ELGIN LIQUOR CONTROL COMMISSION MEETING
January 8,2020
The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dixon, Gavin, Lopez, Shaw
and Chairman Kaptain. Absent: None.
Approval of Minutes
Commissioner Gavin made a motion, seconded by Commissioner Dixon,to approve the minutes
of the December 4, 2019 meeting. Upon a roll call vote: Yeas: Commissioners Dixon, Gavin,
Lopez, and Chairman Kaptain. Nays: None. Abstain: Commissioner Shaw.
Public Hearing on consideration of a Class E-3 Liquor License Application,Fex Xin Inc.
d/b/a Elgin Buffet located at 300 South McLean
Corporation Counsel Cogley provided an overview of the application. He noted that the
application was for a change of ownership. Currently the location holds a Class F and the new
owner would like the Class E-3 to retain the video gaming machine license at the location. He
stated that if this application was approved the application for video gaming would be heard at
the next meeting. Staff recommended approval subject to conditions outlined in the memo.
Commissioner Gavin made a motion, seconded by Commissioner Dixon,to approve the Class E-
3 liquor license application for Fex Xin Inc. d/b/a Elgin Buffet located at 300 South McLean
subject to the conditions outlined in the memo. Upon a roll call vote: Yeas: Commissioners
Dixon, Gavin, Lopez, Shaw and Chairman Kaptain. Nays: None.
Miscellaneous
Commissioner Dixon asked for clarification regarding the licensing process for cannabis
establishments. Corporation Counsel Cogley explained that the city would not issue a license,
but outlined the zoning and other controls in place to monitor this type of business. He noted the
state of Illinois will be issuing the licenses for this business model.

The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dixon, Gavin, Lopez, Shaw
and Chairman Kaptain. Absent: None.

Commissioner Dixon made a motion, seconded by Commissioner Shaw,to approve the minutes
of the January 8, 2020 meeting. Upon a roll call vote: Yeas: Commissioners Dixon, Gavin,
Lopez, and Chairman Kaptain. Nays: None.•Abstain: Commissioner Shaw.
Application for Five(5) Video Gaming Terminal Licenses,Fex Xin Inc. d/b/a Elgin Buffet

Corporation Counsel Cogley provided an overview of the application. He noted that the
application was fora change of ownership. Currently the location has five video gaming
machines. Staff recommended approval subject to conditions outlined in the memo.

Public Hearing on consideration of a Class E-2 Liquor License Application,Kelles Group

Corporation Counsel Cogley provided an overview of the liquor license application. He noted
there would be no video gaming at the location and the establishment would have the standard

operating hours. Staff recommended approval subject to conditions outlined in the memo. There
was discussion regarding the status of the build-out at the location.
Commissioner Gavin made a motion, seconded by Commissioner Dixon, to approve the liquor
license application for the Class E-2, for Kelles Group LLC d/b/a Gabutto Burger located at 2502
North Randall Road subject to the conditions outlined in the memo. Upon a roll call vote: Yeas:
Commissioners Dixon, Gavin, Lopez, Shaw and Chairman Kaptain. Nays: None.

The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dixon, Gavin, Lopez, Shaw
and Chairman Kaptain. Absent: None.
Approval of Minutes
Commissioner Gavin made a motion, seconded by Commissioner Dixon, to approve the minutes
of the February 12, 2020 meeting. Upon a roll call vote: Yeas: Commissioners Dixon, Gavin,
Lopez, and Chairman Kaptain. Nays: None. Abstain: Commissioner Shaw.
Public Hearing on consideration of a Class F-2 Liquor License Application,Lark& Owl
Eatery LLC.d/b/a Lark& Owl Eatery located at 219 Walnut Avenue
The applicant requested the hearing be held at the next Liquor Commission meeting.
Consideration of Proposed Amendment to City's Liquor Code to Provide for a Wine Club
permit
Corporation Counsel Cogley outlined the current status of this location. He noted it was an event
space that was looking to add a monthly wine club. The proposed amendment would allow a
monthly wine club, for certain liquor license class holders, in which patrons could sample a wine
and purchase a bottle to take home. He outlined the hours the tastings could take place,business
plan requirements, and the annual cost of the permit.
There was discussion regarding the wine club concept,monthly events, if patrons could bring in
liquor, and food service requirements.
Commissioner Gavin made a motion, seconded by Commissioner Dixon,to approve the wine
club ordinance as presented. Upon a roll call vote: Yeas: Commissioners Dixon, Gavin, Lopez,
Shaw, and Chairman Kaptain. Nays: None.
Representatives from The Highland Lofts asked if the ordinance would be in place prior to an
event being planned for.March 28, 2020 at their location. They noted that the tasting event was
for a craft spirit and not a wine. There was discussion regarding the definition of a craft spirit.
Also discussed was the sale of bottles for off-premise consumption.

Commissioner Dixon made a motion, seconded by Commissioner Lopez,to authorize the mayor
to approve,upon approval of ordinance, and ratify with the Liquor Commission a wine club
permit application,that meets all requirements for The Highland Lofts. Upon a roll call vote:
Yeas: Commissioners Dixon, Gavin, Lopez, Shaw, and Chairman Kaptain. Nays: None.
Miscellaneous
Commissioner Gavin asked about the new state law to allow establishment to have up to six
video gaming terminals. Corporation Counsel Cogley explained the city's current cap on the
number of video gaming licenses allowed in the city. He noted that the establishments seeking
to add machines.can make that request in conjunction with their liquor license renewal. These
requests would be presented with the liquor license renewals at the April meeting.
Public Comment
Sue Webb asked questions regarding the application for the Lark& Owl and what was allowed
under the Class F-2 license they were seeking.

