G69-22 ESTABLISHING FEES FOR VARIOUS CITY SERVICES, PERMITS, LICENSES, USE OF FACILITIES AND OTHER MATTERS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Ordinance No. G69-22, adopted by the City Council of the City of Elgin on December 21, 2022, establishing fees for various City services, permits, licenses, use of facilities and other matters, be and is hereby amended by adding the following additional fees to Exhibit 1 thereto: 1. CEMETERY • Reassignment of Burial Space fee ('EMC 2.24.210C) Receiving, filing and recording assignment of quitclaim $25.00 For each duplicate deed issued $10.00. 2. FIRE DEPARTMENT • Sprinkler Alarm Board Service fee (EMC 2.40.220) Initial hookup charge per alarm $120.00 Annual service charge per alarm $35.00 The above charges shall not apply to charitable or governmental institutions. • Mitigation Rates for Certain Emergency Services (EMC 2.40.225) A. Motor Vehicle Incidents: Level 1 $435.00 Level 2 $495.00 Level 3 $605.00 Level 4 $1,800.00 Level 5 $2,200.00 Level 6 — Itemized response (billed to residents and nonresidents as appropriate). In the case of an unusual incident, the fire department of the city may bill each incident as an independent incident with actual costs and/or customary mitigation rates using itemized rates deemed usual, customary and reasonable (UCR). Such incidents will be billed using itemized amounts for apparatus and personnel, plus products and equipment used. B. HAZMAT: Level 1 —Basic response $700.00 Level 2 —Intermediate response $2,500.00 Level 3 —Advanced response $5,900.00 C. Pipeline Incidents/Power Line Incidents: (Includes, but not limited to: gas, sewer, septic to sewer, and water pipelines.) Level 1 —Basic response $400.00 Level 2 —Intermediate response $1,000.00. Level 3 —Advanced response-Itemized claim charges. Includes provision of levels 1 and 2 services as well as supervision and or assisting of intermediate to major pipeline damage, setup and removal of decon center, detection, recovery and identification of material, disposal and environmental cleanup. D. Fire Investigation: Fire investigation team - $275.00 per hour E. Fires: Assignment- $400.00 per hour, per engine/$500.00 per hour per truck. F. Water Incidents: (Billed to nonresidents only) Level 1 —Basic response - $400.00 plus $50.00 per hour, per rescue person Level 2 —Intermediate response - $800.00 plus $50.00 per hour, per rescue person Level 3 —Advanced response - $2,000.00 plus $50.00 per hour, per rescue person and $100.00 per hour per HAZMAT team member. Level 4—Itemized response. In the case of an unusual incident,the fire department of the city may bill each incident as an independent incident with actual costs and/or customary mitigation rates using itemized rates deemed usual, customary and reasonable (UCR). Such incidents will be billed using itemized amounts for each trained rescue person plus rescue products and equipment used. G. Special Rescue: Itemized response—minimum of$400.00 per hour, per emergency response, plus $50.00 per hour, per rescue person. H. Chief Response: Itemized response - $250.00 per hour. • Fees for Service: (EMC 2.40.260). Fees for ambulance services and prehospital care provided by the fire department. Basic life support emergency (BLS) $1,850.00 Advanced life support emergency (ALS 1) $1,850.00 Advanced life support emergency (ALS 2) $1,850.00 Mileage (as measured from the location of $15.00 per mile or portion ambulance call to the hospital) thereof 3. POLICE DEPARTMENT • Fingerprinting Service fee (EMC 2.52.190) $10.00 2 4. PUBLIC RECORDS FEES • Public Records Fees (EMC 4.32.010). There is established the following schedule of fees for copies of public records: A. Category L Records capable of reproduction by photocopy: 1. One (1) to fifty (50) pages: No charge. 2. Fifty-one (5 1) or more pages: Fifteen cents ($0.15) per page. B. Category H. Records with an appropriate waiver request as defined by section 6 of the Freedom of Information Act (5 ILCS 140/6), as amended: 1. One (1) to one hundred (100) pages: No charge. 