WHEREAS, the City and Engineer hereto have previously entered into an agreement dated February 27, 2013 wherein the CITY engaged the ENGINEER to furnish certain professional services in connection with the 2013 Combined Sewer Separation Project—Bluff City Boulevard Phase I (hereinafter referred to as "the Original Agreement" and the"PROJECT"); and WHEREAS, the CITY and ENGINEER hereto have previously entered an Amendment Agreement No. 1 dated December 4, 2013, to include professional services for additional survey, design, engineering, planning and project administration for the additional service area which are directly adjacent to the original agreement area; and an Amendment Agreement No. 2 dated September 23, 2015 to include construction administration and inspection services; and WHEREAS, the CITY has determined that the proposed scope of the PROJECT should be modified to add additional services for the development of plans, specifications and cost estimates for the next phase (Phase 1I) of the Bluff City Boulevard Basin; and WHEREAS, the parties hereto have each determined it to be in their interest to further amend Original Agreement pursuant to this Amendment Agreement No. 3; and WHEREAS, the contract price for the Original Agreement was in the amount of$211,750.00, contract price for the Amendment Agreement No. 1 was in the amount of$124,089.00, contract price for the Amendment Agreement No. 2 was in the amount of$698,515.78, and the cost for additional services to be provided pursuant to this Amendment Agreement No. 3 is in the amount of$729,556.00; and WHEREAS, the changes contemplated by this Amendment Agreement No. 3 are germane to the Original Agreement as signed; and as amended by Amendment Agreement No. 1, Amendment Agreement No. 2 and this Amendment Agreement No. 3 is in the best interest of the CITY and is authorized by law. NOW, THEREFORE, for and in consideration of the mutual undertakings as provided herein, and other good and valuable consideration, the sufficiency of which is hereby mutually acknowledged, the parties hereto agree as follows: 1. The above recitals are incorporated into and made a part of this agreement as if fully recited hereby. 2. "Section 1 of the Original Agreement as modified by Amendment No. 1 and then by Amendment No. 2 is hereby further amended by adding the following additional subparagraph F thereto to read as follows: `F. ENGINEER shall also perform the additional engineering services relating to the PROJECT as outlined and described in Attachment A-2, dated July 27, 2018 and entitled, `SCOPE OF SERVICES —PHASE II BLUFF CITY BOULEVARD BASIN" attached hereto and made a part Wftftxa.— hereof (hereinafter referred to as the "Additional Supplemental Services"). The ENGINEER shall perform such Additional Supplemental Services according to the schedule as set forth in Attachment A-2." 3. "Section 4 of the Original Agreement as modified by Amendment Agreement No. 1 and then by Amendment Agreement No. 2 is hereby further amended by adding the following additional subparagraph to the end thereof: "F. For the Supplemental Additional Services to be provided pursuant to this Amendment agreement No. 3, the CITY shall reimburse the ENGINEER for such services in the total amount not-to-exceed the sum of $729,556.00, regardless of the actual time or actual costs incurred by the ENGINEER unless substantial modifications to the PROJECT are authorized in writing by the CITY and approved by way of written amendment to this Agreement." 4. The changes provided to the Original Agreement as provided in this Amendment Agreement No. 3 are germane to the Original Contract as signed and this Amendment Agreement No. 3 is in the best interests of the City of Elgin and is authorized by law. 5. That except as amended in this Amendment Agreement No. 3 the Original Agreement as previously amended by Amendment Agreement No. 2 and Amendment Agreement No. 1, shall remain in full force and effect. 6. In the event of any conflict between the terms of the Original Agreement, the terms of Amendment Agreement No. 2 and Amendment Agreement No. 1 and the provisions in this Amendment Agreement No. 3, the provisions of this Amendment Agreement No. 3 shall control. (ENGINEER) has been retained by the City of Elgin, Illinois (CITY) to provide professional engineering services in connection with the Combined Sewer Separation Project — Bluff City Boulevard Basin. The Bluff City Boulevard Basin is roughly described as the area surrounded by Villa Street on the north, Cleveland Avenue and Harrison Street on the east, Bluff City Boulevard on the south and Raymond Street on the west. The "Original Agreement" for the professional services was approved and executed by the City on February 27, 2013. A Sewer Separation Strategy was prepared for the entre basin as part of the scope of the Original Agreement. Three (3) separate phases were identified as shown in the attached "Exhibit A — Bluff City Boulevard Basin Phasing Plan". Phase I of the three phased project was completed in fall of 2017 which included construction of new storm sewers, sanitary sewers and sewer lining. Exhibit A also shows portion of the basin previously separated prior to 2013. However, sewer televising and/or sewer lining was not completed in these areas. The CITY has now requested that professional engineering services be provided for the next phases in two (2) parts to complete the following scope of services: PART A— PRELIMINARY ENGINEERING (60% DESIGN) FOR REMAINDER OF BLUFF CITY BASIN The project limits for Part A (which includes approximately 10,555 linear feet or 1.99 miles of utility and roadway improvements and