AN ORDINANCE
AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE ENTITLED
"ALCOHOLIC LIQUOR DEALERS" TO CREATE A NEW CLASS U LICENSE FOR
INSTITUTIONAL CONFERENCE CENTERS
WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and
WHEREAS, the regulation of alcoholic liquor dealers pertains to the government and
affairs of the city; and
WHEREAS, the city council of the City of Elgin has determined that it is appropriate to
create a new class of liquor license for institutional conference centers.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 6.06.040 of the Elgin Municipal Code "License classes; fees"
be and is hereby further amended by adding a new subparagraph AA to read as follows:
"AA. Class U: For the retail sales of beer and wine only for events at and upon the
premises of Elgin Community College, for consumption on the premises only.
Alcoholic liquor under this license may be served and sold only to invited guests at
an event utilizing the services and facilities of Elgin Community College for
educational, cultural, philanthropic, governmental, business, live performances,
culinary arts, and/or training activities, and only where said alcoholic liquor is
incidental to such activities,as further set forth below. Service and sale of alcoholic
beverages shall be restricted to only those events on the premises of Elgin
Community College. The sale or serving of alcohol at weddings, receptions, or
other events not involving educational, cultural, philanthropic, governmental,
business, live performances, culinary arts, and/or training activities is prohibited.
The retail sale of alcoholic liquor at or upon the premises of Elgin Community
College shall be limited to the following events or uses:
1. Food Service Department:Elgin Community College Food Service Department
may offer beer and wine only to external guests for their events. The service of
alcoholic liquor must be accompanied by and served with food at the event.
Alcoholic beverages may not be served at any student-sponsored event or any
athletic event.
2. Culinary Department: Elgin Community College Culinary Department may
offer beer and wine only to guests at events and dinner service in the Spartan
Terrace Dining Room. Said alcoholic liquor may be poured by students and
faulty who hold a ServSafe Alcohol Advanced Certificate, or students who are
concurrently enrolled in a class to earn such certification. The operations of the
Spartan Terrace Dining Room must be overseen by a licensed faculty member.
3. Elgin Community College Arts Center: Elgin Community College Arts Center
may offer beer and wine only in conjunction with performances or events at the
Blizzard Theatre. The sale alcoholic liquor shall begin no earlier than(1)hour
prior to the start of a performance or event, and shall end no later than either
thirty (30) minutes after the start of a performance or event, or thirty (30)
minutes after the end of any intermission for such performance or event,
whichever is later.
The licensee must verify that every guest or patron possessing or consuming
alcoholic liquor is at least twenty-one (21) years of age. The licensee shall not
permit any possession or consumption of alcohol by any person younger than
twenty-one (21)years of age on the licensed premises.
It shall be unlawful for a holder of a Class U license to sell or offer for sale at retail
any alcoholic liquor in the city,or to deliver or permit the consumption of alcoholic
liquor on the licensed premises,between the hours of 12:00 midnight and 6:00 a.m.
The licensee fee per year is in the amount as provided in the most recently enacted
ordinance establishing fees for various city services, permits, licenses, use of
facilities and other matters."
Section 2. That Section 6.06.050 of the Elgin Municipal entitled"Licenses;number to
be issued"be and is hereby further amended by adding a new subparagraph BB thereto,and by re-
lettering the existing subparagraphs BB through DD accordingly,with such new subparagraph BB
to read as follows:
"BB. The number of Class U licenses shall not exceed one (1) in number."
Section 3. That Section 6.06.115 of the Elgin Municipal Code entitled "Bassett
training requirements" be and is hereby further amended by amending the listing of license
classifications in subparagraph A thereof by adding a reference to the Class U license.
Section 4. That the most recently enacted ordinance establishing fees for various city
services, permits, licenses, use of facilities and other matters be amended to provide license fee
per year of a Class U liquor license is Three Hundred Ninety Six Dollars ($396.00).
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.

Section 6. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
