Ordinance No. G17-19 AN ORDINANCE AMENDING ORDINANCE NO. G42-09 WHICH GRANTED A CONDITIONAL USE APPROVAL TO PERMIT A PROGRAM FOR GRAPHICS (1701-1707 North Randall Road) WHEREAS, written application has been submitted requesting an amendment to Ordinance No. G42-09 which granted a conditional use approval to permit a program for graphics to allow additional wall graphics and modifications to existing monument graphics to include electronic changeable copy graphic at 1701-1707 North Randall Road; and WHEREAS,the zoning lot with the buildings containing the premises at 1761-1707 North Randall Road is legally described in Section 3 of Ordinance No. G42-09 (the"Subject Property"); and WHEREAS, the Subject Property is located within the PORI Planned Office Research Industrial District established by Ordinance No. G47-05 and Ordinance No. G79-05; and WHEREAS,the Planning and Zoning Commission conducted a public hearing concerning said application on April 1, 2019 following due notice including by publication; and WHEREAS, the Community Development Department and the Plannin and Zoning Commission have submitted their Findings of Fact concerning said application; an WHEREAS, the Community Development Department and the Planning and Zoning Commission recommend approval of said application, subject to the conditions articulated below: and WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and recommendations of the Community Development Department and the Planning and Zoning Commission; and WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, zoning, including, but not limited to, this ordinance granting an amendment to Ordinance No. G42-09 which granted a conditional use approval to permit a program for graphics in the PORI Planned Office Research Industrial District pertains to the government and affairs of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated April 1, 2019, and the recommendations made by the Community Development 1 Department and the Planning and Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That Section 3. of Ordinance No. G42-09 is hereby amended to include the following additional conditions: 8. Substantial conformance to the Development Application submitted by John B. Sanfilippo+Son,Inc.,as applicant and property owner,received February 1,2019,and supporting documents including: a. Statement of Purpose and Conformance,prepared by Kelly Day,John B. Sanfilippo + Son, Inc., as applicant and property owner, is requesting approval of an amendment to the existing conditional use for program for graphics established by Ordinance No. G42-09 to allow additional wall graphics, and updates to two of the three existing monument graphics to include an electronic changeable copy at the property commonly referred to as 1701- 1707 N. Randall Road. The 95-acre subject property is located on the east side of N. Randall Road between I-90 Tollway on the north and Fox Lane on the south. The property is zoned PORI Planned Office Research Industrial and serves as the home for Fisher Nuts corporate headquarters.The property is improved with one 1.1-milion square foot manufacturing building used for manufacturing and distribution of nuts and seed mixes,and one 400,000-square foot four-story multi-tenant office building located along I-90 Tollway. The office building is home to six other tenants including Mueller certified public accounting firm. Several office buildings, zoned PORI Planned Office Research Industrial District, are located on the west side of N. Randall Road. Advocate Sherman Hospital campus, zoned PCF Planned Community Facility District is located to the south across Fox Lane. In 2009, the program for graphics was amended to allow the existing monument graphic along I-90. The main graphics include a total of three monument graphics (one each along N. Randall Road, Fox Lane, and I-90 Tollway), five wall graphics on the manufacturing building, and two wall graphics on the north side of the four-story office building facing I-90.The additional graphics are primarily directional in reflecting the size of the campus, two principal buildings, several access points, and the potential for multiple tenants. In all,there are a total of 49 graphics on the property (applicant's labeling matrix shows 52 graphics, but there are 49 graphics as defined by the sign ordinance), however, most of those graphics are either directional or building identification graphics which are not visible from a street. Proposal The applicant is proposing to amend the existing program for graphics to allow the modifications to two of the three existing monument graphics to include an electronic changeable copy message center (EMC), installation of one additional wall graphic on the south side of the manufacturing building, and future installation of two more wall graphics on the office building(one on the north side and one on the west side of the building). - 3 - Recommendation & Findings of Fact Petition 06-19 April 1, 2019 The size and location of the existing main graphics and the proposed graphics are summarized in Table 1 below. (The graphic number provided corresponds to the graphic number referenced in the application materials provided by the applicant and incuded in the application documents.) Table 1. Other monument graphics with EMC along 1-90 Tollway are summarized in Table 2 below. The proposed wall graphics on the office building (north façade shown in Figure 3 below) would be installed in the future as needed by the tenants of the office building. Table 2. Property History.The subject property was annexed to the City in 1988.Upon annexation the property was zoned M2 General Manufacturing District. In 1992, the property was rezoned to ORI Office Research Industrial District as part of the comprehensive amendment to the zoning ordinance.In 2005,the property was zoned PORI Planned Office Research Industrial District when the current tenant