The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Gavin, Powell, Prigge, Shaw,
Steffen, and Chairman Kaptain. Absent: Commissioners Dunne, Martinez, and Rauschenberger.
Approval of Minutes
Commissioner Gavin made a motion, seconded by Commissioner Steffen, to approve the
minutes of the December 3, 2014, meeting. Upon a roll call vote: Yeas: Commissioners Gavin,
Powell, Prigge, Shaw, Steffen, and Chairman Kaptain. Nays: None.
Public Hearing on the Liquor License Complaint against 7-Eleven, Inc., d/b/a 7-Eleven
#27616H,957 West Summit Street
Corporation Counsel Cogley provided an overview of the complaint and the proposed agreed
order with a fine of$500.00. He noted that the violation related to the sale to a minor as part of a
routine police department compliance operation and this was the establishment's first violation
of this type of violation.
There was discussion regarding fines and the escalation of the fines if an establishment receives
another violation.
Commissioner Steffen made a motion, seconded by Commissioner Powell, to approve the
stipulation and agreed order regarding the complaint against 7-Eleven, Inc., d/b/a 7-Eleven
#27616H, 957 West Summit Street. Upon a roll call vote: Yeas: Commissioners Gavin, Powell,
Prigge, Shaw, Steffen, and Chairman Kaptain. Nays: None.

Miscellaneous
There was discussion regarding the timing of the liquor license application process, possibly
adding verbiage to the Movie theater liquor license similar to the percentage of food sales to
liquor sales required of some restaurants, and the possibility of a new applicant for the La
Quebrada location at 50 N. Spring Street.

Stop N Shop,located at 455 Bluff City Boulevard
Corporation Counsel Cogley provided an overview of the application noting this was a change in
ownership. Staff recommends approval subject to conditions outlined in the memo.
Commissioner Steffen made a motion, seconded by Commissioner Powell to approve the
Application, subject to conditions, for a Class B-1 Liquor License of Bonalo, LLC d/b/a Stop N
Shop, located at 455 Bluff City Boulevard. Upon a roll call vote: Yeas: Commissioners Dunne,
Gavin, Powell, Prigge, Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.
Public Hearing on the Application for a Class E Liquor License of Azteca De Oro
Restaurant Banquets & Events LLC d/b/a Azeteca De Oro located at 260 National Street
Corporation Counsel Cogley provided an overview of the Class E application, noting the
requirement for revenue and floor space. There was discussion regarding the proximity of the
location to daycare facility. Mr. Cogley stated the there was a distance requirement from certain
entities and that would be verified. He also noted that there was a Class E license held there over
two years ago.
Commissioner Powell made a motion, seconded by Commissioner Steffen to continue the
consideration of the application for a Class E Liquor License of Azteca De Oro Restaurant
Banquets & Events LLC d/b/a Azeteca De Oro located at 260 National Street until March 18,
2015. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.
Miscellaneous
Commissioner Dunne asked for an update at next month's meeting on liquor license
requirements for raffles.

Approval of Minutes
Commissioner Dunne made a motion, seconded by Commissioner Steffen, to approve the
minutes of the January 14, 2015, meeting. Upon a roll call vote: Yeas: Commissioners Dunne,

Public Hearing of a Class G Liquor License Application for G & L Glennwood LLC d/b/a

Assistant Corporation Counsel Christopher Beck provided an overview of the application, noting
that staff was recommending approval of the application.
Commissioner Dunne made a motion, seconded by Commissioner Steffen, to approve the
application, subject to conditions, for a Class G for G & L Glennwood LLC d/b/a Grumpy Goat
Tavern located at 875 Sports Way. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin,
Martinez, Prigge, Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.
Public Hearing of a Class F-1 Liquor License Application for Cows in the Kitchen LTD
d/b/a Burnt Toast Restaurant located at 2492 N. Randall Road and consideration of a
proposed new Class F-2 liquor license classification and the issuance thereof to the

Assistant Corporation Counsel Beck provided an overview of the application. He outlined the
differences in the F-1 and F-2 liquor license classifications. Staff recommends approval of the
ordinance creating the F-2 class and the application subject to conditions outlined in the memo.
There was discussion regarding the percentage of receipts from alcohol sales and if the two
classes should be merged together.

Public Hearing of a Class S Liquor License Application for 231 Douglas LLC d/b/a The
Haight located at 166 Symphony Way and consideration of a proposed new Class S liquor
license classification and the issuance thereof to the applicant
Assistant Corporation Counsel Beck provided an overview of the application noting that the
necessary conditional use approval was on the City Council's agenda that evening. He also,
provided a history of the banquet liquor license and highlighted the proposed Class S liquor
license. Staff recommends approval subject to conditions outlined in the memo.
Commissioner Dunne made a motion, seconded by Commissioner Gavin to approve Class S
Liquor License Application for 231 Douglas LLC d/b/a The Haight located at 166 Symphony
Way and the proposed new Class S liquor license classification and the issuance thereof to the
applicant. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.

