NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. Rice, City Manager SUBJECT: Vacation of Gifford Street at Summit At your last meeting the City Council approved in con- cept the vacation of Gifford Street from Summit south to the McDonald' s entrance (map attached) - subject to ( 1) dedica- tion of 18 ' of property along Dundee, (2) payment of an appro- priate differential between the value of the two rights-of- way, and (3) additional traffic engineering design next year to resolve adjacent traffic patterns. Subsequently the staff and representatives of the petitioner have worked out the immediate details such that this agenda item submits the remaining immediate issues prior to approval of the formal replatting. The letter from Attorney Peter Bazos sets forth the basic issue very well, and provides for a negotiated payment simultaneous with the trade of $8,300 as additional compensa- tion. The one remaining issue which the petitioner would like to get approval from the Council about involves the location of the three signs proposed along Dundee. The petitioner is asking for authorization from the Council to install two new entry signs and relocate the existing corporate sign into the new right-of-way area in order to maximize his exposure to northbound Dundee traffic. At such time as the City then pulls the curb line back as a part of the right turn lane improvement, petitioner is asking for the same authorization to relocate the three signs in the setback area of his proper- ty. Mr. Bazos explains herein the legal issues involved with the City zoning ordinance, and staff will be prepared at the meeting to answer Council questions on this matter. I Mayor and Members of the City Council November 15, 1991 Page 2 Depending upon the traffic engineering determination in g g the coming weeks as to whether there is sufficient "stacking space" in the newly acquired right-of-way on Dundee to justi- fy installing the right turn lane prior to acquiring right- of-way also from Kentucky Fried Chicken - we may well ap- proach Council this next spring to move ahead with the right turn lane as part of the McDonald' s parking lot construc- tion. In that event the Council would be dealing with the issue of allowing the signage in the setback area. That second issue therefore becomes the more important City Coun- cil decision at this time. FINANCIAL IMPACT The City will receive $8,300 as part of this transaction which will be applied toward the subsequent construction of the right turn lane. RECOMMENDATION The City Council is asked to act on the four proposals included in the Summary section of Mr. Bazos ' letter, the primary one being the last dealing with a future authoriza- tion to locate signage in the setback area as part of a varia- tion, etc. , from the new zoning ordinance. Rice, City Manager SUBJECT: Street Vacation - Gifford at Summit PURPOSE This memorandum will provide the Mayor and Council with information to consider a request to vacate a portion of Gifford Street at Summit Street. BACKGROUND The City Council was first requested to consider the vacation of Gifford Street on September 25, 1991 at the Committee of the Whole Meeting. The matter was tabled until the receipt of additional information and for some comments from people in the area. Letters were sent to the businesses that front and back onto Dundee and Gifford and to the Central Elgin Neighborhood Council (CENC) copies of which are attached, requesting comments. Mr. Stuart Wasilowski of NHS was contacted by telephone. A 24-hour traffic count was taken on Gifford just north of the drive to McDonald' s and south of the drive to the cleaners to determine the number of north and south bound vehicles. A copy of that count is attached. We did not receive a response from CENC. A copy of Mr. Wasilowski' s response is attached. We received a telephone response from the manager's/owners of Kentucky Fried Chicken (KFC) and Victory Press and their comments were directed primarily at the horrible and terrific number of motorists that use their parking lots (cut through) to avoid the traffic signals at Dundee/Summit to get to Gifford and then east on Summit. The gentleman from Victory Press said he has seen motorists on Seneca stop at Dundee and then drive across Dundee through his parking lot to get to Gifford. Each person would like the City to do something to discourage that, or at least reduce it. The traffic count does seem to verify that, especially at 4: 00 p.m. and 5:00 p.m. Mayor and Members of the City Council November 1, 1991 Page 2 We have observed motorists make the right turn from Gifford 411 onto Summit and then make an immediate left turn across all the lanes on Summit and enter the Dunkin' Donut lot and exit onto Dundee to go north. Some park in the lot. This movement is really not safe. The impact on the neighborhood from motorists north bound on Gifford being diverted due to the closing of Gifford would be small to slight because people will prefer to find other routes to get onto Summit to go east due to the immediate area streets being narrow and/or with parked vehicles which would slow them down. We have also attached a sketch that illustrates how the intersection of Dundee/Summit should be improved to better accommodate traffic by constructing both left and right turn lanes northbound. The City will therefore need 18 feet instead of the twelve feet along Dundee as first suggested. Also, that portion of Gifford Street proposed to be vacated is a valuable piece of property and the City Council should consider having the "trade parcels" appraised, with the difference applied toward the installation cost of the right turn lane which should be installed as part of the improvement of the adjacent parking lot. Gifford is forty nine feet wide so the area of Gifford to be vacated is 5,796 .7 square feet. Assuming the portion to be dedicated for right-of-way is 47) eighteen feet wide, that area is approximately 1,625 square feet, for a difference of 4, 172 square feet. FINANCIAL IMPACT There is a fee of $675 established in the City Code, Chapter 4.35, to be paid by the persons acquiring the property, plus any additional charges or fees the City Council deems appropriate. RECOMMENDATION It is recommended that the City Council approve the vacation of Gifford Street as shown on the attached sketches, accept an eighteen-foot strip of property along Dundee Avenue dedicated as right-of-way, assess the difference in value of the two parcels toward installation of left and right turn lanes, and direct the staff to prepare the necessary ordinance and contract for Council action. As I said, it is my opinion that this closing would be helpful if there are other traffic related initiatives on Fremont. Hickory and Franklin Streets to work in concert with this closure. In my opinion, the closing of the intersection alone may cause the additional 1000 cars per day to filter into the residential neighborhood to the east. City staff has admitted that these streets are long and afford the opportunity to traverse through the rneighborhood unimpeded. 1000 more cars will have a detrimental impact on the area which is over stressed with traffic. I would hate to see this backfire and create another problem for the area to deal with. The opportunity is one which needs to be reviewed and I commend you for looking for ideas and opinions about the concept. If you would like to talk with other residents of the area, I am sure we could arrange an informal discussion of the plan at our office.
