The meeting was called to order at 4:09 p.m. in the North Wing Second Floor Conference Room
by Commission Chairman Schock. Members present: Commissioner Wasilowski and Chairman
Schock. Absent: Commissioner Gilliam.
Approval of Minutes - December 6, 2000
Commissioner Wasilowski made a motion, seconded by Chairman Schock, to approve the
minutes of the December 6, 2000, meeting. Yeas: Commissioner Wasilowski and Chairman
Schock. Nays: None.
Consideration of Application of Elgin Farmer's Produce, Inc. for Class B-1 Liquor License
for Grocery Store to be Known as Elgin Fruit Market #2, Inc., 306 South McLean
Boulevard
Councilman Wasilowski made a motion, seconded by Chairman Schock, to approve the above
application subject to issuance of an occupancy permit and the creation of an additional Class
B-1 liquor license by the City Council. Yeas: Commissioner Wasilowski and Chairman Schock.

Consideration of Application for Transfer of Corporate Stock of Elgin Restaurant and
Lounge, Inc., 219 East Chicago Street
Councilman Wasilowski made a motion, seconded by Chairman Schock, to approve the
application to transfer the stock of Gani Sakolari to Raman Sakolari. Yeas: Commissioner
Wasilowski and Chairman Schock. Nays: None.
Discussion Regarding Minors in Class AA Licensed Establishments
Section 6.06.140(N) currently provides that any person who has not attained the age of twenty-
one years shall not be permitted to remain on the premises of a Class A or R licensed
establishment. This does not apply to persons 18 years of age or older who are on the premises
pursuant to employment or persons accompanied by his or her parents, legal guardian or spouse.
The Liquor Commission determined that it would be appropriate to also have this provision
apply to Class AA licensed establishments.
Councilman Wasilowski made a motion, seconded by Chairman Schock, to direct staff to draft
an amendment which would add Class AA establishments to Elgin Municipal Code Section
6.06.140(N) Yeas: Commissioner Wasilowski and Chairman Schock. Nays: None.

Consideration of Request for Approval for Change in Layout of
Prairie Rock Brewing Company, 127 South Grove Avenue (Class 0
Liquor License)
By consensus, the Commission approved the concept for the change
in layout and asked that a floor plan of the layout be presented
for consideration at the April meeting prior to renewal of the
liquor license for this establishment .
Consideration of Amendment to Section 6 . 06 . 100 (C) Pertaining to
Transfer of Corporate Stock for Class B Package Liquor
Establishments
Councilman Wasilowski made a motion, seconded by Councilman
Schock, to recommend approval of the proposed ordinance which
amends Section 6 . 06 . 100 (C) to provide that if the transfer of 50%
or more of corporate stock for a Class B license is made to a
surviving spouse, descendant , parent , brother, sister or
descendant of a brother or sister of the stock transferor, the
stock transferee shall not be required to pay the $10 , 000 fee
normally required for stock transfers of 50% or more for Class B
licensees . Yeas : Councilman Wasilowski and Chairman Schock.

Discussion Regarding Marlene' s, 50 North Spring Street
Guadalupe Rubio, sole shareholder of Rubio, Inc . , d/b/a
Marlene' s, appeared before the Commission to discuss what
activities are permitted at her restaurant pursuant to the Class
E license issued for said establishment . The Code Administration
Department has recently raised the issue of whether the
restaurant is functioning as a nightclub because they admission
has been charged when entertainment has been offered. The
Commission requested that Assistant Corporation Kozal research
the issue and report back to the Commission.

Discussion of BASSET Training for Festival and Special Event
Volunteers Selling and Serving Alcoholic Beverages
Deputy Chief Duffy stated that the Police Department has
significant concerns regarding the fact that a number of
not-for-profit organizations and churches do not use a licensed
vendor for the sale and service of alcoholic liquor. Employees
of licensed vendors are BASSET trained, but volunteers for
not-for-profit organizations and churches who are selling and
serving the liquor at the festivals are not BASSET trained.
Currently the Police Department is requiring that additional
police personnel be hired to work at the events when vendors are
not used. Discussion was held regarding this issue . The
Commission does not want to make the requirement so onerous that
the organizations are not able to make a profit, and the
suggestion was made that perhaps the City could either provide
the BASSET training in-house or pay for the training for
not-for-profit organization volunteers .
The Commission directed that Assistant Corporation Counsel
Kozal, City Clerk Mecum, and Deputy Chief Duffy to explore
options regarding requiring BASSET training for festival and
special event volunteers beginning in 2002 .

