AN ORDINANCE
DESIGNATING THE D.C. COOK/LOVELL AREA HISTORIC DISTRICT
WHEREAS, the area known as the proposed D.C. Cook/Lovell Area Historic District
depicted and legally described in Exhibit A hereto was nominated as a proposed historic district
pursuant to a petition signed by a majority of the owners of record of the properties of such area;and
WHEREAS,the Elgin Heritage Commission conducted a public hearing on October 3,2006,
to consider the nomination of the proposed D.C. Cook/Lovell Area Historic District; and
WHEREAS,the Elgin Heritage Commission adopted a resolution and report determining and
finding that the proposed D.C. Cook/Lovell Area Historic District meets the criteria for designation
as a historic district; and
WHEREAS,the proposed D.C. Cook/Lovell Area Historic District has been identified by the
Elgin Heritage Commission as a significant historic area within the City of EIgin due its connection
to prominent Elgin citizens, architects and builders; and
WHEREAS,the proposed D.C. Cook/Lovell Area Historic District has been identified by the
Elgin Heritage Commission as an area of significant architectural design due to the style of the
various homes within the area; and
WHEREAS,the proposed D.C. Cook/Lovell Area Historic District embodies characteristics
of various style homes including Queen Anne, Craftsman and Craftsman Bungalow, Prairie,Tudor
Revival, Colonial Revival, Dutch Colonial Revival, Classical Revival, Renaissance Revival and
Cape Cod,and that the building types that exist within the proposed historic district also include the
Front and Side Gabel Houses, the Mail-Order Bungalow, the Gambrel Cottage and the American
Foursquare; and
WHEREAS,the proposed D.C. Cook/Lovell Area Historic District is identified with David
C. Cook, who is credited with establishing the David C. Cook Publishing Company, and Vincent
Lovell, a prominent Elgin merchant and owner of land within the proposed historic district; and
WHEREAS, the structures within the area of the proposed D.C. Cook/Lovell Area Historic
District retain their architectural and structural integrity are worthy of preservation; and
WHEREAS, the area of the proposed D.C. Cook/Lovell Area Historic District is in a
condition exhibiting sufficient integrity of location, design, materials and workmanship making it
eligible for designation as an Elgin Historic District; and
WHEREAS, the designation of the proposed D.C. Cook/Lovell Area Historic District
provides a mechanism to preserve and protect landmarks, buildings, fixtures, facades, places of
historical and architectural significance and will stabilize and improve the property values within the

r city and encourage civic pride in the accomplishments of the past as manifested in the existing
structures and landscapes therein; and
WHEREAS, it is appropriate to designate areas having special historic, community or
aesthetic interest or value for the purpose of recognizing Elgin's historic,aesthetic,architectural and
cultural heritage,enhancing one of the city's older residential areas,promoting civic pride through an
awareness of Elgin's unique development and history,and encouraging conservation of an important
segment of the man-made environment of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby designates the territory
legally described in Exhibit A and depicted in Exhibit B and attached hereto and made a part hereof
by this reference as an historic district pursuant to Title 20 of the Elgin Municipal Code, 1976, as
amended, entitled "Historic Preservation", which shall be known and referred to as the "D.C.
Cook/Lovell Area Historic District".
Section 2. That the significant exterior architectural features of the structures within the
D.C. Cook/Lovell Area Historic District which shall be protected shall be those as defined as a
Significant Exterior Architectural Feature in Section 20.04.010 of the Elgin Municipal Code, 1976,
as amended.
Section 3. That the City Clerk is hereby directed within seven(7)days of the passage of
this ordinance to send a copy of this ordinance by regular mail to the Elgin Heritage Commission,the
Planning and Development Commission,the Community Development Department,the nominator
and/or applicants of the proposed historic district and to the common street address of all property
within the historic district. The City Clerk is hereby further directed to cause a certified copy of this
ordinance to be recorded with the Kane County Recorder.
Section 4. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed.
Section 5. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

The D.C. Cook/Lovell Area Historic District
The D.C.Cook/Lovell Area Historic District comprises part of Home in the Woods Subdivision established in
1926,David C.Cook's Addition established in1901,Lovell's Grove Addition established in 1893,Pillinger's
Subdivision,Lovell's Subdivision of Lovell's Addition established in 1913,(Lovell's Addition was
established in 1868)and Towner's Subdivision established in 1862.
The district is associated with David C.Cook who is credited with established the David C.Cook Publishing
Company. The company was established in Chicago in 1875,moved to Elgin in 1882,and finally to its
present 8 acre location along the Fox River in 1901.The company was a publisher of religious texts.The
portion of David C.Cook's Addition within the district includes the residential lots and a park(Esmeralda
Park)located opposite the publishing house.
The district is also associated with Vincent Lovell,an early settler in Elgin who owned lands North of
Jefferson Avenue. Lovell, a merchant,came to Elgin in 1837 and bought 160 acres extending east from the
Fox River. Lovell was one of the small group that was granted the charter for Elgin Academy in 1839.The
school did not open until 1856,after Lovell's death.His wife Lucy,a teacher,became a benefactor of the
Academy,and saw to it that her two sons were well educated.With her son Vincent S.(a later mayor of Elgin
between 1887-1889),she began subdividing family lands in 1868,particularly those west of Spring Street and
to the areas north and south of Lincoln Street.
The district embodies very fine examples of the Queen Anne,Craftsman and Craftsman Bungalow,Prairie,
Tudor Revival,Colonial Revival,Dutch Colonial Revival,Classical Revival,Renaissance Revival,and Cape
Cod styles. A few later examples in the Ranch and Split Level Raised Ranch also exist.The building types
that existing within the proposed district include the Front and Side Gable Houses,the Mail-Order Bungalow,
the Gambrel Cottage,and the American Foursquare.

