JANUARY 5, 1993
The meeting was called to order at 12 :05 p.m. in the Council
Conference Room by Commission Chairman George VanDeVoorde.
Members present: Commissioner Gilliam and Chairman
VanDeVoorde. Absent: Commissioner Yearman.
Approval of Minutes - December 2, 1992
Chairman VanDeVoordemade a motion, seconded by Commissioner
Gilliam, to approve the minutes of the December 2, 1992,
meeting. Yeas : Commissioner Gilliam and Chairman VanDeVoorde.
Nays : None.
Consideration of Application of St. Joseph Catholic Church for
Class G liquor license for social dance to be held February 13,
1993, at 274 Division Street
In that no one appeared on behalf of the applicant, Commissioner
Gilliam made a motion, seconded by Chairman VanDeVoorde, to
table consideration of the aforementioned application until the
February 1993 meeting. Yeas: Commissioner Gilliam and Chairman
tow VanDeVoorde. Nays : None.
Consideration of Application of Dominick's Finer Foods, Inc. ,
d/b/a Omni Superstore, for Class B liquor license for
establishment to be located at 250 South Randall Road
Assistant Corporation Counsel Gehrman requested clarification
regarding the relationship between Dominick' s Finer Foods, Inc.
and Omini Superstore. Judith Rogers, Assistant Property Manager
for Dominick' s, stated that Dodi Properties, Inc. owns
Dominick' s Finer Foods, Inc. , and Omni Superstore is a
subsidiary of Dominick' s .
Commissioner Gilliam made a motion, seconded by Chairman
VanDeVoorde, to approve the aforementioned application. Yeas:
Commissioner Gilliam and Chairman VanDeVoorde. Nays : None.
Meeting with Manager of Elgin Turners
Richard Lindquist Jr. , Manager of Elgin Turners, appeared before
the Commission with reference to Police Report No.
92-11-1297 regarding possible sale of liquor to minors . The
Commission advised Mr. Lindquist that it is very concerned about
service of liquor to minors. Mr. Lindquist stated that
procedural changes have been initiated with reference to rental
of a portion of the building to groups involving minors . He
stated that even when the facilities are rented to other groups,
Elgin Turners ' employees serve the liquor.

Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to table this matter until the next meeting. Yeas :

Assistant Corporation Counsel Gehrman was directed to set a
public hearing for the February meeting regarding Police Report
No. 92-12-0251, sale of liquor to a minor.

FEBRUARY 3, 1993
The meeting was called to order at 12 p.m. in the Council
Conference Room by Commission Chairman George VanDeVoorde.
Members present: Commissioner Yearman and Chairman
VanDeVoorde. Absent: Commissioner Gilliam.
Approval of Minutes - January 5, 1993
Commissioner Yearman made a motion, seconded by Chairman
VanDeVoorde, to approve the minutes of the January 5, 1993,

Discussion of liquor license classes and fees
This matter was deferred to a later meeting.
Discussion regarding Jewel/Osco corporate structure
The Commission discussed the January 5, 1993, letter from
American Drug Stores, d/b/a Osco Drug, regarding their corporate
structure. Said letter sets forth that American Drug Stores,
Inc. and Jewel Food Stores are subsidiaries of the same parent
corporation, American Stores Company. At the request of the
City of Elgin, a separate corporate entity known as Oakbrook
Beverage Center, Inc. , a subsidiary of American Drug Stores,

Inc. , was formed to hold the liquor licenses for the Osco stores
located in Elgin.
Commissioner Yearman stated that the reason for this request Was
that at the time the Osco stores applied for a liquor license,
the City of Elgin had an ordinance which prohibited issuing a
Class B license to any firm whose principal business was sale of
products other than alcoholic liquor. This requirement is no
longer in effect.
Assistant Corporation Counsel Gehrman stated that it is his
opinion that the liquor license being held by Oakbrook Beverage
Center, Inc. and its relationship to Jewel and Osco comply with
the requirements of the Elgin Municipal Code.
Setting meeting for considering liquor license renewal
applications
Subject to Commissioner Gilliam' s availability, liquor license
renewals will be considered at a special meeting on April 21,
1993 .
Discussion regarding Elgin Symphony Orchestra fundraiser
An inquiry has been received as to whether a liquor license is
required for a fundraising dinner to be held at the Panasonic
facility for the benefit of the Elgin Symphony Orchestras .
Drinks are not to be sold; however, donations will be accepted.
Assistant Corporation Counsel Gehrman advised the Commission
that a special events liquor license (Class I) would be required
in that a form of "sale" is contemplated.
Setting special meeting for consideration of application of new
licensee for Sherlock Holmes Pub at Ramada Inn
The Commission agreed to set a special meeting as soon as
possible for consideration of the aforementioned application.
Public hearing regarding John' s Place, 835 Summit Street, Class
E Liquor License No. 2254 - violation of Elgin Municipal Code
6 .06 . 120(D) - sale of liquor to a minor
John Vlagos, sole shareholder of Pagrati ' s, Inc. , d/b/a John's
Place, was present and stipulated to the fact that the
aforementioned allegation, as set forth in the complaint, did
occur. Chairman VanDeVoorde informed Mr. Vlagos that the Liquor
Commission is very concerned about sale of liquor to minors and
considers this a very serious offense. Mr. Vlagos and Patricia
Koenig, the bartender involved in the incident, assured the
Commission that a number of changes have been initiated in an
L attempt to prevent sale of liquor to minors .

