RESOLUTION
AUTHORIZING EXECUTION OF A SECOND AMENDMENT TO
ANNEXATION AGREEMENT WITH ORLEANS HOMES RHIL, YURS, INC.,
DONALD YURS, TRUSTEE UNDER TRUST NO. 405 and REHM-YURS, LLC
(Stonebrook Subdivision Units 1 and 2)
WHEREAS,the owner of certain property commonly known as Units 1 and 2 of Stonebrook
Subdivision has proposed that the annexation agreement between the owner and the City of Elgin
concerning said property be amended; and
WHEREAS, after due notice as required by law,a public hearing on said proposal was held
by the corporate authorities of the City of Elgin; and
WHEREAS, the proposed Second Amendment to Annexation Agreement with Orleans
Homes RHIL,Yurs,Inc.,Donald Yurs,Trustee under Trust No.405 and Rehm-Yurs,LLC, is in the
best interests of the City of Elgin.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS, that David J. Kaptain, Mayor, and Kimberly A. Dewis, City Clerk, be and are
hereby authorized and directed to execute,on behalf of the City of Elgin,the Second Amendment to
Annexation Agreement with Orleans Homes RHIL,Yurs,Inc.,Donald Yurs,Trustee under Trust No.
405 and Rehm-Yurs, LLC, a copy of which is attached hereto.

SECOND AMENDMENT TO ANNEXATION AGREEMENT
(Stonebrook Subdivision Units 1 and 2)
THIS SECOND AMENDMENT TO ANNEXATION AGREEMENT (hereinafter
referred to as the "Second Amendment") is made and entered into this 24th day of
June , 2015 by and between the City of Elgin, Illinois, a Municipal Corporation,
of the Counties of Cook and Kane, in the State of Illinois (hereinafter referred to as the "City");
Orleans Homes RHIL, an Illinois limited partnership (hereinafter referred to as "Owner" or
"Developer"); Yurs, Inc., an Illinois corporation (Yurs Inc.); Donald Yurs, Trustee under Trust
No. 405 (Donald Yurs as Trustee); and Rehm-Yurs, LLC, an Illinois limited liability company
(Rehm-Yurs).
WITNESSETH
WHEREAS, the City; Laura Helen Yurs as Trustee under Trust Agreement dated
October 18, 1991 and known as Laura Helen Yurs Trust No. l; Donald E. Yurs as Trustee under
Trust Agreement dated October 18, 1991 and known as Donald E. Yurs Trust No. 1; and B&B
Properties of Illinois, Inc., an Illinois corporation entered into an annexation agreement dated
April 13, 2005 regarding the property commonly known as the Stonebrook Subdivision and
legally described therein (such Annexation Agreement is hereinafter referred to as the
"Annexation Agreement" and such property is hereinafter referred to as the "Subject Property");
and
WHEREAS, Owner is a successor in title and owns a portion of the Subject Property
known as Units 1 and 2 of the Stonebrook Subdivision, being legally described in Exhibit A,
which is attached and made a part hereof (which real property, for convenience, is hereinafter
referred to as the "Units 1 and 2 of the Stonebrook Subdivision"); and
WHEREAS, Yurs Inc., Donald Yurs as Trustee and Rehm-Yurs are successors in title to
various other portions of the Subject Property other than Units 1 and 2 of the Stonebrook
Subdivision and the portion of the Subject Property known as the Cedar Grove Subdivision; and
WHEREAS, the Annexation Agreement was amended on May 27, 2015, by Resolution
No. 15-76, entitled "Resolution Authorizing Execution of a First Amendment To Annexation
Agreement With Ryland Group, Inc. (Stonebrook Development-Cedar Grove Subdivision) to
allow for additional single-family detached homes within the portion of the Subject Property
known as the Cedar Grove Subdivision; and
WHEREAS, the Owner now desires to further amend said Annexation Agreement to
develop single family lots within Units 1 and 2 of the Stonebrook Subdivision with additional
building elevations and floor plans, such as are depicted in Exhibit B which is attached hereto
and made a part hereof(the "Building Elevations and Floor Plans").
