RESOLUTION
AUTHORIZING EXECUTION OF AN EMERGENCY INTERCONNECTION
AGREEMENT WITH ILLINOIS-AMERICAN WATER COMPANY
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS,
that Sean R. Stegall, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby
authorized and directed to execute an Emergency Interconnection Agreement on behalf of the
City of Elgin with Illinois-American Water Company to provide potable water to the Illinois-
American Water Company on an emergency basis in connection with the Rollins Service Area, a
copy of which is attached hereto and made a part hereof by reference.

EMERGENCY INTERCONNECTION AGREEMENT BETWEEN THE CITY OF ELGIN
AND THE ILLINOIS-AMERICAN WATER COMPANY
This Emergency Interconnection Agreement(the"Agreement,"herein)is made and entered
into this 13th day of April , 2016, by and between the City of Elgin, an
Illinois home rule municipal corporation ("Elgin," herein), and Illinois-American Water
Company, an Illinois corporation("Illinois American,"herein).
WITNESSETH
WHEREAS, Elgin is the owner and operator of a public water supply and distribution
system in and around the City of Elgin, Illinois, and currently has capacity available to provide
potable water for Illinois American's service area on an emergency basis, as hereinafter defined;
and
WHEREAS, Illinois American currently provides water service to approximately 89
customers within a service area commonly known as"Rollins,"said service area being depicted as
Area 1 on Exhibit A,attached hereto and incorporated herein by this reference(the"Service Area,"
herein); and
WHEREAS,Illinois American desires to install and operate,at its sole cost and expense,an
emergency interconnection to the public water supply system with a packaged meter station and
pressure reducing valve, as further described in Exhibit B, attached hereto and incorporated herein
by this reference (the "Interconnection Facilities," herein), in order to provide a backup water
supply for the Service Area in the event of an emergency.
NOW,THEREFORE, for and in consideration of the mutual covenants and agreements set
forth herein, and other good and valuable consideration, the sufficiency of which is hereby
acknowledged, it is mutually agreed between the Elgin and Illinois American as follows:
1. Definitions. All words contained in this Agreement shall be as defined in the
Elgin Municipal Code, unless otherwise specifically provided for herein.
A. "Emergency" as used in this Agreement shall mean any temporary and unexpected
disruption of the designed and established manner of public water supply
production and distribution resulting from, without limitation, an act of God, a
catastrophe, or major system failures for an extended period of time exceeding
twelve (12) hours, and which results in low water pressure or low water storage
levels that endanger public safety, public health, or fire prevention or suppression
efforts.
B. "Emergency conditions" as used in this Agreement shall mean a temporary period
of time as a result of an emergency,during which Illinois American's potable water
distribution system is experiencing water pressure at or below thirty-five (35)
pounds per square inch.

2. Construction of Improvements. Illinois American shall construct, or cause to be
constructed, the Interconnection Facilities described in Exhibit B. The Interconnection Facilities
shall be owned by Illinois American, and Illinois American shall be solely responsible for the
operation and maintenance thereof. The Interconnection Facilities shall be designed, permitted,
constructed, tested and maintained by Illinois American at its sole costs and expense. The
Interconnection Facilities shall be constructed on property that is owned and maintained by Illinois
American, on easement that is owned and maintained by Illinois American, or within the public
right of way that is owned by Kane County. Illinois American will endeavor to have the
Interconnection Facilities substantially installed and operational by September 30, 2016. The
Interconnection Facilities shall be subject to the following conditions, to-wit:
A. The location of any connection to the Elgin water supply system and the
method of effecting such connection to the Illinois American system shall be as described
in Exhibit B and subject to the approval of Elgin, and the work of effecting any such
connection shall not be started until any such approval has been granted in writing by the
Water Operations Director of the City of Elgin.
B. Illinois American shall submit engineering plans and specifications
regarding such proposed connection to Elgin's Water Director for approval. The
connection by Illinois American to Elgin's water supply shall be as directed and approved
by Elgin's Water Director. The connection to Elgin's water supply shall be performed in
conformance with all applicable Elgin ordinance requirements and other applicable
requirements of law.
C. The connection shall be provided with a water measuring device meeting
Elgin's specifications and capable of remote reading along with a water metering pit.
D. The connection shall be provided with a check valve to be mounted close to
the water measuring device, as approved by Elgin, in such a manner as to prevent the flow
of water from Illinois American to Elgin. In addition, a valve on each side of the meter
shall be provided.
3. Connection and Initiation Fee. In further consideration, within thirty (30) days
of the entry into this Agreement and before initiation of any connection for emergency water
service to the Service Area by Elgin, Illinois American shall pay Elgin a one-time fee in the lump
sum amount of Seven Thousand One Hundred Thirty Dollars ($7,130.00). Such fee shall be in
addition to any other charges and fees otherwise provided for in this Agreement.
4. Water Supply. Elgin agrees to supply to Illinois American,on an emergency basis
only, water that is consistent in quality with the water delivered to Elgin's customers for use by
Illinois American's customers located within the Service Area. Illinois American shall not
provide water supplied by Elgin to any persons or properties located outside the Service Area
without the prior written consent of Elgin.
A. Emergency Basis. Elgin's water supply shall be available to Illinois
American on an emergency basis and in emergency conditions only. Emergency