Banquets & Events LLC d/b/a Azteca De Oro located at 260 National Street until April 8, 2015.

Shaw, Steffen, and Chairman Kaptain. Nays: None.
Consideration of an amendment to the city's liquor code to authorize limited special

Assistant Corporation Counsel Beck provided an overview of the proposal noting that proposed
ordinance would allow for special promotional sales in conjunction with special promotions and
for only certain liquor license classes.

code to authorize limited special promotion sales of alcoholic liquor in the original package for

There was discussion regarding pending complaints, a review of the various liquor license

There was discussion regarding the revenue figures for the E-3 liquor license classification and
options to simplify the regulations by combining or deleting different license classifications.

There was discussion regarding the requirements for exterior sales permit areas. There were
concerns over various establishments' location of the permitted areas, the safety of patrons, and
the types of materials that were used in these areas.
Commissioner Gavin made a motion, seconded by Commissioner Powell, to table the exterior
sales permit for Gasthaus Zur Linde until May 6, 2015. Upon a roll call vote Yeas:
Commissioners Gavin, Powell Prigge, Rauschenberger, Shaw, Steffen and Chairman Kaptain.

Corporation Counsel Cogley provided an overview of the application noting the number of tables
and the location of the exterior area. Staff recommended approval subject to entering into a
license agreement for use of the public sidewalk and amendment to Section 6.06.055, Exterior
Sales Permit, of the Municipal Code to add the E-4 liquor license classification.
Commissioner Shaw made a motion, seconded by Commissioner Gavin, to approve the exterior
sales permit application by RJ Marin& Co., Inc. d/b/a Solo at 13 Douglas Avenue subject to

Corporation Counsel Cogley provided an overview of the Class E application, noting the changes
in the application that removed the nightclub component and added an ice cream parlor.
Attorney Cogley stated that staff was recommending approval with conditions including the
revised floor plans and updated applications. There was discussion regarding the proposed
business plan, noise, and parking concerns. The petitioner was not present to address the
commission's questions and concerns.

Consideration of an Exterior Sales Permit Application by Gasthaus Zur Linde, Inc. d/b/a
Gasthaus located at 13-15 North Grove Avenue
Commissioner Gavin made a motion, seconded by Commissioner Shaw, to remove the
consideration of the exterior sales permit application by Gasthaus Zur Linde, Inc. d/b/a Gasthaus
from the table. Upon a roll call vote: Yeas: Commissioners Dunne, Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
Corporation Counsel Cogley provided an overview of the application and noted that the exterior
sales permit was a discretionary permit that could be issued by the city. The proposed exterior
sales for the establishment would be in two street parking spaces adjacent to the establishment.
Attorney Cogley noted that it was recommended that the permit be denied based on the
establishment continuing to operate outside of its Class U license, by not serving food, and a
recent history of police calls at the location.
There was discussion regarding the location of the exterior area including safety concerns for
patrons. Also discussed were the number and type of police calls to the location and the food
versus alcohol sales. Staff was directed to contact the owner of the establishment to outline the
commissions concerns.
Commissioner Dunne made a motion, seconded by Commissioner Powell to deny the exterior
sales permit application by Gasthaus Zur Linde, Inc. d/b/a Gasthaus located at 13-15 North

Public Hearing on consideration of a Class B Liquor License Application for Rambhadra

Assistant Corporation Counsel Christopher Beck provided an overview of the application, noting
that the applicant currently hold a Class B license. This application was for a different location
and would operate under a different corporate entity. Mr. Beck noted that the required
Conditional Use was on the City Council agenda and that staff was recommending approval of
the application.
There was discussion regarding a violation for underage sales from 2004 and potentially
prorating annual and one time fees for the applicant.

application, subject to conditions, for a Class B Liquor License Application for Rambhadra Inc.

Assistant Corporation Counsel Christopher Beck provided an overview of complaint and the
proposed dismissal order. Mr. Beck noted that the criminal matter, the basis of the complaint,
had been resolved and the licensee had been found not guilty. Due to this finding it was
recommended that the complaint be dismissed.

product. Mr. Cogley noted that the required conditional use was approved by City Council and

There was discussion regarding the type of products and the amount of floor space that was
allowed.

