The meeting was called to order by Chairman Schock at 4:04 p.m. in Conference Room A, South
Wing of Elgin City Hall. Members present: Commissioner Gilliam and Warren and Chairman
Schock. Absent: None
Approval of Minutes
Commissioner Gilliam made a motion, seconded by Commissioner Warren, to approve the
minutes of the December 2, 2009, meeting. Yeas: Commissioners Gilliam, Warren, and
Chairman Schock. Nays: None.
License Application
1. Gasthaus Zurlinde, Inc., d/b/a The Gasthaus, located at 15 N. Grove Avenue, for a Class
U license. (They currently hold a Class A license.)
Corporation Counsel William Cogley reviewed the application and noted that an
additional "U" license will need to be created by the city council.
Commissioner Gilliam made a motion, seconded by Commissioner Warren, to approve
the application of Gasthaus Zurlinde, d/b/a Gasthaus Zurline, for a Class U liquor license
and recommended the creation of an additional Class U license. Yeas: Commissioners
Gilliam, Warren, and Chairman Schock. Nays: None.
2. MAB, Inc., d/b/a JB's Pub & Pietro's Pizza, located at 297 S. McLean Boulevard, for a
Class U license. (They currently hold a Class A license.)

Miscellaneous
1. Approval of the 2010 Meeting Schedule
Commissioner Gilliam made a motion, seconded by Commissioner Warren, to approve
the Liquor Control Commission 2010 Meeting Schedule for 2010. Yeas: Commissioners
Gilliam, Warren, and Chairman Schock. Nays: None.
2. Status on Recent Complaints
• Road House
Mr. Cogley reported that noise complaints at the Road House had been recently
received. Decibel checks were conducted by the Police Department and they
were found to be in compliance. He also said that their kitchen has been open and
it appears to be running smoothly.
• Mad Maggie's
Mr. Cogley reported that noise complaints had also been received concerning
Mad Maggie's and that he said that he has talked with owner about this. Sgt.
Young has reported that most of the noise seems to be coming from people in the
courtyard. There have been loud music complaints on Thursday nights and Sgt.
Young said he will set up checks on that night also.

3. Young Adult
Evelyn Ferry, manager of the Gasthaus Zur Linde, asked about having minors in the
establishment listening to music. Mr. Cogley said there was no restriction under the
Class U license, but if a minor were to end up with a drink then the establishment would
be held responsible.

proposed amendment to the City's Liquor code to provide for a Corkage License. Yeas:

The meeting was called to order by Chairman Schock at 4:00 p.m. in Conference Room 208,

Commissioner Warren made a motion, seconded by Commissioner Gilliam, to approve the
minutes of the February 10, 2010, meeting. Yeas: Commissioners Gilliam, Warren, and

License Application
• Kahn, Inc., d/b/a Otter Creek Wine & Spirits, located at 250 S. Randall Road, for a Class B

Corporation Counsel William Cogley reviewed the application for the Commission. The
applicant was present and asked about any regulations regarding home delivery. Mr. Cogley
stated that this would have to be research.
Commissioner Warren made a motion, seconded by Commissioner Gilliam, to approve the
application of Kahn, Inc., d/b/a Otter Creek Wine & Spirits, located at 250 S. Randall Road,
for a Class B Liquor License, subject to Council approval of an additional Class B Liquor
License and issuance of a conditional use permit. Yeas: Commissioners Gilliam, Warren,
and Chairman Schock. Nays: None.
Public Hearing
1. Public Hearing regarding Elgin Hotel, LLC., d/b/a Bennigan's Grill and Tavern, located

Mr. Cogley reviewed the history of the violation noting this is the second violation.
Wendy Cozzi and Migual Guardad, representing the licensee, were present. Mr. Cogley
stated that a Stipulation and Agreed Order had been prepared and the licensee was
waiving appeal.
Commissioner Gilliam made a motion, seconded by Commissioner Warren, to approve
the Stipulation and Agreed Order and to fine the licensee $750 plus costs. Yeas:

holder of a Class A Liquor License; Violation on December 16, 2009, of Elgin Municipal
Code Chapter 6.06 entitled "Alcoholic Liquor Dealers", - Sale of Alcoholic Liquor to a
Minor by Licensee's Agent and Employees
Mr. Cogley reviewed the history of the violation noting this is the third violation. Tim
Muhr and Ed Hernandez were present representing the licensee. Mr. Cogley stated that a
Stipulation and Agreed Order had been prepared and the licensee was waiving appeal.
The licensees were advised that a fourth violation could result in the suspension of their
license and they indicated they understood the consequences.
Councilmember Gilliam made a motion, seconded by Councilmember Warren, to
approve the Stipulation and Agreed Order and to fine the licensee $1,000 plus costs.
Yeas: Commissioners Gilliam, Warren, and Chairman Schock. Nays: None.
3. Sushi Station Elgin, Inc., d/b/a Sushi Station, located at 2486 Randall Road, holder of a
Class E Liquor License, Violation on December 16, 2009, of Elgin Municipal Code