conditions shall not include interruptions of service due to regular maintenance,
replacement or repair of Illinois American's water supply facilities. In the event that
Illinois American believes that emergency conditions exist, Illinois American shall advise
Elgin of its determination prior to availing itself of Elgin's water supply or as soon
thereafter as possible. Illinois American's determination that emergency conditions exist
shall be subject to the review and approval of Elgin, in its sole discretion. Illinois
American shall be required to take appropriate steps to reestablish the Illinois American
water supply to the Service Area as soon as practicable in order to discontinue the
emergency use of Elgin's water supply.
B. Water Quality. Water to be delivered at the point of delivery by Elgin and
received by Illinois American hereunder shall be of the same quality as that provided to
customers within the corporate limits of the City of Elgin from the Elgin system. Water
quality after the point of delivery is the responsibility of Illinois American, and Illinois
American will protect the quality of any water provided by Elgin and delivered within the
Service Area. In addition to any other protections set forth in this Agreement, this
protection will also include, but shall not be limited to, the following procedures:
i. Constructing the Interconnection Facilities in accordance with
specifications approved by the Illinois Environmental Protection Agency (IEPA)
and Elgin;
ii. Requiring plumbing to be constructed in accordance with the
Illinois Plumbing Code and the Elgin Municipal Code;
iii. Enforcing the cross-connection regulations of the Illinois Pollution
Control Board (IPCB), Illinois American's tariffs, and the Elgin Municipal Code;
iv. Performing water sampling and analysis of distribution samples as
required by the IEPA, Elgin, or other regulatory agencies having jurisdiction.
C. Water Quantity. Elgin agrees to supply water to Illinois American for
emergency use within the Service Area only, and not for non-emergency domestic use by
Illinois American customers. Flows shall be limited to a maximum hourly rate
not-to-exceed 1,000 gallons per minute; provided, however, that there shall be no flow
restrictions for fire flow demand or for testing the fire flow capacity of the system. Illinois
American agrees to maintain its water distribution system within the Service Area in good
order to prevent water waste.
5. Water Metering.
A. Location of Meters. Illinois American, at its sole cost and expense, shall
furnish, install, and replace as may be necessary, a meter to measure water usage at each
point of connection to the Elgin water system ("Connection Point,"herein). The location
of each such meter shall be subject to Elgin's review and approval, subject to Elgin's sole
discretion.

