AN ORDINANCE
AMENDING CHAPTER 6.06 OF THE ELGIN MUNICIPAL CODE ENTITLED
"ALCOHOLIC LIQUOR DEALERS"TO CREATE A NEW CLASS V LICENSE FOR
INDOOR SPORTS CLUBS AND FACILITIES
WHEREAS,the City of Elgin is a home rule unit and as a home rule unit may exercise any
power and perform any function pertaining to its government and affairs; and
WHEREAS, the regulation of alcoholic liquor dealers pertains to the government and
affairs of the city; and
WHEREAS, the city council of the City of Elgin has determined that it is appropriate to
create a new class of liquor license for indoor sports clubs and facilities.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 6.06.040 of the Elgin Municipal Code "License classes; fees"
be and is hereby further amended by adding a new subparagraph V thereto, and by re-lettering the
existing subparagraphs V through X accordingly, with such new subparagraph V to read as
follows:
"V. Class V: For the retail sale of beer and wine only by indoor sports clubs and
facilities for consumption on the premises, subject to the following restrictions and
conditions:
1. A sports club or facility qualifying for this license shall be kept,used
and maintained, advertised, and held out to the public as a full-time
sports facility regularly providing or hosting practices, training,
games, events, and/or tournaments in one or more sports.
2. The sale of alcoholic liquor shall only be in connection with the
operation of an eating place on the premises, which eating place
shall be an established accessory use on the premises. The
consumption of alcoholic beverages shall be limited to a designated
seating area associated with the eating place on the premises. There
shall be no consumption of alcoholic beverages in the athletic areas
where the practice, game,or other event takes place.
3. The licensee must verify that every patron possessing or consuming
alcoholic liquor is at least twenty-one (21) years of age. The
licensee shall utilize colored wristbands to readily identify those
patrons that have been verified as being at least twenty-one (21)
years of age.
4. If not sold in the original can, bottle, or other retail container, the
containers in which alcoholic beverages are served must be of a
different color, size, and design than those in which non-alcoholic
beverages are served.
5. The licensee shall not serve or deliver more than two (2) alcoholic
beverage to a customer at a time, and no person shall have in his/her
possession at any given time more than two (2) alcoholic beverage.
6. There shall be no service of alcoholic beverages unless the sports
facility is open and operating for the purpose of providing or hosting
previously scheduled practices, training, games, events, and/or
tournaments at the facility.
7. A licensee holding a Class V license may sell or permit to be sold
alcoholic liquor on Monday through Sunday from 12:00 noon until
11:00 p.m. that same day.
8. There shall be no exterior signage on the premises indicating or
advertising the sale of alcoholic liquor.
9. The licensee fee per year is in the amount as provided in the most recently
enacted ordinance establishing fees for various city services, permits,
licenses, use of facilities and other matters."
Section 2. That Section 6.06.050 of the Elgin Municipal entitled"Licenses; number to
be issued" be and is hereby further amended by adding a new subparagraph AA thereto, and by
re-lettering the existing subparagraphs AA through CC accordingly, with such new subparagraph
AA to read as follows:
"AA. The number of Class V licenses shall not exceed one (1) in number."
Section 3. That Section 6.06.115 of the Elgin Municipal Code entitled "Bassett
training requirements" be and is hereby further amended by amending the listing of license
classifications in subparagraph A thereof by adding a reference to the Class V license.
Section 4. That the most recently enacted ordinance establishing fees for various city
services, permits, licenses, use of facilities and other matters be amended to provide license fee
per year of a Class V liquor license is Three Hundred Thirty Dollars ($330.00).
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.

Section 6. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
