HomeMy WebLinkAbout16-118 Resolution No. 16-118 RESOLUTION AUTHORIZING EXECUTION OF ADDENDUM NO. 2 TO COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF ELGIN AND CLERICAL/TECHNICAL EMPLOYEE GROUP/SEIU MUNICIPAL DIVISION, LOCAL 73 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Richard G. Kozal, City Manager, and Kimberly A. Dewis, City Clerk, be and are hereby authorized and directed to execute on behalf of the City of Elgin addendum no. 2 to collective bargaining agreement between the City of Elgin and Clerical/Technical Employee Group/SEIU Municipal Division, Local 73, a copy of which is attached hereto and made a part hereof by reference. s/David J. Kaptain, Mayor Presented: August 24, 2016 Adopted: August 24, 2016 Omnibus Vote: Yeas: 9 Nays: 0 Attest: s/Kimberly Dewis Kimberly Dewis, City Clerk ADDENDUM NO. 2 TO COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF ELGIN AND CLERICAL/TECHNICAL EMPLOYEE GROUP/SEIU MUNICIPAL DIVISION, LOCAL 73 THIS ADDENDUM NO. 2 to a collective bargaining agreement is made and entered into as of the 24th day of August, 2016, by and between the City of Elgin (herein called the "City") and the Service Employees International Union Local 73 Clerical/Technical Group (herein called the "Union"). WHEREAS, the City and the Union have previously entered into a collective bargaining agreement with a term of December 19, 2011 through December 31, 2016 (herein called the "Agreement"); and WHEREAS, Article IX, Section 1 of the Agreement entitled "Wages" provides in part that the parties agree to a reopener for wages for the years 2014, 2015 and 2016 for the purpose of discussing wage settlements for such years; and WHEREAS, the City and the Union have previously entered into Addendum No. 1 dated November 5, 2014,providing for a wage settlement for the year 2014; and WHEREAS, Article IX, Section 1 of the Agreement further provides that effective January 1, 2015, and January 1, 2016 employees covered by the Agreement shall receive hourly wage increases commensurate with wage increases provided to the City's police or fire bargaining units or to non-bargaining unit management employees, whichever is the greatest(the so-called "me too"provision); and WHEREAS, the wage increases provided to the City's police bargaining unit, fire bargaining unit and the City's non-bargaining unit employees were in the amount of 2.5% across-the-board hourly wage increases for 2015 and 2016; and WHEREAS, the City and the Union wish to agree to a final wage settlement for Union employees covered by the Agreement at this time to be effective during the fiscal year commencing January 1, 2015, and retroactive to January 1, 2015, and to be effective during the fiscal year commencing January 1, 2016, and retroactive to January 1, 2016. NOW, THEREFORE, IT IS AGREED by the City and the Union as follows: 1. Article IX, Section 1 of the Agreement entitled "Wages" be and is hereby further amended as follows: The following additional provisions are added to such section as follows: "Effective at the beginning of the next payroll period immediately following the execution of Addendum No. 2 by both parties, employees covered by this Agreement who are still on the active payroll as of the beginning of such next payroll period shall receive a 2.5% across-the-board hourly wage increase retroactive to January 1, 2015 for the period of January 1, 2015 through December 31, 2015. The foregoing 2.5% across-the-board hourly wage increase retroactive to January 1, 2015 is the final settlement and resolution of the reopener for wages and the wage settlement to be effective during the fiscal year commencing January 1, 2015, and is the final settlement and resolution of the so-called "me-too" provision with respect to wage increases for the period of January 1, 2015 through December 31, 2015, for employees covered by the Agreement. Effective at the beginning of the next payroll period immediately following the execution of Addendum No. 2 by both parties, employees covered by this Agreement who are still on the active payroll as of the beginning of such next payroll period shall receive a 2.5% across-the-board hourly wage increase retroactive to January 1, 2016. The foregoing 2.5% across-the-board hourly wage increase retroactive to January 1, 2016 is the final settlement and resolution of the reopener for wages and the wage settlement to be effective during the fiscal year commencing January 1, 2016, and is the final settlement and resolution of the so-called "me-too" provision with respect to wage increases for the period of January 1, 2016 through December 31, 2016, for employees covered by the Agreement." 2. Except as amended in this Addendum No. 2, and as previously amended in Addendum No. 1, the Agreement between the City and the Union shall be in force and effect. IN WITNESS WHEREOF, the parties hereto have entered into and executed this Addendum No. 2 as of the date and year first written above after ratification by Union membership and approval by the city council.