2. One hundred one (101) or more pages: Ten cents ($0.10) per page. C. Category III. Records provided in color: 1. One (1) to five (5) pages: No charge. 2. Six (6) or more pages: Fifty cents ($0.50) per page. D. Category IV. Records provided in a size other than letter or legal: The actual cost of reproducing the records, not including the costs of any search for and review of the records or other personnel costs associated with reproducing the records. E. Category V. Traffic accident reports: 1. Standard traffic accident reports: Five dollars ($5.00) per copy. 2. Traffic accident reports investigated by an accident reconstruction officer or accident reconstruction team: Twenty dollars ($20.00) per copy. F. Category VI. Records provided on any medium other than paper or by e-mail: 1. The cost of purchasing the applicable recording medium, whether disk, diskette, tape, or other medium. 6. PROPERTY VACATION FEES • Property Vacation fees (EMC Chapter 4.36) 3 $670.00 for vacating any property owned by the City. Such vacation fee shall be an addition to any charge or price that may be established by the City Council for the value of the property vacated. 7. ALCOHOLIC LIQUOR DEALERS FEES • Liquor License fees (EMC 6.06.040) A. Class A and A-1. The annual license fee for Class A liquor license is $1,540.00. The annual license fee for Class A-I liquor license is $2,200. B. Class AA. The annual license fee for a Class AA liquor license is $1,540.00. C. Class B. The annual license fee for a Class B liquor license is $880.00. D. Classes B-1, B-2, B-4 and B-5. The annual license fee for a Class B-I liquor license is $660.00. The annual license fee for a Class B-2 liquor license is $770.00. The annual license fee for a Class B-4 liquor license is $660.00. The annual license fee for a Class B-5 liquor license is $770.00. E. Classes C and C-1. The annual license fee for a Class C liquor license or C-I liquor license is $396.00. F. Classes D and D-1. The annual license fee for a Class D liquor license is $792.00. The annual license fee for a Class D-I liquor license is $110.00. G. Class E. The annual license fee for a Class E liquor license is $792.00. H. Classes E-1, E-2 and E-3. The annual license fee for a Class E-1 liquor license is $572.00. The annual license fee for a Class E-2 liquor license or E-3 liquor license is $660.00. I. Classes F, F-I and F-2. The annual license fee for a Class F liquor license is $374.00. The annual license fee for a Class F-I liquor license or F-2 liquor license is $550.00. J. Class G. The annual license fee for a Class G license for operation by the city is no fee. The annual license fee for a Class G license for operation by an independent contractor is $440.00. K. Class H. The annual license fee for a Class H liquor license is $11.00. L. Class 1. The annual license fee for a Class I liquor license is $11.00. M. Class J. The annual license fee for a Class J liquor license is $374.00. 4 N. Class K. There shall be no annual fee for a Class K liquor license when the city is the licensee. When the licensee is an independent contractor, the annual license fee for a Class K liquor license is $44.00. O. Class K-1. The Class K-1 liquor license fee per special event is $44.00, however, there shall be no Class K-1 liquor license fee for any special event on the premises of the Elgin Art Showcase. P. Class M. The annual license fee for a Class M liquor license is $2,200.00. Q. Classes N and N-1. The annual license fee for a Class N liquor license is $880.00. The annual license fee for a Class N-1 liquor license is $660.00. R. Class O. The annual license fee for a Class O liquor license is $1,000.00. S. Classes P and P-1. The annual license fee for a Class P liquor license is $500.00. The annual license fee for a Class P-1 liquor license is $1,000.00. T. Classes R and R-1. The annual license fee for a Class R or R-1 liquor license is $3,080.00. U. Class S. The annual license fee for a Class S liquor license is $396.00. V. Class W. The annual license fee for a Class W liquor license is $110.00. W. Class Y. The annual license fee for a Class Y liquor license is $100.00. X. Class Z. The annual license fee for a Class Z liquor license is $660.00. • Corkage License (EMC 6.06.045) The annual license fee for a corkage license is $250.00. • Exterior Sales Permit fee (EMC 6.06.055) The annual fee for an exterior sales permit is$500.00,provided no fee shall be required for permits issued for exterior sales areas which are engaged in the regular service of food with alcoholic liquor and which have a total seating capacity of not more than twenty (20) or for sales in conjunction with a valid Class I license. • Off-site Special Event Permit fee (EMC 6.06.059) The fee for a special event permit is $25.00. • Downtown Farmers' Market Event Permit fee (EMC 6.06.059.2) The annual fee for a downtown farmer's market event permit is $25.00. • Liquor License Application; Filing; Processing fee (EMC 6.06.060) Liquor license application fee is $300.00. 5 Prior to the issuance of a new Class B liquor license,the applicant shall deposit the sum of$10,000 with the city clerk to be placed in the general fund of the city. Prior to the issuance of a new Class B-1, B-2, B-4 or B-5 license, the applicant shall deposit the sum of$5,000 with the city clerk to be placed in the general fund of the city. • Liquor License; Change in Personnel (EMC 6.06.100) Change in personnel fee is $150.00. 6.06.1 OOC.When a license has been issued to a corporation and a change takes place in the officers, directors, managers or shareholders of more than five (5) percent of the stock, which change results in the holding of office or shares by one who is not eligible for a license, said license shall terminate. Any transfer of fifty(50)percent or more of the partnership interest,membership interest in a limited liability company,or of the shares of a Class B licensee's corporate stock shall require a payment of ten thousand dollars($10,000.00) by the stock transferee to the city clerk to be placed in the general fund of the city.Any transfer of fifty(50)percent or more of the partnership interest, membership interest in a limited liability company, or of the shares of a Class B-1 or B-2 licensee's corporate stock shall require payment of five thousand dollars ($5,000.00) by the stock transferee to the city clerk to be placed in the general fund of the city. • Liquor License Expanded Hour Application fee (EMC 6.06.140B) Application fee for expanded hour sales is $25.00. 8. VIDEO GAMING • License fee for distributors of video gaming terminals (EMC 6.08.030) The annual license fee for every distributor that is licensed to distribute, sell, lease out, establish or supply any video gaming terminal in the City is $1,500.00. • License fee for establishments with video gaming terminals (EMC 6.08.040) The annual license fee for establishments with video gaming terminals is $25.00. • License fee for video gaming distributor applications (EMC 6.08.050) Application fee for video gaming distributors license shall be $200.00 for an initial application. 9. AMUSEMENTS • License applications; Fees (EMC 6.09.030) A. Menageries: $15.00 per day B. Exhibitions of inanimate objects: $5.00 per day C. Other amusements: $5.00 per day or$20.00 per week • Billiard halls and bowling alleys (EMC 6.09.140) 6 The annual license fee for billiard halls or bowling alleys is $20.00 for each alley or table maintained or operated. • Automatic amusement devices (EMC 6.09.155) The annual license fee for automatic amusement devices is $40.00 for each automatic amusement device kept or installed on a premises. • Admission surcharge (EMC 6.09.160A) There is levied and imposed upon every person who pays an admission charge to any event at Hemmens Auditorium a surcharge of$0.25 per admission. 10. AUCTIONEERS • Auctioneer license fee (EMC 6.12.090) The annual license fee for an auctioneer license is $100.00 11. DAY AND TEMPORARY LABOR AGENCIES • Application fee (EMC 6.18.040) The application fee for a day and temporary labor agency license is $50.00. 12. TRANSIENT MERCHANTS AND ITINERANT VENDORS • License; Application; Duration(EMC 6.30.030) The fee for a license application for a transient merchant or itinerant vendor license is $100.00. 