WHEREAS, the Owner desires to amend the ordinances classifying the portions of the
property in the Group Exhibit "C" to the Annexation Agreement for the areas of the subject
property identified in Exhibit "C-1" such Group Exhibit C-1 being the zoning exhibit map
prepared by Glen D. Krisch Land Surveyor, Inc. dated last revised April 5, 2005, and only
pertaining to land encompassing Units 1 and 2 of the Stonebrook Subdivision; and
WHEREAS, the City desires to accommodate Owner's desire to so amend such Group
Exhibit "C" specifically those ordinances as described within Paragraph 3.A., Subparagraph (i)
describing PSFR2 Planned Single Family Residence District Ordinance G44-05, Subparagraph
(ii) describing PSFR2 Planned Single Family Residence District Ordinance G23-06 and
Subparagraph (iii) describing PSFR1 Planned Single Family Residence District Ordinance G43-
05; and
WHEREAS, Owner, Yurs Inc. and the City desire to provide for the completion of the
conveyance to the City of Public Park Parcel 8 identified in the preliminary plat attached as
Exhibit D to the Annexation Agreement pursuant to the provisions with respect thereto as
described herein; and
WHEREAS, the parties hereto desire to approve and ratify the Annexation Agreement as
amended; and
WHEREAS, the City has held the public hearings on the proposed amendment to the
annexation agreement and the proposed amended PSFR1 and PSFR2 zoning ordinances as
required by law.
NOW, THEREFORE, for and inconsideration of the premises and the mutual promises
and agreements herein contained and pursuant to the authority and conditions given and
contained in the statutes of the State of Illinois, the parties hereby agree as follows:
A. This Second Amendment to Annexation Agreement is made pursuant to and in
accordance with the provisions of Section 11 of the Illinois Municipal Code (65 ILCS 5/11-
15.1.1 et seq.), and in the exercise of the home rule power of the City.
B. The "Building Elevations and Floor Plans" exhibit attached as Exhibit "H" to the
Annexation Agreement is hereby expanded to permit the building elevations and floor plans as
depicted in Exhibit B of this amendment on the one hundred and ten (110) lots (Lots 53-61, 66-
74, 75-85, 86-89, 92-100, 120, 130-132, 146-148, 161-163, 168 and Parcel 25 within Unit 1 as
referenced within the Final Plat for Stonebrook Unit No. 1; and specifically Lots 62-65, 133-145,
149-160, 164-167 and 169-192 within Unit 2 as referenced within the Stonebrook Preliminary
Plat Exhibit D) located within Units 1 and 2 of Stonebrook Subdivision.
C. Group Exhibit C to the Annexation Agreement being the PSFR1 Planned Single
Family Residence District Ordinance G43-05, the PSFR2 Planned Single Family Residence
District Ordinance G44-05 and PSFR2 Planned Single Family Residence District Ordinance
G23-06 is hereby amended as set forth in Group Exhibit C attached hereto and made a part
hereof by this reference. The City agrees to adopt said amended PSFR1 and PSFR2 ordinances
within thirty (30) days following the entry into and execution of this amendment.

D. Within thirty (30) days of the entry into this Second Amendment the Owner shall
convey to the City that portion of Public Park Parcel 8 owned by the Owner.
E. Within thirty (30) days of the entry into this Second Amendment Yurs Inc. shall
convey to the City that portion of Public Park Parcel 8 owned by Yurs Inc. It is agreed and
understood that such conveyance by Yurs Inc. shall not include the rectangular parcel at the
northwest corner of Public Park Parcel 8 depicted on Exhibit D hereto and identified as parcel
05-26-100-037 (hereinafter referred to as the "Omitted Parcel"). In consideration of Omitted
Parcel not being included in the conveyance of Public Park Parcel 8 by Yurs Inc. to the City
Yurs Inc. shall pay to the City concurrently with the conveyance of the remaining portion of
Public Park Parcel 8 to the City the sum of Five Thousand Dollars ($5,000). It is further agreed
that such Omitted Parcel is hereby otherwise deleted and removed from the Annexation
Agreement and the terms and provisions thereof.
