AN ORDINANCE a.
AMENDING CHAPTER 21 OF THE CITY CODE OF ELG,IN , ILLINOIS , ENTITLED
"THE ELGIN ZONING ORDINANCE" .
WHEREAS , the City Council has been requested to classify
certain property hereinafter described as M-2, General Manufac-
turing District , under the Elgin Zonin; Ordinance , with a
Special Use authorized thereon , per^ritting the excavation of
isand and gravel from a portion of said territories , and
WHEREAS , a written renort has been prepared and forwarded to
the Zoning Board of Appeals of the City of Elgin by the Plan
Commission pertaining to this particular petition , and
;:44- WHEREAS , a public hearing has been held by the Zonino Board
of Appeals , after due notice by publication , as provided by
4 Statutes , and its findings and recommendations have been reported
to the City Council , all of which have been duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ELGIN , ILLINOIS :
Section 1 . That Sub-section B of Section 21- 106 of Chapter
21 of the City Code of Elgin , Illinois , as a-ended , be , and the
sare hereby is , amended by adding thereto the following
paragraph :
That the boundaries hereinbefore described and laid
out in the "Zoning District Mao" , as amended, be , and
they hereby are , altered and amended in the following
manner , to-wit:
By including in M-2 , General Manufacturing District ,
the following described premises , to-wit :

line of said Southwest quarter a distance of 1492 . 90

1650 .0 feet North of the Southeast corner of said
Southwest quarter ; thence Northerly along said East
line a distance of 1014 . 64 feet to the Northeast
corner of said Southwest quarter.

A parcel of land situated in the West half of Section
32 Township 41 North , Range 9 East of the Third
Principal Meridian in Cook County , Illinois , and
being more particularly described as follows :
Beginning at the point of intersection of the
East and West centerline of said Section 32 with the �t
most Westerly right of way line of the Elgin , Joliet
and Eastern Railway Corpany ; thence East , along saio
East and West centerline , 50 .03 feet to a point ;
thence Southerly , along the Westerly line of the
Railway Company ' s normal 100 foot right of way which
forms an angle of 87 degrees , 56 minutes to the last
described course , 100 .065 feet to a point ; thence
East along a line parallel to the aforementioned
East and West centerline of Section 32 , 100 .065 feet
to a point on the Easterly line of the Railway
Company ' s normal 100 foot right of way ; thence
Northerly , along said Easterly right of way line
which forms an interior angle of 92 degrees , 04
minutes to the last described course , 100 .065 feet
to a point on the aforesaid East and West centerline
of Section 32 ; thence East , along said East and
West centerline , 50 .03 feet to a point ; thence
Northerly , along the most Easterly right of way line
of the Railway Company which forms an interior angle
of 92 degrees . 04 minutes to the last described
course , 100 .065 feet to a point ; thence West, along a
a line parallel to the aforesaid East and West
centerline of Section 32 , 200 . 13 feet to a point V
on the most Westerly right of way line of the Rail -
way Company ; thence Southerly , along said most
Westerly right of way line , 100 .065 feet to the tR
point and place of beginning , comprising a total of
30 ,019 square feet , more or less , a portion of which
is now used a a public roadway commonly known as
West Bartlett Road .
Section 2 . That a Special Use for the excavation of sand
and gravel be , and the same hereby is , granted and authorized upon
the premises hereinabove described as Parcel I , subject to the

following specific conditions , to-wit :
1 . Said Special Use for the excavation of sane:
and gravel is permitted in order that a hill with
sand and gravel located on the Southeast 18 acres
of the premises described as Parcel I may be
removed and the Northwest 22 acres of said property ,
which is a low area with grade considerably below
the level of West Bartlett Road , may be filled and
brought to grade .
2 . That petitioner , their successors or cssigns ,
shall bring the entire parcel to a level and proper
grade , as determined and approved by, the City
Elgineer of the City of Elgin , upon the completion
of any and all sand and gravel excavation frog
the premises .
3. That said Special Use for the excavation of
sand and gravel shall terminate within 10 years
from the effective date of this Ordinance , or when
the entire tract has been brought to level grade , ►
as hereinabovc provided , whichever event shall
first occur.
4 . That no sand or gravel shall be excavated from
below or underneath a grade established at U . S . G . S .
datum 756 (which is 14 feet below the existing
lowest grade on the tract which has been determined
to be U . S . G . S . datum 770 ) .
Section 3. That all ordinances or parts thereof , in conflict
herewith , be , and the same hereby are , repealed and of no further
force and effect .

t. the above described property on March 13, 1968. The conditi 'nr of
the 4uecial use provide that the excavation of sand and grsvr• shall
terminate in March 13, 1978.
The City Engineer shall determine and approve the final grade of said
property, therefore I feel that you should notify the ,vner of the
property of the terminati'n of this special use.