B. Type of Meters. The meter at each Connection Point shall be a
turbine-type meter with strainers and check valves approved by Elgin. Such meters shall
be capable of reading rate and quantity, and shall include telemetering equipment to permit
remote reading for measuring the quantity of water delivered under this Agreement.
Illinois American shall install a hydraulic flow control valve on each side of the meter at
each Connection Point to limit flows to the rate set forth in paragraph 4.0 of this
Agreement. Each meter shall be installed in an above-ground station to allow for
maintenance.
C. Reading and Recording. Elgin shall read the meter at each Connection
Point in accordance with its then-current ordinances,regulations,practices and procedures,
as may be from time-to-time amended.
D. Access, Testing and Calibration. Each party shall have the right to access
the meters at the Connection Points, the backflow control devices, and the recording
instruments for the purpose of testing accuracy or calibration. Such tests shall be made
only after giving the other party at least five (5) days prior written notice of the time and
place that such tests are to be performed. In addition,meters shall be tested and calibrated
annually, at Illinois American's sole cost and expense. Such annual testing shall be
performed by Elgin and paid for by Illinois American in accordance with the billing
procedures set forth in paragraph 6 of this Agreement.
E. Illinois American Maintenance Responsibility. Illinois American shall
continuously maintain and operate the meter at each Connection Point at its sole cost and
expense, and shall cause the same to be promptly repaired or replaced when necessary or
upon reasonable written notice from Elgin. There shall be no compensation to Illinois
American for reversal of flow through the meter. If a reversal of flow occurs, Illinois
American shall take such measures that are necessary to ensure that the backflow control
valve is functioning properly.
6. Charges,Rates, Notice and Payment.
A. Water Service Charges. The price to be paid for the furnishing of water
under this Agreement by Illinois American to Elgin shall be 1.75 times the water rates
established and collected for water furnished by Elgin to consumers within Elgin's
corporate limits, in accordance with the Elgin rate ordinance in effect at the time the water
is supplied to Illinois American, as may be from time-to-time amended. In addition,
Illinois American shall pay Elgin an annual water availability charge equal to 1.75 times
the water availability charge established and collected from consumers within Elgin's
corporate limits,in accordance with the Elgin rate ordinance in effect at the time the annual
water availability charge is incurred by Illinois American, as may be from time-to-time
amended. A copy of the current rate ordinance is attached hereto as Exhibit C and
incorporated herein by this reference. Illinois American shall not be entitled to, and
hereby waives, any notice of rate changes or any other changes to the Elgin Municipal
Code, including but not limited to any changes to the water and sewer regulations set forth

in chapters 14.04 and 14.08 thereof, or of any standalone water regulations or ordinances
that may be adopted by Elgin.
B. Billing and Payment. Elgin shall bill Illinois American in accordance with
its then-current ordinances, regulations, practices and procedures, as may be from
time-to-time amended. Illinois American shall pay said bill within twenty (20) days of
receipt. Late payments shall bear interest at the rate of one and one-half percent (1 '/2 %)
per month.
C. Nonpayment; Disconnection. In addition to any other remedies available
to Elgin under this Agreement, the failure of Illinois American to make any payment
provided for under this Agreement by the date on which it is due shall constitute grounds
to shut-off and/or disconnect Illinois American's water service, in accordance with the
applicable provisions of Chapter 14.04 of the Elgin Municipal Code.
7. Elgin's Right to Inspect and Review. Elgin's Water Director, or any other
employee so authorized by Elgin, upon reasonable notice first given to Illinois American, shall
have the right to inspect the Interconnection Facilities at any time to see that the same are being
operated in compliance with Elgin, State, and Federal requirements, as well as with the terms,
provisions and conditions of this Agreement. Illinois American shall not unreasonably delay any
inspection by Elgin.
8. Continuity of Service — Conditions. Elgin reserves the right to curtail, reduce,
suspend, discontinue, or terminate the emergency water service to Illinois American provided for
in this Agreement at any time that Elgin determines that it would be in the public interest to do so,
in Elgin's sole discretion. Elgin shall not be liable for damages,whether for breach of contract or
otherwise, for failure, suspension, diminution, or other variation of service occasioned by any
cause, including without limitation any act or omission of Elgin or any of its employees or agents,
and regardless of whether such person, act or omission was, or may be deemed as, negligent. In
addition to the foregoing, such causes include,but are not restricted to, acts of God or of the public
enemy,acts of the State or Federal government in either its sovereign or contractual capacity; fires,
flood, epidemics, quarantine restrictions, strikes, or failure or breakdown of transmission or other
facilities.
9. Construction and Maintenance. Illinois American agrees that the improvements
described herein shall be erected and maintained at all times in a safe, neat, sightly and good
physical condition and in accordance with all requirements of the Elgin Municipal Code, 1976, as
amended. During the term of this Agreement, Illinois American shall, at Illinois American's sole
cost and expense,maintain the Interconnection Facilities in good condition and in compliance with
any applicable requirements of law. Elgin shall review the quality of the construction and
maintenance and, upon written notice of Elgin stating in general terms how and in what manner
maintenance is required, Illinois American shall be required to perform such maintenance, unless
such maintenance is contrary to the rules and regulations of the Illinois Commerce Commission,
Illinois Environmental Protection Agency, or other government regulatory body. If Illinois
American fails to do so, then Elgin shall have the right to perform such maintenance, the full and

