Adjournment A 9 ELGIN LIQUOR CONTROL COMMISSION MEETING January 10, 2007 The meeting was called to order by Liquor Commission Secretary Mecum at 4:35 p.m. in Conference Room 208, South Wing of Elgin City Hall. Members present: Commissioners Gilliam and Walters. Absent: Chairman Schock. Appointment of Chairman Pro Tem Due to the absence of Chairman Schock, Commissioner Gilliam made a motion, seconded by Commissioner Walters, to appoint Commissioner Walters Chairman Pro Tern. Yeas: Commissioners Gilliam and Walters. Nays: None. Approval of Minutes Councilmember Gilliam made a motion, seconded by Councilmember Walters, to approve the minutes of the December 6, 2007, meeting. Yeas: Commissioners Gilliam and Walters. Nays: None. License Application of White Pearl, Inc., d/b/a White Pearl Restaurant, for a Class E-2 Liquor License at 265 South McLean Boulevard risk Crystal Schee, one of the shareholders of White Pearl, Inc. d/b/a White Pearl Restaurant and Chief Schee, the manager for White Pearl Restaurant, were present and represented by Attorney Scott Richmond. Assistant Corporation Counsel Kozal stated that everything in the application was in order. He reported that the White Pearl Restaurant has been a restaurant for 6 or 7 years and had previously wanted a liquor license for their restaurant. However, there was no class available that fit their particular circumstances until the Class E-2 liquor license was created. Commissioner Gilliam made a motion, seconded by Commissioner Walters, to approve the application of White Pearl, Inc. for a Class E-2 liquor license for the White Pearl Restaurant, located at 265 South McLean Boulevard. Consideration of the Proposed Ordinance Amending the Provisions of the Class K Liquor License Assistant Corporation Counsel Kozal explained that it is proposed that the Class K liquor license be amended. Parks and Recreation Director Randy Reopelle was present and explained that this amendment would allow the applicants who hold special events and festivals in the City of Elgin parks to draw more people to their activities, and would also give the City of Elgin a competitive edge when bidding for special events at the Sports Complex. • Liquor Commission Meeting January 10, 2007 Page 2 Commissioner Gilliam made a motion, seconded by Commissioner Walters, to recommend approval to the City Council of the proposed amendment to the Class K liquor license classification. Approval of 2007 Proposed Meeting Schedule Councilmember Gilliam made a motion, seconded by Councilmember Walters, to approve the proposed meeting schedule for 2007. Review of Memorandum Regarding_Liquor Compliance Check Conducted December 28, 2006 Police Deputy Chief Beeter stated that the Elgin Police Department conducted compliance checks of various businesses licensed to sell liquor December 28, 2006. The two businesses found not to be in compliance were Nasrin's, located at 2175 Point Boulevard, Suite 100, and Bennigan's Grill and Tavern, located at 495 Airport Road. Police Deputy Chief Beeter reported that bartenders at each location served an alcoholic beverage to a minor who was assisting the Elgin Police Department in conducting the compliance check. Assistant Corporation Counsel Kozal stated that he has drafted complaints for public hearings to be conducted at the February Liquor Control Commission Meeting regarding the aforesaid establishments. Assistant Corporation Counsel Kozal initiated a discussion regarding the problems the Elgin Police Department is currently experiencing with the establishment called The Afterset, located at 158 Symphony Way. Sergeant Glenn Therialt, Lieutenant Jeff Adam, and Officer Ed Cummings were present to give reports regarding frequent violent incidents and occupancy violations at that location. They testified to the fact that it is a severe drain on the Elgin Police Department's resources and services, with the problems mainly occurring after midnight. The officers also stated that 50% of the clientele of The Afterset have criminal backgrounds and that the violence escalates quickly at the establishment. In December 2006, the Elgin Police Department had a meeting with the owner. He was less than responsive and seemed to think that if the problems occurred outside of the establishment, then The Afterset was not responsible and such problems should be taken care of by the Elgin officers on duty. The Elgin Police Department has to deploy at least four units at the time of closing in order to maintain some semblance of order and at times mutual aid from South Elgin has been necessary to control fights. They stated that for safety reasons, the detail officer on duty cannot address many of the issues, but he has noted numerous times when the occupancy limit has been violated and patrons have exited the establishment with alcoholic beverages. Assistant Corporation Counsel Kozal outlined the steps being taken by the Elgin Police Department. Commissioner Gilliam asked what the Liquor Commission could do in response to the problems outlined by the Elgin Police Department. Assistant Corporation Counsel Kozal will review the feasibility of filing a complaint against The Afterset with reference to the chronic nuisance abatement ordinance for the 10 criminal incidents that have occurred at that location within a one year time period. Commissioner Gilliam stated that the Liquor Commission may have to Liquor Commission Meeting January 10, 2007 Page 3 consider taking away The Afterset's Class R-1 liquor license that allows them to stay open until 4:00 a.m. and returning them to their previous license class at the time of renewal. Commissioner Gilliam asked that the owners of The Afterset be notified to attend the next Liquor Commission