AN ORDINANCE
VACATING AN ALLEY
WHEREAS there is a certain alley situated between the buildings located
at 169 East Highland Avenue and 22 North Spring Street, Elgin, Illinois; and
WHEREAS there is no record that said alley was dedicated to the City of
Elgin, and
WHEREAS the City of Elgin may have acquired some right, title or interest
in and to said alley; and
WHEREAS said alley is not necessary to serve the public; and
WHEREAS the public interest will be subserved by vacating said alley and
surrendering any right, title or interest, if any, that the City of Elgin may
have in and to said alley.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That the alley situated between the buildings located at 169
East Highland Avenue and 22 North Spring Street, Elgin, Illinois and legally
described as:
The West 11 Feet of the East 22 Feet of the North 88 Feet of
Lot 2 in Block 16 of James T. Gifford's original plat of Elgin
in the City of Elgin, Kane County, Illinois,
be and the same is hereby vacated.
Section 2. That the City of Elgin does hereby reserve to itself and to
any public utility company awning any public service for facilities in, upon or
under said alley vacated by this Ordinance full right of access for the purpose
of continuing or extending any public service facilities and to maintain, renew,
extend or construct or reconstruct any such public service facilities.
Section 3. That a certified copy of this Ordinance, together with a plat
of said alley vacated be filed with the RECORDER OF DEEDS OF KANE COUNTY.
Section 4. That all ordinances or parts of ordinances in conflict with
the provisions of this Ordinance are hereby repealed.
Section 5. That this Ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