Fisher Nuts began its operations on the site. The City originally approved a program for graphics in 2006 by Ordinance No. G58-06. The program for graphics was amended in 2009 to allow the existing monument graphic along 1-90. The majority of the manufacturing building was constructed 1989. The four-story office building was completed in 1991. B. Surrounding Land Use and Zoning. Several office buildings, zoned PORI Planned Office Research Industrial District, are located on the west side of N. Randall Road. Advocate Sherman Hospital campus, zoned PCF Planned Community Facility District is located to the south across Fox Lane. On the east,the subject property is adjacent to a one- story light-industrial building zoned GI-General Industrial, while several office buildings, zoned PORI Planned Office Research Industrial are located to the north across 1-90 Tollway. C. Comprehensive Plan. The subject property is designated as Light Industrial by the City's 2018 Comprehensive Plan. This land use includes light industrial uses and business parks consisting of a range of uses, such as research and development, light distribution and warehousing, light manufacturing, and service and consumer-oriented businesses. The scale and intensity of these uses should vary based on context and respect the scale and character of nearby housing when located near a residential area. When adjacent to commercial districts or residential neighborhoods, buffering and screening should be in place to appropriately mitigate potential negative impacts and nuisances. Generally speaking,light industrial uses and activities are conducted entirely indoors and ae relatively low in intensity with limited impact on adjacent properties. D. Zoning District.The purpose of this PORI Office Research Industrial District is to provide a planned industrial environment that fosters a sense of place and destination within a coordinated campus or park setting, subject to the provisions of Chapter 19.60, Planned Developments. A PORI zoning district is most similar to, but departs from the standard requirements of the ORI zoning district. E. Trend of Development. The subject property is located at the southeast corner of 1-90 Tollway and N. Randall Road. The property serves as the home for Fisher Nuts corporate headquarters. Most other properties along 1-90 Tollway, and in the Northwest Industrial - 6 - Recommendation & Findings of Fact Petition 06-19 • April 1, 2019 Park near I-90 Tollway have been developed office,warehousing and manufacturing uses. Due to the close proximity and easy access to I-90 from N.Randall Road,the properties in the immediate area of the intersection will continue to be developed and occupied with office,warehouse,and manufacturing uses.The N.Randall Road corridor,especially north of I-90,continues to develop with commercial uses serving the residents from a larger area. The subject property also includes a small retail store near its access driveway on N. Randall Road. The property will continue to operate without any negative effects on the surrounding properties and uses. FINDINGS After due notice as required by law, the Planning & Zoning Commission conducted a public hearing in consideration of Petition 06-19 on April 1,2019. Testimony was presented at the public hearing in support of the application. The Community Development Department submitted a Development Application Review and Written Findings & Recommendation to the Planning & Zoning Commission dated April 1, 2019. The Community Development Department and the Planning & Zoning Commission have made the following findings regarding this application against the standards for a program for graphics outlined within § 19.50.100: STANDARDS FOR PROGRAM FOR GRAPHICS 1. Departure from Requirements. No allowable departure from the requirements of this chapter shall be granted unless it has been found that the requested departures are mitigated through an equivalent and more restrictive application of other regulations of this title or chapter. The standards for conditional uses listed in section 19.65.030 of the Municipal Code need not be considered. Findings. The subject property is suitable for the intended program for graphics with respect to being mitigated through an equivalent and more restrictive application of other regulations of the Street Graphics chapter of the zoning ordinance. The applicant has agreed to install all new graphics in a manner and design that match other street graphics on the property. As such, all monument graphics would have the same type of base made of aluminum and steel. In addition to the Electronic Message Center,the gray, white, and blue colors would be the only colors found on the street graphics. The proposed wall graphic on the manufacturing building would be blue, individual letters attached directly to the exterior wall of the building to match other existing wall graphics on the building. Future wall graphics on the office building would also be designed to complement other existing wall graphics on the building. 