SUBJECT: Designation of the D.C. Cook/Lovell Area Historic District.
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of the City Council with
information to consider an ordinance designating a new historic district in the Northeast
Neighborhood.
RECOMMENDATION
It is recommended that the City Council approve the designation of the D.C. Cook/Lovell Area
Historic District.
BACKGROUND
A nomination for a new historic district to be named the D.C. Cook/Lovell Area Historic District
was submitted on July 7, 2006. The nomination was submitted by Carol Seid, Don Souder,
Gerald Sorensen and Brian Anderson, who are property owners in the nominated area. The
proposed historic district is located in the Northeast Neighborhood immediately west of the
already designated Spring-Douglas Historic District.
These Criteria for nomination outlined in the historic preservation ordinance allow for properties to
be nominated based on their association with significant events, persons, architectural styles and the
suitability of the properties to be preserved.
The application was brought before the Elgin Heritage Commission on August 1, 2006. Per the
requirements of the historic preservation ordinance, the Elgin Heritage Commission conducted a
public hearing on October 3, 2006, to obtain testimony from the property owners and concerned
citizens on the proposed local historic district (reference attached the transcripts, findings of fact
and resolution).

Historic Significance
The D.C. Cook/Lovell Area Historic District is identified as contributing to the development of
the east side of Elgin.
The proposed district is named after two figures in Elgin's history that significantly contributed
to the development of the area being proposed as an historic district - David C. Cook, who is
credited with establishing the David C. Cook Publishing Company, and Vincent Lovell, an early
settler in Elgin who owned significant amounts of land North of Jefferson Avenue.
The area embodies characteristics of the following styles — Queen Anne, Craftsman and
Craftsman Bungalow, Prairie, Tudor Revival, Colonial Revival, Dutch Colonial Revival,
Classical Revival, Renaissance Revival, and Cape Cod. A few later examples in the Ranch and
Split Level Raised Ranch also exist. The building types that exist within the proposed district
include the Front and Side Gable Houses, the Mail-Order Bungalow, the Gambrel Cottage, and
the American Foursquare.
The property is in a condition exhibiting sufficient integrity of location, design, materials and
workmanship to make it eligible for designation as an Elgin historic district.
Requirements of a Local Landmark and Historic District designation
If adopted, an ordinance designating the historic district will require that the no-charge
Certificate of Appropriateness (COA) be obtained for exterior work to the structures on the
property.
The COA is administratively approved approximately 75 percent of the time. Administratively
approved COAs can be processed over the counter the same day along with the normally
required building permit.
Larger or more complicated projects are reviewed by the Design Review Subcommittee of the
Elgin Heritage Commission. Appeals of the Design Review Subcommittee's decisions can be
made to the whole Heritage Commission and ultimately to the City Council. Regardless of the
forum of the review, staff and Commissioners take the approach of working with the property
owners to suggest improvements and alternatives as necessary to help the property owner add to
the overall character of the building and the neighborhood. To date, over 4,500 COAs have been
issued for exterior work on structures either designated as local landmarks or situated in one of
the three historic districts of the City.

COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
A public hearing was conducted by the Elgin Heritage Commission on October 3, 2006. Notices
for the public hearing were sent to every property owner within the nominated area and
published in the local news papers.
FINANCIAL IMPACT
The expenses associated with the designation of the historic district includes the cost of
conducting the public hearing and mailing printed educational and informational material,
estimated to be under $500. There are sufficient funds budgeted ($32,320) and available
($21,900) within the Elgin Heritage Commission's FY 2006 budget, account number 010-0902-
709.80-04, Contributions—Heritage Commission, to cover any additional expenses.
LEGAL IMPACT
An ordinance designating D.C. Cook/Lovell Area Historic District will need to be prepared.
ALTERNATIVES
1. Accept the recommendation of the Elgin Heritage Commission to designate the D.C.
Cook/Lovell Area Historic District as an historic district.
2. Reject the recommendation of the Elgin Heritage Commission to designate the area as an
historic district.

WHEREAS, the area, as described as the D.C. Cook/Lovell Area Historic District, and attached hereto, is
located in the Northeast part of the City of Elgin, Illinois; and
WHEREAS, the area described as the D.C. Cook/Lovell Area Historic District, and attached hereto,has
been identified by the Elgin Heritage Commission, Illinois, as a significant historic area within the City of
Elgin due to its connection to prominent Elgin citizens, architects and builders; and
WHEREAS, the area described as the D.C. Cook/Lovell Area Historic District, and attached hereto, has
been identified by the Elgin Heritage Commission, Illinois, as an area of significant architectural design
due to the style of the various homes within the area, and;
WHEREAS, the structures within the area described as the D.C. Cook/Lovell Area Historic District, and
attached hereto, retain their architectural and structural integrity and are worthy of preservation; and
WHEREAS, area described as the D.C. Cook/Lovell Area Historic District, and attached hereto, is
identified with David C. Cook who is credited with establishing the David C. Cook Publishing Company;
and Vincent Lovell, a prominent Elgin merchant owner of land within the proposed district; and
WHEREAS, the area described as the D.C. Cook/Lovell Area Historic District, as proposed,has met the
requirements for local landmark designation as specified in Title 20 of the Elgin Municipal Code; and
WHEREAS, it is appropriate to designate properties having special historic, cultural, community, or
aesthetic interest or value for the purpose of recognizing Elgin's historic, aesthetic, architectural and
cultural heritage; thereby enhancing the City's urban architectural heritage; and
WHEREAS, it is appropriate to promote civic pride through an awareness of Elgin's unique development
and history; and encourage the conservation and preservation of an important segment of the man-made
environment of the City of Elgin.
NOW THEREFORE, BE IT RESOLVED BY THE ELGIN HERITAGE COMMISSION OF THE CITY
OF ELGIN, ILLINOIS, that the Elgin Heritage Commission, hereby recommends the designation as an

