Ordinance No. G52-19 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A PERSONNEL SUPPLY SERVICE (221 East Chicago Street, Unit A) WHEREAS, written application has been made requesting conditional use approval to establish an employment agency, a personnel supply service, at 221 East Chicago Street, Unit A; and WHEREAS, the zoning lot with the building containing the premises at 221 E. Chicago Street, Unit A, is legally described herein(the "Subject Property"); and WHEREAS, the Subject Property is located within the CC1 Center City District, and a personnel supply service is listed as a conditional use within the CCI Center City District; and WHEREAS, the Planning & Zoning Commission conducted a public hearing concerning said application on September 9, 2019 following due notice including by publication; and WHEREAS, the Community Development Department and the Planning & Zoning Commission have submitted their Findings of Fact concerning said application; and WHEREAS, the Community Development Department and the Planning & Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Community Development Department and the Planning & Zoning Commission; and WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS,zoning,including,but not limited to,this ordinance granting a conditional use in the CC1 Center City District pertains to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated September 9, 2019, and the recommendations made by the Community Development Department and the Planning&Zoning Commission,a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a conditional use for an employment agency, a personnel supply service, is hereby granted for the property commonly known as 221 East Chicago Street, Unit A, which is part of the property commonly identified by Kane County Property Index Number 06-13- 302-010, and legally described as follows: PARCEL 1: THE EAST 44 FEET OF LOT 2 IN BLOCK 11 OF ORIGINAL TOWN OF ELGIN, ON THE EAST OF FOX RIVER, IN THE CIT OF ELGIN, KANE COUNTY, ILLINOIS. (commonly known as 221-223 East Chicago Street) Section 3. That the conditional use for the Subject Property as authorized by this ordinance shall be subject to the following additional conditions: 1. Substantial conformance to the Development Application submitted by Employbridge, LLC dba Prologistix/ResourceMFG, as applicant, and Patrick O'Neil Property Group LLC, as property owner, received July 31, 2019, and supporting documents including: a. Conditional Use Statement of Purpose and Conformance, prepared by Employbridge, LLC, dated July 26, 2019; b. ALTA/ACSM Land Title Survey, prepared by MJM Consulting, Inc., dated November 20, 1999; c. Undated overall building floor plan, received August 5, 2019, with such further revisions as required by the Community Development Director; and d. Undated floor plan for ProLogistix/Resource MFG 221 E. Chicago St. Unit A Elgin, IL 60120, received July 31, 2019, with such further revisions as required by the Community Development Director. In the event of any conflict between such documents and the terms of this ordinance or other applicable city ordinances, the terms of this ordinance or other applicable city ordinances shall supersede and control. 2. The employment agency shall not directly provide transportation, otherwise arrange for transportation, or provide any compensation or accommodations for transportation, for any employers or employees to or from their employment locations. 3. All street graphics must comply with the zoning ordinance requirements. Any wall graphics to be installed must be channel-letters-type street graphic. 4. Draft Ordinance BACKGROUND Employbridge, LLC dba Prologistix/ResourceMFG, as applicant, and Patrick O'Neil Property Group LLC, as property owner, are requesting a conditional use to establish an employment agency,a personnel supply service, at the property commonly referred to as 221 E Chicago Street, Unit A. The property is located in downtown Elgin and is zoned CC 1 Center City District. The subject property is a 5,808 square foot lot improved with a three-story mixed-use masonry building. The 16,500-square foot building occupies the entire lot. Pedestrian access to the front of the building is provided from E. Chicago Street, while vehicular access is provided in rear of the property from the adjacent public alley.The property includes a total of six residential units on the second and third floors, and four ground-floor commercial tenant spaces, three of which are currently vacant. The Eastern Grove dance studio occupies a ground floor commercial space in rear of the building. The two other commercial tenant spaces are expected to be occupied by an insurance agency office and a financial agency office in the near future. All surrounding properties are also zoned CC 1 Center City District and are improved with mixed- use buildings.The property adjacent to the west is a two-story building home to Elgin Public House restaurant on the first floor and residential units on the second floor. The property adjacent to the east is a two-story mixed use building with a hair salon and a physical fitness facility on the ground floor and residential units on the second floor. The property across E. Chicago Street to the north is improved with a two-story building home to YWCA. And the property across a public alley to the south is a two-and-a-half story masonry building home to Knights of Columbus membership organization. - 2 - Recommendation & Findings of Fact Petition 30-19 September 9, 2019 17--9 7/8" The applicant is proposing to