complete cost of which shall be borne by Illinois American. Illinois American covenants and
agrees to reimburse Elgin its full cost and expense for any such maintenance.
10. Compliance with Law. Illinois American shall adhere to and comply with all
ordinances, laws, rules and regulations that may pertain to or apply to work and/or subject matter
of this Agreement. Illinois American agrees and warrants that it has procured or shall procure any
licenses, permits or like permission required by law, if any, to conduct or engage in the work
described herein, that Illinois American will procure all additional licenses, permits or like
permission hereinafter required by law during the term of this Agreement, and that Illinois
American will keep the same in full force and effect during the term of this Agreement. Illinois
American shall perform under this Agreement in accordance with all applicable legal
requirements.
11. Insurance. Illinois American shall maintain at all times during the term of this
Agreement,at Illinois American's sole cost,a policy or policies of comprehensive general liability
coverage on an occurrence basis from an insurance company licensed with the State of Illinois or
other insurer approved by Elgin with at least $1,000,000.00 single limit coverage on all risks.
Such policy or policies shall provide that the coverage afforded thereunder shall not be canceled,
terminated or materially changed until at least thirty (30) days written notice has been given to
Elgin. Illinois American shall name Elgin as additional insured and shall furnish Elgin with
duplicate policies or certificates evidencing insurance in force as required herein prior to
undertaking any of the work contemplated by this Agreement. Evidence of payment of premiums
shall be delivered to Elgin at least thirty (30) days prior to the expiration dates of each existing
insurance policy. This insurance shall apply as primary insurance with respect to any other
insurance or self-insurance programs afforded to Elgin. There shall be no endorsement or
modification of this insurance to make it excess over other available insurance; alternatively,if the
insurance states that it is excess or prorated, it shall be endorsed to be primary with respect to
Elgin.
12. Indemnification. Notwithstanding anything to the contrary in this Agreement, to
the fullest extent permitted by law, Illinois American hereby agrees to and shall save Elgin and its
officials, officers, employees, attorneys, agents, servants, boards and commissions harmless from
and against and shall indemnify the Elgin from and against any and all losses, liabilities, damages,
claims, judgments, fines, suits, demands, costs, interest and expenses of any kind or nature
whatsoever (including, but not limited to, reasonable attorney's fees and expenses) asserted
against or incurred by the Elgin in connection with any claim, proceeding or judgment (and the
defense thereof) arising out of or resulting from the terms or performance of this Agreement,
and/or Illinois American's connection to the Elgin water supply system, and/or Elgin's provision
of water to Illinois American and/or Illinois American's customers under this Agreement. Illinois
American voluntarily waives any and all such claims, both present and future, that may be made
against Elgin, and covenants not to sue Elgin for any such claims.
In the event of any action against Elgin,its officials,officers, employees, attorneys,agents,
servants, boards and commissions by the foregoing duty to indemnify, defend and hold harmless,
such action shall be defended by legal counsel of the Elgin's choosing. Illinois American, on
behalf of themselves and their successors, assigns and grantees further hereby acknowledge the