F. Within thirty (30) days of the entry into this Second Amendment, Yurs, Inc. shall
provide to the City the original executed Final Plat of Stonebrook Unit No. 1-A in the final form
as approved by the City for recording by the City.
G. Parcel 25 in the recorded Final Plat for Unit 1 may be built upon with a home
subject to the same terms, conditions and requirements for other lots within such Unit 1. Prior to
any construction on Parcel 25 a plat of resubdivision in a form approved by the City shall be
recorded for such Parcel 25 which among other matters shall depict and provide for the
easements and building setback line as provided for the other lots within such Unit 1 and as
depicted on the Final Plat easement/building setback line detail. The sanitary sewer service line
and the water service line to service Parcel 25 shall be constructed by the Owner on or before
December 31, 2015.
H. The City acknowledges and agrees that the Preliminary Plat for the Yurs Property
and the Orleans Property consisting of Units 1 and 2 of the Stonebrook Subdivision and the
planned developments for each of such properties are in full force and effect and have not
expired.
I. The parties hereto hereby agree to, approve and ratify the Annexation Agreement
and all of the terms thereof, as amended.
J. This Second Amendment may be executed in counterparts, each of which shall be
an original and all of which shall constitute one and the same agreement.
K. In the event of any conflict between the terms of the Annexation Agreement and
the terms of this Second Amendment, the terms of this Second Amendment shall control. In all
other respects, the Annexation Agreement shall remain in full force and effect, as amended.

AN ORDINANCE
AMENDING PSFR1 PLANNED SINGLE FAMILY RESIDENCE DISTRICT
ORDINANCE NO. G43-05
(Stonebrook Subdivision—901-1000 Corron Road - Tracts 1,6,11,12, andl3)
WHEREAS, the territory herein described has previously been annexed to the City of
Elgin and originally classified in the PSFR1 Planned Single Family Residence District under
Ordinance No. G43-05; and
WHEREAS, written application has been made to amend PSFR1 Planned Single Family
Residence District Ordinance No. G43-05 to permit additional single-family models constructed
with street-facing forward-oriented garages on certain lots within Stonebrook Subdivision Units
1 and 2; and
WHEREAS, the City Council of the City of Elgin, Illinois, adopted a Comprehensive
Plan and Design Guidelines on February 9, 2005 through ordinance G18-05; and
WHEREAS, the adopted comprehensive plan includes guidelines that provide that new
single family homes in planned residential developments be constructed with street-facing
garages that are designed and oriented to be recessed behind the main residential façade; and
WHEREAS, the new single-family models will be constructed with street-facing garages
that will be designed and oriented to be in front of the main residential façade which would be a
departure from the design guidelines of the comprehensive plan; and
WHEREAS, after due notice in the manner provided by law the Planning and Zoning
Commission conducted public hearings concerning said applications and has submitted its
written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin, Illinois, has reviewed the findings and
recommendations of the Planning and Zoning Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated May 4, 2015, and the recommendations made by the Community Development
Department and the Planning and Zoning Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That Ordinance No. G43-05 entitled "An Ordinance Classifying Newly
Annexed Territory in the PSFR1 Planned Single Family Residence District (Stonebrook
Subdivision — 901 and 1000 Corron Road — Tracts 1,6,11,12,13)," passed April 13, 2005, be and

is hereby amended only as set forth in this ordinance by amending Section G.13, entitled
"Supplementary Conditions"through the addition of Subparagraph "d"to read as follows:
"d. New home models constructed with street-facing garages shall be allowed to
extend in front of the main residential facade for a distance no greater than six (6) feet on
Lots 53-61, 66-74, 75-85, 86-89, 92-100, 120, 130-132, 146-148, 161-163, 168 and
Parcel 25 within Unit 1; and Lots 62-65, 133-145, 149-160, 164-167 and 169-192 within
Unit 2 of Stonebrook Subdivision.
