Members present: Commissioners Gavin and Yearman. Absent: Chairman Kelly. Appointment of Chairman Pro Tem Commissioner Gavin made a motion, seconded by Commissioner Yearman, to appoint Commissioner Chairman Pro Tem. Yeas : Commissioners Gavin and Yearman. Approval of Minutes - November 4, 1998 Commissioner Gavin stated that the November 4, 1998, minutes should reflect that Commissioner Gavin seconded the motion to approve the minutes of the October 7, 1998, meeting. Commissioner Gavin made a motion, seconded by Commissioner Yearman, to approve the November 4, 1998, as corrected. Yeas : Commissioners Gavin and Yearman. License Application of App1eILLINOIS, L.L.C. for Class E Liquor License for Establishment Known as Applebee's Neighborhood Grill & Bar, 125 S. Randall Road Commissioner Gavin made a motion, seconded by Commissioner Yearman, to approve the aforesaid application, subject to receipt of all necessary documents, including favorable criminal background reports from the Illinois State Police. Request of M.A.B. , Inc. , d/b/a JB's Pub, 207 South McLean Boulevard, for Variance from Time Limitation Set Forth in Elgin Municipal Code 6.06.055 Kevin McCarty, attorney for M.A.B. , Inc. advised the Commission that an amendment to the City' s Liquor Code would be required in order for the above establishment to be able to continue having an exterior sales permit for its beer garden after March 2001 . The Commission discussed allowing the subject establishment to continue applying for annual exterior sales permits and eliminating the date in Elgin Municipal Code Section 6 . 06 . 055 . Commissioner Gavin made a motion, seconded by Commissioner Yearman, to make a recommendation to the City Council to amend Section 6 . 06 . 055 to allow the subject establishment to continue applying for annual exterior sales permits and to completely eliminate a date in said section. Liquor Commission Meeting January 6, 1999 Page 2 rik Miscellaneous At the request of Chairman Kelly, Commission Secretary Mecum advised the Commission that an application will be forthcoming for the White hen Pantry at 11 North McLean Boulevard from the corporation known as Wayne & Betty Barthel, Inc . , which currently is the franchisee for the White Hen Pantry at 333 South McLean Boulevard. The Barthels will be applying for a Class B-i liquor license. Said establishment currently has a Class B liquor license. Application of Betty & Wayne Barthel, Inc. for Class B-1 Liquor License for Establishment Known as White Hen Pantry #0-8819-3, 1195 North McLean Boulevard Diane Larsen, attorney for owners of the gasoline station and few convenient store, across the street from the subject property, stated that her clients object to issuance of a liquor license for this establishment and believe City regulations should be applied consistently. Commissioner Gavin made a motion, seconded by Commissioner Yearman, to approve the application, subject to a B-1 liquor license being available for this establishment, and to make a recommendation to the City Council that it increase the number of B-i liquor licenses by one. Discussion Regarding Automatic Downgrade from Class B to B-1 Liquor License In the absence of Chairman Kelly, this item was deferred until he could be present. Liquor Commission Meeting April 7, 1999 Page 2 Announcement of Special Liquor Commission Meeting on April 21, 1999, at 1 p.m. Chairman Pro Tem Yearman announced that a special Liquor Commission meeting will be held April 21, 1999, at 1 p.m. to consider the applications for renewal for liquor licenses for the 1999-2000 license year. Chairman Secretary Mecum stated that an application for a liquor license filed by the Elgin Plaza Hotel will also be considered at the April 21 meeting. However, a review by the Zoning Officer revealed that the Summit School is now located on property adjacent to the hotel property, and the Elgin Municipal Code prohibits the issuance of a liquor license to any premises within 100 feet of any school . A liquor license may not be issued for the applicant hotel unless the Code is amended. Corporation Counsel Cogley described the following options for amending the Code which would permit the Liquor Commission to consider approving the application: 1 ) prohibition could be limited to initial liquor licenses at a premises located within 100 feet of a church or school; 2) prohibition could exclude restaurants with regular capacity to serve more than 150 persons rft and hotels having not fewer than 150 guest room; 3) or a combination of these two alternatives . The Liquor Commission directed that this matter be placed on the Council agenda for the April 14 , 1999, meeting and that the various alternatives be presented to the Council for their consideration. Consideration of Applications for Renewal of Liquor Licenses for the Period May 1, 1999 through April 30, 2000 A discussion was held regarding the letters received from R. R. Donnelly and Home Federal Savings and the memorandum from the Police Department regarding various issues involving the Spring Street parking deck. Large quantities of beer cans and bottles litter the parking deck and individuals drink alcohol in the parking deck and harass R. R. Donnelly employees as they arrive for and leave work. The Police Department