AN ORDINANCE
AMENDING ELGIN MUNICIPAL CODE SECTION 11.18.020 ENTITLED "PENALTY FOR
VIOLATION", RELATING TO THE PENALTY FOR PERSONS CONVICTED OF DRIVING
UNDER THE INFLUENCE
WHEREAS, the City of Elgin is a home rule unit, and as a home rule unit may exercise
any power and perform any function pertaining to its government and affairs; and
WHEREAS, the City Council of the City of Elgin has previously adopted Chapter 11.18
of the Elgin Municipal Code which provides for local ordinance regulations adopting Sections I I-
500 through 11-507 of the Illinois Vehicle Code (625 ILCS 5/11-500-5/11-507), as amended,
which include driving while under the influence of alcohol, other drug or drugs, intoxicating
compound or compounds or any combination thereof, and
WHEREAS, the City Council has determined that it is appropriate to amend the penalty
provisions for any person convicted of driving while under the influence; and
WHEREAS, the penalty provisions for local ordinance regulations prohibiting driving
under the influence pertain to the government and affairs of the City of Elgin.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Section 11.18.020 of the Elgin Municipal Code, entitled "Penalty for
Violation" be and is hereby further amended by amending Subparagraph A thereof to read as
follows:
"A. Any person convicted of driving while under the influence of alcohol, other drug
or drugs, intoxicating compound or compounds, or a combination thereof shall be
guilty of a Class A misdemeanor and shall be punished by a fine of not more than
two thousand five hundred dollars($2,500.00)and shall be subject to a sentence of
imprisonment of less than one (1)year. Such fine and/or imprisonment shall be in
addition to any sentencing alternatives elected by the court."
Section 2. That all ordinances or parts of ordinance in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 3. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
