HomeMy WebLinkAboutG25-16 (2) Ordinance No.G25-16 AN ORDINANCE AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE, 1976, AS AMENDED, TO AMEND THE CLASS N LICENSE REGULATIONS AND TO PROVIDE FOR CERTAIN EDITORIAL REVISIONS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 6.06.040 of the Elgin Municipal Code, 1976, as amended, entitled "License Classes;Fees:"be and is hereby further amended by amending subparagraph Q,subsection 1 thereof relating to the Class N license to read as follows: "1. Class N: For the retail sale of alcoholic liquor at the riverboat gaming pavilion on the premises commonly known as 250 South Grove Avenue, Elgin, Illinois, in the following areas: a. First floor;designated restaurant area in conjunction with the service of meals for consumption on the premises. b. First floor;designated food court,snack bar and all seating areas for consumption on the premises. c. First floor; designated tavern area for consumption on the premises. d. First floor; designated deli area for consumption on the premises and for the sale of craft beer in containers of not less than a six-pack and bottles of wine in the original package for consumption off premises. e. Second floor; designated banquet facility for consumption on the premises. The term"premises" shall include any adjoining interior areas utilized in conjunction with the first floor designated food court, snack bar and seating areas. The term "premises" shall also include any adjoining exterior terrace areas utilized in conjunction with the designated area. The first floor designated tavern area shall be subject to the restrictions for a class A license as set forth under subsection 6.06.140N of this chapter,as amended,relating to the admission of persons who have not attained the age of twenty one(21)years. f. For the retail sale of alcoholic liquor at the city owned Festival Park premises commonly known as 132 South Grove Avenue, Elgin, Illinois, in conjunction with special events approved by the city. g. The license fee per year is eight hundred eighty dollars ($880.00)." Section 2. That Section 6.06.040 of the Elgin Municipal Code, 1976, as amended, entitled "License Classes;Fees"be and is hereby further amended by amending subparagraph S,subsection 1 thereof by deleting from the listing of license classifications therein the reference to the Class E-4 license. Section 3. That Section 6.06.042 of the Elgin Municipal Code, 1976, as amended, entitled "Limited Special Promotion Sales"be and is hereby further amended by deleting from the listing of license classifications in the initial paragraph thereof the reference to the Class E-4 license. Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed to the extent of any such conflict. Section 5. Cogley, Corporation Counsel Subject: Consideration of Request by Licensee Elgin Riverboat Resort,d/b/a Grand Victoria Casino at 250 S.Grove Avenue for a Proposed Change to the Class N Liquor License Regulations PURPOSE The purpose of this memorandum is to provide information regarding the request by licensee Elgin Riverboat Resort,d/b/a Grand Victoria Casino at 250 S.Grove Avenue to change the current Class N liquor license regulations to also allow the sale of single bottled craft beer, single bottled wine and gift baskets with bottled beer and wine for consumption off premises. RECOMMENDATION Approval of the proposed amendment to the Class N liquor license regulations to allow for off premise sales of single bottled craft beer,single bottled wine and gift baskets with bottled beer and wine enclosed. BACKGROUND Elgin Riverboat Resort,d/b/a Grand Victoria Casino at 250 S.Grove Avenue holds a Class N and N- 1 liquor licenses. The current regulations for the Class N and N-1 liquor licenses are attached. The regulations generally allow for the sale of alcohol for consumption on the premises. Attached is a letter from the Director of Food and Beverage for the Grand Victoria Casino requesting an amendment to the liquor license regulations for the Grand Victoria Casino. The request is to allow the sale of single bottled craft beer,single bottled wine and gift baskets with bottled beer and wine enclosed for consumption off the premises. The proposal is to sell these items from the Crave Deli on the first floor of the premises. This item is being placed on the liquor commission agenda of May 4, 2016 for discussion. Grand Victoria's intent is as follows; The sale of single bottled craft beer, single bottled wine, and gift baskets with bottled beer and wine enclosed. The sale of said items to be offered during the current hours of alcoholic sales. It is our belief the sale of individual beer/wine privileges would allow Grand Victoria to recoup revenue loss on individual sales as a result of the recently established City of Elgin Liquor Tax that was imposed by law. The term "premises" shall include the adjoining exterior terrace areas used in conjunction with the designated area. Said designated lounge area shall be subject to the restrictions for a class A license as set forth under subsection6.06.140N of this chapter, as amended, relating to the admission of persons who have not attained the age of twenty one (21) years. The license fee per year is six hundred sixty dollars ($660.00).