13. MASSAGE ESTABLISHMENTS AND MASSAGE SERVICE • Filing of application and fee provision (EMC 6.31.030) The application fee for a permit to maintain and operate or conduct a massage establishment is $75.00. • Masseur or masseuse permit (EMC 6.31.070) The application fee for a masseur or masseuse permit is $25.00 for original application and $10.00 for renewal application. 14. CERTIFIED MASSAGE THERAPISTS IN RESIDENTIAL DISTRICTS • Application and fee provision (EMC 6.32.030) The fee for an application for a permit for a residential therapeutic massage establishment is $75.00. • Certified massage therapist permit fee (EMC 6.32.070) The application fee for a certified massage therapist permit is $25.00 for an original application and $10.00 for a renewal application. 7 15. MINIATURE GOLF COURSES • License; Fee (EMC 6.33.020) The annual fee for a miniature golf course license is $50.00. 16. OUTDOOR ADVERTISING • Outdoor advertiser license fee (EMC 6.39.040) The annual license fee for an outside advertiser is $50.00. 18. PAWNBROKERS • Pawnbroker fees (EMC 6.42.050) The annual license fee for a pawnbroker is $200.00. 19. RESALE DEALERS • Resale dealer license fee (EMC 6.43.050) • The annual license fee for a resale dealer is $200.00. 20. RECYCLABLE METAL DEALERS • Recyclable metal dealers license fee (EMC 6.44.040) The annual license fee for a recyclable metal dealer is $200.00. 21. PEDDLERS AND SOLICITORS • Peddlers and solicitors permit fee (EMC 6.45.080) The application fee for a peddlers and solicitors license is as follows: A. $30.00 for each solicitor or peddler for permits pursuant to EMC section 6.45.020. B. $30.00 for a permit issued pursuant to EMC sections 6.45.030 or 6.45.040. C. $150.00 for a mobile vendor food handling permit for each ice cream truck and $75.00 for a mobile vendor food handling permit for each ice cream cart that would operate within the city pursuant to EMC section 6.45.180, except where the truck or cart has a valid mobile vending unit permit issued by Kane County. 9 D. The cost of any background check required by Chapter 6.45 shall be borne by the applicant and due at the time of application. • Identification badges (EMC 6.45.100) In the event an identification badge is lost, stolen or otherwise unusable and requires replacement the permittee shall pay a fee of$10.00. 22. PUBLIC GARAGES AND PARKING LOTS • License; Application; Fee (EMC 6.51.020) The annual license fee for a license to operate and maintain a public garage is $100.00. • License; Required; Application(EMC 6.51.100) The annual license fee to operate and maintain a public parking lot is $0.60 for each 200 square feet or fraction thereof of such premises, provided, that no license shall be issued for fee of less than $10.00. 23. RAFFLES • Fees; schedule (EMC 6.52.020) Raffle license fees shall be as follows: Aggregate Prize Value Fee Less than $500.00 None $501.00 to $5,000.00 $5.00 $5,001.00 and over $25.00 24. SCAVENGERS • License; Fees (EMC 6.54.030) The annual license fee for a scavenger shall be determined by the number of vehicles used by the applicant for the collection of garbage, trash, ashes, or animal, human or vegetable refuse or offal originating in the city as follows: Hauler using one vehicle: $30.00 Each additional vehicle: $15.00 25. SHOOTING GALLERIES • Annual fee (EMC 6.60.020) The annual license fee for shooting galleries is $50.00. 26. SKATING RINKS • License; Fee (EMC 6.63.030) The annual license fee for skating rinks is $50.00. 10 27. TAXICABS • Taxicab owners' and drivers' license fees (EMC 6.66.020) The annual license fee for each taxicab owner's license sticker for each taxicab is $50.00. • The annual taxicab driver's license fee is $30.00. • Taxicab owner's license sticker fee for substitution of vehicles (EMC 6.66.060) In the event of a substitution of taxicab vehicles there is a fee of$10.00 for the taxicab owner's license sticker for the substituted vehicle. 