approximately 28,693 linear feet or 5.43 miles of sewer televising) includes areas of Phase II and Phase III of the three phased project as shown in Exhibit B and additional sewer televising areas in previously completed sewer separation areas of the basin. The following general scope of services will be included in Part A. • Data collection including survey and utility information for the remainder of the Bluff City Basin (Phase II and Phase III limits); • Sewer televising for all of the Bluff City Basin for the remainder of the Bluff City Basin (Phase II and Phase III limits) plus area previously separated. • Initial permit application meetings with Illinois Department of Transportation (IDOT)for improvements along Liberty Street (IL-25); • Preliminary engineering (60% level) design for the remainder of the Bluff City Basin (Phase II and Phase III) including preparing Engineer's Opinion of Probable Construction Costs; and • Define the limits and scope of the design project with an approximate budget of$2.5M which shall include construction plus construction engineering. Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 2 of 20 PART B — CONTRACT PLANS WITH SPECIFICATIONS AND BIDDING SERVICES The project limits for Part B for the purposes of this contract are assumed and is subject to change based on discussions with the CITY during completion of PART A. The following limits have been assumed for PART B scope; approximately 5,260 linear feet or 0.99 miles of utility and roadway improvements and sewer lining) as shown in the hatched area in Exhibit B and includes areas along Sherman Avenue, Regent Street, Bent Avenue, and IL-25. The following general scope of service will be included in Part 2: • Prepare final engineering design for the project limits including contract documents and provide bidding services. The specific tasks and associated scope of services for both Part A and Part B are detailed in the following sections. For ease of review, similar tasks were estimated for both PART A and PART B and noted as either needing scope in PART A, PART B or both. PART A - SCOPE OF SERVICES Upon issuance of a Notice to Proceed (NTP), ENGINEER will prepare preliminary design for the project limits. The scope will include completion of the following tasks: Task 1 - Kickoff Meeting Task 2 - Topographic Survey Task 3 - Sewer Televising Video Inspections Task 4 - Geotechnical Investigations Task 5 - Sewer Televising Video Review and Lining Design Task 6 - Field Reconnaissance (30% and 60%) Task 7 - Utility Coordination (30% and 60%) Task 8 - Concept (30%) Engineering Plans Task 9— Preliminary (60%) Engineering Plans Task 10 — Lead Service Line Replacement (OMITTED, SEE PART B SCOPE OF SERVICES) Task 11 - Pre-Final (90%) Engineering Plans (OMITTED, SEE PART B SCOPE OF SERVICES) Task 12 - Final (100%) Engineering Plans (OMITTED, SEE PART B SCOPE OF SERVICES) Task 13 - Public Information Meeting (OMITTED, SEE PART B SCOPE OF SERVICES) Task 14 - Progress Meetings (30%, and 60%) Task 15 - IDOT Coordination Meetings (30% and 60%) Task 16 - Permitting (30% and 60%) Task 17 - Engineer's Opinion of Probable Construction Costs (EOPCC) (30%, and 60%) Task 18—Quality Control and Quality Assurance (30%, and 60%) Task 19 - Phasing Plan and Selection of PART B Design Project Task 20 - Bid Award and Assistance (OMITTED, SEE PART B SCOPE OF SERVICES) Task 21 - Project Administration Task 22 — Design Allowance Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 3 of 20 A detailed scope of services for each of the tasks identified above along with deliverables is provided below. TASK 1 — KICKOFF MEETING Scope of Work: The ENGINEER will prepare a meeting agenda for the project and distribute to CITY prior to the scheduled kickoff meeting. ENGINEER will attend a kickoff meeting with the CITY to discuss the project schedule, major deliverable milestones, and schedule. ENGINEER will also setup an internal meeting with the Design Team after the initial kickoff meeting with the CITY to coordinate the project scope, schedule and expectations discussed with CITY staff. Deliverable: Minutes of the meeting with the CITY will be prepared and distributed to all attendees. TASK 2 - TOPOGRAPHIC SURVEY Scope of Work: The topographic survey will include locating existing visible topographic information within the project limits and will extend approximately 20' beyond the existing right- of-way (ROW) of the roads as needed. The topographic survey will include location of existing visible utility markings by J.U.L.I.E. utility identification (if available), existing trees larger than 6 inches in diameter, roadways, signs, sidewalks and landscaping features. Municipal utilities (i.e. storm sewer, sanitary sewer, combined sewers and water main) will also be located showing size, depth and flow direction from observed evidence at manholes, catch basins, inlets and valve vaults. The field survey will also include verifying right-of-way and property ownership. ENGINEER will utilize existing ROW documents available such as plat of highways, plat of subdivisions and parcels plats to determine ROW limits. Depending on the final placement of the proposed storm or sanitary sewers, temporary or permanent construction easements may be required for segments along the project route. Number of parcels requiring easements will be determined during this design phase; however easement documents will not be prepared in PART A and shall be completed during the final design phase. No additional ROW acquisition is anticipated at this time. The City has also requested that backflow prevention be provided for outfalls 13, 14 and 15 of the City's combined sewer outfalls. In order to provide design and specifications for the backflow prevention at these outfalls, ENGINEER will provide survey of the three outfalls to verify pipe sizes and obtain immediate site topographic information to include in the design plans and specifications. The topographic survey for the project will be performed using RTK GPS and robotic total stations referenced to the Illinois State Plane Coordinate System — East Zone (NAD83). The topographic survey will be completed in COMPANY's current standard version of AutoCAD Civil 3D format. Deliverable: A CADD file along with a shape file of existing surveyed utilities will be provided to the CITY for their use incorporating into GIS. Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 4 of 20 Items Not Included in the Scope: ROW acquisition, easement exhibits and/or plat of easements, and appraisals and negotiations is not included in the scope. If these services become necessary, ENGINEER can provide these services, upon approval by the CITY, as supplemental services. See PART B scope of services section for additional information regarding temporary construction easements for lead service line replacements. TASK 3 - SEWER TELEVISING VIDEO INSPECTIONS AND SMOKE TESTING Scope of Work: ENGINEER will subcontract with a contractor to provide sewer cleaning and televising services. The existing combined sewer system within the project limits will be cleaned and televised. Inspection will be completed by close circuit TV (CCTV) with all data transferred and stored on Compact Disk. ENGINEER shall notify the CITY at least 48 hours before the start of this work. The ENGINEER's design team will review the sewer televising video to determine existing conditions, connection locations, and identify locations in need of point repair and CIPP lining. ENGINEER will prepare a list of corrective actions by sewer reaches and coordinate the same with the CITY. Approximately 28,693 LF of sewer televising is included within the scope of work. Sewer Televising Scope of Work is further provided in Exhibit C which shows the breakdown by roadway network in which 14,186 lineal feet are within the identified Phase II limits while another 14,507 lineal feet are located within the previously separated basin area. The scope includes light cleaning of the sewer system to allow CCTV inspection. Heavy Cleaning, often needed in older system is hard to predict and is anticipated. For the purposes of this contract, an allowance of $7,500.00 has been provided in Task 22.1 for heavy cleaning which will be utilized upon approval by the CITY. Similarly, for the purposes of this contract, an allowance of $5,000.00 has been provided in Task 22.2 for smoke and dye testing in the Bluff City Basin, which will be utilized upon approval by the CITY. The City has also identified areas within other combined sewer basins, outside of the Bluff City Boulevard basin, that are showing overflows in previously separated areas. Further smoke and dye testing may be required to assess if there are areas needing further separation in these basins. An additional allowance of $10,000.00 has been included in Task 22.2 for smoke testing in other basins. An additional allowance of $5,000.00 is included in Task 22.2 for the ENGINEER to develop scope and coordinate and review smoke testing in areas outside of the Bluff City Basin. Deliverable: Two (2) copies of the sewer televising report along with recorded video on CD to be provided. Items Not Included in the Scope: Sewer televising and inspections beyond 28,693 LF is not included in the scope. Heavy cleaning exceeding allowance assumption in Task 21.2 is also not included in the scope. If any additional televising and or heavy cleaning becomes necessary, ENGINEER can provide these services, upon approval by the CITY, as supplemental services. Existing storm sewer televising in previously separated areas is not included in the scope. If televising of storm sewer in previously separated areas becomes known during design, these will be handled by a separate agreement in future design contracts. Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 5 of 20 TASK 4 - GEOTECHNICAL INVESTIGATIONS Scope of Work: ENGINEER will subcontract with a qualified geotechnical consultant to provide geotechnical borings and pavement cores within the project area at locations identified by ENGINEER and in consultation with the City. A total of sixteen (16) soil borings up to fifteen foot (15') in depth are included in the scope. In addition, up to twenty-four(24) pavement cores will be obtained along various roadways within the project area to determine pavement depth and section. Deliverable: Two (2) copies of the geotechnical report will be provided. Items Not Included in the Scope: Geotechnical Investigations beyond the sixteen (16) borings and the twenty-four (24) pavement cores are not included in the scope. If additional borings becomes necessary, ENGINEER can provide these services, upon approval by the CITY, as supplemental services. TASK 5— SEWER TELEVISING VIDEO REVIEW AND LINING DESIGN Scope of Work: Upon completion of Task 3 - Sewer Televising and Inspections, ENGINEER will review video and draft a deficiency report log in excel format based on each section of pipe that was televised. Based on outcome and the results of the pipe televising, ENGINEER will prepare a summary recommendation to document areas feasible for and requiring sewer lining versus spot repairs via open cut methods. These recommendations will be then incorporated in the final design. Deliverable: Excel spreadsheet summarizing the video results and deficiency