The D.C. Cook/Lovell Area Historic District is identified as contributing to the
development of the east side of Elgin. The area comprises part of Home in the
Woods Subdivision established in 1926, David C. Cook's Addition established
in1901, Lovell's Grove Addition established in 1893, Pillinger's Subdivision,
Lovell's Subdivision of Lovell's Addition established in 1913, (Lovell's Addition
was established in 1868) and Towner's Subdivision established in 1862.
C: The nominated area is identified with persons who significantly contributed to
the development of the community, county, state, or country.
The D.C. Cook/Lovell Area Historic District is identified with the following
. persons:
1. David C. Cook— David C. Cook is credited with established the David C.
Cook Publishing Company. Established in Chicago in 1875, it moved to Elgin
in 1882, and finally to its present 8 acre location along the Fox River in 1901.
the company was a publisher of religious texts. The property under
consideration includes the residential lots and a park (Esmeralda Park) located
opposite the publishing house.
2. Vincent Lovell - Vincent Lovell, an early settler in Elgin owned lands North
of Jefferson Avenue. Lovell, a merchant, came to Elgin in 1837 and bought
160 acres extending east from the Fox River. Lovell was one of the small
group that was granted.itlhe charter for Elgin Academy in 1839. The school did
not open until 1856, af10- Lovell's death. His wife Lucy, a teacher, became a
benefactor of the Academy, and saw to it that her two sons were well
educated. With her sons Vincent S. (a later mayor of Elgin between 1887-

1889), she began subdividing family lands in 1868, particularly those west of
Spring Street and to the areas north and south of Lincoln Street.
D: The nominated area embodies distinguishing characteristics of an
architectural style valuable for the study of a period, type, method of construction
or use of indigenous materials.
The area embodies characteristics of the following styles— Queen Anne,
Craftsman and Craftsman Bungalow, Prairie, Tudor Revival, Colonial Revival,
Dutch Colonial Revival, Classical Revival, Renaissance Revival, and Cape Cod.
A few later examples in the Ranch and Split Level Raised Ranch also exist. The
building types that existing within the proposed district include the Front and Side
Gable Houses, the Mail-Order Bungalow, the Gambrel Cottage, and the American
Foursquare.
Note: the document titled "Historic Resources in the Northeast Neighborhood: A
Summary and Inventory," prepared for the City of Elgin by Historic Certification
Consultants (1996), lists in detail the style and building type of each house within
the proposed historic district..
J: The nominated area is suitable for preservation and restoration.
Overall, the nominated landmark historic district comprises of structures that are
in a condition exhibiting sufficient integrity of location, design, materials and
workmanship to make them worthy of preservation or restoration.
II. Explanation of the integrity or lack of integrity of the nominated area.
The area continues to exhibit sufficient integrity of location, design, materials and
workmanship to make it worthy of preservation or restoration.
The document titled "Historic Resources in the Northeast Neighborhood: A
Summary and Inventory,"prepared for the City of Elgin by Historic Certification
Consultants (1996), lists 89 structures located within the proposed of the D.C.
Cook/Lovell Area Historic District. Of these structures, 22 structures were
determined as "Significant," 36 structures were determined as "Contributing," and
33 determined as "Non-Contributing" based on Criteria set by the Elgin Heritage
Commission for the survey and inventory of structures within the City's older
established neighborhoods.
The survey therefore indicates that a majority of structures within the proposed
D.C. Cook/Lovell Area Historic District are either significant or contribute to the
overall character of the proposed historic district.
Note: it should be noted that properties built following 1946 were determined to
be non-contributing at the time the survey and inventory was completed in 1996.

• These structures may qualify based on their post World War II architectural style
and are eligible for preservation.
III. In the case of a nominated historic landmark found to meet the criteria for
designation:

New Residential Buildings and Construction (Primary and Secondary Buildings)
Satellite Dishes and Antennas
Signs and Graphic Designs
Solar Panels, Skylights, and Roof Vents
Swimming Pools
and any other feature as defined by the Elgin Design Guideline Manual.
Note: the purview of the Elgin Design Guideline Manual would pertain to all
features outlined above on the primary structure and contributing ancillary
structures. Any new construction on the property will need to conform to the
requirements of the Elgin Design Guideline Manual, and contribute to the overall
character of the property.

