Adjournment r PROPERTY MAINTENANCE BOARD OF APPEALS MINUTES January 9, 2007 MEMBERS PRESENT: Jay W. Cox, Steve Silva, Bruce Corn, Patrick Hudgens, Gary Lichthardt, and Patrick Hines MEMBERS ABSENT: Ann Stewart STAFF PRESENT: Sheila Caza and Jerry Deering CALL TO ORDER AND ROLL CALL: The meeting was called to order by Chairperson Cox at 5:04 p.m. in the Second Floor Conference Room, North Tower. MINUTES: A motion was made by Steve Silva to approve the minutes from the Regular meeting on October 3, 2006, seconded by Bruce Corn. Vote of 4 to 0. Motion carried and passed unanimously. OLD BUSINESS: None NEW BUSINESS: Appeals process and overall code enforcement changes. Jerry explained to the Board members the difference between code enforcement today and back when the Board was initiated in 1995. In 1995 the department was primarily complaint driven and now we have systematic code enforcement. The Rental Licensing Program has increased the level of code enforcement and increased the number of properties that are now inspected. Electrical codes, ceiling heights and a few other old building issues were brought to the Board for review, however since the Boards primary function is to verify that the code official cited the correct code; limitations are put on the Board. The City has been able to grant administrative exceptions to some and others were forced to comply with the current codes. Jerry and the Board did meet to discuss how the City could better serve the concerns of the community regarding code violations. Since that time, Jerry has been meeting with the applicants and working with them to resolve the Page 2 Property Maintenance Board of Appeals Minutes - January 9, 2007 issues and concerns prior to ever filing an appeal. The Board has not heard an appeal since this process was put into place. Recently, some of the Board members have been getting calls from concerned citizens regarding the new no nuisance violations and issuance of citations. A more thorough explanation to the Board was given explaining how the City's process doesn't allow appeals thru the Property Maintenance Board of Appeals. Jay requested a list of the citations that are issued. Pat Hudgens asked for a list of the different types of citations we issue and the activity. He would also like to have a list of the most common violations that are receiving citations. The City will check into providing that list prior to the next meeting. The Board also requested a copy of the new 2003 International Property Maintenance Code with amendments. Jerry ended with an explanation of how his goal for the coming year is to better communicate with not only the staff, but to the citizens within the community when it comes to code enforcement. DISCUSSION: Pat Hudgens asked " Do we have inspectors for commercial and industrial properties.?" Yes, we have one inspector who specializes in only those properties. Another concern was the number of inspectors we have for the amount of growth within the City. We have added weekend code enforcement and a new position is still waiting to be filled. ADJOURNMENT: A motion was made by Patrick Hudgens to adjourn the meeting at 5:50 p.m., seconded by Pat Hines. Vote of 5 to 0. Motion carried and passed unanimously. Meeting adjourned. Cox,Steve Silva, Bruce Corn, Patrick Hudgens, Gary Lichthardt, Ann Stewart and Patrick Hines MEMBERS ABSENT: none STAFF PRESENT: Sheila Caza and Matt Fitzgibbons CALL TO ORDER AND ROLL CALL: The meeting was called to order by Chairperson Cox at 5:04 p.m. in the Second Floor Conference Room, North Tower. MINUTES: A motion was made by Patrick Hudgens to approve the minutes from the Regular meeting on January 9, 2007, seconded by Bruce Corn. Vote of 6 to 0. Motion carried and passed unanimously. OLD BUSINESS: Matt went through the 2007 code activity with a slide presentation that updated the Board on how the department is doing as a whole. NEW BUSINESS: Election of new officers for 2008. A motion to nominate Jay W. Cox for Chairperson was made by Patrick Hines, seconded by Ann Stewart. Vote of 7 to 0. Motion carried and unanimously approved. A motion for vice-chairperson was made by Patrick Hines to nominate Bruce Corn, seconded by Gary Lichthardt. Vote of 7 to 0. Motion carried and unanimously approved. ADJOURNMENT: A motion was made by Bruce Corn to adjourn the meeting at 5:40 p.m., seconded by Gray Lichthardt. Vote of 7 to 0. Motion carried and passed unanimously. Meeting adjourned.
