FEBRUARY 2, 1994
The meeting was called to order at 1 :05 p.m. in the Council
Conference Room by Commission Chairman George VanDeVoorde.
Members present: Commissioners Schock, Popple (arrived at
1 : 08 p.m. ) , and Chairman VanDeVoorde. Absent: None.
Approval of Minutes
Commissioner Schock made a motion, seconded by Chairman
VanDeVoorde, to approve the minutes of the December 1, 1993,
regular meeting and the December 6, 1993, special meeting.
Yeas : Commissioner Schock and Chairman VanDeVoorde. Nays:
None.
Application of Lawrence Pub, Inc. for Class E liquor license for
John's Place, 835 Summit Street
A discussion was held regarding the report of the Public Health
Officer concerning deficiencies found in the above establishment.
The Commission was also advised that the new owner must obtain
an occupancy permit, which will require other inspections, such
" as electrical, building, etc.
The Commission advised the applicant that they will not consider
his application until all codes have been complied with. They
agreed to hold a special meeting on February 23, 1994 , to
consider this application.
Continued discussion regarding proposed amendments to liquor
ordinance
Commissioner Popple made a motion, seconded by Commissioner
Schock, to recommend approval to the City Council of the
proposed ordinance establishing a Class M liquor license for
small restaurants on Fountain Square Plaza. Yeas :
Commissioners Popple, Schock, and Chairman VanDeVoorde. Nays :
None.
Commissioner Popple made a motion, seconded by Commissioner
Schock, to recommend approval to the City Council of the
proposed ordinance repealing the prohibition against dancing in
certain licensed establishments . Yeas : Commissioners Popple,
Schock, and Chairman VanDeVoorde. Nays : None.
Notification of Name Changes
The Commission was informed that the establishment formerly
known as Book Binders and Memories, located at 50 North Spring
Street, is now doing business as Facaccia' s .

The Commission was also informed that the establishment formerly
known as Uncle Paul ' s Restaurant is now doing business as
Lefty' s Food Factory. The sole shareholder, officer, and
director of the licensee corporation, Uncle Paul ' s Restaurant,
Inc. , is now George Arsoniadis .
Staff Liaison to Liquor Commission
Assistant Corporation Counsel Gehrman advised the Liquor
Commission that Assistant Corporation Counsel, William Cogley,
will be the staff liaison to the Liquor Commission for the next
several months .
Charlie's Place
Commissioner Popple made a motion, seconded by Commissioner
Schock, to set a disciplinary public hearing at the March 2,
1994, meeting at 1 p.m. , regarding the alleged sale of liquor to
minors as reported in the recent police report. Yeas :
Commissioners Popple, Schock, and Chairman VanDeVoorde. Nays :
None.
After discussion, it was agreed that Attorney Robert Smith of
Chicago should represent the Liquor Commission atthis public
hearing. However, local attorneys will be considered for future
Liquor Commission public hearings .
Resident Alien Identification Cards
Jerry Mowinski asked for a ruling regarding whether resident
alien identification cards issued by the Department of
Naturalization are a valid piece of identification for the
purpose of purchasing liquor. Assistant Corporation Counsel
Gehrman was directed to furnish Mr. Mowinski with the requested
information.

