AN ORDINANCE GRANTING
A CONDITIONAL USE FOR AN EVENT SPACE FOR ACTIVITIES PERTAINING TO
ASSEMBLIES OF PEOPLE IN THE CC1 CENTER CITY DISTRICT
(200 Prairie Street and 127 S. Grove Avenue)
WHEREAS, written application has been made requesting conditional use approval to
establish an event space for activities pertaining to the assembly of people at 200 Prairie Street and
127 S. Grove Avenue; and
WHEREAS, the zoning lot with the building containing the premises at 200 Prairie Street
and 127 S. Grove Avenue is legally described herein(the"Subject Property"); and
WHEREAS, the Subject Property is located within the CC1 Center City District, and an
event space for activities pertaining to assembly of people is listed as a conditional use within the
CC 1 Center City District; and
WHEREAS,the Planning and Zoning Commission conducted a public hearing concerning
said application on May 3, 2021, following due notice including by publication; and
WHEREAS, the Community Development Department and the Planning and Zoning
Commission have submitted their Findings of Fact concerning said application; and
WHEREAS, the Community Development Department and the Planning and Zoning
Commission recommend approval of said application, subject to the conditions articulated below;
and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Community Development Department and the Planning and Zoning
Commission; and
WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and
WHEREAS,zoning,including,but not limited to,this ordinance granting a conditional use
in the CC1 Center City District pertains to the government and affairs of the city.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated May 3, 2021, and the recommendations made by the Community Development
Department and the Planning and Zoning Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That a conditional use to establish an event space for activities pertaining to
the assembly of people is hereby granted for the property commonly known as 200 Prairie Street
and 127 S. Grove Avenue,and commonly identified by Kane County Property Index Numbers 06-
13-309-017 and 06-13-309-016,and legally described as follows:
PARCEL 1: LOT 10 AND THAT PART OF LOT 9 IN BLOCK 13 OF THE ORIGINAL
PLAT OF ELGIN.AS LAID OUT BY JAMES T.GIFFORD,LYING SOUTH OF A LINE
DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE WESTERLY LINE
OF SAID LOT,25 1/2 FEET NORTHERLY FROM THE SOUTHWESTERLY CORNER
THEREOF AND RUNNING THENCE EASTERLY TO A POINT IN THE EAST LINE

ordinance shall be subject to the following additional conditions:
1. Substantial conformance to the Development Application submitted by Imago Media, Inc.
DBA Imago Events,as applicant,and Discovery Church,Inc., as property owner,received
April 1, 2021, and supporting documents including:

a. Letter from Discovery Church, prepared by Senior Pastor Danny S. Alacon, dated
March 29, 2021;
b. Undated Statement of Propose and Conformance letter,received April 1, 2021;
c. Plat of Survey, prepared by Dundee Engineering, dated November 15, 1996; and
d. Undated six-page Discovery Floor Plans, received April 1, 2021.
In the event of any conflict between such documents and the terms of this ordinance or
other applicable city ordinances, the terms of this ordinance or other applicable city
ordinances shall supersede and control.
2. A food handling/food establishment permit is not required if food is not prepared on site,
and if dishes,utensils and other food contact equipment are not washed,or sanitized onsite.
Food must be catered by a licensed caterer, and all soiled food contact equipment must be
washed, rinsed and sanitized at a licensed commercial facility.
3. Assembly uses permitted by this grant of conditional use shall include:
a. Art Classes;
b. Business Meetings, Business Dinners, Breakout Session, and/or Round-Table
Discussions;
c. Banquets(General);
d. Baby Showers and/or Bridal Showers;
e. Baptisms and/or Christenings;
f. Celebrations, Soirees, and Private Parties, such as Anniversaries, Birthdays, Bar
Mitzvahs and Bat Mitzvahs,and/or Quinceaneras;
g. Conferences,Conventions,and/or Seminars;
h. Colloquiums;
i. Consumer Shows,Trade Shows,Trunk Shows,and Fashion Shows;
j. Cooking Competitions;
k. Corporate and/or Non-profit Events;
1. Design and Creative Workshops, such as Calligraphy, Art, Pottery, and/or Painting
Classes;
m. Exhibitions,including but not limited to Art Shows;
n. Expositions;
o. Fairs and/or Festivals;
p. Farm-to-table Meal Events;
q. Fundraisers;
r. Galas;
s. Gallery Displays, including but not limited to works of art, either temporary or
permanent;
t. Graduation Parties;
u. Live Performances,such as musical,dance,dramatic,readings and/or plays;
v. Meetings, including but not limited to Board, Business, Public and/or Shareholders
Meetings;

