Adjournment r ELGIN LIQUOR CONTROL COMMISSION MEETING January 8, 2002 The regular meeting was called to order at 4 : 05 p.m. in Conference Room A at Elgin City Hall by Commission Chairman Schock. Members present : Commissioner Wasilowski and Chairman Schock. Absent : Commissioner Gilliam. Approval of Minutes - December 5, 2001 Commissioner Wasilowski made a motion, seconded by Chairman Schock, to approve the minutes of the December 5, 2001, meeting. Yeas : Commissioner Wasilowski and Chairman Schock. Nays : None. Consideration of Proposed Ordinance Amending the Elgin Liquor Code to Expand the Requirement for BASSET Certification to Include Supervisors at Special Events The Commission discussed the proposed amendment and felt that the provision to allow the not-for-profit organizations to apply to the City for reimbursement for the cost of BASSET training should be removed from the proposed ordinance . Commissioner Wasilowski made a motion, seconded by Chairman Schock, to delete Paragraph A(3) from the proposed ordinance amending Section 6 . 06 . 115 entitled "BASSET Training Requirements" and to recommend approval of the amended proposed ordinance to the City Council . Yeas : Commissioner Wasilowski and Chairman Schock. Nays : None . Consideration of Proposed Ordinance Amending the Tobacco Dealers Ordinance A discussion was held regarding the proposed ordinance which prohibits the sale or distribution of tobacco products within 100 feet of any school or day care facility for children under the age of 18 years and prohibiting the self-service sale of tobacco products . Assistant Corporation Counsel Kozal was also directed to change the proposed ordinance to include the following: increase the annual license fee from $25 to $100 ; increase the possible fine to be charged to tobacco dealers for violation of provisions of the tobacco dealers ordinance to not less than $250 and nor more than $500 ; and to require posting of the tobacco permit in a prominent location on the premises . Discussion was also held regarding revising the application form and procedure as well as enforcement procedures . Liquor Commission Meeting January 8 , 2002 Page 2 Commissioner Wasilowski made a motion, seconded by Chairman Schock, directing Mr. Kozal to amend the proposed tobacco ordinance pursuant to the above, prepare a Committee of the Whole memorandum explaining the purpose of the proposed amendments, and place the proposed ordinance on a future Committee of the Whole agenda. Adjournment t ELGIN LIQUOR CONTROL COMMISSION MEETING February 6, 2002 The regular meeting was called to order at 4 : 07 p.m. In Conference Room A at Elgin City Hall by Commission Chairman Schock. Members present : Commissioner Gilliam, Wasilowski, and Chairman Schock. Absent : None . Approval of Minutes - January 8, 2002 Commissioner Wasilowski made a motion, seconded by Commissioner Gilliam, to approve the minutes of the January 8, 2002 , meeting. Consideration of Application for Transfer of Corporate Stock Filed by Johanna Gross as Trustee of Gross Family Trust Dated November 9, 2001, Regarding Establishment Known as Gasthaus Zur Linde, Inc. , 13 N. Grove Avenue Commissioner Gilliam made a motion, seconded by Commissioner Wasilowski, to approve the aforesaid application for transfer. Yeas : Commissioners Gilliam, Wasilowski, and Chairman Schock. Public Hearing Regarding Bowlway Enterprises, Inc. , 810 Villa Street, Holder of Class A License; Violation on November 21, 2001, of Elgin Municipal Code Sections 6 . 06 . 140K, 6 . 06 . 150A, 6 .06 . 150H and 6 . 06 . 120D - Sale of Liquor to a Minor by Agent and Employee of Licensee William Grocke, one of the shareholders of Bowlway Enterprises, Inc . , appeared pursuant to the Notice of Hearing with reference to the aforesaid allegations . Assistant Corporation Counsel Kozal stated that a stipulation has been entered into by the licensee acknowledging that the violations alleged in the complaint did occur. Mr. Grocke and Mary Bjorkman, the bartender who sold the liquor to the minors, advised the Commission that the two minors involved had been coming to the bowling alley weekly for approximately 10-12 weeks with a group of people, and their identifications had been checked on all the previous visits . However, because it was a busy night and their ID' s had been checked on many previous occasions, they were not checked the night of November 21, 2001 . Liquor Commission Meeting January 8, 2002 Page 2 Because of Bowlway' s extraordinary record of no problems for the past 18 years and because they now changed their procedure to check identifications each time for anyone who appears under 30 years of age, the Commission decided to waive imposition of a fine but required them to pay for the court reporter costs . LIST F Fox Hole Pub, 158 Symphony Way Public Hearing Regarding Bernardino Robledo, d/b/a 212 Club,212 