2. Site Characteristics. The suitability of the subject property for the program for graphics with respect to its size, shape and any existing improvements. - 7 - Recommendation & Findings of Fact Petition 06-19 April 1, 2019 Findings. The subject property is suitable for the intended program for graphics with respect to its size, shape, and any existing improvements. The subject property is 95 acres in area and is improved with two principal buildings: a 1.1 million-square foot manufacturing building occupied by one tenant,and a 400,000-square foot four-story office building,which is occupied by multiple tenants. The property has frontage on three roads: I-90 Tollway,N.Randall Road,and Fox Lane,and has two access driveways, one from N. Randall Road and the second from Fox Lane. In addition,the property has several parking and loading areas adjacent to different parts of each building. A program for graphics is necessary to allow more graphics than typically allowed by the sign ordinance to identify different access points to the site,and to direct traffic to appropriate destinations within the site. 3. Surrounding Land Use and Zoning. The suitability of the subject property for the program for graphics with respect to consistency and compatibility with surrounding land use and zoning. Findings. The subject property is suitable for the intended program for graphics with respect to consistency and compatibility with surrounding land use and zoning.The subject property is located along the I-90 corridor and is not located in close proximity to any residential areas. Several office buildings,zoned PORI Planned Office Research Industrial • District, are located on the west side of N. Randall Road, and Advocate Sherman Hospital campus,zoned PCF Planned Community Facility District is located to the south across Fox Lane. On the east, the subject property is adjacent to a one-story light-industrial building zoned GI-General Industrial, while several office buildings, zoned PORI Planned Office Research Industrial are located to the north across I-90 Tollway. The additional signage proposed would not have any negative effect on the surrounding properties. • 4. Architectural Style. Each graphic shall be designed to relate to the architectural style of the main building or buildings upon the site, and to the extent not inconsistent with such style, to existing improvements upon lots adjacent to the site; provided that graphics located on any isolated commercial site containing a gross floor area of less than ten thousand (10,000) square feet within one (1) or more buildings and located within a predominantly residential area shall be compatible with the residential character of such area and consistent with other graphic types permitted in residential districts. Findings. The subject property is suitable for the intended program for graphics with respect to each graphic being designed to relate to the architectural style of the main building or buildings upon the site, and to the extent not inconsistent with such style, to • existing improvements upon lots adjacent to the site. The subject property exceed 10,000 square feet in area, is improved with more than one principal building and is not located in close proximity to any residential areas. The proposed updates to the monument graphics would match the existing monument graphic along N. Randall Road in size, style, and - 8 - Recommendation & Findings of Fact • Petition 06-19 April 1, 2019 materials. The white and gray aluminum and steel design of the monument graphics matches and complements the industrial look of the manufacturing campus. The proposed wall graphic on the manufacturing building would include individual cut-out letters directly attached to the exterior wall of the building to match other existing wall graphics on the building. 5. Relationship to Buildings. Consistent with the architectural style, each graphic shall be designed to incorporate at least one (1)of the predominantly visual horizontal and vertical elements of the main building or buildings on the site, such as the type of construction material, color, or other design details; and any graphic on a building shall have dimensions which are proportional to and visually balanced with the building facade of the side of the building upon which such graphic is located. Findings. The subject property is suitable for the intended program for graphics with respect to each graphic being designed to incorporate at least one (1) of the predominantly visual horizontal and vertical elements of the main building or building on the site, such as the type of construction material, color, or other design details, and any graphic on a building having dimensions which are proportional to and visually balanced with the building façade of the side of the building upon which such a graphic is located. The proposed white and gray monument graphics match the white and gray colors of the precast panels on the building. The proposed 59'7" wide wall graphic on the manufacturing building would be installed on the west end of the south wall which measures approximately 385 feet in length. The 120-square foot graphic is appropriate for the scale of the building wall on which it would be mounted. Similarly, the proposed 250-square foot wall graphic on the west side of the office building would be 50 feet wide while that side of the building is approximately 157 feet wide. The 150-square foot proposed wall graphic on the north side of the building would be consistent in scale and location(near the top of the building) with the existing 184.6-square foot wall graphic on the west end, and 510.79-square foot wall graphic on the east end of the north facade,which is approximately 600 feet wide. The proposed wall graphics would visually balance the exterior elevations of the buildings. 6. Relationship to Other Graphics.Each graphic shall be well related to all other graphics on the site by the incorporation of not less than four(4)of the following seven(7)elements: a. Materials; b. Letter style of graphic copy; c. Color; d Illumination; e. Method used for structural support or attachment; f Technical details of graphic construction; and g. Shape of entire graphic and its several components. - 9 - Recommendation & Findings of Fact • Petition 06-19 April 1, 2019 Findings. The subject property is suitable for the intended program for graphics with respect to all graphics being related to all other graphics on the site by the incorporation of • not less than four(4)of the seven(7)elements listed above.The monument graphics would all include the same rectangular shape, same aluminum and steel bases, white and gray colors with blue line accents, and the same illumination with the Electronic Message Center. Similarly the proposed wall graphics would match other wall graphics with acrylic letter faces, internal illumination, individual cut out letters mounted directly to the wall or with a mounting channel,and dark blue color that complements the white and gray exterior • of the pre-cast building. 