AN ORDINANCE
AMENDING SECTION 5.06.020 OF THE ELGIN MUNICIPAL CODE ENTITLED
"CHANGE ORDERS"
WHEREAS, Section 5.06.020 of the Elgin Municipal Code relates to certain procedures
regarding change orders to City contracts and specifies compliance with the requirements of 720
ILCS 5/33E-9, as amended; and
WHEREAS, 720 ILCS 5/33E-9 has recently been amended; and
WHEREAS,the city council has determined it is necessary and desirable to amend Section
5.060.020 to conform to the recently amended state statute; and
WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs;
WHEREAS, ordinance provisions relating to city procurements and change orders to city
contracts pertain to the government and affairs of the City.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 5.06.020 of the Elgin Municipal Code entitled "Change Orders"
be and is hereby further amended to read as follows:
"All change orders to city contracts shall be in writing and except as provided herein shall
be submitted to the city council for authorization.Change orders or a series of change orders which
authorize or necessitate an increase or decrease in either the cost of a contract by a total of twenty-
five thousand dollars ($25,000.00) or more or the time of completion by a total of one-hundred
eighty (180) days or more shall comply with the requirements of section 33E-9 of the Criminal
Code of 2012 (720 ILCS 5/33E-9), as amended. The city manager shall have the authority to
authorize change orders in an amount not exceeding twenty-five thousand dollars($25,000.00)per
change order or increasing or decreasing the time of completion by a total of not exceeding one-
hundred eighty (180) days; provided, however, change orders approved by the city manager for a
contract shall not exceed ten(10)percent of the original contract amount.A change order shall not
be artificially or arbitrarily divided so as to be limited to an amount which may be authorized by
the city manager. All change orders which have not been approved by the city council shall be
reported in writing monthly to the city council."
Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this
ordinance be and are hereby repealed to the extent of any such conflict.
Section 3. This ordinance shall be in full force and effect upon its passage and publication
in the manner provided by law.