Ball Street, Holder of Class AA License; Violations of the Elgin Municipal Code, the Illinois Liquor Control Act, and the Criminal Laws of the State of Illinois, for the Period Between August 12, 2001, and November 12, 2001 Attorney Donald Hughes appeared on behalf of Bernardino Robledo, d/b/a 212 Club pursuant to the Notice of Hearing and Complaint with reference to the aforementioned violations. Chairman Schock read the following statement: The Commission has been advised of additional incidents of alleged criminal activity occurring on the licensed premises at 212 Ball Street and is amending the complaint that has been filed against Mr. Robledo to include these new allegations. Section 6.06.125 of the City's liquor code requires the Commission to provide the licensee with ten days' notice of such charges. In accordance with that provision, the Commission will be establishing a hearing date—or series of hearing dates—on the •, - Liquor Commission Meeting April 3, 2002 Page 6 amended complaint beginning on or after April 13, 2002. The Commission intends to conclude the hearing on the complaint before the liquor license for the premises expires on April 30, 2002. The Commission agreed to set the following dates for hearing: April 23 at 5 p.m., April 25 at 4 p.m., and April 29 at 4 p.m. Commissioner Gilliam made a motion, seconded by Commissioner Wasilowski, to continue the public hearing until April 23, 2002, at 5 p.m. Yeas: Commissioners Gilliam, Wasilowski, and Mayor Schock. Member present: Commissioner Gilliam and Chairman Schock. Absent: Commissioner Wasilowski. Public Hearing Regarding Bernardino Robledo, d/b/a 212 Club, 212 Ball Street, Holder of Class AA License; Violations of the Elgin Municipal Code, the Illinois Liquor Control Act, and the Criminal Laws of the State of Illinois, for the Period Between August 12, 2001, and November 12, 2001 Assistant Corporation Counsel Kozal stated that the Bernardino Robledo and his attorney, Donald Hughes, were present. Mr. Kozal presented and reviewed the agreed stipulation and order which Mr. Robledo, as holder of the Class AA liquor license at 212 Ball Street, has entered into. Essentially, the terms of the stipulation are as follows: 1) The licensee admits to the allegations set forth in the complaint; 2) The licensee shall surrender the Class AA liquor license for the licensed premises to the City Clerk no later than 12:00 p.m. on April 26, 2002; 3) Neither licensee nor any successor in interest to the licensed premises shall file an application for the premises nor shall a retail alcoholic liquor dealer's license be issued to any person or entity for the licensed premises before December 2, 2002; 4) The application for renewal of the Class AA liquor license for the licensed premises filed on April 10 is withdrawn; and 5) The licensee waives his rights to appeal. Consideration of Proposed Ordinance Amending the Liquor Code to Provide Permit Allowing All-ages Entertainment at The Mission, 209 East Chicago Street Dave Shelton, manager and one of the shareholders of The Mission located at 209 East Chicago Street, is proposing that he be allowed to use the club one night a week for 17 to 21 year olds. He has operated a young adult club for ten years in Chicago. It would be for members only and the entertainment would be DJs, an art gallery, track acts, etc. A lot of interest has been expressed in having a young adult facility in Elgin. Assistant Corporation Counsel Kozal stated that it would involve an amendment to the Liquor Code, and he presented a proposed ordinance that would permit a"young adult night"to be held at the Mission. Deputy Police Chief Duffy stated that the Police Department would like to have the proposed ordinance reviewed by the police command staff and they will then work with the City Manager's Office and Corporation Counsel to address any concerns. Commissioner Gilliam made a motion, seconded by Commissioner Wasilowski, to recommend approval of the proposed ordinance to the City Council subject to review by the Police Department. Consideration Regarding Proposal to Expand Hoppe's Corner Tom Hoppe, manager and one of the shareholders of Hoppe's Corner located at 1075 North Liberty Street, advised that he would like to expand his bar/restaurant into the now vacant area between Hoppe's and Nottolini's Pizza and use that area as a family-style restaurant and serve Nottolini's pizza there and also use it for private parties. Prior to approaching the landlord, he wanted to know whether the Liquor Commission has any objections to such an expansion. The Commission indicated that it has no objections. They did ask whether Mr. Hoppe would be amenable to removing all parking from the front of his establishment when the Dundee Avenue corridor is improved. Mr. Hoppe stated that he has no objections but it would require the approval of the landlord.