meeting in February in order to make them aware of the actions that the Commission is considering taking. The Liquor Commission made it clear that they wanted to address all licensees that have continual problems in upcoming meetings and named the following specifically: the Mission, Azteca De Oro Restaurant, Jalapeno's Restaurant, and JB's Pub & Pietro's Pizza. Fire Marshall Richard Dunne stated that all liquor licensees should be required to certify their establishment's occupancy prior to issuance of a license and also at the time of renewal. Randall Road Consideration of Proposed Ordinance Pertaining to "Young Adult Night Permit" for Class R Liquor License Holders Assistant Corporation Counsel Kozal reviewed the history of the Young Adult Night Permit, which permits an evening on which persons under the age of 21 are permitted on the licensed premises. Alcohol is not served. The Young Adult Night Permit, was initially created on a one the ordinance would expire as a matter of law at the end of the licensing year unless the ordinance provision was readopted by the City Council. The City Council has approved extensions for the past four years, with the most recent extension expiring on April 30, 2007. At its December 2006 and January 2007 meeting, the Police Department stated that Young Adult Night events do not generate calls for service that are out of the ordinary for such activities and that no major disturbances were reported at the Mission. Similar reports regarding calls for police services for Young Adult Night events have also been provided to the Liquor Commission during the four preceding licensing years. In the absence of any major disturbances, liquor code violations, or an inordinate number or nature of calls for service during Young Adult Night events, it is recommended that the Liquor Commission advise the City Council to adopt an ordinance continuing the operation of the Young Adult Night Permit. Further, the Young Adult Night Permit ordinance has been in effect for five consecutive years without the occurrence of any significant incident or series of incidents suggesting the sunset legislation should expire. Commissioner Gilliam made a motion, seconded by Commissioner Walters, as follows: 1) Recommend that the City Council pass an ordinance providing for a Young Adult Night permit, without a sunset provision. 2) Recommend that the City Council reduce the special police detail to just one officer. Assistant Corporation Counsel Kozal stated that Deputy Chief Swoboda has prepared a preliminary plan for the establishment of an"entertainment district"that will encompass the Center City area in general. The various establishments would pool together to provide a heightened police presence for those areas. Mr. Kozal stated that they are in the process of determining what the appropriate number of police officers would be. ,Liquor Commission Meeting April 10, 2007 Page 6 Once that is done, an initial proposal will be developed and a meeting will be held with licensees that will be affected by this. Consideration of Amendment to Liquor Code Creating New License Classification for Premises Operating Restaurants with Taverns Assistant Corporation Counsel Kozal distributed a proposed ordinance regarding establishing a new license classification authorizing on-premises alcoholic liquor sales in establishments where the primary business being conducted is the service of meals in a restaurant that also has an integrated tavern area. The proposed Class U license may sell alcoholic liquor daily from 6 a.m. until 3 a.m. with provisions for sales until 4 a.m. on the Wednesday preceding Thanksgiving and on New Year's Eve. Mr. Kozal also stated that the amount of capital investment in the kitchen will determine that the primary business is a restaurant instead of requiring that the sale of liquor be less than a certain percentage of total revenues. This standard is suggested because the price of some liquors are substantially more than the meal. Councilmember Gilliam made a motion, seconded by Councilmember Walters, to recommend approval to the City Council of the proposed ordinance creating the Class U liquor license. Adjournment r ELGIN LIQUOR CONTROL COMMISSION MEETING MAY 2,2007 The meeting was called to order by Chairman Schock at 4:09 p.m. in Conference Room 208, South Wing of Elgin City Hall. License Application of Dundee Elgin CVS, L.L.C., d/b/a CVS/Pharmacy#5829 for a Class B Liquor License Chairman Schock stated that the Commission had just learned that there were some concerns about this application from two neighborhood groups,Northeast Neighborhood Association and the Summit Park Association. Chairman Schock mentioned that he had talk with representatives from NENA, but not with anyone from the Summit Park Association. His recommendation was to table the application until a meeting with representatives from the Summit Park Association was held. License Application of Elgin's Swizzle Inn, Inc., d/b/a Elgin Swizzle Inn at 751 North State Street, for a Class F Liquor License The owners, Nicholas and Janice Cartina, were in attendance and described the nature of their business. They stated that the restaurant would be open for breakfast, lunch, and dinner until 8:00pm. The Commission complimented them on the appearance of the building. Mr. & Mrs. Cartina stated they hoped to open by the end of May. Assistant Corporation Counsel Rick Kozal reported that Sgt. Glenn Theriault and his team conducted a number of bar checks that resulted in violations. These will be brought before the Commission at the June meeting. 2. Sgt. Theriault also reported that an investigation has begun regarding the use of outside promoters by various liquor establishments.