The meeting was called to order at 4:10 p.m. in Conference Room A at Elgin City Hall by
Commission Chairman Schock. Members present: Commissioner Wasilowski and Chairman
Schock. Absent: Commissioner Gilliam.
Approval of Minutes -April 4, 2001
Commissioner Wasilowski made a motion, seconded by Chairman Schock, to approve the
minutes of the April 4, 2001, meeting. Yeas: Commissioner Wasilowski and Chairman Schock.

Consideration of Application for Transfer of Corporate Stock Filed by Edward Burgess for
Bill's Tap, Inc., 260 Brook Street
Commission Secretary Mecum stated that Bill's Tap, currently the holder of a Class AA liquor
license, is being sold to Edward Burgess, subject to approval of the application for transfer of
corporate stock. However, Section 6.06.040(B) of the Elgin Municipal Code provides that a
Class AA license shall terminate, expire, cease to exist when it is revoked or not renewed or the
business is sold. Accordingly, a Class AA license will not be available for this establishment
after the sale, so Mr. Burgess has applied for a Class A license.
Commissioner Wasilowski made a motion, seconded by Chairman Schock, to approve the
request to transfer 100 percent of the corporate stock of Bill's Tap, Inc. from Tim Finley to
Edward Burgess. Yeas: Commissioner Wasilowski and Chairman Schock. Nays: None.
Commissioner Wasilowski made a motion, seconded by Chairman Schock, to make a
recommendation to the City Council that an additional Class A liquor license be created and that
Bill's Tap, Inc.'s application for a Class A liquor license be approved, subject to City Council's
creation of an additional Class A license. Yeas: Commissioner Wasilowski and Chairman
Schock. Nays: None.
Public Hearing Regarding Papas Properties,Inc., d/b/a Leitner's Hamburgers, 992
St. Charles Street, Holder of Class A License; Violation of Elgin Municipal Code Section
6.06.120C.3 -Violation of Any State Law
Assistant Corporation Counsel Kozal summarized the complaint which alleges that the state
liquor license of Papas Properties, Inc. was revoked for failure to pay certain taxes. However,
the has now paid the taxes in full, and the state's order of revocation was vacated on April 9,
2001. Ray Papas entered into a stipulation in which he admits the allegations set forth in the
complaint. Chairman Schock recommended a fine of$100 in that the situation has been rectified
and the licensee is now in compliance. Commissioner Wasilowski made a motion, seconded by
Chairman Schock, to assess a fine of$100 plus costs. Yeas: Commissioner Wasilowski and
Chairman Schock. Nays: None.

Public Hearing Regarding Jalapenos Corporation, d/b/a Jalapenos Restaurant, 7 Clock
Tower Plaza, Holder of Class E License; Violation on March 15, 2001, of Elgin Municipal
Code Sections 6.06.120C.3 and 6.06.120D -Violation of Criminal Laws of the State by
Licensee's Employee
Assistant Corporation Counsel Kozal stated that as a result of the sale of drugs on the licensed
premises by an employee, the license holder is in violation of criminal laws of the State of
Illinois, which is in violation of the Elgin Liquor Code. The licensee has entered into a
stipulation admitting the allegations contained in the complaint. Gustavo Sotos, shareholder of
Jalapenos Corporation, advised the Commission that he had previously met with the Police Chief
and requested assistance to curb any possible drug activities in that he had heard that drug dealers
were frequenting his establishment. Chairman Schock stated that the Commission appreciates
Mr. Sotos's cooperation with the police. However,he believes a fine is appropriate in view of
the seriousness of the violation and the fact that the licensee is responsible for the actions of its
employees.
Commissioner Wasilowski made a motion, seconded by Chairman Schock, to assess a fine of
$250 plus costs. Yeas: Commissioner Wasilowski and Chairman Schock. Nays: None.
�.• Consideration of Liquor Ordinance Compliance Operation Conducted April 7, 2001
Commissioner Wasilowski made a motion, seconded by Chairman Schock, to schedule a public
hearing regarding the alleged liquor code violation by an employee of Dino's of Elgin Food
Yeas: Commissioner Wasilowski and Chairman Schock. Nays: None.
Miscellaneous
Liquor licensee Roger Eads stated that he had appeared before the City Council to request
elimination of payment of the $5000 fee for Class B-1 licenses as had been done recently
regarding the $10,000 fee for Class B licenses under certain circumstances. Chairman Schock
advised Mr. Eads that the Liquor Commission is gathering information to see what options are
available before making a recommendation to the City Council regarding changing this
provision. The Commission requested that Assistant Corporation Counsel Kozal prepare
information regarding a possible amendment with reference to this provision.

