AN ORDINANCE
AMENDING CHAPTER 12.08 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "PUBLIC PARKS; GENERAL REGULATIONS"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That Chapter 12.08 of the Elgin Municipal Code, 1976, as amended, entitled
"Public Parks; General Regulations" be and is hereby further amended by amending
Section 12.08.010M to read as follows:
"M. The closing time for all parks is sunset. The opening time for all parks
is sunrise. With the exception of on duty city employees,no person shall be present
in any park after sunset and prior to the following sunrise,unless participating in an
activity authorized or scheduled by the City of Elgin,or for which written permission
has been granted by the Director of Parks and Recreation. The provisions of this
section shall not apply to lighted tennis courts,lighted baseball fields or lighted golf
course facilities in a park or to individuals traveling to or from such lighted facilities.
The closing times for such lighted tennis courts,lighted baseball fields or lighted golf
course facilities shall be as determined by the Director of Parks and Recreation and
�..� shall be posted at such lighted facilities. With the exception of on duty city
employees, no person shall be present at any such lighted facility after the posted
closing time."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this
ordinance be and are hereby repealed.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.

SUBJECT: 2004 Parks Opening and Closing Time Ordinance
PURPOSE
The purpose of this memorandum is to provide the Mayor and members of City Council with
information to change the closing and opening times for all parks.
RECOMMENDATION
It is recommended that City Council approve amending Chapter 12.08 of the Elgin Municipal
Code, 1976, as amended, entitled "Public Parks; General Regulations" establishing the opening
time for parks at sunrise and the closing time for parks at sunset.
BACKGROUND
The Parks and Recreation Department and the Police Department are requesting a change to
Chapter 12.08.010, M., of the Elgin Municipal Code, 1976, as amended , entitled "Public Parks;
General Regulations." The current article addresses the closing times for all parks to be 10:00
P.M. The ordinance does not address the time that parks will open. The current time frames have
allowed for criminal mischief to take place in the parks after night fall and hindered the police
efforts in curtailing these actions.
The Police Department and Parks Department have worked together to develop an amendment to
the ordinance to allow the police to help control illegal activity, while allowing certain
authorized recreational uses to take place such as baseball, soccer and tennis use under athletic
field lights.
The new ordinance changes the parks opening time to sunrise and closing time at sunset.

FINANCIAL IMPACT
There will be minimal costs associated with the making and installing of new signs. These
expenses can be absorbed within the current Parks and Recreation Department's budget.

1. Change the ordinance for the opening and closing times of the parks for opening at
sunrise and closing at sunset.