propriety, necessity and legality of this Agreement and all of the terms thereof, including, without
limitation, the obligations to indemnify and hold Elgin harmless, and do further hereby agree and
do waive any and all rights to any and all legal or challenges or defenses to this Agreement and the
terms hereof. The provisions of this paragraph 12 shall survive any expiration, completion and/or
termination of this Agreement.
13. Breach and Limitation on Damages. If either party violates or breaches any term
of this Agreement, such violation or breach shall be deemed to constitute a default, and the other
party shall have the right to seek such administrative, contractual or legal remedies as may be
suitable for such violation or breach; provided, however, that in no event shall Elgin be liable to
Illinois American and/or any of their successors, assigns and/or grantees or any other related
person or entity for monetary damages of any kind relating to or arising from any breach of this
Agreement, and that no action of any kind shall be commenced by Illinois American against Elgin
for monetary damages. In the event any legal action is brought by Elgin for the enforcement of
any of the obligations of Illinois American related to or arising from this Agreement and Elgin is
the prevailing party in such action, Elgin shall be entitled to recover from Illinois American
reasonable interest and attorney's fees. The provisions of this paragraph 13 shall survive any
expiration, completion and/or termination of this Agreement.
14. No Special Duty or Third Party Beneficiaries; Non-waiver of Immunities. It is
agreed and understood with respect to Elgin that the services referred to in this Agreement,
including but not limited to Elgin's provision of water to Illinois American, are general services
only and that no special duties or obligations are intended nor shall be deemed or construed to be
created by this Agreement. It is further agreed and understood that this Agreement is not intended
nor shall be construed to alter,limit, or constitute a waiver of any of the civil immunities afforded
Elgin and/or its officials, officers, employees and/or agents pursuant to the Local Governmental
and Governmental Employees Tort Immunity Act at 745 ILCS 10/1-101, et seq., as amended,
and/or any other immunities afforded to Elgin as otherwise provided by law, it being agreed that
all of the civil immunities as set forth in such Act, as amended, and/or as otherwise provided by
law shall fully apply to any claims asserted or which might be asserted against Elgin and/or its
respective officials, officers, employees and/or agents as a result of this Agreement or any actions
of the parties pursuant to this Agreement. Without limiting the foregoing, it is further agreed and
understood that Elgin and/or its respective officials, officers, employees and/or agents, as a result
of this Agreement or any of the actions of Elgin pursuant to this Agreement, shall not be liable to
any other person or entity for failure to provide adequate water, fire protection or emergency
service,failure to suppress or contain a fire, and/or for any other act or omission in connection with
Elgin's provision of water to Illinois American under to this Agreement. Notwithstanding
anything to the contrary in this Agreement, it is agreed and understood that no third party
beneficiaries are intended or shall be construed to be created by the provisions of this Agreement
and it is the intention of the parties hereto that no action may be commenced by any person or
entity against Elgin and/or its respective officials, officers, employees, agents and/or other related
persons or entities for monetary damages for any alleged breach or failure to provide services
described in this Agreement. The provisions of this paragraph 14 shall survive any expiration
and/or termination of this Agreement.
15. No Vested Right. Notwithstanding any expenditure of money, time and/or labor

by Illinois American pursuant to this Agreement, Illinois American agrees that this Agreement
shall in no event be construed to create an assignment coupled with an interest or any vested right
in favor of Illinois American. Illinois American shall expend any time, money or labor pursuant
to this Agreement at Illinois American's own risk and peril.
16. Term and Termination. This Agreement will be in effect for a term of twenty
(20) years from the date first written above. This Agreement may be terminated by either party
for any reason or no reason upon giving one(1)year written notice to the other party. In addition,
this Agreement may be terminated by Elgin upon five(5) days written notice to Illinois American
of a breach of any term or condition of this Agreement,which breach shall not have been remedied
within said five (5) days written notice to Illinois American. In the event of termination of this
Agreement, Illinois American shall not be entitled to receive a refund of any portion of the
consideration paid for this Agreement,nor shall Illinois American be entitled to any compensation
or reimbursement for any costs or expenses incurred in any way arising from this Agreement or
relating to the construction, installation, maintenance and/or removal of any improvements
pursuant to this Agreement, nor any monetary damages of any kind whatsoever.
17. Notices. All notices of communications as provided for herein shall be in writing
and shall be either personally delivered, or sent via certified or registered U.S. Mail, postage
pre-paid,to Elgin or Illinois American at the following address:

18. No Joint Venture or Partnership. This Agreement shall not be construed so as to
create a joint venture, partnership, employment, or other agency relationship between the parties
hereto.
19. No Personal Liability. No official, director, officer, agent or employee of Elgin
shall be charged personally or held contractually liable under any term or provision of this
Agreement, or because of their execution, approval or attempted execution of this Agreement.
20. Joint and Collective Work Product. This Agreement is and shall be deemed and
construed to be a joint and collective work product of Elgin and Illinois American, and as such,
this Agreement shall not be construed against any other party as the otherwise purported drafter of
the same by any court of competent jurisdiction in order to resolve any inconsistency, ambiguity,
vagueness or conflict, if any, in the terms or provisions contained herein.
21. Severability. The terms of this Agreement shall be severable. In the event any of
the terms or provisions of this Agreement are deemed to be void or otherwise unenforceable, for
any reason,the remainder of this Agreement shall remain in full force and effect.
22. Governing Law. This Agreement shall be subject to and governed by the laws of
the State of Illinois. The exclusive venue for the resolution of any disputes or the enforcement of
any rights arising out of or in connection with this Agreement shall be in the Circuit Court for the
Sixteenth Judicial Circuit, Kane County, Illinois.
23. References in Agreement. All references in this Agreement to the singular shall
include the plural where applicable, and all reference to the masculine shall include the feminine
and vice versa. If either reference shall be declared invalid, such decision shall not affect the
validity of any remaining portion that shall remain in full force and effect.

24. Multiple Counterparts. This Agreement may be executed in multiple
counterparts, each of which shall be deemed an original, but all of which together shall constitute
one and the same instrument.
25. Paragraph Headings. Paragraph headings are inserted for convenience only and
in no way limit or define the interpretation to be placed upon this Agreement.
26. Binding Agreement on Parties. This Agreement shall be binding on the parties
hereto and their respective successors and permitted assigns.
27. Assignment. This Agreement and the obligations herein may not be assigned
without the express written consent of each of the parties hereto, in each party's sole discretion.
Any rights granted herein are personal to Illinois American. Any attempt to assign, transfer, or
convey ay right, title or interest in and to this Agreement without the written consent of Elgin,
which consent shall be in Elgin's sole discretion, will automatically terminate the Agreement and
any rights, title or interest granted to Illinois American hereunder, provided, however, that the
Illinois American shall still be responsible for any and all obligations undertaken by it pursuant to
this Agreement.
28. Entire Agreement. This Agreement and its exhibits constitute the entire
agreement and understanding between the parties and supersedes any prior agreement or
understanding relating to the subject matter of this Agreement.
29. Modification. This Agreement may be changed, modified or amended only by a
duly-authorized written instrument executed by the parties hereto. Each party agrees that no
representations or warranties shall be binding upon the other party unless expressed in writing
herein or in a duly-authorized and executed amendment hereof

AN ORDINANCE
ESTABLISHING FEES FOR VARIOUS CITY SERVICES,PERMITS,LICENSES,
USE OF FACILITIES AND OTHER MA 11 ERS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That the fees, charges and rates for 2016 as set forth in the User Fees
Exhibit from the adopted 2016 Budget 2016-2018 Financial Plan, attached hereto as Exhibit 1,
be and the same are hereby established for the various city services, permits, licenses, use of
facilities and other matters as set forth in such attached User Fees Exhibit.
Section 2. If any provision, clause, sentence, paragraph, section or part of this
ordinance including the user fees exhibit attached hereto,or the application thereof to any person
or circumstance shall, for any reason, be adjudged by a court of competent jurisdiction to be
unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of
this ordinance and the application of such provision to other persons or circumstances, but shall
be confined in its operation to the provision, clause, sentence, paragraph, section or part thereof
directly involved in the controversy in which such judgment shall have been rendered and to the
person or circumstance involved. It is hereby declared to be the legislative intent of the city
council that this ordinance would have been adopted had such unconstitutional or invalid
provision,clause, sentence,paragraph, section or part thereof had not been included.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 4. That this ordinance shall be in full force and effect from and after
January 1,2016.

