ELGIN LIQUOR CONTROL COMMISSION MEETING
May 6, 2015
The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Dunne, Gavin, Martinez
(arrived at 4:38), Powell, Prigge, Rauschenberger (arrived at 4:33), Shaw, and Chairman
Kaptain. Absent: Commissioner Steffen.
Approval of Minutes
Commissioner Shaw made a motion, seconded by Commissioner Gavin, to approve the minutes
of the April 8, 2015, meeting. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin,
Powell, Prigge, Shaw, and Chairman Kaptain. Nays: None.
Public Hearing on consideration of a Class E-1 Liquor License Application for Dog’s Paw
Brewing LLC d/b/a Dog’s Paw Brewing, located at 74 S. Grove Avenue
Corporation Counsel Cogley provided an overview of the application, noting that this location
recently had been granted the same class of license as Abe Froeman’s and the business had
undergone a re-organization. Mr. Cogley stated they were not pursuing video gaming and that
staff was recommending approval of the application.
Commissioner Gavin made a motion, seconded by Commissioner Powell, to approve the
application, subject to conditions, for a Class E-1 Liquor License Application for Dog’s Paw
Brewing LLC d/b/a Dog’s Paw Brewing, located at 74 S. Grove Avenue. Upon a roll call vote:
Yeas: Commissioners Dunne, Gavin, Powell, Prigge, Rauschenberger, Shaw, and Chairman
Kaptain. Nays: None.
Consideration of an Exterior Sales Permit Application by GruppoF4 Inc., d/b/a Café
Roma, located at 2175 Point Boulevard, Ste. 120
Corporation Counsel Cogley provided an overview of the exterior sales permit application. The
outdoor seating area is already in place on private property and they are asking for permission to
serve alcohol in this area. Mr. Cogley noted that staff was recommending approval.
Commissioner Dunne made a motion, seconded by Commissioner Gavin, to approve the Exterior
Sales Permit Application by GruppoF4 Inc., d/b/a Café Roma, located at 2175 Point Boulevard,
Ste. 120. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw and Chairman Kaptain. Nays: None.

Consideration of an Exterior Sales Permit Application by RJ Marin & Co., Inc. d/b/a Solo
at 13 Douglas Avenue
Corporation Counsel Cogley provided an overview of the application noting the number of tables
and the location of the exterior area. Staff recommended approval subject to entering into a
license agreement for use of the public sidewalk and amendment to Section 6.06.055, Exterior
Sales Permit, of the Municipal Code to add the E-4 liquor license classification.
Commissioner Shaw made a motion, seconded by Commissioner Gavin, to approve the exterior
sales permit application by RJ Marin & Co., Inc. d/b/a Solo at 13 Douglas Avenue subject to
conditions. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
Public Hearing on consideration of a Class E Liquor License Application for Antunez
Group Inc. d/b/a Casa Lara Restaurant, located at 7 Clock Tower Plaza
Corporation Counsel Cogley provided an overview of the Class E application, noting the
requirements for food sales revenue and floor space. There was discussion regarding the type of
entertainment that was planned and the city’s noise ordinance.
Commissioner Gavin made a motion, seconded by Commissioner Martinez, to approve the
application for a Class E Liquor License Application for Antunez Group Inc. d/b/a Casa Lara
Restaurant, located at 7 Clock Tower Plaza. Upon a roll call vote: Yeas: Commissioners Dunne,
Gavin, Martinez, Powell, Prigge, Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
Public Hearing on the Application for a Class E Liquor License of Azteca De Oro
Restaurant Banquets & Events LLC d/b/a Azteca De Oro located at 260 National Street
Corporation Counsel Cogley provided an overview of the Class E application, noting the changes
in the application that removed the nightclub component and added an ice cream parlor.
Attorney Cogley stated that staff was recommending approval with conditions including the
revised floor plans and updated applications. There was discussion regarding the proposed
business plan, noise, and parking concerns. The petitioner was not present to address the
commission’s questions and concerns.
Commissioner Prigge made a motion, seconded by Commissioner Dunne, to continue the
consideration of the application for a Class E Liquor License of Azteca De Oro Restaurant
Banquets & Events LLC d/b/a Azteca De Oro located at 260 National Street until the next
meeting. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.

Consideration of an Exterior Sales Permit Application by Gasthaus Zur Linde, Inc. d/b/a
Gasthaus located at 13-15 North Grove Avenue
Commissioner Gavin made a motion, seconded by Commissioner Shaw, to remove the
consideration of the exterior sales permit application by Gasthaus Zur Linde, Inc. d/b/a Gasthaus
from the table. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
Corporation Counsel Cogley provided an overview of the application and noted that the exterior
sales permit was a discretionary permit that could be issued by the city. The proposed exterior
sales for the establishment would be in two street parking spaces adjacent to the establishment.
Attorney Cogley noted that it was recommended that the permit be denied based on the
establishment continuing to operate outside of its Class U license, by not serving food, and a
recent history of police calls at the location.
There was discussion regarding the location of the exterior area including safety concerns for
patrons. Also discussed were the number and type of police calls to the location and the food
versus alcohol sales. Staff was directed to contact the owner of the establishment to outline the
commissions concerns.
Commissioner Dunne made a motion, seconded by Commissioner Powell to deny the exterior
sales permit application by Gasthaus Zur Linde, Inc. d/b/a Gasthaus located at 13-15 North
Grove Avenue. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.

Commissioner Dunne made a motion, seconded by Commissioner Shaw, to adjourn the meeting.
Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