7. Graphic Copy. The graphic copy for a graphic shall not exceed forty percent(40%)of the graphic area. Findings. The subject property is suitable for the intended program for graphics with respect to the graphic copy for a graphic not exceeding forty percent(40%) of the graphic area. The graphic copy of the EMC within the monument graphic along Fox Lane represents only 16%of the 112.5 square foot monument graphic. The proposed 95-sqaure foot EMC within the 193-sqaure foot monument graphic along I-90 represents 49%of the overall graphic, which is larger than 40%, but is within the 50% maximum allowed for Electronic Message Centers.The graphic copy does not apply to the proposed wall graphic on the manufacturing building, as the proposed graphic only contains individual cut-out letters. Similarly, any future wall graphics on the office building would contain individual cut-out letters with image logos far less than then 40%of the overall graphics. 8. Graphics Affixed To Buildings. The area for any graphic affixed to a building shall not exceed ten percent(10%)of the building facade upon which such graphic is located, except . that an applicant for a program for graphics may, subject to the approval of the city council, designate one or more enterprises, which collectively occupy more than fifty percent(50%) of the usable floor space within the main building upon the site, as a "main tenant"or "main tenants"of the site. Each main tenant may have a graphic with an area not to exceedfifteen percent(15%) of the building facade of the building side upon which such graphic is located. Findings. The subject property is suitable for the intended program for graphics with respect to the area for any graphic affixed to a building not exceeding ten percent(10%)of the building façade upon which such graphic is located. The proposed wall graphic on the south side of the manufacturing building represents less than one percent of the building's south wall on which it is affixed. The proposed wall graphic on the west side of the office building represents approximately 2.6% of the building's west façade, and the proposed wall graphic on the middle portion of the north side of the building represents approximately 3.5%of the building façade on which it is affixed. - 10 - Recommendation & Findings of Fact Petition 06-19 April 1, 2019 9. Graphics Affixed To Buildings Above Eave Line.Any graphic located above a building facade (eave line)shall be integral with the building and also an integral design feature of the building. Findings. This standard is not applicable. All proposed wall graphics on both the manufacturing building and the office building would be installed directly on the building wall and would not extend beyond the building façade. 10. Graphics Affixed To Buildings Below Canopy. Any graphic located beneath a canopy, arcade, marquee or other similar building projection shall not contain more than three (3) square feet in graphic area and shall be located on a building frontage proximate to an entrance to the building in regular use by the general public. Findings. This standard is not applicable. All proposed wall graphics on both the manufacturing building and the office building would not be installed above any canopies. RECOMMENDATION The Community Development Department and the Planning & Zoning Commission recommend approval of Petition 06-19, subject to the following conditions: 1. Elgin, IL 60120 Statement of Purpose and Conformance Dear Damir: John B. Sanfilippo &Son, Inc. located at 1703 N. Randall Rd. is requesting changes to our allowed signage on the property. Our 95-acre campus is unique, in that we own and rent the 400,000 square foot multi-tenant building which is currently home to 7 tenants. In addition, we manufacture and distribute our nuts and snack mixes in the 1.1 million square foot building adjacent to the office building. With 8 businesses calling this large campus home,our sign requirements vary from a single use company. We are requesting the following updates to signage on our property: Fox Lane Monument Sign: Current size: 7'7"x15' (Sign q 37). Proposing to replace sign with same size and include Electronic Message Center 15 square feet in size. NO CHANGE to overall size. Sign is consistent with other buildings and signs in the area and matches design of Randall Rd. EMC erected in 2018. No impact to traffic or safety. The electronic sign will provide a means to provide better guidance of traffic on large property and provide alerts for the dozens of trucks that enter and exit the property daily. 1-90 Monument Sign: Proposing removal of current monument sign (10'x20") (sign 41 46) that is adjacent to 1-90. Remove and replace with sign of same size and incorporate 95 square foot electronic messaging center within sign. Sign will be located on a perpendicular along 1-90 and relocated to berm as noted on site plan. Addition of electronic sign will allow JBSS to market its retail store as well as attract new tenants to our building which will lead to increased tax revenues for the city of Elgin. The sign is consistent with all other signage in the area and matches design of electronic sign erected in 2018. No impact to traffic or safety. 1707 Building Signage: Proposing addition of tenant signage on west and north wall of building. North side 150 square feet and West side 250 square feet. (Sign#53 &54) Addition of wall signage in these locations will allow 1B5S to continue to attract tenants to large multi-tenant building. Wall signage proposed is consistent in sizing as other approved signage on building. No impact to traffic or safety.