The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dixon, Lopez(4:37 via
telephone), Shaw and Chairman Kaptain. Absent: None.
Chairman Kaptain stated: I have determined that requiring an in person meeting by all of the
members of the liquor commission for this liquor commission meeting is not practical or prudent
given the COVID-19 disaster, and that electronic attendance via video or audio conference by
members of the liquor commission shall be permitted.
Approval of Minutes
Commissioner Shaw made a motion, seconded by Commissioner Dixon,to approve the minutes
of the March 4, 2020 meeting. Upon a roll call vote: Yeas: Commissioners Dixon, Shaw and
Chairman Kaptain. Nays: None.

Corporation Counsel Cogley provided an overview of the liquor license application. This
application is a change of ownership and Mr. Cogley noted there would be no video gaming at
the location with the establishment having standard operating hours. There was an exterior sales
area permit that is also for consideration by the commission. Staff recommended approval
subject to conditions outlined in the.memo. .

The meeting was called to.order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dixon, Lopez, Martinez and
Chairman Kaptain. Absent: Commissioner Shaw. Commissioners Dixon and Lopez attended

Corporation Counsel Cogley provided an overview of the liquor license application. He noted
there would be no video gaming at the location and the establishment would have the operating
hours of 6:00 a.m. to 2:00 p.m. Staff recommended approval subject to conditions outlined in the
memo. . .
Commissioner Martinez made a motion, seconded by Commissioner Dixon,to approve the
liquor license application for Class F-2 Liquor License Application, Lark&,Owl Eatery LLC
d/b/a Lark& Owl Eatery located at 219 Walnut Avenue, subject to the outlined conditions.

Corporation Counsel Cogley provided an overview of the liquor license application and the
requirements for a Class F liquor license. He outlined the terms of the conditional use ordinance
G45-17,noting the addition of alcohol would be inconsistent and not in substantial conformity

with the.ordinance. Staff recommended denial of the application. There was discussion
regarding the business concept. There was further discussion regarding the floor plan,barriers to
café and play areas, and safety protocols.
Commissioner Dixon made a motion, seconded by Commissioner Martinez,to table the liquor
license application for Class F liquor license for Bumblebee Play LLC d/b/a Bumblebee Play
Cafe located at 1015 N. Randall Road. Upon a roll call vote: Yeas: Commissioners Dixon,
Lopez, Martinez, and Chairman Kaptain. Nays: None.

The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dixon, Lopez, Martinez,
Shaw and Chairman Kaptain. Absent:None.. Commissioners Dixon'and Lopez attended via

Approval of Minutes
Commissioner Martinez made a motion, seconded by Commissioner Dixon, to approve the
minutes of the August 12, 2020 meeting. Upon a roll call vote: Yeas: Commissioners Dixon,
Lopez, Martinez, and Chairman Kaptain. Nays: None. Abstain: Commissioner Shaw.
Public Hearing on Consideration of a Class G Liquor License Application, City of Elgin
d/b/a Bowes Creek Country Club Located at 1250 Bowes Creek Boulevard
Corporation Counsel Cogley provided an overview of the liquor license application. He noted
that this is a similar situation to the City's other golf course, The Highlands. Staff recommended
approval subject to conditions outlined in the memo.
Commissioner Shaw made a motion, seconded by Commissioner Martinez,to approve the liquor
license application for Class G Liquor License Application, City of Elgin d/b/a Bowes Creek
Country Club Located at 1250 Bowes Creek Boulevard, subject to the outlined conditions. Upon
a roll call vote: Yeas: Commissioners Dixon, Lopez, Martinez, Shaw and Chairman Kaptain.

Consideration of Application for Four Additional Video Gaming Terminal Licenses,
Glogovsky Oil Company d/b/a Elgin Shell Located at 2320 N. Randall Road
Corporation Counsel Cogley provided an overview of the application for four additional video
gaming terminals. Mr. Cogley provided a history of the video gaming license in Elgin,the
reasons a license cap was put in place, and the number of licenses currently issued in the city.
Staff recommended denial of the application.
There was discussion regarding the size of the parcel and the qualifications for a truck stop.
There was further discussion regarding future requests for video gaming licenses and revisiting
increasing the number of licenses in the spring.

Commissioner Shaw made a motion; seconded by Commissioner Dixon,to approve the minutes

Consideration of Bajirao Mastani,Inc. d/b/a Total Liquors located at 823 Summit Street
for a Transfer of Corporate Stock for the Existing Class B Liquor License
Corporation Counsel Cogley provided an overview of the application for the transfer of
corporate stock. Mr. Cogley outlined the reasons this type of application is needed and what
materials are necessary to approve this transfer. Staff recommended approval of the stock
transfer.
Commissioner Shaw made a motion, seconded by Commissioner Martinez,to approve the
transfer of corporate stock for the existing Class B Liquor License of Bajirao Mastani, Inc. d/b/a
Total Liquors located at 823 Summit. Upon a roll call vote: Yeas: Commissioners Dixon,Lopez,
Martinez, Shaw and Chairman Kaptain. Nays: None.
In the Matter of the Retail Alcoholic Liquor Dealers License of Olde Towne Inn,Inc., d/b/a

Corporation Counsel Cogley provided an overview of the complaint including the various
months that the alcoholic liquor tax was not paid and filed properly. He noted that while staff
was asking that this complaint be dismissed at this time, if another complaint is filed for this
location, fines would be imposed.