2. The types of alterations and demolitions that should be reviewed for
appropriateness pursuant to the provisions of Chapters 20.08 and 20.10 of
title 20.
Per Chapter 20.08 the types of alterations that would be reviewed for
appropriateness, where a Certificate of Appropriateness (COA) shall be required
before the following actions affecting the exterior architectural appearance of any
designated landmark, or any property within an historic district may be
undertaken:
a Any exterior construction, alteration, removal or demolition requiring a
building permit from the City:
b. Any exterior construction, alteration, removal or demolition affecting a
significant or contributing exterior architectural feature.
Notwithstanding any of the provisions of Title 20 to the contrary, a Certificate of
Economic Hardship may be issued to allow for the performance of work for
which a Certificate of Appropriateness has been denied.
IV. Proposed design guidelines for applying the criteria for review of Certificates
of Appropriateness to the nominated historic district.
The guidelines document currently used is the Elgin Design Guideline Manual for
Landmarks and Historic Districts.
These guidelines are specific to Elgin's landmarks and historic districts and serve
as a guide and resource to property owners, architects, contractors, and staff
during the process of reviewing exterior changes to properties.
V. The relationship of the nominated historic landmark to the ongoing efforts of
the Elgin Heritage Commission to identify all potential areas and structures
that meet the criteria for designation.
Per Chapter 3.70.060 —"Duties and Responsibilities," the following are in
keeping with the ongoing efforts of the Elgin Heritage Commission to identify
and nominate all potential areas and structures for landmark designation.
Item 7: to investigate, hold public hearings and recommend to the City Council
designation of certain Elgin sites, structures or areas as having special historic,
community, architectural or archeological value as "landmarks" or"historic
districts."
VI. Recommendations as to appropriate permitted uses, special uses, height and
area regulations, minimum dwelling size, floor area, sign regulations and

placing regulations necessary or appropriate to the preservation of the
nominated historic district.
The regulations for permitted uses, special uses, height and area regulations,
minimum dwelling size, floor area, sign regulations and placing regulations
necessary or appropriate for the preservation of the nominated historic district
shall comply with the provisions of Title 19 (Zoning) of the Elgin Municipal
Code.

The City of has vision and respect for its historic architecture. Preservation interests
contribute to cur community pride, especially here in the Northeast Neighborhood. We request that
the " P.C. Cook / Lovell area " be considered for designation as a Historic District,
Our residents enjoy, and would like to maintain for others, the historic qualities of our
surrounding homes and neighborhood. This area contains significant and contributing homes we
seek to incorporate into the ` DC Cook / Lovell Area Historic District', 20 homes in this
particular area have been cited in the survey by Historic Certification Consultants as being
qualified for significant status, 56 are included as contributing.

• Prominent, previous landowners Vincent Lovell and Phineas J. Kimbell subdivided this particular

As a group of home owners, proud to be supporting and contributing to the rich history of
Flgin, 75 percent of residents in the designated " D.C. Cook / Lovell Area " signed "ye " to a
petition reguesting Historic resignation, ( 16% were unable to be contacted, 11%declined to
sign )
This area, if designated, will contribute to the character of in perpetutty.
This area includes West of Douglas Avenue from Spring Douglas Historic District at the North
point, following South river 131uff, including Slade Avenue to Douglas, Grove Avenue through the
800 block, Lovell Street West from Spring Douglas Historic 17istrict to mid way between Grove

20.06.030 CRITERIA FOR CONSIDERATION OF NOMINATION.
A nominated structure, property, or area must be fifty years of age on the date of
designation unless it is an integral part of a designated historic district or if it has otherwise
achieved significance of exceptional importance.
The heritage commission shall, upon such investigation as it deems necessary, make a
determination as to whether a nominated structure, property or area meets one or more of the
following criteria:
A. That it has character, interest or value as part of the development, heritage or cultural
characteristics of the community, county, state or country;
B. That its location was a site of a significant local, county, state or national event;
C. That it is identified with a person who significantly contributed to the development of the
community, county, state or country;
D. That it embodies distinguishing characteristics of an architectural style valuable for the
study of a period, type, method of construction or use of indigenous materials;
E. That it is identified as the work of a master builder, designer, architect or landscape
architect whose individual work has influenced the development of the community,
county, state or country;
F. That it embodies elements of design, detailing, materials or craftsmanship that render it
architecturally significant;
G. That it embodies design elements that make it structurally or architecturally innovative;
H. That it has a unique location or singular physical characteristics that make it an
established or familiar visual feature;
I. That it is a particularly fine or unique example of a utilitarian structure, including, but not
limited to farmhouses, gas stations or other commercial structures, with a high level of
integrity or architectural significance;
J. That it is suitable for preservation or restoration.
Any structure, property or area that meets one or more of the above criteria shall also
have sufficient integrity of location, design, materials and workmanship to make it worthy of
preservation or restoration.

15 is Elgin heritage and preservation .

16 Historic District . This is an area that is located
17 in the northeast part of the City of Elgin . And it
18 is comprised of subdivisions that were established
19 between the 1860s and the 1920s . These subdivisions

1 that Lovell ' s Addition was established in 1868 ; and
2 finally Towner ' s Subdivision, established in 1862 .
3 The area is named after two important
4 people that were instrumental in establishing this
5 area .
6 David C . Cook , he was the established - -
7 the founder of the David C . Cook Publishing Company,
8 which was established in 1875 , moved to Elgin in
9 1882 , and finally to it ' s present location on the
10 eight -acre location along the Fox River in 1901 .
11 Vincent Lovell is the other person whose
12 name is associated with this proposed Historic
13 District . He is an early settler that came to Elgin
14 in 1837 and established areas in - - in - - his
15 additions in that area following that . Most of his
16 land was sold following his death into the
17 subdivisions and additions that comprise this area .
18 The information on this proposed Historic
19 District was compiled together in 1996 in a survey of
20 the northeast neighborhood, and in that survey the
21 ratings of all the houses into either significant ,
22 contributing or noncontributing were marked according
23 to that survey .
24 The survey indicates that a majority of the

1 structures within the proposed D . C . Cook/Lovell Area
2 Historic District are either significant or
3 contribute to the overall character of that
4 neighborhood .
5 Areas - - or , rather , homes that were
6 determined to be noncontributing at that time were
7 designated as such because they were built after
8 1946 , and their rating could have changed following
9 that time . Ten years have passed since that survey
10 was completed and many of those homes could now fall
11 into the contributing category or the significant
12 category .
13 And tonight ' s testimony can be obtained
14 from public - - from the residents of the area or any
15 other interested party interested in the nomination
16 tonight . And this testimony will be recorded by the
17 court reporter tonight . And a resolution will be
18 required to be passed by the Heritage Commission,
19 which will be passed along to the City Council for
20 their final designation or rejection , as the case may
21 be , of this proposed Historic District .