reports will be provided and then incorporated into the final design plan for CIPP areas. TASK 6— FIELD RECONNAISSANCE (30% AND 60%) Scope of Work: ENGINEER and CITY representatives will perform an initial walkthrough of the site prior to preparing the 30% design plans to become familiar with site conditions. Additional reconnaissance will be completed with the CITY during the design stage to coordination the design layout with existing conditions and to verify that the proposed assumptions are accurate and constructible. The ENGINEER will capture general photo documentation of the project limits during the initial walkthrough. Deliverable: N/A TASK 7 - UTILITY COORDINATION (30%, AND 60%) Scope of Work: Based on the nature of proposed improvements involving utility construction, ENGINEER will provide utility coordination with the Franchise Utilities Owners (AT&T, ComED, Nicor) and will also coordinate with CITY Public Works Department to identify potential known conflicts or approximate/recorded utility locations in the field. The ENGINEER will develop an existing utility infrastructure base map for reference in the design stage process. A J.U.L.I.E. Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 6 of 20 Design Stage Ticket will be filed for the entire project area to initiate and identify franchise utility contacts in anticipation to develop the utility atlas and obtain best available information. Deliverable: ENGINEER will prepare and provide copies of transmitted submittal documents to each of the identified franchise utility companies at each design stage submittal that are involved within the project limits. Utility atlases received from franchise utilities will also be transmitted to the CITY for project records and reference. TASK 8 & TASK 9 — CONCEPT (30%) AND PRELIMINARY (60%) ENGINEERING PLANS Scope of Work: These services will include preparing conceptual and preliminary engineering plans for the purposes of sewer separation within the project limits. The conceptual and preliminary engineering plans will be prepared in accordance with applicable regulatory agency requirements having jurisdiction within the project limits. These include the following design guidelines and ordinances: • CITY standards and details; • Standard Specifications for Sewer and Water Main Construction in Illinois; • IDOT Standard Specifications; • IEPA NPDES Phase II regulations for Stormwater Pollution Prevention Plans (SWPPP); Kane County Stormwater Ordinance (KCSO); and • Fox River Water Reclamation District (FRWRD) standard details, if applicable. The specific scope for the concept (30%) and preliminary (60%) engineering plans is further provided below: a. Basin Separation Strategy and Hydrologic and Hydraulic Analysis: Previously completed hydraulic models and sewer separation strategy was based on CITY provided GIS data including rims and invert elevations. As detailed survey is obtained throughout the project limits, it will be required to input this data in the hydraulic models including updating the models as a result of utility coordination and needed revisions. During the scoping meeting, CITY has also requested to re-evaluate the previously prepared Sewer Separation Strategy and evaluate if the sewer system can be re-aligned such that it will help eliminate a Combined Sewer Overflow (CSO) at IL-25 (Liberty Street) and Dwight Street intersection. This scope will include looking at the re- alignment of the storm sewer along IL-25 (Liberty Street). Deliverable: Hydraulic model of the revised system in electronic format. Items Not Included in the Scope: N/A b. Concept and Preliminary Engineering Plans and Specifications: ENGINEER will develop and assemble the engineering plans in AutoCAD Civil 3D software. Plans will be developed to predetermined milestones for submittal which will consist of Concept (30%), and Preliminary (60%) milestones. Comments received will be addressed and a disposition of comments provided to the CITY. The general nature of improvements within the project limits will include construction of new storm or Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 7 of 20 sanitary sewer, water main replacements, sanitary and water service replacements, sewer lining, pavement patching and full width resurfacing along impacted roadways. The areas of water main needing replacements and sizing of the water mains will be provided by the CITY. Due to the nature of improvements involving utility construction, early coordination with the Franchise Utilities and CITY Public Works Department will be completed to identify potential known conflicts in the field. Due to the age of the existing combined sewer systems in this area, special consideration will be given to existing sanitary services and its depth to avoid potential shading of utilities with the new storm sewers. If needed, exploratory excavation will be recommended by the ENGINEER through a subcontract with an exploratory excavation company. For the purposes of this contract, an allowance of $12,500 has been provided in Task 22.3 for exploratory excavation, which will be utilized upon approval by the CITY. A typical set of engineering plans will include the following minimum sheets: • Cover Sheet; • Typical Sections; • Maintenance of Traffic—Typical; • Removal Plans; • Plan and Profile Sheets; • Schedules & Limited Tag Data (type, size and location); Deliverable: One (1) full size and two (2) half-size copies of the engineering plans will be provided at the 30% and 60% submittals. Items Not Included in the Scope: Detailed Tag Sheets, Erosion Control Plan Sheets, Construction Details, Permit Applications, Pre-Final (90%) and