MARCH 2, 1994
The meeting was called to order at 1:00 p.m. in the Council
Conference Room by Mayor Pro Tem Gilliam. Members present:
Commissioners Commissioners Popple and Schock and Mayor Pro Tem
Gilliam. Absent: Commission Chairman VanDeVoorde.
Approval of Minutes
Commissioner Popple amended the minutes of the February 23,
1994 , meeting to reflect the correct date of February 23 and to
reflect that she was absent.
Commissioner Schock made a motion, seconded by Commissioner
Popple, to approve the minutes of the February 2, 1994, regular
meeting, and the February 9, 1994, special meeting, and to
approve the minutes of the February 23, 1994, special meeting as
amended. Yeas: Commissioners Popple and Schock and Mayor Pro
Tem Gilliam. Nays : None.
License Application of Elgin Community College, 1700 Spartan
Drive, for Class G Liquor License for March 15, 1994, for
Visiting Chef's Recognition Dinner
Commissioner Popple made a motion, seconded by Commissioner
Schock, to approve the aforementioned application. Yeas:
Commissioners Popple and Schock and Mayor Pro Tem Gilliam.
Nays : None.
Entry of Stipulation Regarding Charlie's Place
Assistant Corporation Counsel Gehrman stated that he had
previously been directed by the Liquor Commission to prepare a
complaint against the owners of Charlie' s Place pursuant to the
charge of sale of liquor to minors and later for the sale of
controlled substance by an employee. He was advised by Attorney
Fred Cohn, representing Charlie' s Place, that the liquor license
for Charlie's Place was going to be surrendered voluntarily .
Rosalio A. Perez, one of the shareholders and officers of Avina
Bros, Inc. , d/b/a Charlie' s Place, submitted a statement
executed by him, surrendering their liquor license effective
March 20, 1994, at 2 a.m.
Commissioner Schock made a motion, seconded by Commissioner
Popple, to accept the relinquishment of the liquor license of
Avina Brothers, d/b/a Charlie' s Place. Yeas: Commissioners
Popple and Schock and Mayor Pro Tem Gilliam. Nays : None.

Request of Illinois Treasurer Patrick Quinn for Advisory
Referendum Regarding "Not A Drop" law for teenage drivers
The aforementioned request was discussed by the Liquor
Commissioners . They requested that the Police Department
furnish them with its position and recommendation regarding the
proposed referendum before they take any action regarding this
request.
Scheduling Special Meeting in April for consideration of
Applications for Renewal of Liquor Licenses
By consensus, the Commission scheduled a special meeting for
April 20, 1994, at 4 p.m. , including but not limited to
considering applications for liquor license renewal .

The regular rescheduled meeting was called to order at 6 : 30
p.m. in the Council Conference Room by Commission Chairman
George VanDeVoorde. Members present: Commissioners Schock,
Popple, and Chairman VanDeVoorde. Absent: None.

Commissioner Popple made a motion, seconded by Commissioner
Schock, to approve the minutes of the March 2, 1994, meeting.

Commissioner Popple made a motion, seconded by Commissioner
Schock, to approve the aforementioned application, subject to
the Clerk' s receipt of all necessary documents . Yeas :

' Discussion regarding liquor license renewals
A discussion was held concerning whether the Commission wanted
to meet with any of the current licensees at the time their
application for renewal is considered. It was the consensus of
the Commission not to meet with any of the licensees at this
time.
959 Villa Street
City Clerk Mecum advised the Commission that an application for a
liquor license has been received for 959 Villa Street, site of
the former Charlie' s Place. Consideration of this application
is scheduled for the special meeting on April 20, 1994 .
Commission members requested that they be advised of the status
of the pending Cook County State's Attorney's nuisance abatement
proceedings against the owner of the subject property prior to
consideration of the application for liquor license.
Continued Discussion regarding Illinois Treasurer Quinn's
request for advisory referendum regarding "Not A Drop" law for
teenage drivers
Pursuant to the Commission's request, Deputy Police Chief Burns
advised the Commission of the Police Department's opinion and
recommendation concerning the aforementioned referendum. He
outlined various concerns that the Police Department has
regarding the proposed legislation. It was the consensus of the
Commission not to take any action on this request.

Deputy Chief Burns advised the Commission of what actions are
currently taken when a minor is caught driving after having
consumed alcoholic liquor. He also stated that Elgin hotels
have been contacted and advised to prohibit teenage drinking
parties at their establishments .
Miscellaneous
A special Liquor Commission meeting will be held April 20, 1994,
at 4 : 30 p.m. for the purpose of considering new and renewal
applications .

City Clerk Mecum advised the Commission that the aforementioned
application has been withdrawn because of the Fox River Water
Reclamation District' s requirement that a grease trap be

license.