believes the problem stems from the fact that many of the patrons leaving Elgin Restaurant at closing time purchase beer for off-premise consumption and drink it in the parking deck. The manager of Elgin Restaurant stated that he believes a number of their customers purchase and consume beer prior to arriving at Elgin Restaurant and then discard the containers at the parking deck. He stated that he will have his employees pick up the litter, and he will also make annoucements at his establishment during the evening regarding the prohibition of littering and drinking Liquor Commission Meeting April 21, 1999 Page 2 in the parking deck. He also indicated that he would not want to eliminate his ability to sell beer for off-site consumption. The Commission also discussed the issue of an open window in the Mission' s women' s bathroom, which is across the street from the parking deck. The owner of the Mission stated that he now has a bathroom attendant, and he will block the window so that it will not be possible to view anyone in the bathroom from the deck. Commissioner Yearman suggested that both establishments be notified that they would be unable to sell alcohol after April 30 unless an application is received and a special meeting held by the Liquor Commission to approve said application. Discussion Regarding Automatic Downgrade from Class B to B-1 Liquor License The Elgin Liquor Code provides that when there is a change in ownership of a convenient store or gasoline filing station, the establishment may only qualify for a Class B-1 liquor license. If the Liquor Commission gives tentative approval for a Class B-1 license to the new owner, it is necessary to have the City Council consider whether or not to increase the number of B-1 licenses in order to make a license available for the new owner of the convenient store or gasoline station. Liquor Commission Meeting April 21, 1999 Page 5 Chairman Kelly suggested that the Liquor Commission make a recommendation to the City Council to amend the Liquor Code to provide that under the above-described circumstances there be a provision to automatically decrease the number of Class B licenses and increase the number of Class B-i licenses . Members present: Commissioner Yearman. Absent: None. Application for Renewal of Betty & Wayne Barthel, Inc. for Class B Liquor License for White Hen Pantry, Inc, 333 South McLean Boulevard Commissioner Yearman made a motion, seconded by Chairman Schock, to approve the aforesaid application. Yeas : Commissioner Yearman and Chairman Schock. Nays : None. Change in Meeting Time Chairman Schock announced that the Liquor Control Commission is changing the time of their regular meetings from 1 : 00 p.m. to 4 : 00 p.m. on the first Wednesday of the month. A notice will be published in the newspaper as required by state statutes . Miscellaneous A memorandum received from Deputy Police Chief Darr reflected that nine liquor establishments were checked on April 23, 1999, to determine if they complied with the prohibition against selling liquor to a minor. Speedway/Starvin' Marvin was the only establishment of the nine checked that failed to comply. Corporation Counsel Cogley was directed to schedule a public hearing regarding the allegation of sale of liquor to a minor by the Speedway/Starvin Marvin establishment at 1570 Big Timber Road at the June Liquor Commission meeting. The Liquor Commission also stated that it wished to continue the practice of sending letters to those establishments which successfully pass the investigations . Public Hearing Regarding Speedway SuperAmerica LLC, d/b/a Speedway/Starvin Marvin #7513, 1570 Big Timber Road, Holder of Class B-1 Liquor License; Violation of Elgin Municipal Code Sections 6.06. 140 and 6.06. 150 - Sale of Alcoholic Liquor To a Minor by Agent and Employee of Licensee Corporation Counsel Cogley advised the Commission that the attorney for licensee, Speedway SuperAmerica LLC, requested a continuance in that he is on trial . Commissioner Wasilowski made a motion, seconded by Chairman Schock, to continue the public hearing to the July 7, 1999, meeting. Yeas : Commissioner Wasilowski and Chairman Schock. Nays: None. Consideration of Proposed Amendment to the City's Liquor Code to Reduce the Number of Class B Liquor Licenses Corporation Counsel Cogley advised the Commission that the Elgin Municipal Code currently allows 21 Class B liquor licenses . Two Class B licenses exist which have not been issued due to the closing of the former 7-Eleven store at 633 E. Chicago Street and the surrender of the liquor license for the White Hen Pantry at 1195 N. McLean Boulevard. Commission Secretary Mecum advised the Commission that the franchisees for the White Hen Pantry at 333 South McLean Boulevard have advised her they also intend to surrender their liquor license on June 8 . Commissioner Wasilowski made a motion, seconded by Chairman Schock, to make a recommendation to the City Council to pass an ordinance reducing the number of Class B liquor licenses by three if the liquor license for the South McLean White Hen Pantry is surrendered or by two if that does not occur. Yeas : Commissioner Wasilowski and Chairman Schock. Nays : None. In view of the City Council ' s recent trend to reduce the number of Class B