic exiting through the neighborhood. Therefore, we urge the city to execute the agreement with Sherman Hospital , accepting the single parcel of land in lieu of two parcels bordering Lincoln Ave. and abandoning the use of one block of Center Street. We look forward to seeing a passive park area in our neighborhood to add to aesthetics. We approve of the parking lot configuration because it affords us minimal traffic on smaller residential streets. We encourage Sherman Hospital to continue its course of appearance improvements. We hope that Sherman Hospital cares about the maintenance and responsible management of their rental homes along Prospect Ave. as much as we care about our homes. Their continued efforts, along with ours will result in a more attractive and revitalized neighborhood. Thank you for considering our opinion. This memorandum is prepared to provide background relating to the potential vacation of part of Center Street. The portion of Center Street that is being considered for vacation lies between Slade Avenue and Lincoln Avenue. A 1983 Comprehensive Development Plan for the area in the vicinity of Sherman Hospital proposed the vacation of one block of the right-of-way of Center Street. Also included in this comprehensive plan is the transfer of lands at the northeasterly corner of Lincoln Avenue and Center Street from,Sherman Hospital to the City for use as a neighborhood park. All the vacated right-of-way from Center Street would revert to Sherman Hospital with the exception of the residence at the northeasterly corner of the Center/Lincoln intersection. That part of the right-of-way would revert back to the owner of the residence. The City has public utilities including water, sanitary sewer and storm sewer in this right-of-way. _ Consideration must be given to how these utilities will be handled in the future regarding maintenance and operation. WATER A 6-inch water main under the pavement on the easterly side of Center Street serves as a loop in the municipal water distribution system, but does not service any particular residence. All houses on Center Street have been demolished previously. It is proposed that a 10-foot public utility easement centered over the watermain be retained by the City. r Page 1 • CITY OF ELGIN ENGINEERING DIVISION SANITARY SEWER An 8-inch sanitary sewer serving only the hospital flows southerly from Slade Avenue to Lincoln Avenue in the.center of the right-of-way. All other services to this line have been disconnected, and the buildings have been demolished. A copy of the sanitary sewer plans in this area are attached for general information. It is recommended that this sanitary sewer be donated to Sherman Hospital during the vacation of the right- of-way. It could then be treated as a private sanitary sewer servicing a single unit. Accordingly, municipal responsibility for maintenance ofthe sanitary sewer would start at the manhole at the intersection of Lincoln and Slade Avenues. STORM SEWER A 10-inch storm sewer serving municipal inlets at the intersections of Slade Avenue and Center Street as well as at Lincoln Avenue and Center Street lies under the pavement on the easterly side of Center Street.
