i Ordinance No. G62-19 AN ORDINANCE AMENDING TITLE 19 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, ENTITLED "ZONING" REGARDING DRIVE-THROUGH FACILITY GRAPHICS WHEREAS,a written application has been made to amend Chapter 19.50.090 of the Elgin Zoning Ordinance entitled "Special Street Graphics"; and WHEREAS, the Planning & Zoning Commission conducted a public hearing concerning said application on November 4, 2019 following due notice including by publication; and WHEREAS, the Community Development Department and the Planning & Zoning Commission have submitted their Findings of Fact concerning said application; and WHEREAS, the Community Development Department and the Planning & Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Community Development Department and the Planning & Zoning Commission; and WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, zoning, including but not limited to,regulations in the city's zoning ordinance relating to drive-through facility graphics, pertain to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 19.50.090.D. of the Elgin Municipal Code, 1976,as amended, entitled "Drive-Through Facility Graphic" be and is hereby further amended as follows: "D. Drive-Through Facility Graphic: A drive-through facility graphic shall be permitted only in the NB Neighborhood Business District, AB Area Business District, CC2 Center City District, and CI Commercial Industrial District Zoning Districts, as well as the like planned development districts, and in conjunction with a drive-through facility. A drive-through facility graphic shall be either a monument graphic or a wall graphic. 1. Size: No drive-through facility graphic shall exceed sixty (60) square feet in surface area or eleven (11) linear feet in height. The surface area of drive-through facility graphics shall not limit the surface area of other allowable signage on a zoning lot. 2. Number: The maximum number of drive-through facility graphics shall be two (2) such graphics per drive-through lane, with a maximum of four (4) such graphics per business. The number of drive-through facility graphics shall not limit the number of other allowable signage on a zoning lot. 3. Base Material: A new monument-style drive-through facility graphic associated with a newly constructed "principal use" [SR] shall have a masonry base. Where a new monument-style drive-through facility graphic is added at an existing "principal use" [SR], or where an existing drive- through facility graphic is replaced at an existing"principal use" [SR], the new or replacement monument-style drive-through graphic may include as its base a fabricated metal box of a color, style, and material consistent with the graphic; the exception for the fabricated metal box is where a masonry base already exists, in which case a masonry base shall be provided. 4. Electronic Changeable Copy: A drive-through facility graphic may include an electronic changeable copy graphic. The electronic display panel shall be operated in compliance with the standards of subsection I.S. a. through f.of this section 19.50.090,except the rate of change may be more frequent so that said panel is responsive to employee-customer interactions. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 3. Draft Ordinance BACKGROUND The City of Elgin, as applicant, is proposing to amend Chapter 19.50, "Street Graphics" of Title 19,"Zoning",of the Elgin Municipal Code, 1976,as amended,to modify the regulations for drive- through facility graphics. Many retail service-oriented businesses, such as fast-food restaurants, banks, car washes, and others provide drive-through service for their customers. Each establishment,particularly fast-food restaurants,has drive-through facility graphics along its drive-through lanes advertising food menu options or other services provided by the establishment. The sign ordinance allows commercially-zoned properties located in the NB Neighborhood Recommendation & Findings of Fact Petitions 33-19 November 4,2019 Business District, AB Area Business District, CC2 Center City District, and CI Commercial Industrial District to have up to two drive-through facility graphics each with a maximum of 60 square feet in sign surface area and maximum 11 feet in height. A drive-through facility graphic may be a wall-mounted graphic or a monument graphic. The monument drive-through facility graphic is required to have a masonry base. Drive-through facility graphics are not permitted to have an electronic changeable copy with an electronic display panel.The size and number of drive- through facility graphics does not limit the number or the size of other allowable graphics on the property. Fast-food restaurants are starting to develop "pre-order" menu graphics in addition to regular drive-through menu graphics. The proposed amendment can be summarized as follows: 1. Increase the maximum number of drive-through facility graphics permitted to two graphics per drive-through lane,with a maximum of four drive-through facility graphics per zoning lot. 2. Allow a maximum of 60 square feet of sign surface area and maximum 11 feet in height for each drive-through facility graphic with a maximum(not to exceed) 100 square feet of sign surface area per one drive-through lane. 3. Allow drive-through facility graphics to have electronic changeable copy via an electronic display panel. 