The meeting was called to order at 4 : 00 p.m. in Conference Room A
at Elgin City Hall by Commission Chairman Schock. Members
present : Commissioner Wasilowski and Chairman Schock. Absent :

Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to approve the minutes of the May 2 , 2001, meeting.

Consideration of Application of David H. Pool for Class K Liquor
License as Concessionaire for Hemmens Cultural Center, 150 Dexter
Court
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to approve the aforesaid application. Yeas : Commissioner
Wasilowski and Chairman Schock. Nays : None .
Consideraion of Application of Maria Espinoza, Inc . , d/b/a Elgran
Burrito #2, 415 Dundee Avenue, for Class F Liquor License
Assistant Corporation Counsel Kozal described a Class F liquor
license as being for a service bar in a restaurant for the sale
and service of beer and wine, which must be incidental to the
service of a meal . Ina Dews and Willie Tate expressed concern
about a liquor license being issued for an establishment in this
neighborhood in the general vicinity of a church and the Wayside
Mission.
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to approve the aforesaid application, subject to the
applicant furnishing site plans containing an architectural
stamp. Yeas : Commissioner Wasilowski and Chairman Schock. Nays :
None .
Public Hearing Regarding AAME, Inc. , d/b/a Dino' s of Elgin Food,

Jerry Ventrella, shareholder and President of AAME Inc . , appeared
pursuant to the Notice of Hearing with reference to the aforesaid

allegations . A stipulation has been entered into by the licensee
acknowledging that violations did occur. Mr. Ventrella stated
that the person who sold the liquor to the minor had not gone
through BASSET training because he was initially hired as a
security guard. However, he will now go through the required
BASSET training.
Corporation Counsel Kozal advised the Commission that this
licensee was previously found guilty of sale of liquor to a minor
in December 1996 and was fined $750 . They successfully passed a
liquor compliance operation in March 1997 .
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to assess a fine of $500 for sale of liquor to a minor
and $250 for failure to comply with the BASSET training
requirement, plus costs of the hearing. Yeas : Commissioner
Wasilowski and Chairman Schock. Nays : None .
Public Hearing Regarding Suvagia Brothers, Inc. , d/b/a Villa
Liquors, 695 Villa Street, Holder of Class B License; Violation
on April 30, 2001, of Elgin Municipal Code Sections 6 . 06 . 140 and
eft 6 . 06 . 150 - Sale of Alcoholic to a Minor by Agent and Employee of
Licensee
Atkul Suvagia, an officer of Suvagia Brothers, Inc . , appeared
pursuant to the Notice of Hearing with reference to the above
allegations . Assistant Corporation Counsel Kozal advised the
Commission that this is the first offense for this licensee, they
have successfully passed five previous liquor ordinance
compliance investigations, and a stipulation has been entered
into acknowledging that the violation did occur.
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to assess a fine of $500 plus costs of the hearing.

Consideration of Creating Sign to be Posted at Licensed
Establishments Regarding Recently Passed Preservation of Peace
Ordinance
Commission Secretary Mecum advised the Commission that a licensee
had contacted her and stated that he believed it would be
beneficial to have a sign that could be posted in the licensed
establishments stating that licensees are required to notify the
police when any criminal activity or fighting on the licensed
premises is observed in accordance with the ordinance which was
passed on April 11, 2001 .
The Commission directed Mr. Kozal to draft a proposed ordinance
for the Liquor Commission' s consideration requiring all liquor
licensees to post such a sign.
Consideration of Request from Schock' s Greenhouses & Gifts and
Our House Antiques & Treats
Josh and Mary Sherman, owners of Schock' s, would like to be able
to serve wine with meals at Our House Antiques & Treats and be
able to sell Midwestern grown wines in their store . A Class B-1
package liquor license requires an initial fee of $5, 000 plus an
annual fee of $1, 500 . Because of the limited amount of sales
expected, it would not be feasible for them to obtain a Class B-1
license .
The Liquor Commission asked that Mr. Kozal work with the Shermans
to draft a proposed ordinance for the Liquor Commission' s
consideration.

Consideration of Application of Meijer Stores Limited Partnership
for Class B Liquor License for Meijer, #183 at 815 South Randall
Road
Don Nunn, Liquor Licensing Specialist for Meijer Stores,
described various programs used by Meijer to discourage underage
drinking and the cash register system used by Meijer to insure
that the purchaser of alcoholic liquor is of age and that the
hours for sale of liquor are strictly adhered to. Assistant
Corporation Counsel Kozal advised the Commission that the sale of
package sales of alcoholic liquor was approved as part of the
Planned Unit Development Ordinance G45-99 passed by the City
Council on July 28, 1999 .
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to recommend to the City Council that an additional Class
B liquor license be created and that the aforesaid application be
approved, subject to creation of an additional Class B license .

