AN ORDINANCE
ESTABLISHING THE DEPARTMENT OF CODE ADMINISTRATION
AND PRESERVATION
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS :
Section 1 . That Chapter 2 .40 entitled "Fire Department"
of the Elgin Municipal Code, 1976, as amended, be and is
hereby further amended by deleting Sections 2 . 40 . 300 ,
2 . 40 . 310, 2 . 40 . 320 , 2 .40 . 330 and 2 .40 . 340 under the Bureau of
Inspection Services .
Section 2 . That Title 2 entitled "Administration and
Personnel" of the Elgin Municipal Code, 1976 , as amended, be
and is hereby further amended by adding Chapter 2 . 65 entitled
"Department of Code Administration and Preservation" to read
as follows :
Chapter 2 . 65 Department of Code Administration
and Preservation.
2 . 65 . 010 Established.
There is established an administrative
department of the city government to be known as the
department of code administration and preservation.
This department shall consist of the director,
deputy director, code enforcement supervisor, health
officer, and such other officers and employees as
may be provided by the city council and such
equipment and supplies assigned to the operation
thereof .
2 . 65 . 020 Director--Office established.
There is established the office of director of
code administration and preservation who shall be
the supervising officer of said department who shall
be known as the code enforcement official, and shall
have charge of all property and employees thereof .
The director shall be appointed by the city manager.
2 . 65 . 030 Director--Powers and duties .
The director of code administration and
preservation shall be responsible for all building
activities including:
A. The enforcement of all building, health
and zoning codes and ordinances of the city relating
to the health and safety and the maintenance and
preservation of property as found in Title 9 and
Title 16 of the Elgin Municipal Code.
B. Assistance to boards and commissions . The
code enforcement official shall advise and assist

the various boards and commissions of the city
involved in or concerned with the amendment or
enforcement of the health, building, housing, food
service, sanitation and safety codes of the city
including but not limited to the board of health,
the building commission, the electrical committee
and the plumbing committee.
Section 3 . That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are
hereby repealed.
Section 4 . That this ordinance shall be in full force
and effect immediately after its passage in the manner
provided by law.

MEMORANDUM
TO: Mayor and Members of City Council
FROM: Larry Rice, City Manager
SUBJECT: Department of Code Administration Reorganization
PURPOSE:
To reorganize the Bureau of Inspection Services into a new
department to be called the DEPARTMENT OF CODE ADMINISTRATION.
This reorganization will include several adjustments in staff
titles and responsibilities . An organizational chart has also
been included which will show the structure of the new
department .
BACKGROUND:
In November 1992, the Bureau of Inspection Services was removed
from the Fire Department and placed under the direction of the
City Manager' s office. The Superintendent and Assistant
Superintendent were assigned to the newly formed Fire Marshal ' s
office.
A search was initiated for a new director. In the interim, the
department was supervised by the Plan Examiner and Housing
Supervisor under the direction of the Assistant City Manager.
On June 14 , 1993, H.C. Joel Webb started as the department ' s new
Director. Along with the hiring of the new director, a number of
changes are necessary to facilitate the reorganization of the
department. These changes are detailed here.
Position: Deputy Director
Purpose:
To request the reclassification of the job title for Emilio
Miniscalco from Plan Examiner 48-B Step 4 , to Deputy Director
50-B Step 3 .

Background:
Emilio currently performs duties and tasks required of the
position. The title change will clarify Emilio' s role within the
organization. Emilio will assume oversight of the Department in
the absence of the Director. With this title, additional
responsibilities as deemed necessary by the Director will be
allocated to this position.
Financial Impact:
1993-None
Future- Addition of one step.
Position: Code Enforcement Supervisor
Purpose:
To change the title of Supervisor of Housing Enforcement to Code
Enforcement Supervisor and reposition it from 42 C to 46 B to
accurately reflect the expanded duties and responsibilities .
Background:
With the reorganization of the Code Administration Department,
the duties of this position have increased. Current duties
include supervising the daily activities of the code enforcement
staff, expanded responsibilities include development of the
departments computer applications , court case preparation and
supervision, coordinating activities which involve other
departments and outside organizations, purchasing approval for
budgetary supplies, and other management duties involving the
overall supervision of the entire department.
In recognition of these expanded duties , Mike Millikan, who is
currently holding this position, was given a temporary increase
in salary to compensate him for this work. This adjustment kept
the position at 42 C and increased the salary above step 5 which
is where he is currently.
Financial Impact:
1993 - None. Mike ' s current salary is equal to 46 B step 4 .
Next Year - one pay step.
Position: Field Supervisor
PURPOSE
To consider changing the Field Supervisor position from S 34
(clerical technical) to 43 C (management) .

BACKGROUND
The position was created to produce a management buffer between
the Housing Inspectors and the Housing Supervisor. The primary
duty is the supervision of the Housing Inspector' s daily
activities, training, follow up inspections, and special projects
as assigned. The Field Supervisor assumes the Housing
Supervisor' s duties when this officer is absent . The position
requires interaction with City departmental management staff and
outside special interest groups . Directing the activities of
personnel within a department is clearly a function for
management, not a peer of the bargaining unit members being
supervised.
FINANCIAL IMPACT
There will be the elimination of overtime pay required by this
position, $3632 YTD, with a $2 , 000 increase in base salary.
Position: Plan Examiner (full-time)
Purpose:
To consider the reclassification of the current part-time Plan
Examiner position to full time. This position would be placed in
the clerical technical employee group. Salary range is currently
being studied in relation to pay scale of current employees , and
similar positions throughout the surrounding area.
Background:
Currently the Plan Examiner position exists as a management
position. Removal of the plan examiner position as it currently
exists, and expanding the position under clerical/technical, will
enable the position to become specialized. This reclassification
will assist in the streamlining, coordination and expertise
required for plan review. The outcome will be a more thorough
efficient plan review system. The current part-time position will
remain in effect through the 1993 fiscal year.
Financial Impact:
1993-None
1994-Anticipated Salary Range 35 S or 36 S.

RECOMMENDATIONS:
1 . The name of the Department be officially changed from the
"Bureau of Inspection Services" , to the "Department of Code
Administration" .
2 . The current position of Plan Examiner be changed to Deputy
Director and moved from 48 B step 4 to 50 B step 3 . This
change is needed to maintain a clear chain of command in the
absence of the Director.
3 . The title and position of Supervisor of Housing Enforcement
be changed from 42 C step 5 to Code Enforcement Supervisor at
level 46 B step 4 to reflect expanded departmental
responsibilities .
4 . The position of Field Supervisor be changed from 34 S step 6
(clerical technical group) to 43 C management step 3 which is
reflective of the supervisory responsibilities this position
carries .
5 . Expand the part-time plan examiner position to full-time in
order to maintain an acceptable plan review level .
