HomeMy WebLinkAboutG23-23 Ordinance No. G23-23 AN ORDINANCE AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE ENTITLED "ALCOHOLIC LIQUOR DEALERS" TO ADD A LICENSE CLASSIFICATION FOR BREW PUBS WHEREAS, the City Council of the City of Elgin has determined that is necessary and desirable to amend Chapter 6.06 of the Elgin Municipal Code to provide for an additional license classification for brew pubs; and WHEREAS, the City of Elgin is an Illinois municipal corporation and a home rule unit pursuant to the Constitution of the laws of the State of Illinois; and WHEREAS,a home rule unit may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, the regulation of the sale of alcoholic liquors is a matter pertaining to the government affairs of the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 6.06.040 of the Elgin Municipal Code entitled "License Classes; Fees" be and is hereby further amended by adding new subparagraph V thereto to read as follows: "V. Class T: For Brew Pubs which authorizes the manufacture and storage of beer on the licensed premises, the sale of alcoholic liquor for consumption on the premises and the sale of beer brewed or manufactured on the licensed premises in its original package not for consumption on the licensed premises. A brew pub may, but is not required, to offer food service. The licensee shall maintain in good standing a State of Illinois brew pub license as required and authorized under the Illinois Liquor Control Act(235 ILCS 511, et seq., as amended). The number of gallons of beer sold by a brew club each year for off premise consumption shall not exceed the number of gallons authorized for sale each year by approved brew pub in the Illinois Liquor Control Act(235 ILCS 5/1, et seq., as amended). The annual license fee shall be in the amount as provided in the most recently enacted ordinance establishing fees for various city services,permits, licenses, use of facilities and other matters." Section 2. That Section 6.06.040 entitled "License Classes; Fees" be and is hereby further amended by relettering the remaining subparagraphs therein accordingly. Section 3. That Section 6.06.050 of the Elgin Municipal Code entitled "Licenses; Number to be Issued"be and is hereby further amended by adding to the existing listing of licenses therein the following additional subparagraph thereto: "The number of Class T licenses shall not exceed zero (0) in number." Section 4. That Section 6.06.115 of the Elgin Municipal Code entitled "Bassett Training Requirements" be and is hereby amended by adding to the listing of licenses in subparagraph A thereof the additional license of Class T. Section 5. That Section 6.06.117 of the Elgin Municipal Code entitled"Service Hours" be and is hereby amended by adding to the listing of license classes in subparagraph A thereof the additional license classification of Class T. Section 6. That Ordinance No. G69-22, adopted by the City Council of the City of Elgin on December 21, 2022, establishing fees for various City services, permits, licenses, use of facilities and other matters, be and is hereby further amended by adding the following additional fee to the alcoholic liquor dealer fees in Exhibit 1 thereto: "Class T. The annual license fee for a Class T liquor license is $1,000." Section 7. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed to the extent of any such conflict. Section 8. That this ordinance shall be in full force and effect upon its passage and publication in the manner provided by law. avid J.