Public Hearing Regarding 802 Villa, Inc. , d/b/a City Limits Cafe
and Bar, 802 Villa Street, Holder of Class A License; Violations
of the Elgin Municipal Code, the Illinois Liquor Control Act, and
the Criminal Laws of the State of Illinois on March 25, May 5,
May 12, and June 14, 2001
Assistant Corporation Kozal described the dates, offenses, and
the applicable legislation violated in the five-count complaint
filed against 802 Villa, Inc . , d/b/a City Limits Café and Bar.
The licensee had originally been represented by Attorney Garrett
Malcolm. However, when negotiations regarding a possible plea
agreement were unsuccessful, the licensee hired Attorney William
Chesbrough, who was unavailable for today' s hearing. He

requested that the hearing be continued.
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to grant the request to continue the hearing to August 1,
2001, at 1 p.m. , and to also schedule August 2 , 2001, at 1 p.m.
for continued hearing, if not completed on August 1, 2001 . Yeas :

Consideration of Proposed Ordinance Requiring Posting of a Notice
Regarding the Preservation of Peace on Licensed Premises
Pursuant to the Liquor Commission' s earlier direction, Assistant
Corporation Counsel Kozal presented a proposed ordinance
requiring licensed establishments to post a printed sign which
sets out the liquor licencee' s duty to maintain peace on the
premises in accordance with the recently passed ordinance .
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to recommend passage of the proposed ordinance to the
City Council and to place it on a future Committee of the Whole
agenda. Yeas : Commissioner Wasilowski and Chairman Schock.

Consideration of Application of Helmos, Inc. for Class E Liquor
License for Restaurant Known as Spring Garden West, 90 Tyler
Creek Plaza
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to approve the aforesaid application subject to applicant
obtaining a re-occupancy permit and providing a certificate of
insurance. Yeas : Commissioner Wasilowski and Chairman Schock.

Consideration of Proposed Ordinance to Create New Class of Liquor
License for Boutique Sale of Alcoholic Liquor
Assistant Corporation Counsel Kozal described the various aspects
of the proposed license class (Class T) which was prepared in
response to a request from Josh and Mary Sherman, owners of Our
House Antiques & Treats, to be able to sell Midwestern grown
wines in their store and to serve wine with meals in their
restaurant . The proposed ordinance also addresses a recent
inquiry received by the City Clerk from Pastigel Bakery regarding
selling liqueurs with coffee in their coffee shop and cafe. The
proposed ordinance was discussed, and Mr. Kozal was directed to
amend the proposed ordinance to limit advertising and bring it
back to the Liquor Commission for further consideration.
Commissioner Schock also requested that we require as part of the
renewal procedure for holders of the newly proposed Class T
license and Class E and E-1 licenses that records for the prior
year be submitted reflecting that they are complying with the
provision that at least 50 percent of their revenue is from the
sale of food.

The proceedings regarding the above-described public hearing were
recorded by the court reporting firm of Sonntag Reporting,
Geneva, Illinois
On October 2 , 2001, Commissioner Chairman Schock commenced the
public hearing at 4 :23 p.m. Members present : Commissioner
Wasilowski and Chairman Schock. Absent : Commissioner Gilliam.
William Chesbrough, attorney for licensee 802 Villa, Inc . , and
Thomas and Helen Kanakaris, shareholders of the licensee
corporation, appeared pursuant to the Notice of Hearing.
Assistant Corporation Counsel Kozal stated that violations set
forth in the five-count Complaint dated June 15, 2001, involve
sex, sale of drugs, and violence .
Testimony was given by Detectives Frank Jones and Jiminez Allen
of the Bellwood Police Department and Officer Jonathan Rustay of
the Elgin Police Department . Exhibits were entered into
evidence .
Prior to recessing for the evening, the parties agreed that the
hearing would continue on October 16, 17, and 30 at 4 p.m.
The public hearing recessed at 8 : 00 p.m.

The public hearing was commenced on October 16 , 2001, at 4 :41
p.m. and declared recessed by Chairman Schock immediately
thereafter.
At 6 : 55 p.m. the meeting was reconvened and Chairman Schock
requested that the record show those in attendance were Chairman
Schock, Commissioner Wasilowski, Deputy City Clerk Losch,
Assistant Corporation Counsel Kozal , Attorney William Chesbrough,
and Tom Kanakaris, owner of City Limits Café and Bar.