Discussion regarding future renewal procedures
A discussion was held concerning the possibility of having all
licensed premises inspected prior to renewal in future years and
making compliance with all City codes a requirement for liquor
license renewal . The importance of informing licensees well in
advance was stressed should compliance with all codes be a
prerequisite to liquor license renewal . Assistant Corporation
Counsel Cogley was requested to contact area communities to
determine whether inspections are part of their liquor license
renewal procedures . Further discussion regarding this matter
will be held at a future meeting.
Status Report on Application for Liquor License for
Establishment Located at 959 Villa Street
Police Officer Duffy informed the Commission that a plea
negotiation has been entered in between the Cook County State' s
Attorney' s Office and the owner of the property at 959 Villa
Street regarding the nuisance abatement charges filed against
Mr. and Mrs . Richard Lange. As part of the plea negotiation,
the Langes have admitted the charges filed against them and have
agreed that the premises shall be closed until August 5, 1994,
that they will not execute a lease before July 5, 1994, and have
agreed to abide by various other provisions for a year should
the premises be used as a tavern or restaurant.
In view of the foregoing,. City Clerk Mecum advised the
Commission that the application for a liquor license recently
filed for said establishment has been withdrawn.

City Clerk Mecum advised the Commission that the Police
Department has delivered letters to four establishments which
have not yet produced the appropriate Certificate of Insurance
with reference to their applications for renewal of liquor
licenses .
She also advised the Commission that the owners of the Shanghai
Restaurant have not yet decided whether to proceed on renewal
under the former corporate name or to apply for a new license
under a new corporate name. In the meanwhile, they are not
serving alcoholic liquor.

Chairman VanDeVoorde made a motion, seconded by Commissioner
Schock, to approve the aforementioned application with issuance
of the liquor license being subject to the lease being further
revised to incorporate the terms of the Cook County Order
regarding the premises to the satisfaction of corporation
counsel and compliance with all codes . Yeas : Commissioner
Schock and Chairman VanDeVoorde. Nays : None.
Report of results of survey regarding systematic code inspection
programs as part of annual liquor license renewals
A discussion was held regarding the aforementioned report and
whether the City of Elgin should make systematic code inspection
part of its annual liquor license renewal process . Chairman
VanDeVoorde stated that he can see the merit in making sure
licensees comply with all codes but expressed concern about only
singling out liquor licensees . Commissioner Schock agreed that
the City should consider moving toward licensing and inspecting
all businesses . However, in the meantime, Commissioner Schock
suggested that the inspections which are already being conducted
on liquor licensees be expanded to include several more items .
Code Administration Director Webb will prepare a checklist which
can be furnished to licensees so that they are aware of what is
expected of them regarding code compliance.

Request of Carlos Villanueva to hold dances at Foxhole Nightclub
for persons under the age of 21 years
A discussion was held concerning the aforementioned request.
Allowing "teen nights" at a licensed establishment would require
an amendment to the liquor ordinance. Several concerns were
raised regarding parking, whether this is a permitted use, and
whether there are any conditions in the PUD which would disallow
this use.
Commissioner Schock made a motion, seconded by Chairman
VanDeVoorde, to refer this request to the City Council for its
consideration and have it placed on the agenda for the July 27,
1994 , Committee of the Whole meeting. Yeas : Commissioner
Schock and Chairman VanDeVoorde. Nays : None.
Police Report regarding John's Place, 835 Summit Street
A discussion was held regarding the June 3, 1994, police report
regarding people drinking in John' s Place after hours .
Chairman VanDeVoorde made a motion, seconded by Commissioner
Schock, to have a public hearing on the alleged liquor ordinance
violation at its next regular meeting on August 3, 1994 . Yeas :
Commissioner Schock and Chairman VanDeVoorde. Nays : None.
Assistant Corporation Counsel Cogley recommended that the
section of the liquor ordinance pertaining to allowing persons
to remain on the premises after hours be amended to clarify any
possible ambiguities . The Commission directed him to draft such
an amendment.