20 develop in our citizens . Our community pride in the
21 northeast neighborhood of Elgin grew within our
22 neighbors to request that the following area be
23 considered for designation of Historic District . Our

16 Grove Street . Twenty homes of this area are awarded
17 as being historically significant .
18 Historically significant , the definition - -
19 and I quote the Book of Historic Resources - - in the
20 northeast neighborhood , age of 50 years or older
21 unless it has achieved exceptional importance .
22 Architectural merit . Must possess
23 architectural distinction in one of the following
24 when compared with other buildings of this type .

1 Architectural style . The work of a master
2 builder or architect , exceptional craftsmanship ,

7 materials . No porch alterations . No unsympathetic
8 additions .
9 A sub- function would be to maintain these
10 homes as single - family dwellings .
11 Seventy- five percent of our district area
12 neighbors signed the petition, yes , to historic
13 designation . Sixteen percent were unable to be
14 contacted . Eleven ( sic ) percent declined to sign .
15 A very few would say that this places
16 unreasonable rules , too much City control , or feel
17 that they are over reaching their powers .
18 The goal is simple : Preserve that which we
19 have inherited .
20 New developments are calling their parades
21 of homes upscale , luxurious , executive . It is these
22 homes that could be found anywhere in the United
23 States , exactly the same , or a take -off of rajas
24 (phonetic) dominating the roads . A barelessness .

1 You could be in this neighborhood without distinction
2 of where you are in any other similar development .
3 The perception of upscale bends the true
4 definition of neighborhood character and
5 architecture , if introduced into our D . C . Cook/Lovell
6 area . I believe it does not fit well with our
7 established homes .
8 Therefore it is important that the Elgin
9 Heritage Commission, who can help and advise in many
10 ways , review either favorably or unfavorably the
11 request for exterior repair or additions to their
12 homes from new owners .

15 designed by Frank Lloyd Wright , but it sure looks
16 like his architecture style .
17 And I was - - as a long-time resident in the
18 neighborhood there , I ' d really hate to see that
19 building torn down . I think that should be preserved
20 and saved, at least the front part . If you ' re going
21 Co build condos , build them in the back . But I am
22 totally against tearing it down .

6 One of the strengths of our neighborhood is

8 reasons we chose to live in the neighborhood . Our
9 homes are unique and it makes our neighborhood
10 special . We have a strong sense of community and we
11 hope to keep that going .
12 Our neighborhood right now is in somewhat
13 of a state of flux . We - - it ' s all - - the state of
14 the D . C . Cook building is uncertain at this point .
15 And something that maybe could help us preserve , like
16 I said, the individuality of our neighborhood is this
17 historic designation .
18 We ' d like to - - I guess I ' d just like to go
19 on record as asking that the - - you know, that this
20 gets approved . And it will help us preserve our
21 sense of history and a tradition that is so rich in
22 our neighborhood .

17 saw here . Never expected to see anything like this
18 in Elgin, which, from our perspective , had a really
19 lousy reputation .
20 It was a great - - a great opportunity that
21 came our way just to be able to - - just that led us
22 right into Elgin . And this is one of the first
23 places - - the second house that we saw , and we didn ' t
24 leave until almost midnight before we actually put

1 some - - put a down payment down on the home because
2 we were so interested in it . But that ' s me
3 personally .
4 I think the whole - - the whole historic
5 aspect of a neighborhood is something that ' s going to
6 keep it - - keep Elgin very, very viable as a City
7 that ' s interested in its past , its present and
8 obviously in the - - excuse me - - in its future just
9 because we care about all these - - all the historic
10 buildings .
11 And D . C . Cook - - we ' re very involved in
12 that whole process , also, you know .
13 And - - and if you go to any other City
14 and - - and we can ' t look at Elgin as a town any more .
15 I think we have to look at it as a City .
16 Everywhere you go, Boston , you know, the
17 northeast is rich with history, with culture and
18 everything else . And this is what we should aspiring
19 too .
20 And that ' s really all I have to say .

2 Elgin for about nine years , which makes me a relative
3 newcomer to the northeast neighborhood . And my home
4 was built in 1937 , which makes it relatively one of
5 the newer homes in the neighborhood .
6 And I just want to speak from a personal
7 note of why my wife and I chose Elgin when we moved
8 to this area nine years ago . We could have chosen
9 any of the northern or western or northwestern
10 suburbs to live in , and we did a lot of searching
11 around those areas . And when we landed in the
12 northeast neighborhood we really fell in love with
13 the diversity of the architecture in this
14 neighborhood . And that was what attracted us to
15 Elgin, as someone else said, despite some of the
16 negative things that you may hear about Elgin . Once
17 we saw this neighborhood we knew this was where we
18 wanted to live .
19 And I think it ' s very important to Elgin to
20 preserve the uniqueness of this particular area in
21 order to continue to attract new residents .