Mr. Cogley reviewed the history of the violation noting this was the first one for the
licensee. Akiyuki Noda was present on behalf of the licensee. Mr. Cogley stated that a
Stipulation and Agreed Order had been prepared and the licensee was waiving appeal.
Councilmember Gilliam made a motion, seconded by Councilmember Warren, to
approve the Stipulation and Agreed Order and to fine the licensee $500 plus costs. Yeas:
Commissioners Gilliam, Warren, and Chairman Schock. Nays: None.
Miscellaneous
• Diana Lange of Club 58 asked the Commissioners if it would be possible to pay the liquor
license renewal fees for 2010/2011 in installments. Chairman Schock said that this would be
considered, but that it would be on a case-by-case basis.
• Chairman Schock asked if the Police Department could do a check of the various package
liquor stores to be sure they are not in violation of the single serving container provision of
the Liquor Code.
• A discussion was held regarding the noise levels at the Main Event and at Mad Maggie's.
Commissioner Gilliam reported that a task force has been formed by the Downtown
Neighborhood Association and the first meeting will be held on March 11, 2010. He noted
that the goal was to have a report submitted within sixty days.

The meeting was called to order by Chairman Schock at 4:00 p.m. in Conference Room 208,

Commissioner Warren made a motion, seconded by Commissioner Gilliam,to approve the
minutes of the August 11, 2010, meeting. Yeas: Commissioners Gilliam, Warren, and Chairman

Miscellaneous
1. Report on Pending Liquor License Complaints
Mike Gehrman, Assistant Corporation Counsel, reviewed pending complaints against the five
following establishments:
• Prachi & Priya, Inc. d/b/a Super Saver Food Mart
• AJ Food Shop, Inc
• KMK Ventrues, d/b/a Rookies Sports Bar
• Pedro DeLara's, Inc., dlb/a Estrellas Del Millenium
• Rodriguez Corporation, d/b/a La Quebrada Restaurant
He said that hearings on these complaints will be set for October 13, 2010, at 4:00 p.m.
2. Proposed Tasting Permit
Mr. Gehrman reviewed the request for a tasting permit. Commissioner Gilliam asked if there
would be a limit on the number tastings allowed. Mr. Neel Patel, owner of Otter Creek Wine
& Spirits, said that he would like to do six off-site tasting per year and that he would like to
do these for organizations. He explained that orders would be taken at the tasting and that
pickup up of the wine sold would be at the store or by delivery, if a delivery ordinance was
approved.
Chairman Schock said that he would like to see anyone else interested in doing this to come
before the Commission to seek approval. He also mentioned that he wants the sales
controlled such that no wine would be delivered at the tasting, that it must be picked up at the
store or by delivery, and that the tasting is limited to wine only. Mr. Patel said that he would
also like to have scotch and beer tastings.

Commissioner Gilliam said that he wants this under control. There will be no additional fee
for this permit, but for on-site tastings it was suggested there be a window on the hours. It
was suggested four hours on Saturdays.
Mr. Gehrman said a proposed ordinance will be presented in October.
3. Proposed Delivery Permit Ordinance
Chairman Schock reviewed Mr. Patel's delivery proposal. He said that the buyer's driver's
license or other form of identification should be registered at the store and then validated at
the time of delivery.
It was also agreed that this permit would not be granted per se, but that any interested Class
B licensee would have to appear before the Commission,present their delivery guidelines,
and seek approval from the Commission.
It was suggested that a letter be sent to all Class B licensees informing them of these
proposed ordinances. The proposed ordinance will be presented in October.
4. Report from Elgin Police Department regarding the proposed Teen Night at Mad Ma gg ie's
Chief Swoboda reported that Lt. Rafferty had met with Tad Kuriata, owner of Mad Maggie's,
and had reviewed the premises. Lt. Rafferty's report indicated that teens would enter at only
one entrance where security would be present. Wrist bands will be stamped and issued. It
was the opinion of the Police Department that the teens can be kept separated from the area
where alcohol is served.
Commissioner Warren said that he was afraid that this is going to be a big enforcement issue.
Chairman Schock said the Mission has been able to do this. Chief Swoboda said that
enforcement will be the responsibility of the establishment's security. The Police
Department is only saying that it is feasible.
Commission Gilliam reminded Mr. Kuriata that the doors should be kept closed to the music
does not disturb the residences across the street. Mr. Kuriata said that he would.
Commissioner Warren said he would support the proposed Teen Night until the first
violation. Commissioner Gilliam suggested this proposal include a six-month probationary
period. Chairman Schock reminded the Commission that the license would automatically
expire in April, 2011.
By consensus it was agreed to approve a teen permit for Mad Maggie's.
