PETITION FOR VACATION
To the Mayor and Members of the Council of the City of Elgin, Illinois:
Pursuant to the provisions of Section 11-91-2 of Chapter 24 of the Illinois Revised
Statutes, also known as the MUNICIPAL CODE, 1969, theundersigned hereby states that
he is attorney for the owners of record of the land abutting the culdesac described
on the Plat of Vacation attached hereto and made a part hereof.
Petitioner respectfully requests the vacation of the culdesac described on said Plat
of Vacation and as grounds therefore states as follows:
1. That said property to be vacated is located within the corporate limits of the
City of Elgin and consists entirely of a culdesac for turn-around purposes on
Davis road of the Miller-Davis Research and Industrial Center which was included
in the subdivision plat approved by the Council of the City of Elgin on March 11,
1970 and which plat was recorded with the recorder of Kane County, Illinois as
Document #1162317 in the Book of Maps #55, Pages 19 and 20.
2. That since said subdivision plat was duly approved and recorded, certain additional
property, west of and contiguous to the property which is the subject of this
petition, has been annexed to the City of Elgin and a Plat of Subdivision of said
additional property will be submitted to the City of Elgin. That said contiguous
subdivision will contain the continuation west of said Davis road and does not
require the culdesac which is the subject of this petition.
3. Property to be vacated does not include the 60 foot right-of-way presently
known as Davis road which will be extended into the above described contiguous
subdivision as a continuation west of said Davis road.
4. That said vacation is consistent with the overall plan of the development of
the Miller-Davis Research and Industrial Center and that maintenance of above
described culdesac serves no useful purpose to the City of Elgin or the Miller-
Davis Research and Industrial Center.
WHEREFORE Petitioner requests that an Ordinance of Vacation be approved by the
Council of the City of Elgin and the same issued forthwith.