User Fees
OVERVIEW
User fees are services and/or goods provided by local government which are financed by charging the individual
user. These services and/or goods benefit only the user, hence the term "User Fee." The amount charged is,
typically,directly related to the cost of providing the service.
One of the guiding principles adopted in the budget calls for regular,justifiable user fee increases when necessary.
As a part of the regular review of operations, user fees are compared to the cost of providing the service. If a
subsidy exists, it should be justified in terms of the public purpose being served. Within the Recreational Fund and
Cemetery Operating Fund, all user fees generated by each respective fund will be committed, as defined by the
City's policy of fund balance classification and disbursement, for use of each funds purpose with the exclusion of
perpetual care revenue which will be maintained separately from the Cemetery Operating Fund in accordance with
the Elgin Code of Ordinances.
User Fees are broken down into three categories: Community Services, Regulatory and Administrative, and
Quality of Life.

COMMUNITY SERVICES
Community Services are those fees associated with everyone in a community, such as utilities. For Elgin, those
fees would be directly associated with the Water and Sewer Funds. These fees are commonly established to fully
recover the cost of the activity or service. The advantage of charging these costs as user fees, rather than as part
of the property tax is that the fees can be calculated based upon usage.
SEWER RATES
The following rates and fees are established and shall be collected for sanitary sewer service furnished by the city
to any user in the city:
For all properties connected to the city water system which are also served by a sanitary sewer, directly or
indirectly connected to any sewer owned or maintained by the city, a rate is established as follows for each one
hundred cubic feet of water supplied by the city or such quantity of water used as determined by the Fox River
Water Reclamation District for billing purposes,whichever is less.
For all properties which are not connected to the city water system which are served by a sanitary sewer, directly
or indirectly connected to any sewer owned or maintained by the city,rates identified below shall apply.

The following rates are established and shall be collected for all water furnished by the city to any consumer in the
city for purposes other than fire protection:

Special services shall be billed at the prevailing water rates or, if temporary meter service is not feasible, a
substantially equivalent rate will be determined by the city manager.

REFUSE COLLECTION
The city of Elgin contracts with Waste Management to provide weekly residential waste collection and recycling
services to single-family residential households, detached single-family households with five units or less, condos
and townhouses.The city offers unlimited recycling and any amount of trash over the standard 64-gallons can be
disposed of using pre-paid refuse stickers or pre-paid bags. Curbside recycling service has been provided since
2002 and allows residents to combine all recyclables in one container (also referred to as "single stream") rather
than separate paper and plastics. Elgin's solid waste program offers free yard-waste collection in October,
November and April.
The city's solid waste collection and disposal services fee has been established pursuant to Elgin Municipal Code
Section 9.24.125 in the dollar amount per month of the City's costs to provide Curbside Collection Service. Such
fees for are set forth in the table below.
Additional rates shall apply for the following goods or services:
• In recognition of the additional costs associated with providing street rake-out leaf collection,the City's street rake-
out leaf collection fee has been established pursuant to the Elgin Municipal Code Section 9.24.125 in the dollar
amount per month of the City's costs to provide such additional street rake-out leaf collection service
• Refuse stickers for excess trash,bulk items and yard waste sold by the city of Elgin and local vendors.
• Appliance stickers for discarded household appliances such as hot water heaters, dishwashers, refrigerators,
freezers,stoves,washers,dryers,dehumidifiers,and air conditioner sold by the city of Elgin and local vendors.

QUALITY OF LIFE
Quality of Life reflects those fees which are associated with a broad array of public services that generally add to
the quality of life in a community that that all the residents do not requires such as parks and recreation
programming.These services in Elgin are associated with the Recreation and Golf Funds. Ideally, the fees for these
services are designed to cover the costs, however, at times a subsidy is provided to make them more equitable for
the entire community.
Communities have traditionally been charged user fees for some parks and recreation services and activities, but
the level of cost recovery varies significantly. Cost recovery rates for those services or activities which are
enterprise in nature or whose users have the ability to pay are often at or even above 100 percent. Cost recovery
rates for those activities which have a social service component or whose users have limited ability to pay are often
low and the majority of funding for these services are subsidized by general tax revenues. Given that user fees
have been traditionally charged for these types of services and activities, there is already a public expectation that
a percentage of costs are recovered through user fees. This also gives parks and recreation departments a higher
degree of control over their fiscal condition that administrative or central support departments.