And subject to the following conditions:
1. Substantial conformance with the Petitioner's Application, Statement of Purpose,
Consent and Disclosure and attachments dated January 29, 2015.
2. Substantial conformance with the house plan exhibits prepared by Orleans Homes dated
February 3, 2015, for each model proposed as follows:
a. Fordham (Two-story) — 2,810 square feet (58'-0"x41'-0") — containing the
Homestead, Manor, Low Country and Craftsman elevation options.
b. Prescott (Two-story) — 2,927 square feet (50'-0"x41'-8") — containing the Manor,
Low Country and Craftsman elevation options. The Homestead elevation option will
not be permitted for construction within Units 1 and 2 of Stonebrook.
c. Essex (Two-story) — 3,321 square feet (50'-0"x41'-0") — containing the Homestead,
Manor, Low Country and Craftsman elevation options.
d. Stirling (Two-story) — 3,369 square feet (50'-0"x52'-0") — containing the Manor,
Low Country and Craftsman elevation options. The Homestead elevation option will
not be permitted for construction within Units 1 and 2 of Stonebrook.
e. Stockton (Two-story) — 3,384 square feet (50'-0"x53'-0") — containing the
Homestead, Manor, Low Country and Craftsman elevation options.
3. Substantial conformance with the Final Plat of Subdivision for Stonebrook Unit No. I —
recorded on March 14, 2008. A final plat of subdivision for Unit 2 will need to be
approved prior to construction of homes within such unit.
4. Substantial conformance with the ALTA/ACSM Land Title Survey for Stonebrook Units
1 and 2 (referenced as Parcels 1 and 2 within such survey), prepared by Terra Technology
Land Surveying, Inc., and dated April 17, 2014.
5. Substantial conformance with the Stonebrook Preliminary Plat Exhibit "D" and detailed
Sheet 2 of 4 encompassing Units 1 and 2, prepared by Land Vision Inc., dated January 7,
2005.
6. The additional home models referred to in this amendatory ordinance shall be restricted
to the 110 lots within Units 1 and 2 of Stonebrook Subdivision — specifically Lots 53-61,
66-74, 75-85, 86-89, 92-100, 120, 130-132, 146-148, 161-163, 168 and Parcel 25 within
Unit 1 as referenced within the Final Plat for Stonebrook Unit No. 1; and specifically

7. Homes with a garage forward orientation will be allowed on no more than 33 lots (30%)

agents will be required to complete all subdivision improvements within the Subdivision
as outlined within the Permit Availability Letter prepared by the Community
Development Department and dated August 4, 2014.
9. Compliance with all applicable codes and ordinances."
Section 3. That except as amended herein, the use and development of the Subject
Property shall be controlled pursuant to the provisions of Ordinance No. G43-05. In the event of
any conflict between this ordinance, which expressly includes those documents detailed within
Section 2 and the allowances and departures described and provided thereon, and Ordinance No
G43-05, this ordinance and associated documents shall control and prevail.
Section 4. That this ordinance shall be full force and effect immediately after its passage
in the manner provided by law.

Department and the Planning & Zoning Commission, a copy of which is attached hereto and
made a part hereof by reference as Exhibit A.