2 I have lived in the new district for eleven
3 years - - hopefully new . Prior to that I have lived
4 in the Kimball Park Historic District and I have seen
5 how it flourished with the designation and how things
6 were improved over the nine years I lived in that
7 area . And I would very much like to see the area
8 where I live at right now to see - - to have it
9 preserved as well as it is or even make it better .
10 I see every day people that drive through
11 our area and hear lots of comments that , Wow, we did
12 not even know that this area is . It ' s beautiful .
13 And I think it really deserves to be preserved .
14 And I hope with the D . C . Cook building that
15 it can be worked into the area so it would fit in
16 and, especially with the overcrowdedness , not have a
17 bad influence .
18 So I think would be a great thing if we
19 could get the district going , and work everything
20 together , and improve it .

2 I ' m here today to voice my opposition to
3 this latest Historic District .
4 When considering the nationwide legislative
5 efforts to bring Historic Districts to the different
6 areas , there ' s basically two reasons why this is
7 generally considered . The first is a recognition
8 that a large number of historic structures have been
9 destroyed without adequate consideration of either
10 the values represented therein or the possibility of
11 preserving and - - preserving the destroyed properties
12 for use in economic and productive ways .
13 To this first point I cite examples in
14 Elgin has found no reason to save either Crocker
15 Theater or the coin shop . The urban sprawl has
16 continued unabated in the form of condos , row houses ,
17 some of which still stand vacant .
18 Even if you do agree that homes of historic
19 architecture must be preserved , to those ends we
20 already have three Historic Districts in Elgin . I
21 have no question that those were worthwhile . Homes
22 can be preserved without Historic Districts .
23 I do however question the motivation of
24 this fourth one in whether or not it would be better

1 served in Elgin to have it someplace other than this
2 area .
3 The second widely held concern is a belief
4 that structures of special historic , cultural , and
5 architectural significance somehow enhance the
6 quality of life for all .
7 To the second point I would ask : On what
8 grounds do we believe it would enhance the quality of
9 life? Is it via aesthetics?
10 There are examples in our own neighborhood
11 of homes that have continued to be eyesores for years
12 to come . Take for example 856 North Spring Street .
13 It was required to remove both fence and siding .
14 After almost a full season of work not even one side
15 of this home has yet to be completed . Maybe it ' s due
16 to economics .
17 I can have two quotes that help disagree
18 with this . A 1991 federal report found :
19 "Regulations governing the
20 preservation of buildings can also block
21 rehabilitation of older structures . If
22 the building is labeled as historic ,
23 then the planned rehabilitation is
24 sometimes subject to lengthy and costly

1 approval processes to assure the
2 authenticity of appearance .
3 " In other cases where the building
4 has been in a Historic District or has
5 been individually designated historic ,
6 energy- efficient enhancements ; such as ,
7 replacement of windows , doors , or the
8 drilling of holes into sides for
9 injection of insulation ; can be blocked
10 based upon strict adherence to
11 preservation codes . "
12 The second quote is :
13 "Despite the preservationist ' s
14 belief , assets do not become more
15 valuable because the government has
16 gained more financial control over them .
17 "A study for the May 1994 issue of
18 the Journal of Real Estate and Finance
19 and Economics explains how stringent
20 preservation rules in Philadelphia
21 weakened the value of some buildings by
22 up to 24 percent relative to comps
23 without rules . "
24 Maybe this is a concern via due to safety or

1 concern over codes . What does the property owner have
2 to do in order to do anything to the outside of their
3 home if they live in a Historic District?
4 First you have to submit a COA . Then you have
5 to have - - wait for the Design Review Committee that
6 meets the second or fourth Mondays . For fences ,
7 driveways , retaining walls you may need - - you may also
8 need to include a plat of survey . You further are going
9 to have to wait for the Historic Preservation
10 Coordinator to review your work .
11 I have to wonder whether or not people will
12 say the heck with it , why bother , and could result in
13 either work failing to be done or permits ignored
14 completely .
15 Therefore , for this particular Historic
16 District , I further question the appropriateness of this
17 petition and the signatures collected . I am not stating
18 that anything was inappropriately done . However,
19 being - - after being requested to sign, I came away with
20 two distinct impressions .
21 The - - the first is that the Historic District
22 would in some way help preserve the D . C . Cook building .
23 When I received the paperwork I was flabbergasted to
24 find that even though it bears its name , this does

1 absolutely nothing for the preservation of this
2 building .
3 The second motivating factor that was
4 presented for me to sign was the ability to receive
5 grants and financial incentives to be able to do some
6 work in the area . To this end I have to question
7 whether or not the gold coast of Elgin - - if it ' s the
8 best location for this type of motivation .
9 I believe that a good number of signatures
10 were required . This is really about a small vocal click
11 which is trying to enforce powers of the City to control
12 what the neighbors do and ultimately who their neighbors
13 are .
14 I wish to appeal to the boundaries - - appeal
15 the boundaries outlined . I find it interesting that
16 North Grove is a jagged boundary outline which ends up
17 missing two locations which were identified as
18 significant , yet the 60th block of River Bluff Road has
19 nothing historical about it but it has been included .
20 The 60th block of River Bluff Road is two homes that
21 were built in the ' 50s and one that was built in the
22 late ' 90s which had siding on it '41ready . There is
23 absolutely no reason for this bloc.* to be included .
24 Further , from what I ' ve been able to

1 determine , I do not believe anyone on this block has
2 sign the petition either .
3 If this insanity must be passed , I would
4 implore you to at least ignore and exclude this
5 insignificant block .