License Application of 2 South State, Inc. for Class B liquor
license for proposed convenience store known as J. J. Peppers
Food Store, 2 South State Street
After discussion and input from the applicants and objectors to
the application, Commissioner Schock made a motion to deny the
aforementioned application as presented in that state statutes
and local ordinances prohibit issuance of a liquor license to an
establishment within 100 feet of a church. Applicants may
reapply if circumstances change. Yeas : Commissioners Popple,
Schock, and Chairman VanDeVoorde. Nays : None.
Commissioner Popple made a motion that notice of the liquor
commission meeting at which a liquor application will be
considered be mailed directly to all property owners, using the
same standard as that applied for land use hearings . The motion
was withdrawn. Assistant Corporation Counsel Cogley is to
prepare a proposed ordinance providing for written notification.
Notification of Name Change for John's Place, 835 Summit Street
The City Clerk received notification that the establishment
formerly known as John' s Place has been changed to Legacy' s Bar
& Grill . Further, the name of the corporate liquor licensee for
this establishment has been changed from Lawrence Pub, Inc. to
Legacy' s Restaurant & Lounge, Inc.
Commissioner Popple requested that the municipal code be amended
to require notification when an establishment with a liquor
license changes its name.

Public hearing regarding Legacy's Restaurant & Lounge, Inc. ,
(f/k/a Lawrence Pub, Inc. ) d/b/a Legacy's Bar & Grill (f/k/a
John's Place) , located at 835 Summit Street, Class E liquor
license - violation of Elgin Municipal Code 6 .06. 140(N) and
6.06. 150(A) - allowing persons to remain on the premises and
consume alcohol on the premises after 1 a.m.
Dimitri Stathakis, sole shareholder and manager of the
establishment now known as Legacy' s Bar & Grill, appeared
pursuant to the Notice of Hearing with reference to the
aforementioned violation. Said licensee was also represented by
Attorney Harry Gabrielides .
The licensee stipulated that the allegations and matter set
forth in the Complaint dated July 12, 1994, relating to
permitting persons to remain on the licensed premises after the
designated hours did occur. Attorney Gabrielides advised the
Commission that this is his client ' s first liquor license. In
the future he will see to it that all rules are observed. He
requested that Mr. Stathakis be shown leniency.
Commissioner Popple made a motion, seconded by Commissioner
Schock, to assess a fine of $750 plus the court reporter' s cost
for the hearing. Yeas : Commissioners Popple, Schock, and
Chairman VanDeVoorde. Nays : None.
Chairman VanDeVoorde stressed to the licensee that compliance
with all ordinances must be obeyed, and he particularly stressed
the Commission' s concerns regarding sale of liquor to minors .
A complete transcript of the proceedings may be obtained from
the court reporting firm of Janson Reporting and Record Copy
Service, Elgin, Illinois .
Discussion regarding Police Report No. 94-07-0924 concerning
212 Club, 212 Ball Street
Assistant Corporation Counsel Cogley advised the Commission that
he was still investigating the statement contained in the
aforementioned police report regarding a minor drinking at the
212 Club to determine whether the allegation could be proven.
Chairman VanDeVoorde reported that he has heard of people
leaving this establishment and being robbed and accosted. He
also requested that the Department of Code Administration check
on occupancy levels on Saturday nights .
Commissioner Popple made a motion, seconded by Commissioner
Schock, to continue this matter to the next regular meeting.