28. THEATERS • License; Fee (EMC 6.69.030) The annual license fee for theaters is $100.00. • Fee for presentation on unlicensed premises (EMC 6.69.040) For motion pictures or theatricals which are presented in premises which are not covered by a license, the fee to be paid is $5.00 per day. 29. TOBACCO DEALERS • License; Fee (EMC 6.72.040) The annual license fee for a tobacco dealer is $100.00. 30. TRANSPORTATION NETWORK COMPANY SERVICES • TNC License fee (EMC 6.74.020) The annual license fee for a transportation network company (TNC) is $500.00. 31. MOBILE HOMES AND MOBILE HOME PARKS • License; Application; Fee (EMC 6.75.040) Each application for a license to maintain a mobile home park shall be accompanied with an annual fee in the amount of an annual inspection fee of$100.00 for properties accommodating 10 mobile homes or less and an additional fee of $10.00 for each additional mobile home in excess of 10. 32. SMALL WIRELESS FACILITIES • Permit fee for small wireless facilities(EMC 6.94.030) Applicants for a small wireless facility permit shall pay an application fee of$650.00 for an application to collocate a single small wireless facility on an existing utility pole or wireless support structure, and $350.00 for each small wireless facility addressed in 11 a consolidated application to collocate more than 1 small wireless facility on existing utility poles or wireless support structures. Applicant shall pay an application fee of $1,000.00 for each small wireless facility addressed in an application that includes the installation of a new utility pole for such collocation. • Annual occurring rate (EMC 6.94.030G) A wireless provider shall pay to the city an annual recurring rate to collocate a small wireless facility on a city utility pole located in the right-of-way that equals: (1)$200.00 or; (2) the actual, direct and reasonable costs related to the wireless provider's use of space on the city utility pole. If the city has not billed the wireless provider actual and direct costs, the fee shall be $200.00 payable on the first day after the first annual anniversary of the issuance of the permit or notice of intent to collocate, and on each annual anniversary date thereafter. 33. PERSONAL WIRELESS TELECOMMUNICATION SERVICES AND FACILITIES • Personal wireless telecommunication services equipment mounted at grade (EMC 6.95.030E4) In the event that the operator of a personal wireless telecommunication facility proposes to install a facility where equipment or appurtenances are to be installed at grade, screening shall be installed to minimize the visibility of the facility. Such screening shall be natural landscaping material or a fence subject to the approval of city and shall comply with all regulations of the city. In lieu of the operator installing the screening, the city, at its sole discretion, may accept from the operator of the facility a fee of $1,500.00 for the acquisition and installation of screening or landscaping material by the city. 34. ANIMALS • License fee for dangerous dog or vicious dog (EMC 7.04.060) The annual license fee for a dangerous dog or vicious dog shall be in the amount of $50.00. • License fee for keeping of chickens (EMC 7.08.090) The license fee for the keeping of chickens is in the amount of$30.00. • Permit fee for honey beekeeping permit(EMC 7.10.090) The permit fee for a honey beekeeping permit is $65.00. The fee for honey beekeeping permit shall be the same fee as for a shed building permit. 35. PLANTS AND WEEDS • Release of lien fee (EMC 9.16.050) 12 The fee for issuing a release of lien filed for weed cutting pursuant to Chapter 9.16 is $10.00. 36. GARBAGE AND REFUSE • Release of lien fee (EMC 9.24.060) The fee for issuing a release of lien filed pursuant to Chapter 9.24 is $25.00. 37. STORAGE AND DISPOSAL OF JUNK AND WASTE MATTER • Release of lien fee (EMC 9.36.050) The fee for issuing a release of lien filed pursuant to Chapter 9.36 is $25.00. 38. FIREWORKS • Pyrotechnic display fee (EMC 10.31.030) The application fee for a pyrotechnical display permit is $200.00. • Consumer fireworks display permit fee (EMC 10.31.040) The application fee for a consumer fireworks display permit is $200.00. 