HomeMy WebLinkAbout19-34 Resolution No. 19-34 RESOLUTION AUTHORIZING EXECUTION OF A SALES AGREEMENT WITH CHRISTOPHER JONES FOR TRANSFER OF A RETIRED POLICE CANINE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that pursuant to Elgin Municipal Code Section 5.02.020B(9) the City Council hereby finds that an exception to the requirements of the procurement ordinance is necessary and in the best interest of the city; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute a Sales Agreement on behalf of the City of Elgin with Christopher Jones, for transfer of a retired police canine, a copy of which is attached hereto and made a part hereof by reference. s/David J. Kaptain, Mayor Presented: March 6, 2019 Passed: March 6, 2019 Omnibus Vote: Yeas: 8 Nays: 0 Recorded: March 6, 2019 Published: March 7, 2019 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk SALES AGREEMENT THIS AGREEMENT is hereby made and entered into this LJ day of 2019, by and between the City of Elgin, Illinois, a municipal corporation (hereina er referred to as "City")and Christopher Jones (hereinafter referred to as "Jones"). WHEREAS, the City owns a 5-year-old chocolate labrador retriever which was put into service September 2015 (hereinafter referred to as "Willson"); and WHEREAS, Willson is nearing the end of his service life; and WHEREAS, Jones is the police officer handler of Willson; and WHEREAS, the City and Jones have determined that it is appropriate for the City to transfer and convey Willson to Jones which whereupon Jones shall be responsible for the care of the canine. NOW, THEREFORE, for and in consideration of the mutual promises and covenants provided for herein, the sufficiency of which is mutually acknowledged, the parties hereto hereby agree as follows: 1. The above recitals are incorporated into and made a part of this agreement as if fully recited herein. 2. Jones shall pay the sum of one dollar($1)to the City. 3. The City hereby transfers and conveys all of its right, title and interest in Willson to Jones, without any representations or warranties, effective as of the date of this agreement. Jones understands and agrees that upon such transfer and conveyance that Jones shall be responsible for all costs of Willson including all care and maintenance. C iJ ELGIN .