Discussion regarding liquor license for facilities at Grand
Victoria Casino Pavilion
Attorney Mike Moses, representing Elgin Riverboat Resort,
addressed the Commission regarding a liquor license for the
Grand Victoria Casino pavilion. He outlined the various service
areas in the pavilion as follows :
First Floor
Steak restaurant for approximately 60 people with a service
bar.
Open food court area for approximately 300 patrons with
regular bar service.
Sports bar with seating for approximately 180 patrons .
Terrace area outside the sports bar.
Second Floor
Banquet facility with seating for approximately 300
people. Portable bars will be used. Terrace area
immediately outside this facility.
VIP lounge with a terrace area.
All the service areas will be owned and operated by Elgin
Riverboat Resort. Mr. Moses suggested that one license be
issued with a sliding scale based on the number of service areas .
The Commission directed Assistant Corporation Counsel Cogley to
work with Attorney Moses to draft a proposed ordinance for a
single liquor license for multiservice areas .
Mr. Moses requested that he be allowed to commence the liquor
license application process prior to the City Council passing an
ordinance regarding a new license class for this situation. The
Commission had no objection.
Letter and Information Bulletin from the Illinois Liquor Control
Commission regarding changes to the Illinois Liquor Control Act
The City Clerk furnished the Commission with material received
from the Illinois Liquor Control Commission which advises that
one of the changes made to the Illinois Liquor Control Act
requires that fraternal, educational, political, civic,
religious and not-for-profit organizations now also obtain a
state special event license.

Commissioner Popple stated that she is continuing to receive
complaints about traffic problems created by Highland Liquor
customers . She believes the store is detrimental to the
neighborhood, which is already in decline. Commissioner Popple
made a motion, seconded by Commissioner Schock, to request that
the owner of Highland Liquor meet with the Liquor Commission at
the September 7, 1994, meeting, to discuss the problem of
parking and its intrusion into the neighborhood. Yeas :

Consideration of proposed ordinance adding a Class N liquor
license for riverboat gaming pavilion
The Commission reviewed the proposed ordinance which establishes
a Class N liquor license for the riverboat pavilion. The Class
N license will be for the various designated service areas and
will also include adjoining exterior terrace areas utilized in
conjunction with the designated areas included in the proposed
ordinance. Discussion was held concerning the amount of the
annual license fee.
Councilwoman Popple made a motion, seconded by Councilman
Schock, to recommend approval of the form of the proposed
ordinance to the City Council with the amount of the fee to be

A special liquor commission meeting will be held at 4 :55 p.m. on
September 21, 1994, to consider the application of Elgin
Riverboat Resort for a Class N liquor license.
Meeting with owner of Highland Liquors, 325 West Highland Avenue
At the request of the Liquor Commission, Nick Garris, sole
shareholder and manager of Highland Liquors, appeared before the
Commission with Attorney Allen Anderson to discuss the
complaints of residents in the neighborhood concerning parking
and other problems created by customers of Highland Liquor.
Mr. Garris stated that he has attempted to obtain additional
parking accommodations but has been unsuccessful to date . He
has tried to work with the neighbors regarding their
complaints . He has posted signs requesting his customers go
elsewhere if the parking lot is full .
Police Chief Gruber suggested that the matter be referred to his
department, and they will try to work with Mr. Garris to resolve
some of the problems complained of by the neighbors .
The Commission reminded Mr. Garris that his business is located
in a residential area. If a business creates an inordinate
amount of problems, it can be closed.
The police department is to report on the results of its
discussions with Mr. Garris at the next regular Liquor
Commission meeting.
Continued discussion regarding 212 Club, 212 Ball Street
Assistant Corporation Counsel Cogley reported that he has not
been able to get any cooperation from the minor involved in the
incident which occurred July 17, 1994 . He recommended that the
Commission not proceed with a public hearing.
Discussion regarding amending provision for Class I liquor
license to allow City of Elgin to be applicant for special
events, such as the Fine Arts Festival
Chairman VanDeVoorde made a motion, seconded by Commissioner
Schock, to approve preparation of an ordinance regarding the
aforementioned amendment. Yeas : Commissioners Popple, Schock,

Discussion regarding Elgin Restaurant, 219 East Chicago Street
A discussion was held concerning Police Report 94/09-0142
wherein a minor stated that he had been served several bottles
[ of beer at the Elgin Restaurant. Assistant Corporation Counsel
Cogley stated that the minor has a court date of September 23,
1994, on the charge of consumption of alcohol by a minor. If
the minor is willing to testify before the Liquor Commission,