Final Design (100%), Special Provisions or Bid Documents are not included and will be completed in PART B of the scope of services. c. Clean Construction or Demolition Debris (CCDD) Certification: As a result of legislation enacted by the Illinois General Assembly and signed into law on July 30, 2010 by the Governor of Illinois, Public Act 096-1416, regulating disposal of Clean Construction or Demolition Debris (CCDD), disposal of construction or demolition debris requires a certification from an Illinois registered Professional Engineer that soils generated during construction activities are uncontaminated. The soil samples obtained from the soil borings will be submitted to a certified laboratory qualified to test the soils for the Illinois Environmental Protection Agency (TEPA) Site Remediation Program Target Compound List. The laboratory results will be compared to the Part 742, Tier Approach to Corrective Action Objectives (TACO), Table A. Based on the results of environmental records review and soil sampling, ENGINEER will provide Professional Engineer (P.E.) certification for the soils generated during construction activities that are appropriate for disposal at a permitted CCDD facility. The P.E. certification will be provided on Illinois Environmental Protection Agency form LPC-663. The certification will contain the Basis for Certification that outlines the procedures utilized to certify the soils as uncontaminated including but not limited to PESA, PSI, supplemental PESA and soil testing results. Backflow Prevention Design: Outfalls 13, 14 and 15 of the City's combined sewer outfalls will require backflow prevention to prevent backwater into the system from the river. Based on the pipe sizes and shapes of the pipe at these outfalls, ENGINEER will research appropriate material and backflow prevention alternates available for installation. The ENGINEER will prepare a short technical memorandum to summarize the options available for backflow prevention including a preliminary Engineer's Opinion of Probable Construction costs for available alternates. Based on the material selection by the CITY for backflow prevention at these outfalls, ENGINEER will prepare preliminary engineering plans and specifications for each of the outfalls. TASK 10 — LEAD SERVICE LINE REPLACEMENT OMITTED, SEE PART B SCOPE OF SERVICES TASK 11 - PRE-FINAL (90%) ENGINEERING PLANS OMITTED, SEE PART B SCOPE OF SERVICES TASK 12 - FINAL (100%) ENGINEERING PLANS OMITTED, SEE PART B SCOPE OF SERVICES TASK 13 - PUBLIC INFORMATIONAL MEETING OMITTED, SEE PART B SCOPE OF SERVICES TASK 14— PROGRESS MEETINGS Scope of Work: At the following design milestones i.e. 30% and 60, the ENGINEER will attend a progress meeting at the CITY to discuss the CITY's review comments on the engineering plans. This will allow CITY Staff and ENGINEER to discuss design elements, project progress, permitting requirements, and costs at each of these above milestones to ensure that the project is progressing within budget and on schedule or to make necessary adjustments. Deliverable: ENGINEER will prepare minutes of the meetings and distribute to all attendees. TASK 15— IDOT COORDINATION MEETINGS Scope of Work: The project limits include work along Liberty Street (IL-25) which is under IDOT's jurisdiction. The improvements within Liberty Street may include removal and replacements of existing utilities and/or extensions of new sanitary or storm sewers. As such, IDOT will need to review and approve the plans along Liberty Street including Maintenance of Traffic. ENGINEER will attend up to two (2) coordination meetings with IDOT to present the 30% and 60% plans and obtain concurrence for permitting purposes. Permit applications will be prepared in the final design stage and is not included in the scope. TASK 16 - PERMITTING Scope of Work: The following permits and/or sign offs will be applied for during this stage of the project: • Illinois Historic Preservation Agency (IHPA) Sign Off • Illinois Department of Natural Resources (IDNR) ECOCAT sign off In addition, ENGINEER will identify and provide a summary of permits required for the project during the final engineering design. Scope will include preparing the necessary exhibits and supporting documentation for facilitation in meetings with the permitting agencies. In addition, one (1) coordination meeting with the Fox River Water Reclamation District (FRWRD) is anticipated and included in the scope. Scope will include permit coordination with the regulatory agencies. Deliverable: N/A Items Not Included in the Scope: Scope will not include preparing the permit application and permit fees. The permit fees are unknown and hence not included in the scope. However, an allowance of $500.00 has been added to design allowance for permit fees which will be utilized upon approval by the CITY. TASK 17— ENGINEER'S OPINION OF PROBABLE CONSTRUCTION COSTS Scope of Work: An Engineer's Opinion of Probable Construction Cost (EOPCC) will be prepared for CITY's review with submittal at the 30%, and 60%. If any adjustments are needed in the design plans including limits of construction adjustments, these discussions can occur early in the process. Deliverable: An Illinois Registered Professional Engineer (PE) signed and sealed EOPCC will be provided. TASK 18— QUALITY CONTROL AND QUALITY ASSURANCE (QC/QA) Scope of Work Quality Control and Quality Assurance (QC/QA): A QC/QA review will be completed prior to 30%, and 60% document submittal. A constructability review will also be completed by qualified construction personnel. TASK 19 - PHASING PLAN AND SELECTION OF PART B DESIGN PROJECT Scope of Work An overall phasing