16 proposed Historic District would promote preservation
17 of significant and contributing architectural
18 resources therein , would facilitate maintenance of
19 property values , and would further enhance the image
20 of the City of Elgin . I do therefore support fully
21 and wholeheartedly the designation and establishment
22 of the proposed D . C . Cook/Lovell Area Historic

9 think we are . We let people do things in the
10 Historic District . You just have to get , as that
11 gentleman said , a COA, and that ' s just going by the
12 law .
13 One of the things - - why I want the
14 district is it does preserve and protect . Because
15 once you destroy one of those old houses , you ain ' t
16 getting it back . It ' s just not going to happen .
17 I ' ll give you an example . I did a lot of
18 restorations in Elgin, probably 50 all together in my
19 time , and one of the neighborhoods I first worked in
20 was Ball Street , 319 Ball . They had some infill lots
21 over there , and the worst houses were built on infill
22 lots ; cheap , little , raised ranches , very poorly
23 built . And then what they did is they allow a five
24 flat on the corner , which did not help an already

1 distressed neighborhood .
2 So that ' s one of the reasons why I ' m for a
3 Historic District , because once you let this kind of
4 stuff happen on an infill lot it just takes away all
5 the character of what ' s around you .
6 And my home on Grove , I have a vacant lot ,
7 and the house south of me has a vacant lot . And
8 without that district a little , cheap house can go up
9 there and would just ruin the aesthetic value , I
10 feel , of that neighborhood . And the reason I bought
11 my house over there was because of the David C . Cook
12 Publishing Company . It ' s just a grand view out of
13 the front door of my house . Nice setback .
14 People come over and they say, Wow, like
15 other people have said here , they didn ' t think Elgin
16 was this nice . They saw the neighborhood . Even they
17 were shocked .
18 Dick Bennett and myself , in Dick Bennett ' s
19 car, stopped in my driveway, looking at some of my
20 old cars , he even made a comment , Boy, this is really
21 a nice area .
22 I said , Well , Mr . - - Mr . Shock ( sic) , I
23 said , that ' s because of that across the street .
24 That ' s why a lot of people want to preserve

12 the first Historic District in Elgin . I was on the
13 Heritage Commission and voted in favor of the Elgin
14 National Watch Historic District and the
15 Spring/Douglas Historic District .
16 I was on the Commission and lobbied
17 strongly for the Lords Park Historic District . We
18 lost at that one .
19 So many - - I ' ve been to so many of these
20 meetings I ' m on a first name basis with the court
21 reporter .
22 I ' m a old house enthusast . I ' m a
23 preservationist wannabe . So what I ' m about to say is
24 very, very painful for me , but I am here this evening

1 to testify against creating this new district .
2 I feel we are currently at a crisis point
3 in preservation in Elgin . Until the City commits to
4 a full - time preservation staff I cannot endorse
5 adding more structures to the load of our currently
6 overloaded staff .
7 Grant programs are great , to answer your
8 question . Yes , if you ' re in a Historic District you
9 will be available to get grants . Grant programs are
10 great .
11 But then we do not have the staff to follow
12 up and ensure that things are done correctly . We can
13 actually create problems by giving you a grant
14 because you did the work incorrectly .
15 Many complaints currently go unresolved .
16 If the people of the proposed Historic District think
17 that their status will help them protect their
18 architectural resources , you ' re wrong . We don ' t have
19 the staff to protect what we are already trying to
20 protect . We ' re losing things all the time in the
21 Historic Districts that we have . The work done with
22 COAs are often not followed up upon to ensure the
23 work is acceptable because we do not have enough
24 staff .

1 We can ' t even give - - if we give a new
2 Historic District , we can ' t even give you folks a
3 copy of the design guidelines because we do not have
4 adequate staff to get them revised and reprinted . We

8 planners , two full - time Saroshs . We have a fourth of
9 a Sarosh . What a crime .
10 They have two full - time preservation
11 planners that have preservation training and one
12 full - time secretary on their preservation staff . And
13 they regularly go out for a paid intern . Jennifer
14 Benson - - have any of you dealt with her downtown - -
15 she started out as an intern in Aurora .
16 Aurora has 1 , 000 structures to oversee . We
17 currently have 1551 with the proposed district adding
18 89 more , making it 1640 .
19 So we have to protect , we have to oversee
20 1640 with Sarosh part time , etcetera . I don ' t even
21 know how to say what number we have . And they ' re
22 doing it with three people and an intern with - - with
23 1 , 000 people ( sic ) .
24 The people in Aurora ' s Historic Districts

1 petitioned for and received an inspector , a special
2 inspector just for the Historic Districts . That ' s so
3 important to have an inspector that knows about
4 Historic Districts so that they ' re not going against
5 the preservation guidelines . This guy is sent for
6 special training . He regularly goes to Campbell
7 Center for training .
8 Their inspector - - Aurora has a hearing
9 office program to get people to comply sooner than
10 normal civil court . The hearing officer can initiate
11 fines to get compliance . Ninety percent of their
12 cases are complied with without going to court .
13 Elgin does not have the staff or the will
14 to force compliance .
15 Everything you read says that
16 revitalization of any - - the revitalization of any
17 city has to have a preservation component . The City
18 of Elgin is not giving full attention to
19 preservation . The grants the City currently offers
20 are great but not nearly enough for over 1600
21 structures . Yes , $200 , 000 is fantastic but the
22 library site gets 13 . 6 million . Where are our
23 priorities?
24 If you folks want more Historic Districts ,

1 if we want more Historic Districts , each one of us
2 has to lobby strongly with our City Council to get
3 them to commit to a full - time preservation staff . We
4 need a full - time preservation staff . We are ten
5 years behind Aurora .