39. VEHICLES AND TRAFFIC • Registration fee for operation of nonhighway vehicles on city streets (EMC 11.42.030) A fee of $100.00 shall be paid for the initial annual safety inspection of each nonhighway vehicle to be registered for operation on city streets. A fee of$50.00 for the annual reinspection for the same nonhighway vehicle under the same ownership each year shall thereafter be paid. • Permit fees for overweight and oversized vehicles (EMC 11.54.040) At the time of the filing of a permit application for an overweight or oversized vehicle permit pursuant to Chapter 11.54,the applicant shall pay a fee for the permit according to the following schedule: Single trip permit $75.00 Round trip permit $150.00 Quarterly permit $300.00 Annual permit $900.00 • Fees relating to immobilization, towing and impoundment (EMC 11.62.130) The fee for immobilization shall be $60.00, the fee for towing subsequent to immobilization shall be $105.00, or$135.00 if the vehicle has a gross weight of 8,000 pounds or more, and the storage fee shall be $10.00 per day for the first 10 days, and $20.00 per day thereafter or $25.00 per day if the vehicle has a gross weight of 8,000 pounds or more, provided that no fees shall be assessed for any immobilization or tow which has been determined to be erroneous. 13 40. STREET AND SIDEWALK VAULT SPACES • Permit fee for street and sidewalk vault spaces (EMC 13.12.070) The annual permit fee to be paid for each permit for a street or sidewalk vault space is $25.00. 41. WATERS AND SEWERS • Water reconnection fee for cross connection shut off(EMC 14.04.065) There is a water reconnection fee of$250.00 for the restoring of water service which had been shutoff for an improper cross connection. • Water meter test deposit (EMC 14.04.080) Before making a test of any water meter requested by the customer, the customer shall at the time of making application for a test make a deposit in the amount of$100.00. • Frozen service fee (EMC 14.04.370) If the property owner allows the water service to freeze after mail notification, the customer will be placed at the bottom of any existing waiting list for thawing and will be charged for thawing service at the rate of$100.00 per hour. The owner may hire a private contractor for this service. • Charges for frozen water meters will be set at the prevailing rates on file with the water department, plus a $20.00 labor charge, or $40.00 for meters sized one and one-half inches or larger. • Sanitary Sewer; Connection Permit fee (EMC 14.08.070) The permit and inspection fee for a sanitary sewer connection is $10.00. 42. BUILDINGS AND CONSTRUCTION • Contractor's registration fee (EMC 16.02.020) The annual fee for contractor's registration is $0.00. • Plumbing contractor registration fee (EMC 16.02.050) The annual fee for a plumbing contractor registration is $25.00. • Warm air heating contractor's (HVAC) registration fee (EMC 16.02.060) The examination fee for a warm air heating contractor(HVAC) is $100.00. The annual registration fee for a warm air heating contractor(HVAC) is $25.00. • Release of lien fee for tree maintenance (EMC 16.12.020) Section 302.16, tree maintenance, the fee for issuing a release of lien filed pursuant to this section is $25.00. • Registration fees for electrical contractors (EMC 16.24.050) 14 The initial registration and examination fee for an electrical contractor is $100.00. The annual registration fee for electrical contractors is thereafter $25.00. • Vacant building inspection fee (EMC 16.42.040D) The inspection fee is $500.00. • Obligation to register vacant buildings and foreclosed unoccupied buildings (EMC 16.42.060) Subsection Al, registration of building, the annual non-prorated vacant building registration fee is in the amount of$200.00. Subsection Alc(2), the fee to renew the vacant building registration each year is the amount of $200.00. Subsection A2 inspection conducted, the fee for the city inspection of the interior of the vacant building is $500.00. • Roominghouse license fee (EMC 16.44.030) The annual license fee for a roominghouse is as follows: A.