plan was previously prepared by the ENGINEER for the Bluff City Boulevard Basin. The CITY has expressed a desire that upon completion of the 60% plans for the project limits as defined in PART A above, additional professional engineering services be provided to advance the 60% plans to final design and prepare plans and contract documents for a construction project meeting the CITY's budget requirements of approximately $2.5M, which shall include construction and construction engineering services. The scope will therefore include a review of the overall project, coordination with the CITY on options, updating the phasing plan and finalizing the scope and limits of the construction project. Deliverable: Update to the phasing plan exhibit previously prepared by the ENGINEER. TASK 20 — BID AWARD AND ASSISTANCE OMITTED, SEE PART B SCOPE OF SERVICES TASK 21 — PROJECT ADMINISTRATION Scope of Work: This task will include management of the project scope, schedule and budget including maintaining project documentation binder. A monthly progress report will be provided to the CITY with the invoice detailing activities completed in the prior month and activities anticipated to be completed or undertaken in the following reporting period. The monthly progress report will include project status in accordance with an approved schedule established for this project which as included in Exhibit D. Deliverable: Monthly progress report will be submitted to the CITY. TASK 22— DESIGN ALLOWANCE The following tasks are not anticipated at this time and have been included as allowance in the contract to serve as a reserve for added scope items on a case by case basis that becomes known during the design stage by the ENGINEER and/or requested by the CITY and cannot be foreseen at this time. The ENGINEER understand that utilizing the budget in the design allowance will require prior approval by the CITY and would need to be incorporated by a change order or amendment to the contract every time an item is identified out of scope. At the CITY's discretion these Design Allowance funds may be re-allocated between tasks based on project requirements. The Design Allowance is assigned by tasks as follows: Task 22.1 — Heavy Cleaning of Sewer Pipes: Scope of Work: Heavy Cleaning of Sewer Piping is anticipated within the sewer televising areas. If sewer segments are encountered requiring heavy cleaning, ENGINEER will notify Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 11 of 20 the CITY of the same to require prior approval to allow the subcontractor to proceed with the work in order to complete sewer televising. Heavy cleaning will be considered when obstacles or root penetrations are found within the sewer system preventing advancement of the camera for televising purposes. The heavy cleaning will be provided on an hourly basis (quoted by the subcontractor as a range of$325-$485 per hour). The ENGINEER has accounted for approximately 10% of the overall project area sewer length to require heavy cleaning and a design allowance of $7,500.00 is budgeted for heaving cleaning of sewer piping. At the CITY's discretion these Design Allowance funds may be re-allocated between tasks based on project requirements. Deliverable: N/A Items Not Included in the Scope: N/A Task 22.2 - Field Investigations (Smoke and Dye Testing): Scope of Work: Limited Smoke and Dye Testing studies and House Inspection studies were previously completed in the basin. No additional studies are anticipated. However, due to unknown nature of the work, if additional investigations are needed, an allowance has been included in the contract which will require prior approval and authorization by the CITY. If required, ENGINEER will subcontract with a qualified company to perform smoke and dye testing for determination of sources of Infiltration and Inflow (1/1) and potential sewer systems or drain tiles that are unknown to the CITY or ENGINEER. Results from the smoke testing will be used to determine if further dye testing and home inspections will be required. A survey of only those homes in question that are connected to the combined sewer (to be converted to separate sanitary sewer) will be conducted to identify improper connections. The results of the testing will be discussed with the CITY to determine what actions need to be included in either code enforcement or incorporated in the design plans. At this time the ENGINEER has accounted for a design allowance of $5,000.00 in the contract for Field Investigation services within the Bluff City Boulevard basin. At the CITY's discretion these Design Allowance funds may be re-allocated between tasks based on project requirements. The City has also identified areas within other combined sewer basins, outside of the Bluff City Basin, that are showing overflows in previously separated areas. Further smoke and dye testing may be required to assess if there are areas needing further separation in these basins. An additional allowance of $10,000.00 has been included in the contract for smoke testing in other basins. An additional allowance of $5,000.00 is included for the ENGINEER to develop scope and coordinate and review smoke testing in areas outside of the Bluff City Basin. Deliverable: Two (2) copies of the smoke and dye testing results will be provided. Items Not Included in the Scope: Smoke and Dye Testing beyond the design allowance is not anticipated and is not included in the scope. If additional testing becomes necessary, ENGINEER can provide these services, upon approval by the CITY, as supplemental services. Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 12 of 20 Task 22.3— Exploratory Excavation: Scope of Work: Due to the age of the existing combined sewer systems in this area, special consideration will be given to existing sanitary services and its depth to avoid potential shading of utilities with the new storm sewers. It is likely that selective exploratory excavation may be needed to determine depth of existing services. Exploratory services, if required, will be shall be identified by the ENGINEER and reviewed by the CITY on a case by case basis. If approved by the CITY, exploratory excavation services will be sub- contracted by the ENGINEER. At this time the ENGINEER has accounted for a design allowance of $10,000.00 in the contract for Miscellaneous Design Services. At the CITY's discretion these Design Allowance funds may be re-allocated between tasks based on project requirements. Deliverable: To be determined based on the nature and scope of miscellaneous design services. Items Not Included in the Scope: N/A Task 22.4—Temporary Traffic Signal Design (30% and 60% Design): Scope of Work: Coordination with IDOT is required for work along Liberty Street. As such Maintenance of Traffic (MOT) will be required and is included during the design phase. However, temporary traffic signal at the intersection of Liberty and Villa Street is not included in the scope. If temporary signal is required per IDOT coordination, ENGINEER can provide these services, upon approval by the CITY, under design allowance budget. At this time the ENGINEER has accounted for a design allowance of $7,500.00 in the contract for Temporary Traffic Signal Design services. At the CITY's discretion these Design Allowance funds may be re-allocated between tasks based on project requirements. Deliverable: Temporary Traffic Control Design and associated plan sheets. For the purpose of scope and fee development, the hatched area shown in Exhibit B was used. TASK 1-6 OMITTED (COMPLETED IN PART A) TASK 7 — UTILITY COORDINATION (90%, AND FINAL) Scope of Work: The scope will include continuation of utility coordination with the CITY Utility Department, Public Works and Franchise Utilities Owners to finalize utility locations and possible conflicts in the field as plans are developed to pre-final and final stage. Deliverable: ENGINEER will prepare and provide copies of transmitted submittal documents to each of the identified franchise utility companies at each design stage submittal that are involved within the project limits. TASK 8-9 OMITTED (COMPLETED IN PART A) TASK 10 - LEAD WATER SERVICE REPLACEMENT Scope of Work: There has been recent activity around lead service replacements required as part of construction projects. In several instance, utility owners have been required to replace the lead service lines, if encountered during construction, to the meter on private property. Previously, utility owner's responsibility has ended at the b-box within the Right-of-Way. It is anticipated, that based on the aging water system, that this project will encounter lead service lines within the project limits. As a result of conversations and forthcoming potential for legislation which has not been enacted upon by the Illinois General Assembly or signed into required law regarding lead service line repair or replacement, CITY has requested planned replacements of the lead water service line up to the meter. Upon approval by the CITY, the ENGINEER will design the replacement of lead service lines as part of this project. The design will be completed in in accordance with the following assumptions and understanding: • Lead services are anticipated within the project limits; approximately sixty-five (65) parcels are included for investigation and replacement. The number of parcels was determined from aerial mapping for areas included for final design in Part B of this contract. • The engineering plans shall include removing and replacing the lead services including water shut off(B-Boxes) from the main to the meter. • It is assumed that temporary construction easements will be required from the parcel owner; Individual parcel owner coordination and preparation of temporary construction easement documents will be completed by the ENGINEER. ENGINEER's scope of services shall include the following; o Complete up to sixty-five (65) individual building inspection(s) to document, by photograph, the service location within the building, exit orientation or direction, and service size to be replaced up to the existing meter. It is assumed that parcel owner will readily provide access to the inside of the building for inspection purposes. Up to a maximum of two (2) attempts will be made to enter the building. Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 15 of 20 o Prepare up to approximately sixty-five (65) individual parcel exhibits (plan view only) for CITY and parcel owner coordination purposes. o Prepare Excel spreadsheet summarizing by address the location, direction, type and size for City and Contractor's reference. o Coordinate and attend meetings with the owners up to sixty-five (65) parcels, of up to one (1) hour duration each, to present and deliver temporary construction easement documents along with opt in/opt out agreement forms for water service replacement options. CITY to provide agreement forms as approved by the City attorney. o It is assumed that parcel owner will not be awarded any payment for easements and for entering upon their lands to replace the lead service lines and therefore appraisal and negotiations is not included in the scope. o A boundary survey of the parcel for easement exhibits is not included in the scope; a meets and bound legal description of the temporary construction