Section 2. That Ordinance No. G23-06 entitled "An Ordinance Classifying Newly
Annexed Territory in the PSFR2 Planned Single Family Residence District (Stonebrook
Subdivision — 901 and 1000 Corron Road— Tract 22)," passed March 22, 2006, be and is hereby
EXHIBIT C.3
amended only as set forth in this ordinance by amending Section G.13, entitled "Supplementary
Conditions" through the addition of Subparagraph "d"to read as follows:
"d. New home models constructed with street-facing garages shall be allowed to
extend in front of the main residential facade for a distance no greater than six (6) feet on
Lots 53-61, 66-74, 75-85, 86-89, 92-100, 120, 130-132, 146-148, 161-163, 168 and
Parcel 25 within Unit 1; and Lots 62-65, 133-145, 149-160, 164-167 and 169-192 within
Unit 2 of Stonebrook Subdivision.
And subject to the following conditions:
1. Substantial conformance with the Petitioner's Application, Statement of Purpose,
Consent and Disclosure and attachments dated January 29, 2015.
2. Substantial conformance with the house plan exhibits prepared by Orleans Homes dated
February 3, 2015, for each model proposed as follows:
a. Fordham (Two-story) — 2,810 square feet (58'-0"x41'-0") — containing the
Homestead, Manor, Low Country and Craftsman elevation options.
b. Prescott (Two-story) — 2,927 square feet (50'-0"x41'-8") — containing the Manor,
Low Country and Craftsman elevation options. The Homestead elevation option will
not be permitted for construction within Units 1 and 2 of Stonebrook.
c. Essex (Two-story) — 3,321 square feet (50'-0"x41'-0") — containing the Homestead,
Manor, Low Country and Craftsman elevation options.
d. Stirling (Two-story) — 3,369 square feet (50'-0"x52'-0") — containing the Manor,
Low Country and Craftsman elevation options. The Homestead elevation option will
not be permitted for construction within Units 1 and 2 of Stonebrook.
e. Stockton (Two-story) — 3,384 square feet (50'-0"x53'-0") — containing the
Homestead, Manor, Low Country and Craftsman elevation options.
3. Substantial conformance with the Final Plat of Subdivision for Stonebrook Unit No. 1 —
recorded on March 14, 2008. A final plat of subdivision for Unit 2 will need to be
approved prior to construction of homes within such unit.
4. Substantial conformance with the ALTA/ACSM Land Title Survey for Stonebrook Units
1 and 2 (referenced as Parcels 1 and 2 within such survey), prepared by Terra Technology
Land Surveying, Inc., and dated April 17, 2014.
5. Substantial conformance with the Stonebrook Preliminary Plat Exhibit "D" and detailed
Sheet 2 of 4 encompassing Units 1 and 2, prepared by Land Vision Inc., dated January 7,
2005.
6. The additional home models referred to in this amendatory ordinance shall be restricted
to the 110 lots within Units 1 and 2 of Stonebrook Subdivision— specifically Lots 53-61,
66-74, 75-85, 86-89, 92-100, 120, 130-132, 146-148, 161-163, 168 and Parcel 25 within
Unit 1 as referenced within the Final Plat for Stonebrook Unit No. 1; and specifically

Lots 62-65, 133-145, 149-160, 164-167 and 169-192 within Unit 2 as referenced within
the Stonebrook Preliminary Plat Exhibit"D."
7. Homes with a garage forward orientation will be allowed on no more than 33 lots (30%)
within Units 1 and 2 of Stonebrook Subdivision.
8. Prior to the issuance of any additional building permits the developer or authorized
agents will be required to complete all subdivision improvements within the Subdivision
as outlined within the Permit Availability Letter prepared by the Community
Development Department and dated August 4, 2014.
9. Compliance with all applicable codes and ordinances."
Section 3. That except as amended herein, the use and development of the Subject
Property shall be controlled pursuant to the provisions of Ordinance No. G23-06. In the event of
any conflict between this ordinance, which expressly includes those documents detailed within
Section 2 and the allowances and departures described and provided thereon, and Ordinance No
G23-06, this ordinance and associated documents shall control and prevail.
Section 4. That this ordinance shall be full force and effect immediately after its passage
in the manner provided by law.
