HomeMy WebLinkAboutG40-25 Ordinance No. G40-25 AN ORDINANCE AMENDING CHAPTER 3.12 OF THE ELGIN MUNICIPAL CODE ENTITLED "HUMAN RELATIONS COMMISSION" WHEREAS, members of the community, in cooperation with the Human Relations Commission, have volunteered their time to assist the City of Elgin in the planning and organization of an annual event celebrating the life of Dr. Martin Luther King, Jr., as well as the conducting of a food donation program and a scholarship program (the "MLK Programs"); and WHEREAS, the City Council has determined that it would be necessary and desirable to create a subcommittee of Human Relations Commission to facilitate the continued planning and organization of the MLK Programs; and WHEREAS, the City of Elgin is a home rule unit pursuant to Article VII, Section 6 of the Illinois Constitution, and as a home rule unit may exercise any power perform any function pertaining to its government affairs. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 3.12 of the Elgin Municipal Code as amended, entitled "Human Relations Commission" be and is hereby amended by adding a new Section 3.12.070, entitled "Martin Luther King Subcommittee,"to read as follows: "3.12.070: MARTIN LUTHER KING SUBCOMMITTEE: A. Subcommittee Created. There is created the Martin Luther King subcommittee of the human relations commission. The Martin Luther King subcommittee shall be responsible for the planning and organization of an annual event celebrating the life of Dr. Martin Luther King, Jr., a food donation program, a scholarship program, and such other responsibilities as may be assigned by the city council. B. Composition. The Martin Luther King subcommittee shall be composed of seven (7) members. Members of the subcommittee shall be appointed by the city council. C. Terms. The terms of the members of the Martin Luther King subcommittee shall be for three (3) years; however, of the members first appointed, three (3) members shall be appointed for a term of three (3) years, three (3) members shall be appointed for a term of two (2) years, and one member shall be appointed to a term of one year. Terms of members shall expire on May 1 in the anniversary year of the appointment of the member. 1 D. Officers. Officers of the Martin Luther King subcommittee shall consist of three chairpersons elected by members of the subcommittee. One chairperson shall be responsible for overseeing the planning and organization of the annual celebration event; one chairperson shall be responsible for overseeing the planning and organization of the food donation program; and one chairperson shall be responsible for the overseeing the planning and organization of the scholarship program. In addition, one of the three chairpersons shall be elected by the members of the subcommittee to preside over meetings of the subcommittee. In the absence of such chairperson, one of the other chairpersons shall preside over the meeting and perform the duties of chairperson. E. Meetings. The Martin Luther King subcommittee shall meet at regularly scheduled meetings and upon the call of one of the chairpersons. All meetings shall be subject to the provisions of the Illinois Open Meetings Act (5 ILCS 120/1 et seq.). No business shall be conducted by the Martin Luther King subcommittee without the presence of a quorum consisting of more than one- half(1/2)of the subcommittee members then holding office. F. Operations. The Martin Luther King subcommittee shall provide the chairperson of the human relations commission with a copy of the agenda for any meeting of the subcommittee at such time as the agenda provided to members of the subcommittee. In addition, the subcommittee shall provide the chairperson of the human relations commission with a copy of the minutes from any meeting of the subcommittee. All actions of the Martin Luther King subcommittee shall be made by majority vote of the members of the subcommittee at any meeting where a quorum is present. If any approved action of the subcommittee requires the expenditure of funds, such action shall be presented as a recommendation to the human relations commission for the commission's consideration and action at a duly-noticed meeting of the commission. Following the annual celebration event, the city shall provide the Martin Luther King subcommittee and the human relations commission with a statement of revenues and expenses with respect to the activities of the Martin Luther King subcommittee for the prior year. Such statement shall be provided by April 1 of the calendar year or as soon thereafter as such information is available." Section 2. In making the initial appointments to the Martin Luther King subcommittee, priority will be given to those persons seeking an appointment to the subcommittee that have previously participated in the planning or organization of the MLK Programs. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. 2 Section 4.