Mr. Cogley will schedule a hearing regarding Elgin Restaurant at
the Commission' s next regular meeting.
Commissioner Schock made a motion, seconded by Commissioner
Popple, to proceed as outlined above. Yeas : Commissioners

Discussion regarding possible changes to license classes and fees
A brief discussion was held concerning the above. The
Commission stated that perhaps the entire liquor ordinance
should be reviewed and revised. It was suggested that the Clerk
attempt to obtain model ordinances from Illinois Municipal
League, National League of Cities, and other municipalities .
Miscellaneous
Commissioner Popple said that Aurora has an ordinance which
allows patrons to leave their cars at a drinking establishment
for 24 hours rather than having someone drive while
intoxicated. She suggested Elgin consider a similar ordinance.
Chief Gruber stated that he did not think the Elgin
establishments would object to patrons leaving their cars under
those circumstances and that an ordinance probably was not
necessary.

OCTOBER 12, 1994
The special meeting was called to order at 6 : 50 p.m. in the
Council Conference Room by Commission Chairman George
VanDeVoorde. Members present: Commissioners Popple, Schock,

Consideration of Application of Carlos Villanueva for Teen
Night Permits at Fox Hole Nightclub, 100 Tyler Creek Annex,

Commissioner Popple requested that the flyers being distributed
by the nightclub specifically state that no alcoholic beverages
are allowed during these events . Mr. Villanueva agreed to the
request.
Chairman VanDeVoorde made a motion, seconded by Commissioner
Schock, to approve the October 23 and October 30 Teen Night
Permits, and consider the November 6 and November 13 requests at
the November 2, 1994, Liquor Control Commission meeting. Yeas :

Consideration of Application of Illinois Suburban Soccer
League, 62 Fountain Square Plaza, for End of Season Awards
Dinner/Dance to be held at the Elgin Armory, 254 Raymond Street,
November 13, 1994; Vendor is 212 Club, 212 Ball Street
Commission members expressed their concerns regarding the
limited availability of parking at the Armory and the impact it
will have on the neighborhood. As in any other event, there
must be adequate parking for the event without infringing on the
neighbors . Last year parking was not an issue because there was
sufficient parking in an adjacent public lot. This year that
lot is part of the Riverboat Property and is not available for
Armory parking. Deputy Chief Burns reported that there are 48
regular parking spaces and 2 handicap parking spaces at the
armory.
Commission members inquired if the building meets the city' s
code requirements . Department of Code Administration Director
Webb reported that the armory is a state facility and is not
subject to city inspections but the staff at the armory said
they would welcome inspections at any time. Mr. Webb also
reported that the sergeant at the Armory stated that they wish
to do away with liquor licenses at the facility.

Applications of Carlos Villanueva, d/b/a Foxhole Nightclub, 100
Tyler Creek Plaza, for Teen Night Permits for November 6, 13,

Mr. Villanueva requested that the Liquor Commission make a
recommendation to the City Council to amend the teen night
permit ordinance to require one police officer instead of two.
Discussion was held and Commissioners stated that they did not
feel comfortable making such a recommendation in that the
experience with teen night events was still so limited in that
there had only been two teen night events held so far.
Mr. Villanueva also stated that there were times that both
police officers were outside the establishment at the last
event. They also told him that they could not enforce the "no
loitering" signs . The police liaison was directed to check into
these matters and report back to the Liquor Commission.
Report of Elgin Police Department Regarding Highland Liquors
The Commission was furnished with a written report from Sergeant
Buck regarding steps taken by the owner of Highland Liquors to
minimize the impact of his business on the neighborhood.
Sergeant Buck stated that Mr. Garris appears to be concerned
about his relationship with his neighbors and willing to take

