AN ORDINANCE
ANNEXING CERTAIN TERRITORY TO THE CITY OF ELGIN PURSUANT TO AN
ANNEXATION AGREEMENT
WHEREAS, the City of Elgin has heretofore entered into a certain annexa-
tion agreement dated September 21, 1978 with Valley Creek of Elgin, Inc. , a
Delaware Corporation, and Clarence Do Burnidge, Luella F. Burnidge, Alice
Burnidge and The First National Bank of Elgin, as Trustees under the Last
Will and Testament of Sidney G. Burnidge, Deceased; and
WHEREAS, according to the terms of said agreement the City of Elgin
agreed to annex the territory described in said agreement upon written
petition of the owners of said property; and
WHEREAS, written petition has been made to annex the subject property
to the City of Elgin; and
WHEREAS, said petition has been signed by electors residing on the
subject territory; and
WHEREAS, said territory is not within the corporate limits of any
municipality and is contiguous to the City of Elgin; and
WHEREAS, legal notices of the intent of the City of Elgin to annex said
territory have been forwarded to all public bodies required to receive said o
notice.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, as
ILLINOIS:

Section 1. That the following described territory: M

That part of the South Half of Section 4, part of Section 8, rn ,
part of Section 9, and part of the Southwest Quarter of Section 10, -�
Township 41 North, Range 8 East of the Third Principal Meridian, rn -'
described as follows: Beginning at the Northwest corner of the -t
Southwest Quarter of Section 9; thence South along the West line of
said Section 302.7 feet; thence South 81 degrees 45 minutes East
1085 feet; said line hereinafter referred to as line "A'; thence
South 615.34 feet; thence West 536 feet; thence South 472.44 feet
to the center line of Highland Avenue Road; thence Southeasterly
along said center line to the South line of said Section 9; thence >17

the right-of-way of the Chicago and Northwestern Railway Company;
thence Northwesterly along said Southerly line, a distance of
2533.55 feet to a line drawn North from a point on the South line
of the Southeast Quarter of the Southwest Quarter of said Section 4,
369.60 feet East of the Southwest comer thereof; thence South
along said line to the North line of the Northwest Quarter of Sec-
tion 9; thence West along said North line to the Northwest corner
of said Northwest Quarter; thence South along the West line of said
Northwest Quarter to the place of beginning. ALSO that part of the
East Half of the Northeast Quarter of Section 16, Township 41 North,
Range 8 East of the Third Principal Meridian, described as follows:
Commencing at the Northeast corner of said Section 16; thence West
along the North line thereof 6.28 chains for a place of beginning;
thence South 1 degree 21 minutes West 820 feet to the center of
road; thence Southeasterly along center of road 67.08 feet to the
West line of Tyler Creek being a Subdivision of part of the North-
east Quarter of said Section 16; thence North along said West line
and along said West line extended North 831.97 feet to a point on
the North line of said Northeast Quarter that is 66 feet East of
(as measured along said North line) the place of beginning; thence
West along said North line 66 feet to the place of beginning. Except
that part of the Southwest Quarter of Section 9 described as follows:
Commencing at the Northwest corner of said Southwest Quarter; thence

referred to as line "B"; thence North 83 degrees 03 minutes East
395.95 feet; thence North 2 degrees 49 minutes 30 seconds East 905.75
feet to a line drawn South 81 degrees 53 minutes 38 seconds East from
the point of beginning; thence North 81 degrees 53 minutes 38 seconds
West 251.03 feet to the place of beginning, and also except that
part lying Westerly of the center line of Randall Road ALSO the
Westerly half of Randall Road lying Southerly of the North line of
the Northwest Quarter of said Section 9 and lying Northerly of line
"A"" and line "A"" extended Westerly; ALSO the Southerly Half of
Highland Avenue lying Northerly of the South line of said Section 9
and lying Easterly of line "B" and line""B" extended Southerly, in
the Township of Elgin, Kane County, Illinois.
indicated on the map of said territory, which is appended to and made a part
of this ordinance, is hereby annexed to the City of Elgin, Kane County,
Illinois.
Section 2. That the City Clerk is authorized and directed to file an
affidavit of service of notice of the proposed annexation made on fire pro-
tection and library districts serving the territory annexed. Said affidavit
of service shall be filed in the office of the recorder of deeds for Kane
County, Illinois.
Section 3. That the City Clerk is authorized and directed to give
notice by registered or certified mail of the annexation of the territory
herein described to the United States Post Office branch serving said area
and to the election authorities having jurisdiction in the territory; said
notice shall be given within thirty days. .

Section 4. That the City Clerk is authorized and directed to file a
certified copy of this ordinance together with an accurate map of the
annexed territory with the recorder of deeds of Kane County.
Section S. That this ordinance shall be in full force and effect after
its passage and approval in the manner provided by law.