easement will be included on the exhibit. • Include appropriate information in the plans to show the existing service location, replacement location, and building inspection photographs. It is assumed that contractor will be required to replace the restore the disturbed areas to existing conditions and no additional improvements will be required on private property. Deliverable: Lead Service Investigation spreadsheet; temporary construction easement exhibits, plans and specifications for lead service replacement. Items Not Included in the Scope: Boundary survey of parcels and appraisals and negotiations. TASK 11 &TASK 12 — PRE-FINAL (90%) AND FINAL (100%) CONTRACT PLANS Scope of Work: These services will include preparing pre-final and final contract plans, specifications and bid documents to CITY Standards to insure the proper bidding and award of a construction project. The specific scope for the contract plan services is further provided below: a. Design Standards: The Engineering and Contract Documents will be developed according to applicable regulatory agency requirements. These include the following design guidelines and ordinances: • CITY of Elgin standards and details; • Standard Specifications for Sewer and Water Main Construction in Illinois; • IDOT Standard Specifications; • IEPA NPDES Phase II regulations for Stormwater Pollution Prevention Plans (SWPPP); and • Kane County Stormwater Ordinance. • Fox River Water Reclamation District (FRWRD) standard details if applicable. b. Plans, Specification and Bid Documents: ENGINEER will develop and assemble the contract plans and special provisions for a local letting based on the selection of the construction limits and in accordance with the approved 60% plans in PART A. Plans Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 16 of 20 will be prepared in AutoCAD Civil 3D software. Plans will be developed to predetermined milestones for submittal which will consist of pre-final (90%) and final (100°/x) engineering plans and bid documents of the selected limits. Comments received will be addressed and a disposition of comments provided to the CITY. The general nature of improvements within the project limits will include construction of new storm or sanitary sewer, water main replacements, sanitary and water service replacements, sewer lining, pavement patching and full width resurfacing along impacted roadways. The areas of water main needing replacements and sizing of the water mains will be provided by the CITY. A typical set of contract plans will include the following minimum sheets: • Cover Sheet; • Index/General Notes/Standards; • Summary of Quantities; • Typical Sections; • Maintenance of Traffic—Typical and Notes; • Removal Plans; • Plan and Profile Sheets; • Schedules & Tags; • Erosion Control Plan; • Restoration Plans; and • Standard CITY and IDOT Construction Details. Typical Final Bid Documents will include: • Bid forms - Notice to Bidders, Instructions to Bidders, Bonding and Insurance Requirements • Contract Terms and Conditions; • Special Provisions; • Stormwater Pollution Prevention Plan (SWPPP); • Approved Permits; and • Contract Plans. c. Clean Construction or Demolition Debris (CCDD) Certification: N/A. This was completed in PART A. d. Backflow Prevention Design: Outfalls 13, 14 and 15 of the City's combined sewer outfalls will require backflow prevention to prevent backwater into the system from the river. Based on the approved preliminary engineering plans and specifications for each of the outfalls, ENGINEER will prepare pre-final (90%) and final (100%) engineering plans and bid documents of the backflow prevention to include in the bid documents. TASK 13 — PUBLIC INFORMATION MEETING Scope of Work: ENGINEER will work with CITY staff to schedule one (1) public informational meeting for the project. ENGINEER will attend the public information meeting to solicit feedback and to answer any questions pertaining to impacts to affected properties, project Amendment#3—Scope of Services Combined Sewer Separation Project—Phase II Bluff City Boulevard Basin City of Elgin, IL Page 17 of 20 duration and other pertinent items. The location for the public informational meeting will be identified and organized by the CITY. Deliverable: ENGINEER will prepare necessary exhibits and handouts for the public meeting. TASK 14— PROGRESS MEETINGS Scope of Work: Leading up to and at the following design milestones i.e. pre-final (90% plan submittal), the ENGINEER will attend up to two (2) progress meeting at the CITY to coordinate and discuss the CITY's review comments on the contract plans and specifications. This will allow CITY Staff and ENGINEER to discuss design elements, project progress, permitting, and costs at each of these above milestones to ensure that the project is progressing within budget and on schedule. Deliverable: ENGINEER will prepare minutes of the meetings and distribute to all attendees. TASK 15— IDOT COORDINATION MEETINGS Scope of Work: ENGINEER will attend up to one (1) coordination meetings with IDOT to present the 90% plans and obtain concurrence for permitting purposes. Deliverable: Provide plans and exhibits to assist in meeting discussions. In addition, coordination with Fox River Water Reclamation District (FRWRD) is anticipated and included in the scope. Scope will include permit coordination with the regulatory agencies. Deliverable: One (1) copy of each of the permit application(s) will be provided for CITY records. Items Not Included in the Scope: For the purposes of the scope, it is assumed that permits other than those noted above are not required and are therefore not included in the scope.