w. Mind and Body Classes and Sessions, including but not limited to Mediation and/or
Yoga;
x. Networking Events;
y. Plenary or General Sessions;
z. Political Events;
aa. Press Conferences;
bb. Product Launch Events;
cc. Retreats and Team Buildings Events;

ee. Symposiums;
ff. Video Shoots;

jj. Other like assemblies of people.
4. Incidental entertainment as an accessory use to a permitted principal use is permissible, in so
long as said entertainment complies with all city codes and ordinances,including but not limited
to the restrictions upon"uses,accessory"as articulated within Section 19.90.015, "Definitions
and Regulations"of the Elgin Municipal Code, 1976 as amended, and as said section may be
amended from time to time.
5. Any event of an above assembly use may be catered,with food preparation and service provided
either by the applicant or from an off-site establishment, subject to compliance with applicable
health and sanitation codes,ordinances,rules,and regulations.Similarly,any event of an above
assembly use may include the incidental service of alcohol, with such service provided either
by the applicant or from an off-site establishment,subject to compliance with applicable health,
sanitation,and liquor codes,ordinances,rules and regulations.
6. Any event of an above assembly use may include the incidental playing of amplified live or
recorded music, subject to compliance with applicable noise codes, ordinances, rules and
regulations.The incidental playing of amplified live or recorded music is only permitted on the
interior of the commercial event space.The applicant must comply with Chapter 10.30"Noise"
of the Elgin Municipal Code, 1976 as amended.
7. All street graphics must comply with the zoning ordinance requirements.
8. The conditional use approval is hereby granted only to Imago Media, Inc. DBA Imago
Events to use the property at 200 Prairie Street and 127 S. Grove Avenue as a commercial
event space for the activities pertaining to the assembly of people until December 31,2022,
subject to the terms and conditions of this Ordinance.
9. Compliance with all applicable codes and ordinances.

manner provided by law.

OVERVIEW
Provided herein are the written findings and recommendation of the Community Development
Department and the Planning & Zoning Commission regarding Petition 19-21, an application by
Imago Media Inc.DBA Imago Events,as applicant,and Discovery Church Inc.,as property owner,
requesting a conditional use for a commercial event space for activities pertaining to assembly of
people at the property commonly referred to as 200 Prairie Street and 127 S. Grove Avenue.

BACKGROUND
Imago Media Inc. DBA Imago Events, as applicant, and Discovery Church, Inc., as property
owner, are requesting a conditional use to establish a commercial event space for activities
pertaining to assembly of people at the property commonly referred to as 200 Prairie Street and
127 S. Grove Avenue.
The 17,500-square foot subject property, zoned CC1 Center City District, is located on the south
end of downtown Elgin and is improved with a one-story 16,800-square foot commercial building.
In 2012, the City approved establishment of Discovery Church in the existing building by
Ordinance No. G31-12. The building is located across the street from River Park Place townhome
development and Festival Park.A service alley in rear separates the building from the Fulton Street
parking garage to the north.
In 2018, Imago Media Inc. DBA Imago Events, received a conditional use approval to host
commercial events and rent its building two doors down at 216 Prairie Street for various types of
private events, such as, but not limited to weddings, birthday parties, and other social events.
Unfortunately, the roof of the building at 216 Prairie Street recently collapsed after one of last
winter's snow events. Imago had already scheduled a number of events at their facility through
May 2022. Imago is now seeking approval to be able to host those events at a different location to
honor its commitment to the clients until they find their next permanent location.
Imago has entered into a lease agreement to use the Discovery Church building at 200 Prairie
Street for these events. The church already holds similar types of church-affiliated events, and the
space is well suited to accommodate other private events. Imago's events would largely take place
on Fridays, Saturdays and Sunday and would not take place at the same time the church holds its
own events. The events would take place inside the building and within the "Rock Garden", the
enclosed outdoor patio north of the building. Music will be permitted on the interior of the
commercial event space and within the"Rock Garden"outdoor patio,subject to compliance city's
noise ordinance regulations.

