HomeMy WebLinkAboutG53-05 (2) Ordinance No. G53-05 AN ORDINANCE AMENDING CHAPTER 11.62 OF THE ELGIN MUNICIPAL CODE, 1976,AS AMENDED, ENTITLED "ADMINISTRATIVE ADJUDICATION" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 11.62 of the Elgin Municipal Code, 1976, as amended, entitled "Administrative Adjudication," be and is hereby amended by amending subparagraph B of Section 11.62.10, entitled "Schedule of Fines and Penalties," to read as follows: B. Notwithstanding the provisions of subsection A of this section,a violation of section 11.60.065 or 11.60.155 or 11.60.156 of this title,as amended,shall be an offense punishable by a fine in the amount of one hundred dollars ($100.00). Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3. TO: Mayor and Members of the City Council SAFE COMMUNITY FROM: Olufemi Folarin, City Manager Michael Falese, Fire Chief SUBJECT: Amendment of Chapter 11.60 of the Elgin Municipal Code, 1976, entitled Stopping, Standing and Parking and Amendment of Chapter 11.62 of the Elgin Municipal Code, 1976, entitled Administrative Adjudication PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information relating to the adoption of local ordinance changes regarding the required signage and pavement markings for private property fire lanes and increasing the fine amount for illegally parking in a fire lane. RECOMMENDATION It is recommended that the City Council approve the proposed ordinances amending the City's signage and pavement marking requirements for private property fire lanes and increase the fine for violating the fire lane ordinance. BACKGROUND The Elgin Police Department has requested the assistance of the Elgin Fire Department in making updates to the City's fire lane ordinance. The changes are an effort to make the requirements of the ordinance less difficult and costly to meet for property owners who would like the Police Department to be able to enforce the fire lanes on their private property. The recommended changes will reduce the amount of pavement painting required for areas applying for designation as a fire lane. This decrease in pavement markings should lower the cost of the initial application of the lane markings and decrease the cost of maintaining the lane markings on a yearly basis. The new requirements would also change the paint color used for pavement marking from yellow to red. The use of red paint to denote a fire lane is considered more intuitive and is utilized throughout states such as California and Texas. The change to red curb painting should make the areas designated as fire lanes more visible, especially during the winter months. The requirement to post signage every fifty feet (50') will also improve the visibility and public awareness of the fire lane designation. Amendment of Chapter 11.60 of the Elgin Municipal Code. May 6, 2005 Page 2 The increase in the fine for violating the fire lane parking restriction has been requested in large part to improve public compliance with the ordinance and improve the level of public safety by ensuring that fire lanes are kept unobstructed for use by emergency response personnel. These ordinance changes will provide for the public good and will offer an overall improvement in terms of life safety benefits to the community. That Chapter 11.60 of the Elgin Municipal Code, 1976, as amended, entitled "Stopping, Standing and Parking," be and is hereby amended by amending subparagraph A of Section 1.1.60.065, entitled, "Stopping,.Standing or Parking Prohibited on Private Property," to read as follows: By written agreement with the city pursuant to section 11-209 or 11-209.1 of the Illinois vehicle code, as amended, the following regulations are established for the private properties described below: A. Fire Lanes: Fire lanes are established on the private property described below subject to compliance with the regulations set forth in this section: 1. The property owner shall erect,install and maintain not less than two (2) appropriate signs designating the fire lane. Such signs shall be erected at each endpoint of the fire lane and,when applicable, such signs shall also be erected every fifty(50) feet within the fire lane. Each sign shall the words ":o " "be designed in the following manner_. a. The surface area of the sign shall measure eighteen(18)inches in height and twelve(12) inches in width; b. The words"NO PARKING"shall be printed with uppercase lettering measuring not less than two (2) inches in height and positioned within the upper six (6) inches of the sign. The word "NO"shall be printed with reflective white lettering on a reflective red background and the word"PARKING" shall be printed in reflective red lettering on a reflective white background; d. The words"FIRE LANE" shall be printed with black uppercase lettering measuring not less than two(2)inches in height and positioned within the middle six (6)inches of the sign on a reflective white background. e. The words"TOW AWAY ZONE" shall be printed with reflective red uppercase lettering measuring not less than two (2)inches in height and positioned within the bottom six (6)inches of the sign. 2. The property owner shall designate demarcate the fire lane withfight-yellew " "with red paint that has been approved by the fire marshal on the street curbing located within the fire lane. In those instances where fire lane curbing is present in the fire lane or where there is no street curbing on the portion of the street located within the fire lane, the fire lane curbing or the perimeter edge of the street surface located within the fire lane, as the case may be, shall be painted bright red with such paint being subject to the approval of the fire Marshal. The property owner shall maintain the painted areas demarcating the fire lane in a clear and legible condition. 3. Fire lanes shall have minimum width of twenty(20) feet. 4 3. The standing or parking of any vehicle in such a manner so as to block or obstruct any such designated fire lane shall be prohibited. 5 4. The city,pursuant to said written agreement, is authorized and empowered to cause vehicles violating the prohibitions of said written agreement to be ticketed, removed,towed and stored pending payment by the vehicle's registered owner for the costs of removing,towing and storing such vehicle. 6 5. Designated fire lanes: a. Plymouth Lane within the Tyler Towers Condominium Complex; b. The campus of Elgin Community College; c. Within the Poplar Creek subdivision on Spruce Lane, Spruce Court, Hemlock Lane, Hemlock Court,Apple Lane,Peach Tree Lane,Peach Tree Court; d. Within the Huntington Park subdivision on the east side of Spruce Lane, the south side of Rosemont Lane, and the west side of Apple Lane from Peach Tree Lane to Spruce Lane; e. The grounds of St. Joseph Hospital; f. Within the Tyler Creek Plaza Shopping Center parking lot located at the northeast corner of Big Timber and McLean Boulevard; g. Upon property owned by the Elgin housing authority; h. The grounds of Sherman Hospital; i. Garden Quarter Complex; j. Sandy Creek Condominium Complex; 2 k. Waverly Commons Condominium Complex; I.
