ELGIN LIQUOR CONTROL COMMISSION NOTICE OF RESCHEDULED MEETING NOTICE IS HEREBY GIVEN that the Elgin Local Liquor Control Commission has rescheduled its regular April meeting from April 5 to April 19, 2000 , in Conference Room A, South Wing, Elgin City Hall . The meeting is scheduled for 4 p.m. As has been the practice for a number of years, the meeting to consider applications for renewal has been scheduled for later in the month because the liquor licenses do not expire until April 30 . In addition to renewal applications, other matters to be considered on April 19, 2000 , include, but not are limited to, consideration of an application for a Class S (banquet) license for Elliot ' s Banquets, 1055 N. Members present : Commissioners Wasilowski, Yearman, and Chairman Schock. 2Absent : None . Approval of Minutes - December 1, 1999 Commissioner Yearman made a motion, seconded by Commissioner Wasilowski, to approve the minutes of the December 1, 1999, meeting. Yeas : Commissioners Wasilowski, Yearman, and Chairman Schock. Nays : None . Consideration of Application of Juliot, Inc . for Class S Liquor License for Banquet Facility Known as Elliot' s Banquets, Located at 1055 N. Randall Road Commissioner Yearman made a motion, seconded by Commissioner Wasilowski, to approve the aforesaid application, subject to presentation of an occupancy permit, proof of completion of BASSET training by all employees, and removal of the temporary sign from the property. Yeas : Commissioners Wasilowski, Yearman, and Chairman Schock. Nays : None . Consideration of Application of Total Entertainment, Inc. for Class A Liquor License for Restaurant and Lounge to be Known as John' s, located at 18 Villa Court Scott Richmond, attorney for the applicant, together with shareholders John Vlagos and Raman Sakolari appeared before the Liquor Commission to describe their plans for the above establishment . They intend to operate a full menu restaurant, a lounge, and a virtual gaming center. Surrounding property owners stated that there are already problems in the area of the subject property with reference to parking and disorderly conduct, and they believe there are enough liquor establishments in this area. Other citizens expressed support for the proposed establishment and believe it would draw people to the downtown area. The Liquor Commission expressed concern about the fact that there is no requirement that food be served at a Class A license establishment and that it could become solely a bar. They advised the applicant that they would require more detailed plans of the facility and activities proposed before they could consider the application. Commissioner Wasilowski made a motion, seconded by Commissioner Yearman, to table the application until detailed documents have been produced by the applicant . Commissioner Yearman made a motion, seconded by Commissioner Wasilowski, to recommend approval of the proposed ordinance to the City Council . Consideration of Possible Liquor License Fee Increases Commissioner Wasilowski made a motion, seconded by Chairman Schock, to make a recommendation to the City Council to increase the nonrefundable application fee from $25 to $150 . The vote on each motion was unanimous . ) Discussion Regarding Additional Restaurant License Classes Discussion was held regarding permitting issuance of the Class E-1 liquor license throughout the City rather than restricting it to the CC1 Center City District east of the river as it is now. The Liquor Commission requested that Assistant Corporation Counsel Kozal review and present a proposal regarding additional restaurant liquor licenses and to also consider a class for restaurants that have seating for less than 75 persons . Consideration of Police Reports Regarding Alleged Liquor Code Violations On May 19, 2000, the Elgin Police Department, assisted by the Illinois State Police Criminal Investigations Division, conducted an investigation regarding the purchase of alcohol by under-age minors . Nine businesses sold alcohol to under-age minors and thirteen did not . Assistant Corporation Counsel Kozal described the procedure to be initiated regarding the businesses who did sell alcohol to the under-age minors . Commissioner Wasilowski made a motion, seconded by Chairman Schock, to direct the Legal Department to draft charges against the alleged offenders . Yeas : Commissioner Wasilowski and Chairman Schock. Nays : None . Chairman Schock directed that letters of commendation be sent to those businesses who did not sell alcoholic liquor to under-age minors . Assistant Corporation Counsel Kozal advised the Commission that this hearing is a result of a police investigation on May 19, 2000 . The licensee filed a stipulation acknowledging that the allegations set forth in the complaint relating to the sale of alcoholic liquor to a minor and failure to file evidence of completion of the Basset training program did occur. Mr. Sayer reported that they run their own Basset checks by "shopping their own stores" and provide Basset training at least once each year. They have also changed their staffing so that a manager is on duty during each shift . Consideration of Amendment Regarding Special Event Liquor License - (6 . 60 . 059) Commissioner Wasilowski made a motion, seconded by Chairman Schock, to recommend to City Council approval of the proposed ordinance which eliminates the requirement to limit Special Event licenses (6 . 60 . 059) to private gatherings, and to require that coapplicants have a valid City of Elgin liquor license . Yeas : Commissioner Wasilowski and Chairman Schock. Nays : None . Miscellaneous Chairman Schock stated he is growing increasingly concerned regarding activities at City Limits Cafe and Bar. He has received several letters and telephone calls from surrounding property owners about activities occurring there . He suggested a letter stating the concerns of the commission be sent to the owner requesting he appear before the Liquor Commission to address these issues . Fire Marshall Bone indicated that there are also some outstanding code violations at the establishment that should be addressed. Assistant Corporation Counsel Kozal said he would send a letter. Commissioner Wasilowski asked that an updated version of the liquor ordinance be provided to commission members and mailed to all license holders . Regarding the remodeling of liquor establishments, Assistant Corporation Counsel Kozal reported that any plans for remodeling must be submitted to, and approved by, the Liquor Commission. In the matter relating to the sale of controlled substances at the Elgin Restaurant that occurred in June, because there were no allegations that sales were made by or to any employee, there was no action to be taken. However, should a pattern begin to Liquor Commission Meeting September 6 , 2000 Page 6 develop where instances of this type occur, the commission could consider suspending or revoking their license .
