ELGIN LIQUOR CONTROL COMMISSION MEETING
October 14, 2015
The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Gavin, Martinez, Powell
(4:32 p.m.), Prigge, Rauschenberger, Shaw, Steffen (4:40 p.m.), and Chairman Kaptain. Absent:
Commissioner Dunne.
Approval of Minutes
Commissioner Gavin made a motion, seconded by Commissioner Martinez to approve the
minutes of the September 9, 2015, meeting. Upon a roll call vote: Yeas: Commissioners Gavin,
Martinez, Prigge, Shaw, and Chairman Kaptain. Nays: None. Abstain: Commissioner
Rauschenberger.
Consideration of a Request by Rambhadra, Inc. Regarding Fee Requirements for a New
Class B Liquor License
Corporation Counsel Cogley outlined the request by Rambhadra Inc. regarding the onetime
$10,000 fee requirement for new Class B liquor license. Mark Schuster, the licensee’s attorney,
presented the request on behalf of Rambhadra, Inc.
There was discussion regarding the circumstances of the request and if there was any precedent
for waiving the fee.
Commissioner Gavin made a motion, seconded by Commissioner Rauschenberger to approve the
request by Rambhadra, Inc. regarding waiving the $10,000 fee requirement for their Class B
liquor license based on unique circumstances and to make necessary changed to the municipal
code. Upon a roll call vote: Yeas: Commissioners Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
Public Hearing on application by J-Krishna Inc d/b/a 7-Eleven #27616 for a Class B-4
Liquor License located at 957 W. Summit Street
Corporation Counsel William Cogley provided an overview of the application noting there was
an existing B-4 license and this was a change in the operator of the franchise owned location.
Staff recommended approval subject to conditions outlined in the memo.

Commissioner Steffen made a motion, seconded by Commissioner Gavin to approve the
application by J-Krishna Inc d/b/a 7-Eleven #27616 for a Class B-4 Liquor License located at
957 W. Summit Street. Upon a roll call vote: Yeas: Commissioners Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.
Public Hearing on applications by Benara Corporation d/b/a Fiesta Mexicana for a Class E
and Class S Liquor License located at 50 North Spring Street
Corporation Counsel William Cogley provided an overview of the applications for Benara
Corporation. He outlined the history of the property and the actions of the previous licensee that
lead to the revocation of the liquor license at this location for one year. Staff recommended
approval subject to conditions outlined in the materials.
The applicant presented an affidavit from the landlord stating that they are not involved in the
operation of the business. It was also noted that the applicant operates restaurants in other
municipalities that have had not issues in regards to the liquor license.
There was discussion regarding parking requirements, the building capacity, the types of events
that would be held, and the food and alcohol sale requirements of the Class E license.
Commissioner Gavin made a motion, seconded by Commissioner Shaw to approve applications
by Benara Corporation d/b/a Fiesta Mexicana for a Class E and Class S Liquor License located at
50 North Spring Street. Upon a roll call vote: Yeas: Commissioners Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.
Adjournment
Commissioner Shaw made a motion, seconded by Commissioner Steffen, to adjourn the meeting.
Upon a roll call vote: Yeas: Commissioners Gavin, Martinez, Powell, Prigge, Rauschenberger,
Shaw, Steffen, and Chairman Kaptain. Nays: None.