those steps necessary to cooperate with his neighbors . The
Recording Secretary was directed to place this report in the
Highland Liquor file.
Police Report regarding Alleged Sale of Liquor to Minor by
Employee of Liberty Liquors, 601 Cooper Avenue
Assistant Corporation Counsel Cogley advised the Commission that
a conviction had been entered on the criminal complaint against
the employee charged with the sale of liquor to a minor.
Commissioner Schock made a motion, seconded by Commissioner
Popple, to have a public hearing on the alleged liquor ordinance
violation at the December 7, 1994, meeting. Yeas :
Commissioners Popple and Schock. Nays : None.
Police Report Regarding Elgin Restaurant
Assistant Corporation Counsel Cogley advised the Commission that
the minor who was charged with consumption of alcohol failed to
appear in Court and a warrant has been issued for his arrest.
Miscellaneous
Carlos Villanueva stated that he observed people drinking
alcohol in the Grand Victoria Casino Pavilion after the hours
when alcohol is allowed to be served. The Commission requested
that the Police Department follow up on the allegation and
report to the Liquor Commission at the next meeting.

Thomas Hoppe, president and shareholder of Liberty Liquors,
Inc. , appeared pursuant to the Notice of Hearing with reference
to the aforementioned violation. Mr. Hoppe filed a written
stipulation with the Liquor Commission stipulating to the
allegations and matters set forth in the complaint dated
November 9, 1994 , relating to the sale of alcoholic liquor to a
person under the age of 21 .
Commissioner Schock made a motion, seconded by Commissioner
Popple, to assess a fine in the amount of $750 plus costs .

A discussion was held regarding Mr. Villaneuva 's noncompliance
with two requirements of the ordinance concerning teen night
permits . He has been using a manual counter rather than an
automatic counter, and he has not been issuing parking claim
tickets to control the parking lot and the number of patrons who
use the lot. It was the consensus of the Commission that a
ep. manual counter was sufficient, and that it would be difficult to
close the parking lot and issue parking lot tickets at this
location in that there are other businesses which also use the

Counsel Cogley to revise the existing ordinance to provide that
either automatic or manually operated counters to determine the
occupancy of the building may be used and to give the police
department discretion regarding the requirement to close the

Application of 2 South State, Inc. for Class B Liquor License
for J. J. Peppers Store at 20-22 South State Street
James Edward Syre and Ricky E. Heidner, shareholders and
officers of 2 South State, Inc. , were present and also
represented by Attorney Mark Schuster.
Attorney Schuster stated that this application is for Lots 10,
11, and 12, which are located more than 100 feet from the
Iglesia Apostolica Church. Lot 9, which is on the corner of
Chicago and State Streets, is owned by Parkway Bank and Trust
Company. Mr. Sayre and Mr. Heidner stated that they have no
control of or any ownership interest in Lot 9 . The proposed use
for the subject property is a food store/delicatessen, including
the sale of package liquor, which is anticipated to be
approximately 15% of sales . Mr. Sayre and Mr. Heidner have
constructed 19 other J. J. Peppers stores in the Chicagoland
area. They have an interest in a number of these stores which
have been granted liquor licenses, and they have never had such
a license revoked. Applicants displayed a site plan for the
subject proposal and photographs of a number of their other
stores .

A number of area residents and business owners were present and
stated their objections to the proposed application for a liquor
license.
Paul Berman has a business at 119A West Chicago Street. He
stated that he has information concerning repeated food stamp
problems in one of the Chicago J. J. Peppers stores . He also
stated that the fact that the applicants are not including Lot 9
in the proposed project is a "sham. "
Wende Whiston stated that many of the neighbors are concerned
about all the liquor establishments in the area and the many
problems as a result thereof.
Karen Ahrens, 64 South Crystal, stated that approximately 120
area residents and business owners have signed petitions urging
the Elgin Liquor Commission not to issue a liquor license for
the proposed J. J. Peppers store. She said that the people are
very concerned about problems created by the nearby Highland
Liquors establishment. She said there are drug sales in
driveways, liquor bottles are smashed in residents ' driveways,
and there are traffic problems caused by the customers of
Highland Liquor. She also expressed concern about having
another liquor establishment near the low income building
located at 222 Locust, which has a number of troubled families .
She said there are already three bars and a package liquor store
located in the immediate vicinity of the proposed J. J. Peppers
store. She doesn't believe another establishment which sells
liquor is good for the people who live in that area. She is
concerned about traffic flow and believes another liquor
establishment would harm the children and the neighborhood.
Carol Butler of 64 South Crystal stated that she believes the
location for the proposed store was chosen to profit from the
misery of people who live in that area and who are prone to
drink excessive alcohol .
Ed Dohring has a business at 8 North State Street. He objects
to a liquor license being issued for the subject property. He
says he already spends a lot of time clearing liquor bottles from
his property.
Veronica Beckley, 16 South Jackson, said she has witnessed
fights at Highland Liquors, and she is concerned about another
liquor license in this area.
Frances Garris, one of the owners of Highland Liquors, stated
that they have done the best they can to take care of the
traffic and parking problems around their business, and she
believes they have greatly improved the situation.
Pastor Mark Ahrens submitted the petitions previously referred
to by Karen Ahrens .