establish a local office for the employment agency Employbridge, LLC dba Prologistix/ResourceMFG.The office would occupy the H 8 a a a a vacant 900-square foot ground floor commercial space C.J west of the main building entrance facing E. Chicago Street. The small recruitment office would provide recruitment, payroll, and other staffing services. With no more than two staff members present at any one time, the office would be open during normal business hours Monday—Friday 8:00 AM—5:00 PM. The recruitment 91 office operates primarily by appointment, but walk-in customers would be accepted as well. The applicant anticipates up to six customers present during the peak time. The applicant is not proposing to make any interior or exterior changes to the building, except for possible future street graphics which would have to conform to the sign ordinance requirements. The interior layout is already set up to accommodate two separate offices and several computer desks associated with an office use. o An employment agency is classified as a personnel supply service,which is listed as a conditional use in the CC 1 Center City District, and requires the review and recommendation by the Planning and Zoning e 8'/16" Commission and approval by the City Council. Figure 1.Proposed floor plan The Community Development Department offers the following additional information: A. Property History. The existing three-story building was constructed between 1903 and 1913. The commercial space on the first and second floors of the building was originally occupied by a general furniture store, while residential units occupied the third floor. In 2000, the second floor was also converted to residential units, while the ground floor was divided into multiple commercial tenant spaces. The property was originally classified as D Commercial District by the first zoning ordinance in 1927. In 1962, the property was rezoned to B2 Central Business District. In 1992, the property was rezoned to CC 1 Center City District as part of the comprehensive amendment to the zoning ordinance. - 3 - Recommendation & Findings of Fact Petition 30-19 September 9, 2019 B. Surrounding Land Use and Zoning. All surrounding properties are also zoned CC 1 Center City District and are improved with mixed-use buildings. The property adjacent to the west is a two-story building home to Elgin Public House restaurant on the first floor and residential units on the second floor. The property adjacent to the east is a two-story mixed use building with a hair salon and a physical fitness facility on the ground floor and residential units on the second floor. The property across E. Chicago Street to the north is improved with a two-story building home to YWCA. And the property across the public alley to the south is a two-and-a-half story masonry building home to Knights of Columbus membership organization. C. Comprehensive Plan.The subject property is designated as Downtown Mixed-Use by the City's 2018 Comprehensive Plan. Elgin's historic Downtown contains mixed-use structures featuring retail, restaurant, service uses, office, and residential uses. Mixed-use structures contribute to an active street life and help foster a unique sense of place within Elgin. A variety of uses should be encouraged throughout the Downtown and located at or near the sidewalk with parking in the rear. D. Zoning District. The purpose and intent of the CC 1 Center City District is to facilitate the implementation of the official comprehensive plan for the city center, as focused on a distinctive subarea of the city with a common urban fabric. The CC 1 zoning district provides for a concentration of finance, service, retail, civic, office, and cultural uses in addition to complementary uses such as hotels, entertainment, and housing. The development standards are intended to encourage a mix of activity in the area while providing for quality development that maintains a sense of history, human scale, and pedestrian-oriented character. E. Trend of Development. The subject property is located within the traditional downtown area that has historically been developed with a mix of commercial, retail, service, restaurants, and residential uses. The most-recent construction in the immediate area was the restoration and adaptive reuse of the Tower Building into 44 residential units. The businesses that have recently opened in the area include Billy Bricks Wood Fired Pizza Cafe, Kubo Sushi and Sake Lounge, Jimmy John's, and Café Revive within Dream Hall. FINDINGS After due notice as required by law, the Planning & Zoning Commission conducted a public hearing in consideration of Petition 30-19 on September 9, 2019. Testimony was presented at the public hearing in support of the application. The Community Development Department submitted a Development Application Review and Written Findings & Recommendation to the Planning& Zoning Commission dated September 9, 2019. -4 - Recommendation & Findings of Fact Petition 30-19 September 9, 2019 The Community Development Department and the Planning & Zoning Commission have made the following findings regarding this application against the standards for conditional uses outlined within § 19.65.030: STANDARDS FOR CONDITIONAL USE A. Site Characteristics Standard. The suitability of the subject property for the intended conditional use with respect to its size, shape, significant features including topography, watercourses, vegetation, and existing improvements. Findings. The subject property is suitable for the intended conditional use with