AN ORDINANCE
AMENDING CHAPTER 2 . 31 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "NEIGHBORHOOD IMPROVEMENT GRANT PROGRAM"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS :
Section 1 . That Section 2 . 31 . 040 entitled "Administration" of
the Elgin Municipal Code, 1976, as amended, be and is hereby further
amended to read as follows :
2 . 31 . 040 ADMINISTRATION:
The administration of the provisions of this Chapter is
hereby assigned to the Director of Planning and
Neighborhood Services (Director) or the Director' s
designee . Applications for the Neighborhood Improvement
Grant Program shall be made to the Department of Planning
and Neighborhood Services which shall have the authority
and responsibility for carrying out the provisions of this
Chapter. The Director shall establish any reasonable rules
and procedures not otherwise established by this Chapter
that are deemed necessary for administration of the
Neighborhood Improvement Grant Program. Any such rules and
procedures shall be written and published in pamphlet
form.
Section 2 . That Section 2 . 31 . 050 entitled "Neighborhood
Improvement Grant Program" of the Elgin Municipal Code, 1976, as
amended, be and is hereby further amended to read as follows :
2 . 31 . 050 NEIGHBORHOOD IMPROVEMENT GRANT PROGRAM:
A. Eligible Activities : Each proposed activity or
project shall demonstrate the benefit it will be
conferring upon the neighborhood represented by the
neighborhood group or organization applying for the grant
and shall also take place within the boundaries of that
neighborhood. When applicable, the following conditions
shall also apply:
1 . Projects requiring physical improvements or
additions to the neighborhood shall be located on publicly
owned property.
2 . Projects or activities requiring services to be
rendered shall be provided to all members of the public
without charge .
3 All projects or activities shall be commenced
within one calendar year of a grant award. Projects or
activities shall be completed within a twenty-four (24)
month period after date of award. A twelve (12) month
extension may be requested after twenty (20) months from
date of award. All extensions will be subject to City
Council approval .
4 . Project or activity costs shall be not less
than one thousand dollars ($1, 000 . 00) nor more than
fifteen thousand dollars ($15, 000 . 00) .
B. Eligible Participants : Eligible participants
shall include any group or organization meeting each of
the following requirements :
1 . The group' s or organization' s representation is
confined to a specifically defined geographic area or
"neighborhood" within the City. Groups or organizations
with Citywide representation are ineligible .
2 . The group or organization must have established
bylaws providing for the democratic election of officers
and maintain minutes from each of its meetings .
3 . The group' s or organization' s meeting dates and
times must be publicized within the geographic area of the
City represented by the group or organization and the
meetings must be open to the public .
C. Grants : The selection of grant recipients and
the amount of each grant shall be determined by the City
Council . Grants will be awarded to eligible neighborhood
groups or organizations in amounts of not less than one
thousand dollars ($1, 000 . 00) nor more than fifteen
thousand dollars ($15, 000 . 00) for each grant recipient .
The number of grants awarded and the amount of each grant
may vary depending upon the amount of funds allocated for
the program, number of program applicants and the cost of
each proposed project or activity.
D. Matching Funds And Neighborhood Participation:
Matching funds for proposed projects or activities are
encouraged. Any such funds shall be deposited with the
City for disbursement at the completion of the project or
activity. A neighborhood group' s or organization' s
contributions for labor, materials and maintenance shall
be considered in the grant application.
E . Grant Application And Award: The Director shall
rk create a grant application consistent with this Chapter.
The Director shall receive and process all grant
applications for submission to the City Council and shall
annually establish a final date on which applicants may
submit applications for review. The Director shall also
annually establish the award date for grant applications
and an annual completion date for any awarded project or
activity.
F. Other Taxing Districts : Grants shall not be
awarded for projects that will be constructed on
properties owned by another taxing district, other than
the City, or for programs affiliated with other taxing
districts; unless said projects or programs have a
physical, tangible, and visible benefit to the
neighborhood in which they are located.
G. Grant Recipient Selection: The City Council
shall review and award each grant application on the basis
of a one hundred (100) point rating system, with one
hundred (100) points being the highest rating, using the
following criteria:
1 . Quality And Scope Of The Proposed Project Or
Activity: 0-10 points .
The maximum number of points will be awarded to
projects or activities demonstrating excellence in the
design, planning and execution of the proposed project or
activity.
2 . Level Of Neighborhood Participation And
Support : 0-20 points .
The maximum number of points will be awarded to
projects or activities that form partnerships with other
groups or organizations to complete joint projects or
activities .
3 . Necessity Of The Project Or Activity: 0-20
points .
The maximum number of points will be awarded to
projects or activities addressing highly recognized needs
within the neighborhood.
4 . Neighborhood Matching Contribution: 0-20
points .
The maximum number of points will be awarded to
projects or activities contributing fifty percent (50o)
or greater of the total cost of the project in labor,
materials or money.
5 . Integration With The City' s Master Plan: 0-10
points .
The maximum number of points will be awarded to
projects integrating with the City' s Master Plan.
6 . Maintenance Requirements : 0-15 points .
The maximum number of points will be awarded to
projects or activities requiring minimal maintenance .
7 . Tangibility and Permanence : 0-5 points .
The maximum number of points will be awarded to
projects or activities which are tangible, permanent, and
visible to the surrounding neighborhood.
Section 3 . That Section 2 . 31 . 060 entitled "Conditions" of the
Elgin Municipal Code, 1976, as amended, be and is hereby further
amended by adding Subsection F to read as follows :
F. Consecutive Grants : Only one grant shall be
awarded to any one individual group per program year.
Section 4 . That all ordinances or parts of ordinances in
conflict with the provisions of this ordinance be and are hereby
repealed.
Section S . That this ordinance shall be in full force and
effect ten days after its passage and publication in the manner
provided by law.