licenses, licensees Roger Riebock and Jerry Mowinski expressed their concern about the future marketability of their business if there is a probability that the purchaser of their business might not be able to obtain a liquor license. Chairman Liquor Commission Meeting June 2, 1999 Page 2 Schock stated that it is not the Council ' s intention to eliminate all package liquor licenses . However, saturation and proximity to distressed neighborhoods will be taken into account when considering an application for a liquor license. Assistant Corporation Counsel Gehrman presented exhibits which reflected that there have been four previous incidents of sale of liquor to a minor at this establishments . The dates and fines are as follows : December 1987-fine $750 ; April 1993-fine $1000 ; August 1995-fine $2000 ; and March 1998-fine $1000 . Mr. Gehrman also presented a group exhibit which indicated that letters have been sent to Speedway indicating that on three occasions they successfully passed Police Department investigations wherein they refused to sell alcohol to a minor who attempted to make a purchase . Attorney Vittori described the liquor and tobacco training that each new employee receives, and he stated that they are supervised thereafter for some time . Commissioner Wasilowski made a motion, seconded by Commissioner Yearman, to assess a fine in the amount or $2000 plus the cost of the court reporter. Chairman Schock advised Mr. Vittori that stronger measures will probably be taken if there is another incident of sale of liquor to a minor at this establishment . Application of Talisman Theatre for Class I Special Event Liquor License, Including Discussion of Ordinance Amendments to Allow for Alcoholic Liquor in Wing Park Discussion was held regarding the request of Talisman Theatre to amend the Elgin Municipal Code to permit the sale of alcohol in City Parks . Corporation Counsel Cogley advised the Liquor Commission that the proposed ordinance he prepared provides that only alcohol could only be sold in the parks at events sponsored or cosponsored by the City, and because of deed restrictions prohibiting alcohol in the park, this amendment would not apply to Lord' s Park. Mr. Cogley suggested that the proposed ordinance also require Police Department approval of a security plan. Mr. Cogley also suggested that the provision requiring a bond for Class I licenses only pertain to those situations when no vendor is being used. Councilman Wasilowski made a motion, seconded by Chairman Schock, to recommend to the City Council that the Elgin Municipal Code be amended to allow the sale of beer and wine in City parks when sponsored or cosponsored by the City, to require the filing and approval of a security plan for Class I liquor licenses, and to only require posting of a $5 , 000 bond when no vendor is being used for the event . The motion also included approval of the Talisman Theatre and City of Elgin application for a Class I liquor license for August 5-8 and August 12-15, 1999 . Corporation Counsel Cogley also placed into the record a memorandum from Police Sergeant Welter regarding the fact that the applicant had liquor license violations in Carpentersville and Schaumburg in addition to those listed on the application form. Located at 50 North Spring Street The applicant stated that she is intending to use the upper portion of the building, which fronts Spring Street, as a banquet facility. The lower portion of the building, which has its entrance off Highland Avenue, will be a bar and restaurant . Discussion was held regarding whether a Class A license would be an appropriate license for a banquet facility in that the Elgin Municipal Code prohibits anyone under the age of 21 years from being on the premises of a Class A licensed establishment unless they are with a parent, guardian or spouse . It is likely that there might be guests invited to a wedding that would not be 21 years old and not accompanied by their parents . Corporation Counsel Cogley advised the Commission eft that this incident is the result of a police investigation which occurred on September 4, 1999 . The licensee has filed a stipulation acknowledging that the allegations set forth in the complaint relating to the sale of alcoholic liquor to a minor did occur. There has been one prior incident of this nature involving this licensee on August 13 , 1998 , and he was fined $750 . In response to a question from Commissioner Yearman, Mr. Patel acknowledged that the employee who sold liquor to the minor had not had BASSET training. Chairman Schock advised Mr. Patel that this is not an acceptable practice and employees must receive BASSET training. Commissioner Yearman made a motion, seconded by Commissioner Wasilowski, to assess a fine of $750 plus costs . Yeas : Commissioners Wasilowski, Yearman, and Chairman Schock. Nays : None. Consideration of Proposed Amendment to the City' s Liquor Code to Provide for Banquet Facility License Class Discussion was held regarding the fact that the proposed ordinance establishing a license class for banquet facilities did not permit a cash bar or functions that did not include full meals, such as fundraisers for charities or political parties at which there typically is a cash bar and appetizers, rather than a meal .