Assistant Corporation Counsel Kozal presented and reviewed the
stipulation and agreed order which provides as follows : 1)
Licensee, 802 Village, Inc . , d/b/a City Limits Café and Bar,
admits to the allegations set forth in the complaint; 2) Requires
licensee to surrender its current liquor license by 12 : 00 p.m.
October 17, 2001; 3) Licensee agrees to pay the costs associated
with this hearing; and 4) Parties waive their rights to appeal .
Attorney Chesbrough concurred.
Mayor Schock declared the public hearing closed and the
commission adjourned at 7 : 30 p.m.

November 7, 2001
The regular meeting was called to order at 4 : 00 p.m. in
Conference Room A at Elgin City Hall by Commission Chairman
Schock. Members present : Commissioner Wasilowski and Chairman
Schock. Absent : Commissioner Gilliam.
Approval of Minutes
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to approve the minutes of the October 2 and 16 public
hearing, the October 3 rescheduled regular meeting, and the
October 16 , 2001, special meeting. Yeas : Commissioner Wasilowski
and Chairman Schock. Nays : None .
Consideration of Application of Geno & Julie Doghouse, Ltd. for
Class B Liquor License for Package Liquor Establishment Known as
Geno's Town Liquors, 300 South McLean Boulevard
Commissioner Wasilowski made a motion, seconded by Chairman
eft Schock, to approve the aforesaid application subject to
submission of the certificate of insurance and executed
assignment of lease and issuance of the occupancy permit . Yeas:
Commissioner Wasilowski and Chairman Schock. Nays : None.
Consideration of Request from The Mission, 209 E. Chicago Street,
to Extend Hours of Operation on Night Before Thanksgiving and New
Year' s Eve
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to recommend approval of the proposed ordinance to the
City Council permitting the holder of a Class R license to be
open on the Wednesday preceding Thanksgiving and on New Year' s
Eve from 9 p.m. to 4 a.m. the following day. Yeas : Commissioner
Wasilowski and Chairman Schock. Nays : None .
Consideration of Proposed Ordinance Making Technical Amendments
to the Alcoholic Liquor Dealers Code (Chapter 6 . 06)
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to recommend approval of the proposed ordinance to the
City Council reducing the number of Class A liquor licenses from
20 to 19 and making certain technical amendments to Chapter 6 . 06
relating to applications filed by limited liability companies
eft (LLCs) . Yeas : Commissioner Wasilowski and Chairman Schock.

Miscellaneous
Liquor Commission Secretary Mecum advised the Commission of
upcoming applications for liquor licenses .
Commissioner Wasilowski presented a copy of the recently enacted
LaGrange Park Youth Tobacco Control Ordinance . He requested that
staff review it and make a recommendation regarding presenting a
more stringent ordinance to the City Council for its
consideration.

Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to adjourn the meeting. Yeas : Commissioner Wasilowski
and Chairman Schock. Nays : None .

The regular meeting was called to order at 4 : 12 p.m. in
Conference Room A at Elgin City Hall by Commission Chairman
Schock. Members present : Commissioners Gilliam, Wasilowski and
Chairman Schock. Absent : None .
Approval of Minutes - November 7, 2001
Commissioner Wasilowski made a motion, seconded by Chairman
Schock, to approve the minutes of the November 7, 2001, meeting.
Yeas : Commissioner Wasilowski and Chairman Schock. Nays : None.
Commissioner Gilliam answered present .
Consideration of application of Fred & Judy, Inc. For Class E-1
Liquor License for Restaurant to be Known as Cafe Magdalena, 13
Douglas Avenue
Commissioner Gilliam made a motion, seconded by Commissioner
Wasilowski, to approve the aforesaid application subject to the
eft following: submission of floor plan with precise dimensions;
competition of application indicating anticipated amount of
monthly revenue from the sale of food and from the sale of
liquor; submission of a certificate of insurance; and issuance of
an occupancy permit . Yeas : Commissioners Gilliam, Wasilowski,
and Chairman Schock. Nays : None.
Consideration of Application of Big Ed & Mudd, Inc. For Class A

Commissioner Wasilowski made a motion, seconded by Commissioner

Miscellaneous
A police report regarding sale of liquor to a minor was
distributed to the Commission. A hearing will be scheduled at a
future meeting.
Because the regular meeting date is immediately after New Year' s
!ow Day, the January meeting will be held January 8 , 2002 , at 4 p.m.

Commissioner Wasilowski requested that a proposed amendment to
the Tobacco Dealers ordinance be prepared eliminating all self-
service sales .