10 River Bluff Road .
11 I do not live in the proposed Historic
12 District but I have witnessed the wonderful effects
13 of the Douglas/Spring District . What I have seen
14 during the past years is not only people getting
15 their homes in better shape but the protection of
16 homes that are already there .
17 Whether or not there is enforcement action
18 or not , people know that there is a regulation that
19 needs to be followed . And if I can have 50 percent
20 or 90 percent of those people following that
21 regulation , knowing that there ' s rules that they have
22 to follow, that will maintain or stop them from
23 having these homes being eliminated from further
24 destruction . So whether or not we have the monies or

1 the people , we are stopping a process of going
2 downhill .
3 As far as regards to the D . C . Cook
4 building , I stand in favor of encompassing that in
5 the Historic District . The Historic District not
6 only protects homes from degradation but the
7 surrounding effects ; streets , curbs , sidewalks ,
8 parks , also historic buildings . And if this building
9 is important to this neighborhood to maintain the
10 feel and the essence of why these people moved - - or,
11 why they want to stay there , then this building
12 should be incorporated to maintain that feeling and
13 sense of non-degradation which is what possibly could
14 follow .
15 As we ' ve had an example by Mr . Roxworthy of
16 infill housing , which is what could happen here is
17 someone which show up with a piece of land and put
18 whatever he wants on there , not conforming to the
19 general neighborhood . So I do stand in favor of this
20 and I hope it gets approved .

2 My name is Debra Hill . I live at 752
3 Brook, and I ' m a relative newcomer too .
4 I don ' t quite understand the whole packet ,
5 but I know that my husband and I feel really lucky
6 that we live in this area . The first time I drove
7 down the streets I just full in love with this . It
8 was , Oh, I ' ll never be able to buy a house in this
9 neighborhood . And then the first house that I - -
10 first house I saw I could have bid on it that day and
11 my husband never even saw the house . I talked to my
12 mother and asked her if it was okay .
13 I know the staff is really busy . I tried
14 to reach Sarosh a few times , but it didn ' t stop us .
15 We just had the house painted . The grants are great ,
16 but that ' s kind of besides the point . I mean it ' s
17 preserving our neighborhood .
18 And I live on the corner of Brook and
19 Lincoln so I get to see down Grove . I don ' t want to
20 see condos down there .
21 And I like having the fact that it ' s all
22 open and it ' s - - they don ' t - - you know, that
23 nothing ' s going to be changed . I think I really like
24 that .

1 And I still went ahead with my painting
2 and, you know, kept the business in Elgin and had
3 Chad Roxworthy do my painting . And , you know, tried
4 to incorporate the people that live here , like Expert
5 Roofing did my roofing . And you got to try to keep
6 it within the community and it will preserve it .
7 And if you want - - the grants are important
8 but they ' re not the most important thing .

13 My husband and I live a 933 Brook Street .
14 I ' m an interior architect and we just moved
15 here a year ago , so we ' re pretty much babies in the
16 history of things . But we love our house and we
17 found it through the Historic Home Tour . We went to
18 an open house and pretty much were giggling like
19 little girls in the living room saying , We have to
20 have this house . We love it . We love it . And we ' re
21 just so happy to live in an area that has historic
22 significance , that represents what the history of
23 Elgin is . I mean , it ' s a City with a ton of historic
24 significance .

2 the word about what an amazing place that Elgin is to

18 You know, to allay the fears of some who
19 have sort of a jaundiced view of a Historic District ,
20 having been on the Commission for a while now, I ' m
21 aware of several instances where there ' s a - - just
22 the a. tions of the Commission with the City and with
23 the p'Eople living in the neighborhoods has been very
24 ' outstanding , really top-notch .

1 And one that comes to mind is something
2 very recently . You may have noted that in the
3 newspaper there ' s a picture of the rectory of St .
4 Joseph Church on Division Street . And this went on
5 for quite awhile as - - and, really, it was a ugly
6 building . And a - - and it started out with not a
7 good feel . But now the building has been restored
8 and it ' s a gem . It ' s just - - thanks to Dan Miller ' s
9 talents and skills it ' s just beautiful .
10 This is the type of thing that can come to
11 pass working with the Commission and the City staff .
12 You know, we do not intend the Commission
13 to be strictly an antagonistic body .
14 And likewise with the Design Review
15 Subcommittee . Some people may view that as being a
16 hindrance to doing what they want to do . But there
17 are plenty of avenues open, and I think you ' ll find
18 everyone .on the Commission, or the Design Review
19 Subcommittee , or the City staff , the primary goal is
20 to improve and maintain the neighborhoods of Elgin .

2 The Elgin Heritage Commission will convene
3 a special meeting , within 30 days following the close
4 of tonight ' s public hearing, to make a determination
5 on the final evidence on whether the nominated
6 district meets the criteria for designation . This
7 determination will be passed by resolution of the
8 Commission and will be accompanied by a report
9 stating the findings of the Elgin Heritage Commission
10 concerning the criteria for designation .
11 A notice of the determination of the
12 Commission , including a copy of the report , will be
13 sent within seven days of adopting the regulation, by
14 regular mail , to the common addresses of all
15 properties located within the proposed Historic
16 District and to the City Council .
17 On receiving the determination of the
18 Commission and copy of the report , the Elgin City
19 Council will make a determination to accept or reject
20 the nomination .
21 In the event the nomination is accepted and
22 designated by the City Council , a certified copy of
23 the ordinance designating the district will be
24 recorded with the county recorder - - in this case the

2 In the event the nomination is rejected by
3 the by the City Council , a new petition for
4 nomination for a Historic District may not be filed