The clients renting the space would be responsible for providing their own food and beverages or
choose their own caterer to provide food and beverages. Imago does plan to allow service of
alcohol at the events, and has applied for the liquor license which must be approved prior to the
service of any alcohol.
The proposed commercial event space for activities pertaining to assembly of people is listed as a
conditional use in the CC1 Center City District, requiring the review and recommendation by the
Planning and Zoning Commission and approval by the City Council.
The Community Development Department offers the following additional information:
A. Property History. The subject property has been part of the City of Elgin since its
incorporation. The property was originally classified as E Commercial District by the first
zoning ordinance in 1927. In 1962, the property was rezoned to B3 Service Business

District. In 1992, the property was rezoned to CC1 Center City District as part of the
comprehensive amendment to the zoning ordinance.
The existing building was constructed in the 1920s.The first tenant was the Grove Theater,
a movie theater, which occupied the building until 1976. After that the building was
occupied by several restaurants until 2012. Prairie Rock Bar and Grill was the last
restaurant to occupy the building. In 2012, Discovery Church was granted a conditional
use approval by Ordinance No. G31-12 to occupy the portion of the building at 200 Prairie
Street.In 2014,Discovery Church was granted a conditional use occupy the entire building,
including the portion at 127 S. Grove Avenue
B. Surrounding Land Use and Zoning. The properties to the north, east and west are all
zoned CC 1 Center City District. The properties to the east and immediate west are
improved with commercial buildings. The property to the north is the City-owned Fulton
Street parking garage. To the southwest is the City-owned Festival Park zoned CF
Community Facility District. The property to the south,across Prairie Street,is zoned PCC
Planed Center City District and is improved with River Park Place townhome development.
C. Comprehensive Plan. The property is designated Downtown Mixed-Use by the City's
2018Comprehensive Elgin's
Co ehensive Plan. El 'n s historic downtown contains mixed-use structures

featuring retail, restaurant, service uses, office and residential uses. Mixed-use structures
contribute to an active street life and help foster a unique sense of place. A variety of uses
should be encouraged throughout Downtown and should be located at or near the sidewalk
with parking in the rear.
D. Zoning District. The purpose and intent of the CC1 Center City District is to facilitate the
implementation of the official comprehensive plan for the center city, as focused on a
distinctive subarea of the city with a common urban fabric. The CC1 zoning district
provides for a concentration of finance, service, retail, civic, office, and cultural uses in
addition to complementary uses such as hotels, entertainment and housing. The
development standards are intended to encourage a mix of activity in the area while
providing for quality development that maintains a sense of history, human scale and
pedestrian oriented character.
E. Trend of Development. The subject property is located within the traditional downtown
area that has historically been developed with a mix of commercial, retail, service,
restaurants,residential,and institutional uses.The property is located across the street from
the River Park Place townhome development completed in 2005. Most recent new
developments and businesses in the downtown area have established near the Festival Park
and Riverside Drive Promenade, such as several restaurants along S. Grove Avenue and
the Elgin Art Space Lofts building at 51 S. Spring Street. The City encourages downtown
development that will foster a vibrant, walkable, mixed-use center for the community, as
well as a regional center with an urban fabric unique to the Chicago metropolitan region.

FINDINGS
After due notice as required by law, the Planning & Zoning Commission conducted a public
hearing in consideration of Petition 19-21 on May 3, 2021. Testimony was presented at the public
hearing in support of the application. The Community Development Department submitted a
Development Application Review and Written Findings & Recommendation to the Planning &
Zoning Commission dated May 3, 2021.
The Community Development Department and the Planning & Zoning Commission have made
the following findings regarding this application against the standards for conditional uses outlined
within § 19.65.030:
STANDARDS FOR CONDITIONAL USE
A. Site Characteristics Standard. The suitability of the subject property for the intended
conditional use with respect to its size, shape, significant features including topography,
watercourses, vegetation, and existing improvements.
Findings. The subject property is suitable for the intended conditional use with respect to
its size, shape, significant features including topography, watercourses, vegetation, and
existing improvements. The subject property is approximately 0.28 acres in size and
contains one building that encompasses almost the entire lot.The applicant is not proposing
to make any exterior changes to the building or the site. The proposed commercial events
will be restricted to the interior of the existing building, which can adequately serve the
proposed use. There are no significant features including topography, watercourses, or
vegetation that will have a negative impact on the proposed use.
B. Sewer and Water Standard. The suitability of the subject property for the intended
conditional use with respect to the availability of adequate water, sanitary treatment, and
storm water control facilities.
Findings. The subject property is suitable for the intended conditional use with respect to
the availability of adequate water, sanitary treatment, and storm water control facilities.
The property is currently served by municipal water, sanitary sewer, and storm water
systems. The applicant is not proposing any changes to the existing sewer and water
utilities. The existing facilities can adequately serve the proposed use.
C. Traffic and Parking Standard. The suitability of the subject property for the intended
conditional use with respect to the provision of safe and efficient on-site and off-site
vehicular circulation designed to minimize traffic congestion.
Findings. The subject property is suitable for the intended conditional use with respect to