Discussion of Issues regarding Gasthaus Zur Linde, Inc. d/b/a Gasthaus at 13-15 North
Grove Avenue, Including Compliance with Applicable Liquor License Regulations and
Discussion of Licensee's Request for Reconsideration of the Denial of an Exterior Sales
Permit
Corporation Counsel Cogley provided an overview of the issues regarding Gasthaus Zur Linde at
13-15 North Grove Avenue. The primary areas of concern were the licensee not meeting the
Class U requirement of the regular service of meals and the number of police calls to the
establishment from 2:00 a.m. to 3:00 a.m. Mr. Cogley outlined potential remedies including
changing the class of liquor license; changing the hours of operation; changing the requirement
of food sales to 50%; and requiring a minimum number of dining areas to be maintained.
In a communication to the Legal Department, the Gasthaus Zur Linde asked for reconsideration
of the denial of the exterior sales permit application. Corporation Counsel revisited the issues
that determined the denial including, the location in the street, the lack of food service, and the
previously granted exterior sales permit operated outside the designated hours of operation.
Mr. Cogley addressed retaliation allegations against the Gasthaus Zur Linde for filing litigation
against the city and that being the cause of the liquor commission actions. He stated that was not
the case and the actions were based on the Gasthaus Zur Linde not operating within the Class U
requirements and the number of police calls to the location.
Commissioners expressed their concerns over the number of police calls, the licensee continuing
to operate outside of Class U liquor license requirements and the exterior sales permit.
Charles Muscarello, attorney for the Gasthaus Zur Linde, addressed the commission regarding
their concerns. He noted the licensee's work with the Police Department to decrease the number
of police calls including increasing security and implementing a dress code. He stated that his
client would be open to changing to a Class A license but with the 3:00 a.m. closing time and
asked that the commission reconsider the exterior sales permit as it had been approved in the
past.
Due to the time the commission determined to continue the discussion at the next meeting on
August 12, 2015.

potential dates and times to hold the hearing.

Complaint LC2015-2 on Wednesday October 7, 2015 starting at 4:30 p.m. at the Multipurpose

The meeting was called to order by Chairman Kaptain at 4:30 p.m. in Conference Room 208,
South Wing of Elgin City Hall. Members present: Commissioners Gavin, Martinez, Powell
(4:32 p.m.), Prigge, Rauschenberger, Shaw, Steffen (4:40 p.m.), and Chairman Kaptain. Absent:
Commissioner Dunne.
Approval of Minutes
Commissioner Gavin made a motion, seconded by Commissioner Martinez to approve the
minutes of the September 9, 2015, meeting. Upon a roll call vote: Yeas: Commissioners Gavin,
Martinez, Prigge, Shaw, and Chairman Kaptain. Nays: None. Abstain: Commissioner
Rauschenberger.
Consideration of a Request by Rambhadra, Inc. Regarding Fee Requirements for a New
Class B Liquor License
Corporation Counsel Cogley outlined the request by Rambhadra Inc. regarding the onetime
$10,000 fee requirement for new Class B liquor license. Mark Schuster, the licensee's attorney,
presented the request on behalf of Rambhadra, Inc.
There was discussion regarding the circumstances of the request and if there was any precedent
for waiving the fee.
Commissioner Gavin made a motion, seconded by Commissioner Rauschenberger to approve the
request by Rambhadra, Inc. regarding waiving the $10,000 fee requirement for their Class B
liquor license based on unique circumstances and to make necessary changed to the municipal
code. Upon a roll call vote: Yeas: Commissioners Gavin, Martinez, Powell, Prigge,
Rauschenberger, Shaw, and Chairman Kaptain. Nays: None.
Public Hearing on application by J-Krishna Inc d/b/a 7-Eleven#27616 for a Class B-4
Liquor License located at 957 W. Summit Street
Corporation Counsel William Cogley provided an overview of the application noting there was
an existing B-4 license and this was a change in the operator of the franchise owned location.
Staff recommended approval subject to conditions outlined in the memo.

Public Hearing on applications by Benara Corporation d/b/a Fiesta Mexicana for a Class E
and Class S Liquor License located at 50 North Spring Street
Corporation Counsel William Cogley provided an overview of the applications for Benara
Corporation. He outlined the history of the property and the actions of the previous licensee that
lead to the revocation of the liquor license at this location for one year. Staff recommended
approval subject to conditions outlined in the materials.
The applicant presented an affidavit from the landlord stating that they are not involved in the
operation of the business. It was also noted that the applicant operates restaurants in other
municipalities that have had not issues in regards to the liquor license.
There was discussion regarding parking requirements, the building capacity, the types of events
that would be held, and the food and alcohol sale requirements of the Class E license.
Commissioner Gavin made a motion, seconded by Commissioner Shaw to approve applications
by Benara Corporation d/b/a Fiesta Mexicana for a Class E and Class S Liquor License located at
50 North Spring Street. Upon a roll call vote: Yeas: Commissioners Gavin, Martinez, Powell,
Prigge, Rauschenberger, Shaw, Steffen, and Chairman Kaptain. Nays: None.