Priority Classification"B"pertains to all Elgin citizens, organizations, businesses, and Elgin private and public schools and
pertains to organizations with one or more athletic teams that participate in leagues that are located either inside or outside of
Elgin, that play their home games on Elgin fields. Included are American Legion of Elgin, Elgin Masters Softball League, and
Elgin 12"Fast Pitch League.
Priority Classification"C"(nonresident)pertains to any organizations, private businesses,leagues or teams from outside of
Elgin city limits wishing to use Elgin fields for practice and league games. Included are Illinois Suburban Baseball League,
Illinois Suburban Soccer League,and Men's Adult Baseball League.

Centre Operations Manager and/or Centre Customer Service Manager shall have the authority to implement
periodic promotional programs or discounts as an incentive to generate additional or renewed memberships.
Centre Operations Manager and/or Centre Customer Service Manager shall have the authority to reduce the
room rental rates for the Banquet Room, Gymnasium, Studios and Conference Rooms subject to the
following conditions:
A, A potential customer has presented a written proposal from a bona fide competitor that is quoting a
price for the rental of a competing room facility at a rate that is less than the rate established by the
city for a similar product;
B. Centre Operations Manager and/or Centre Customer Service Manager reasonably believes that the
potential customer will contract for services with the competing facility unless the applicable room
rental rate is reduced in an amount that makes the city facility competitive with the rival written
proposal;
C. Centre Operations Manager and/or Centre Customer Service Manager reduces the applicable room
rental rate in the smallest amount necessary to secure a contract with the potential customer; and
0, Except as otherwise provided in this paragraph, the fee reduction will not exceed twenty-five percent
(25%) of the applicable room rental rate established by this ordinance unless the rental includes food
or bar packages. Centre Operations Manager and/or Centre Customer Service Manager may reduce
the room rental rates in excess of twenty-five percent(25%)of the applicable room rental established
by this ordinance provided the proposed fee reduction is reviewed and approved by the city manager
or his or her designee.

Credit card service fee of 500(+250)per credit card transaction will be deducted from lessee gross sales.

The above equipment rates do not include the cost of the operation. Except where otherwise indicated, the rates
are on a per contract basis.
*The Stage Movie Screen and Full Stage Black will be charged at the backdrop rate if moved from their standard
positions over the stage.
"Standard Pit Configuration will be at stage level. Orchestra Pit Cover fee will apply if cover is used at Golden
Circle level or if fully lowered.
***Follow Spots: No fee will be charged for follow spots operated by Hemmens staff. Equipment rental fees will
apply for follow spots operated by renter's personnel. At least one Hemmens operator is required when spots are
operated from Projection Booth.
Under normal use, clean up service is included in the base rental. However, at the discretion of the Cultural Center
Director, sponsoring organizations will be assessed for clean-up service when the building is left unusually messy
or dirty. Open Rehearsals ARE NOT considered normal use and will be charged at event rate or will have
additional charges for custodial services applied.
Discounts:
Individuals and organizations with not-for-profit status will receive a 35% discount off the base building rental
rate upon receipt of appropriate documentation.
- Elgin resident individuals and organizations will receive a 25%discount off the base building rental rate.
• Elgin not-for-profit organizations which rent the Hemmens Cultural Center on fifty or more separate days
within a calendar year will receive a volume discount of a 50% discount off the base building rental rate, the
applicable labor rates of Hemmens personnel and the applicable rental rate of Hemmens-owned equipment.
For purposes of clarification, no other individual or group shall receive a discount on labor charges or
equipment rental charges.
A 100% discount on building rental shall be given for weekday (Monday-Thursday) events presented by
School District U-46, Kane County, the State of Illinois,or the United States Government.
Only one of the discounts listed above may be applied per contract. Discounts are only available to renters
whose accounts are current.