Commissioner Popple stated that the problem of liquor is very
serious in the subject area, and the number of incidents in this
area is very high. She doesn' t believe it is appropriate for
liquor to be sold in another establishment in this area.
Commissioner Schock stated that this is a difficult set of
circumstances . The zoning is appropriate for the proposed
establishment. The City has envisioned a more intense use at
this location. He stated that this applicant shouldn' t be
denied a liquor license because other liquor establishments in
the area are doing a bad job. The Commission should consider
not renewing those other licenses rather than denying this
application.
Commissioner VanDeVoorde stated that he takes a different
approach to the responsibility of the Liquor Commission. He
believes the Commission is responsible for determining what
impact a liquor license will have on the neighborhood. He also
believes that having a liquor license is a privilege and not a
right. He doesn't think it is appropriate to put another liquor
license in this neighborhood.
Commissioner Popple made a motion, seconded by Chairman
VanDeVoorde, to deny the aforementioned application. Yeas:
Commissioner Popple and Chairman VanDeVoorde. Nays :

Consideration of Request to Serve Beer at Softball Complex
During Police Benevolent & Protective Association State Softball
Tournament in August 1995
Police Officers O'Herron and Genz, on behalf of the Police
Benevolent & Protective Association, informed the Liquor
Commission that the Elgin association is hosting the state
softball tournament August 18-20, 1995, at the City's softball
complex. They stated that it has been the custom for the
tournament host city to serve beer during the tournament. They
are aware that the current City Code prohibits alcohol in city
parks . They asked the Commission to consider making a
recommendation to the City Council to amend the code to provide
for issuance of a special liquor license at the softball complex
under the above-described circumstances .
After discussion, the Commission directed Assistant Corporation
Counsel Cogley to draft an appropriate ordinance for
presentation to the City Council at a Committee of the Whole
meeting. Chairman VanDeVoorde directed that Officers O'Herron
and Genz be informed of the date of the meeting so that they can
be present.

Consideration of Proposed Ordinance Providing for Various
Revisions to Chapter 6 .06, Alcoholic Liquor Dealers
A discussion was held concerning the proposed amendment
requiring written notice to be given to all owners of property
within 250 feet of the property for which a liquor license is
requested. Chairman VanDeVoorde and Commissioner Schock felt
that this is a burdensome requirement on the part of the
applicant and that the posting of the sign is sufficient
notice. The Commission directed that the proposed ordinance on
the various revisions to the liquor code be placed on the
December 14, 1994 , Committee of the Whole agenda for
consideration by the City Council .
Consideration of Letter from Secretary of State Concerning
Growing Trend of Teenagers Purchasing Cooking Wine
The Commission requested that this matter be placed on the
January agenda.
Miscellaneous
Wende Whiston presented Chairman VanDeVoorde with a packet of
information from Judith A. Browne concerning alleged code
violations and police activity at the Price Rite Liquor and Gas
Store on Kimball Street. Chairman VanDeVoorde asked the Clerk
to furnish copies of the material to Commission members .
