HomeMy WebLinkAboutG-1556 (2) Ordinance No. G-1556 AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS, ENTITLED "THE ELGIN ZONING ORDINANCE". WHEREAS, a public hearing has been duly held pursuant to the Statutes of the State of Illinois , and the provisions of the Elgin Zoning Ordinance, and WHEREAS, the Elgin Zoning Board of Appeals has trans- mitted its recommendations to the City Council, all of which have been duly considered, and WHEREAS, the City Council has determined that certain restrictions hereinafter set out are necessary for the health, welfare , and safety of the surrounding area . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1, That Sub-Section B of Section 21-106 of Chapter 21 of the City Code of Elgin, Illinois , as amended be, and the same hereby is , amended by adding thereto, the following paragraphs : That the boundaries hereinbefore described and laid out in the "Zoning District Map", as amended, be, and they hereby are , altered by excluding from R-2, Single Residence District, and including in B-1, Community Business District, the following described premises , to-wits Lot 2 and the Easterly half of the vacated alley lying Westerly of and adjoining said Lot 2 , all in Block VIII of Columbia Park Addition to Elgin, in the City of Elgin, Kane County, Illinois . (Located at 374 N, McLean Blvd , ) That this variation is granted for the sole and sin- gular purpose and use as a real estate and insurance office. That the size and location of the sign to be used on the premises shall be determined by the City Inspection Department as appropriate for the location, and said sign shall not be of the neon or flashing type or such as to disturb the adjacent area . That no vehicles of any type shall be parked between the street and the front line of the building situated on the premises , and in the event the City of Elgin should pass an amendment to the zoning ordinance setting up a special category of zoning for offices of the above mentioned type, the above described property shall revert automatically in zoning to the All new classification without further public hearing or action by the owners or City Council. That the owners of the property shall submit for approval a restrictive covenant to the Corporation Counsel, and record said restrictive covenant within thirty (30) days from the passage of this ordinance. In the event said restrictive covenant is not approved and recorded as above provided, the property shall auto- matically revert to the prior zoning of R-2 without further action of the City Council. Section 2 . That subject to the above restrictions, all ordinances or parts thereof in conflict herewith be, and the same hereby are, repealed and of no further force and effect. Section 3. That subject to the restrictions above listed , this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. JOHNSTON, his wife, of the City of Elgin, Kane County, State of Illinois, hereinafter referrred to as "Owners"= W I T N E SSETH: That the Owners for and in consideration of the City Council of the City of Elgin rezoning the following described real estate from R-2 to B-1 zoning classification, do hereby affirm that they are the owners of record and sole parties in interest of the following described real estate: Lot 2 in the Easterly half of the vacated alley lying Westerly of and adjoining said Lot 2, all in Block VIII of Columbia Park Addition to Elgin, in the City of Elgin, Kane County, Illinois (commonly,,:.known as 374 N. McLean Blvd. , Elgin, Illinois) . And do hereby make the following declarations as to limitations, restrictions and uses to which said real property may be put, hereby specifying that such declarations shall con- stitute covenants to run with the land, as provided by law, and shall be binding on all heirs, executors, administrators and assigns- of the Owners: 1. The sole use of the above-described property will be professional offices, for use in the real estate and insurance business. 2.