minimize traffic congestion. The existing 16,700-square foot building covers almost the
entire property with no on-site parking or vehicular access. Pedestrian access is provided
directly from Prairie Street. The subject property is located in an area that functions with
safe and efficient vehicular circulation. The proposed use will not have any negative effect
on the existing traffic configuration in the neighborhood.
The zoning ordinance does not require off-street parking be provided by any land use
within the CC1 district. The property is adjacent to the city-owned surface parking lot and
Fulton Street parking garage both of which offer free public parking. Employees and
attendees of the events will have access to all parking spaces in the city-owned surface
parking lots, and all 492 parking spaces in the Fulton Street parking garage. On-street
parking is also provided on both sides of Prairie Street between S. Grove Avenue on the
west end and Villa Street on the east end.
D. Location, Design, and Operation Standard. The suitability of the subject property for
the intended conditional use with respect to it being located, designed, and operated so as
topromote the purpose and intent ofthis title and chapter.

Findings. The subject property is suitable for the intended conditional use with respect to
it being located, designed, and operated so as to promote the purpose and intent of the
zoning ordinance. The applicant is not proposing any exterior changes to the building. All
commercial event activities will be conducted on the interior of the building without any
impact on the surrounding properties.
No evidence has been submitted or found that the proposed use will be located or operated
in a manner that will exercise undue detrimental impact on surrounding properties. The
Imago events would take place inside the building and within the "Rock Garden", the
enclosed outdoor patio north of the building. Music will be permitted on the interior of the
commercial event space and within the "Rock Garden" outdoor patio. The applicant must
comply with Chapter 10.30 "Noise"of the Elgin Municipal Code, 1976 as amended.
E. Historic Preservation Standard. Where applicable, the conditional use shall make
possible an efficient contemporary use of or a compatible improvement to a designated
landmark or property located in a designated historic district while preserving those
portions and features of the property which are significant to its historic, architectural,
and cultural values to an historic preservation plan.
Findings. This standard is not applicable. The property is neither designated as a

local historic landmark nor is it located within a locally designated historic district. The
applicant is not proposing any changes to the exterior of the building.

RECOMMENDATION
The Community Development Department and the Planning & Zoning Commission recommend
approval of Petition 19-21, subject to the following conditions:

4. Incidental entertainment as an accessory use to a permitted principal use is permissible, in
so long as said entertainment complies with all city codes and ordinances, including but
not limited to the restrictions upon "uses, accessory" as articulated within Section
19.90.015, "Definitions and Regulations"of the Elgin Municipal Code, 1976 as amended,
and as said section may be amended from time to time.
5. Any event of an above assembly use may be catered, with food preparation and service
provided either by the applicant or from an off-site establishment, subject to compliance
with applicable health and sanitation codes, ordinances, rules, and regulations. Similarly,
any event of an above assembly use may include the incidental service of alcohol, with
such service provided either by the applicant or from an off-site establishment, subject to
compliance with applicable health, sanitation, and liquor codes, ordinances, rules and
regulations.

6. Any event of an above assembly use may include the incidental playing of amplified live
or recorded music, subject to compliance with applicable noise codes, ordinances, rules
and regulations. The incidental playing of amplified live or recorded music is only
permitted on the interior of the commercial event space. The applicant must comply with
Chapter 10.30"Noise"of the Elgin Municipal Code, 1976 as amended.
7. All street graphics must comply with the zoning ordinance requirements.
8. The conditional use approval is hereby granted only to Imago Media, Inc. DBA Imago
Events to use the property at 200 Prairie Street and 127 S. Grove Avenue as a commercial
event space for the activities pertaining to the assembly of people until December 31,2022,
subject to the terms and conditions of this Ordinance.
9. Compliance with all applicable codes and ordinances.
The vote of the Planning and Zoning Commission on the motion to recommend approval, subject
to the conditions outlined above, was six (6) yes, zero (0) no, zero (0) abstentions. One member
was absent.