4. A new drive-through monument graphic for a new establishment(such as a new restaurant) would continue to be required to have a masonry base. However, new drive-through monument graphics at existing establishments,or where an existing drive-through graphic is being replaced,would be permitted to have a fabricated metal box as its base,unless the drive-through monument graphic already has a masonry base, in which case the masonry base would still be required. This change takes in to account the reality of site constraints at existing establishments. There is often little room around the base of existing drive-through monument graphics to accommodate a masonry base,which often requires its own foundation to support the new masonry material. When a new establishment, such as a restaurant, is being constructed, one can design the site to accommodate adequate space around the drive-through monument graphics for a masonry base. The proposed changes to the drive-through facility graphic regulations are summarized in the Table 1 below: - 3 - Recommendation& Findings of Fact Petitions 33-19 November 4,2019 Table 1. The proposed amendment would not affect any other graphics otherwise allowed by the sign ordinance. Those that do tend to allow smaller surface area of drive-through graphics than Elgin, but they allow for more drive-through graphics to account for multiple drive-through lanes. The Village of Arlington Heights allows one main menu board up to 49 square feet in area, and one pre-sell board up to 24 square feet in area per drive-through lane. One digital order screen display is also allowed per drive-through lane with a maximum size of two square feet. -4 - Recommendation & Findings of Fact Petitions 33-19 November 4, 2019 The City of Peoria allows two menu boards per drive-through lane, each up to 30 square feet in sign surface area and five feet high. Each menu board is permitted to have an electronic message board display with no restrictions in size. The City of Rockford does not limit the number of drive-through graphics,but each drive-through graphic is limited to 36 square feet in area and maximum 6 feet in height. The City of Aurora does not have specific regulations for drive-through graphics. Each property is allowed a certain number of total sign surface area based on property's street frontage. For example, for properties with street frontages between 100 and 200 feet, a total of 60 square feet of sign surface area is allowed. Any number of ground signs are allowed, including drive-through graphics, provided the overall maximum sign surface area is not exceeded. The City of Waukegan has similar sign regulations as the City of Aurora. There are no specific regulations for drive-through graphics. They are considered a "changeable copy graphic" which can be wall- or ground-mounted. Drive-through graphics are allowed provided the property does not exceed the maximum number of wall- and or ground-mounted signs and the total sign surface area allowed as determined by the property's frontage along a street. The City of Joliet, the Village of Oak Park, and the City of St. Charles do not have any specific regulations for drive-through graphics. The proposed amendment to the zoning ordinance requires a public hearing before and a recommendation from the Planning and Zoning Commission and final approval by the City Council. FINDINGS After due notice as required by law, the Planning & Zoning Commission conducted a public hearing in consideration of Petition 33-19 on November 4, 2019. Testimony was presented at the public hearing in support of the application. The Community Development Department submitted a Development Application Review and Written Findings & Recommendation to the Planning& Zoning Commission dated November 4, 2019. The Community Development Department and the Planning & Zoning Commission have made the following findings regarding this application: STANDARDS FOR TEXT AMENDMENTS The proposed text amendment complies with the following purposes and intent of the Zoning Ordinance(§ 19.05.300): - 5 - Recommendation & Findings of Fact Petitions 33-19 November 4, 2019 ❑ Promote the public health, safety, comfort, morals, convenience, and general welfare; ❑ Conserve the taxable value of land and structures throughout the city; ❑ Establish standards to which building or structures therein shall conform; and ❑ Prohibiting uses, buildings, or structures incompatible with the character of the preservation, conservation, residence, community facility, business, and industrial zoning districts. In addition,the Comprehensive Plan includes the following objective: Identify opportunities to enhance the City's competitiveness for business and employment investment, including evaluating the current regulatory environment (see Chapter 11, Implementation Action Matrix,Commercial Areas,Goal#2: Further Develop the City's Economic and Employment Development Programs, Business Friendliness: Community Competitiveness Assessment). RECOMMENDATION The Community Development Department and the Planning & Zoning Commission recommend approval of Petition 33-19, subject to the following conditions: The vote of the Planning&Zoning Commission on the motion to recommend approval was seven (7) yes,zero (0)no, and zero(0) abstentions.
