HomeMy WebLinkAboutS-741 VOLUME XXVIII December 12, 1963 485 Ordinance No. S-741 AN ORDINANCE ANNEXING CERTAIN TERRITORIES IN SECTION 15, TOWNSHIP 41 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, ELGIN TOWNSHIP, KANE COUNTY, ILLINOIS, TO THE CITY OF ELGIN, ILLINOIS. WHEREAS, Chapter 24, Section 7-1-13, Illinois Revised Statutes for 1963, provides that any unincorporated territory containing sixty (60) acres or less, which is wholly bounded by any municipality, may be annexed to such municipality by the passage of an ordinance to that effect, and WHEREAS, the territory and lands hereinafter described contain less than sixty (60) acres in area, are not within the corporate limits of any muni- cipality, and are wholly bounded by the existing corporate limits of the City of Elgin, and WHEREAS, in the considered opinion of the City Council it is to the best interest of the general public that such territory and lands be annexed to the City of Elgin, Illinois, and WHEREAS, the owner of the Easterly portion of such territories being annexed, is in the process of developing said property for use as a nursing home, and such property is presently zoned under the Zoning Ordi- nance of Kane County, Illinois, under a classification which permits such use, and WHEREAS, it is the opinion of the Council that said property should be annexed with a Special Use granted thereon to operate and maintain a nursing home, so as to conform with the existing zoning under the Kane County Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the territory and lands described as follow, to-wit: A part of Section 15, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the center of said Section 15; thence Northerly along the North and South center line of said Section 15, a distance of 930. 55 feet for the place of beginning; thence continuing Northerly along said North and South center line, a distance of 195. 05 feet to a point on the Southerly line of Highland Avenue extended Southeasterly; thence Northwesterly along said Southerly line extended Southeasterly and along the Southerly line of Highland Avenue, a distance of 1347. 44 feet to the 486 December 12, 1963 VOLUME XXVIII Westerly line of Burney's Subdivision, being a subdi- vision of part of said Section 15; thence Southerly along said Westerly line, a distance of 196. 35 feet to the Southwest corner of said Burney's Subdivision; thence Southeasterly along the Southerly line of said Burney's Subdivision, a distance of 776. 0 feet to the Southeast corner thereof; thence Southerly along the Easterly line of said Burney's Subdivision extended Southerly, a distance of 46, 15 feet; thence Southeasterly, a distance of 563. 1 feet to the place of beginning. Being situated in Kane County, Illinois. containing less than sixty (60) acres in area, not being within the corp- orate limits of any municipality, and being wholly bounded by the exist- ing corporate limits of the City of Elgin, Illinois, be and they are here- by annexed to and made a part of the City of Elgin. Section 2. That the above described territory and lands be and they are hereby included within the corporate boundaries of the City of Elgin. Section 3. That said territories be and they are hereby included in R-2 Single Family Resident District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois. ) Section 4. That a Special Use be, and the same hereby is, granted under the provisions of the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) on the following described territories, to-wit: That part of Section 15, Township 41 North, Range 8 East of the Third Principal Meridian described as follows: Commencing at the center of said Section 15; thence Northerly along the North and South center line of said Section 15, a distance of 930. 55 feet for the place of beginning; thence con- tinuing Northerly along said North and South center line, a distance of 195. 05 feet to a point on the Southerly line of Highland Avenue extended South- easterly; thence Northwesterly along said Southerly line extended Southeasterly and along the Southerly line of Highland Avenue, a distance of 571. 24 feet to the Easterly line of Burney's Subdivision; thence Southerly along the said Easterly line of Burney's Subdivision extended Southerly 247. 15 feet; thence Southeasterly, a distance of 563. 1 feet to the place of beginning. That a certified copy of this ordinance together with an accurate map of said annexed territory be filed with the Recorder of Deeds, of Kane County, Illinois. Section 6. That this ordinance shall be in full force and effect upon its passage as provided by law. It shall be published in pamphlet form by authority of the City Council. Clyde L. Spiegler, City Clerk 488 December 12, 1963 VOLUME XXVIIT_ • RESOLUT ON AUTHORIZING THE PAYMENT OF ATTORNEYS' FEES BE IT RESOLVED BY THE CITY COUNCIL OF ELGIN, ILLINO'S: That Attorneys' fees in the amount of Five Thousand ($5, 000. 00) Dollars be, and the same hereby are,approved for payment to Gordon D. Abbott for legal services pertaining to the issuance of One Million Three Hundred Thousand ($1, 300, 000. 00) Dollars Urban Rehabilitation Bonds and One Million Two Hundred Thousand ($1, 200, 000. 00) Municipal Building Bonds, and that the City Treasurer be, and he hereby is, authorized and directed to pay said fees out of the proceeds of said bond issues.