respect to its size,shape,significant features including topography,watercourses,and vegetation,and existing improvements. The subject 5,808 square foot property is improved with a three- story mixed-use building, which covers the entire lot. Pedestrian access is provided from E. Chicago Street via common entrance to the building. The access to the four commercial tenant spaces on the ground floor is provided from a common hallway. The vehicular access to the property is provided in rear from the adjacent public alley. The subject commercial space is the 900-square foot Unit A which includes storefront windows to E. Chicago Street. The proposed employment agency would complement other commercial and office tenants in the area. It would be open during normal business hours Monday — Friday, which matches the hours of operation of other office uses in the downtown area. The applicant is not proposing to make any interior or exterior changes to the building except for possible future street graphics which would meet the sign ordinance requirements. No existing site features including topography, watercourses,vegetation, and property improvements exist that would have a negative impact on the proposed conditional use. B. Sewer and Water Standard. The suitability of the subject property for the intended conditional use with respect to the availability of adequate water, sanitary treatment, and storm water control facilities. Findings. The subject property is suitable for the intended conditional use with respect to the availability of adequate water, sanitary treatment, and storm water control facilities. The property is currently served by municipal water, sanitary sewer, and storm water systems. The subject tenant space does not have a kitchen or restroom facilities. Common restroom facilities for all tenants are provided in rear of the ground floor of the building accessible by all tenants and their customers. The applicant is not proposing any changes to the existing sewer and water utilities. The existing sewer and water facilities can adequately serve the proposed use. C. Traffic and Parking Standard. The suitability of the subject property for the intended conditional use with respect to the provision of safe and efficient on-site and off-site - 5 - Recommendation & Findings of Fact Petition 30-19 September 9, 2019 vehicular circulation designed to minimize traffic congestion. Findings. The subject property is suitable for the intended conditional use with respect to the provision of safe and efficient on-site and off-site vehicular circulation designed to minimize traffic congestion. The subject commercial tenant space is part of a three-story mixed-use building which covers the entire property with no on-site parking. Vehicular access is provided via the public alley in rear of the building. Pedestrian access is provided from E.Chicago Street. The proposed use will not have any negative effect on the existing traffic circulation in the downtown. The zoning ordinance does not require off-street parking be provided by any land use within the CC 1 district. On-street parking is provided on both sides of E. Chicago Street adjacent to the existing building. The employees and visitors of the proposed use are expected to utilize on-street parking or the city-owned Spring Street parking garage located one block to the west at the northeast corner of Spring Street and E. Chicago Street. With only two staff members and limited customer base, the proposed use will not have any negative effect on the existing parking conditions in the downtown area. D. Location, Design, and Operation Standard. The suitability of the subject property for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of this title and chapter. Findings.The subject property is suitable for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of the zoning ordinance. All business activities will be conducted on the interior. The hours of operation are consistent with those of surrounding businesses. The applicant is not proposing to make any interior or exterior changes to the building except for possible future street graphics which will meet sign ordinance requirements. No evidence has been submitted or found that the proposed use will be located or operated in a manner that will exercise undue detrimental impact on surrounding properties. The proposed employment agency will complement other existing office uses in the downtown area as well as the residential uses in the building. E. Historic Preservation Standard. Where applicable, the conditional use shall make possible an efficient contemporary use of or a compatible improvement to a designated landmark or property located in a designated historic district while preserving those portions and features of the property which are significant to its historic, architectural, and cultural values to an historic preservation plan. Findings. This standard is not applicable. The subject property is neither designated as a local historic landmark nor is it located within a locally designated historic district. However, the property is part of Downtown Elgin Commercial National Register Historic - 6 - Recommendation & Findings of Fact Petition 30-19 September 9, 2019 District. While no City or State regulations are associated with this designation, the applicant does not propose any changes to the exterior of the building. RECOMMENDATION The Community Development Department and the Planning & Zoning Commission recommend approval of Petition 30-19, subject to the following conditions: 1.