SUBJECT: Neighborhood Improvement Grant 2001 - Ordinance
Revision
PURPOSE
The purpose of this memorandum is to seek concurrence from the
Mayor and Members of the City Council regarding the revision of
Chapter 2 . 31 of the Elgin Municipal Code (Neighborhood Improvement
Grant Program) .
BACKGROUND
This memorandum seeks to address issues raised during the
implementation of the 2000 Neighborhood Improvement Grant Program.
Issues raised by the Council were: 1) funded projects being
constructed on property owned by other taxing districts, 2) bricks
and mortar projects to be encouraged, and 3) desire to see one
award per group per year.
The following are the Ordinance sections being recommended for
modification followed by a brief comment regarding the rationale:
2. 31 . 040 — Administration
Department assignee should be changed from Department of Code
Administration to Planning and Neighborhood Services to
reflect recent Departmental changes .
2. 31 . 050, A. 3. — Project Completion
Since the inception of the Neighborhood Improvement Grant
Program, there have always been projects not completed within
the requisite calendar year. Many factors, including the
seasonal nature of some of the projects, have contributed to
their non-timely completion. The City has always accommodated
projects requiring more time . Therefore, in order to align
the ordinance with present practice, said portion was modified
to require project/activity commencement within one year of
grant award and completed within thirty-six (36) months of
grant award.

2. 31 . 050, B. 4. — Geographic Area
The relevance of this section in the existing ordinance is
uncertain for purposes of the Neighborhood Improvement Grant
Program. Elgin presently has at least three geographical
areas that are represented by more than one neighborhood
group. The Northeast Neighborhood Association and Vecinos
Unidos have overlapping geographical areas . Additionally,
Southeast Elgin Neighbors and Neighbors of Southeast Elgin
have overlapping areas . It is proposed that this section of
the ordinance be deleted in that it may unnecessarily
eliminate participation in the program by legitimate and long-
standing Neighborhood groups .
2. 31 . 050, F. — Other Taxing Districts
This modification seeks to address the potential use of the
Neighborhood Improvement Grant Program by other taxing
districts . Several projects in the past have directly
impacted other taxing district property but have had little to
fair improvement in their respective neighborhoods . Examples
include, school marquis with nothing but the school' s name on
it and school playgrounds not open to the neighborhood. This
portion seeks to underscore improvements which benefit the
actual neighborhood, not solely the immediate taxing district
property.
2. 31 . 050, F. 7. — Grant Recipient Selection - Tangibility
and Permanence
This section was added to encourage brick and mortar projects .
In reviewing the original intention of the Neighborhood
Improvement Grant Program, bricks and mortar projects were
very important, but not exclusively what the Neighborhood
Improvement Program was intended for. Therefore, it is
believed a modest 0-5 points is sufficient to encourage, but
not require, brick and mortar projects . Please note the
points for the "Quality and Scope" criteria [2 . 31 . 050 (F) (7 ) ]
were adjusted downward by 5 points to accommodate this change.
2. 31 . 060, F. — Conditions - Consecutive Grants
This section intends to express the council' s suggestion that
only one grant be awarded to only one group per program year .

COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED
Several Neighborhood Association presidents and some of their
members were consulted as well as feedback received from various
2000 grantees . One neighborhood president expressed concerns over
the apparent lack of objectivity in the recommendation process .
Additionally, several grantees have solicited extensions for
project completions and have suggested they be granted more time in
the future (depending on the scope of their project/activity) .
Lastly, at least one person questioned monies being given to School
District U-46 when their tax monies already go to said body.

1 . Approve the changes as identified in said attachment.

It is recommended that the City Council proceed as identified in
alternative number one above .