Commissioner Yearman made a motion, seconded by Chairman
VanDeVoorde, to assess a fine against said licensee in the
amount of $750 plus the cost of the court reporter. Yeas :
Commissioner Yearman and Chairman VanDeVoorde. Nays : None.

FEBRUARY 18, 1993
The special meeting was called to order at 12 : 15 p.m. in the
Council Conference Room by Commission Chairman George
VanDeVoorde. Members present: Commissioner Yearman and
Chairman VanDeVoorde. Absent: Commissioner Gilliam.
Consideration of application filed by Patco, Inc. for Class
Liquor License for Sherlock Holmes Pub in Ramada Inn, 500 Wet
River Road
Commissioner Yearman made a motion, seconded by Chairman
VanDeVoorde, to approve the aforementioned application, subject
to the Clerk' s receipt of the necessary documents, including
certificate of insurance, copy of lease, and articles of
incorporation. Yeas : Commissioner Yearman and Chairman
VanDeVoorde. Nays : None.
Consideration of Application filed by Saint Sophia Greek
Orthodox Church for Class G Liquor License for dinner/dance to
be held February 21, 1993, at 525 Church Road
Commissioner Yearman made a motion, seconded by Chairman
VanDeVoorde, to approve the aforementioned application, subject
to the Clerk' s receipt of the certificate of insurance. Yeas :
Commissioner Yearman and Chairman VanDeVoorde. Nays : None.
Discussion regarding liquor license class changes
Inquiries have been received regarding the procedure for a
current licensee changing from one liquor license class to
another. Assistant Corporation Counsel Gehrman advised that the
current Code is somewhat unclear, and he recommends that an
amendment be prepared to avoid ambiguity.
The Commission directed that Mr. Gehrman prepare a proposed
amendment to be brought back to the Liquor Commission at its
next meeting. Said amendment should require that the licensee
complete and file a new application form, pay the appropriate
fee for the new class, and pay the application fee of $25 .
Although it will not be necessary for the applicant to post a
public notice sign, the application is to be considered for
approval by the Liquor Commission.
Discussion regarding Police Report No. 93-01-1705 regarding
Charlie' s Place
Lt. Carl Olsen informed the Commission that there have been
three incidents regarding the sale of controlled substance
involving employees of Charlie's Place. The police department
is pursuing a narcotics nuisance abatement action through the

Cook County State' s Attorney' s Office. If this action is
successful, the owner will lose use of the building for one year.
The Commission directed that be placed on the agenda for the
next meeting for a status report and possible action of the
Commission.

The meeting was called to order at 12 : 09 p.m. in the Council
Conference Room by Commission Chairman George VanDeVoorde.

Approval of Minutes - February 3 and February 18, 1993 Meetings
Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to approve the minutes of the February 3, 1993, regular
meeting and the February 18, 1993, special meeting. Yeas :

Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to approve the aforementioned application, subject to
issuance of the occupancy permit. Yeas : Commissioner Gilliam

The question was asked whether it is permissible for a 16-year
r old cashier to have someone 18 years of age or older punch the
liquor sales price into the cash register and then have the
16-year old ring up the final total and accept the payment.

law to determine what actually is considered "sale" of alcoholic
liquor.

Discussion regarding Charlie's Place
A discussion was held concerning various police reports
involving Charlie ' s Place.
Discussion regarding adding liquor license class
Todd Holmes, owner of a business known as Beer Across America,
advised the Commission that his company is considering
relocating from Lake Barrington to Elgin. He asked whether the
City would consider establishing a liquor license class which
would enable his company to operate a microbrewery beer of the
month club.
Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to make a recommendation to the City Council to approve
establishment of a new liquor license class for the
aforementioned type of operation. Yeas : Commissioner Gilliam
and Chairman VanDeVoorde. Nays : None.

Discussion regarding meeting with licensees regarding renewal of
liquor licenses
The Commission directed that City Clerk Mecum contact the owners
of Elgin Restaurant, Hilltop Pub, and Charlie's Place and
request that they attend the April 22, 1993, Liquor Commission
meeting to discuss police reports regarding their establishments .

and Robert Smith, their attorney, regarding the Liquor
Commission' s procedure when there are problems involving a
liquor licensee.

Chairman VanDeVoorde advised Hilltop Pub owner, George George
Tsiftilis, that the Liquor Commission has an ongoing concerning
regarding his establishment. Mr. Tsiftilis informed the
Commission that although there have been problems in the parking
lot of the business, he has not had problems inside the
establishment. He also stated that when he becomes aware that a
patron may be selling drugs, he is barred from coming into the
pub. Chairman VanDeVoorde reminded Mr. Tsiftilis that a liquor
license is a privilege, and he issued a strong warning to be
alert to the sale of drugs on the premises .
Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to approve the application for renewal of Class A
liquor license for the Hilltop Pub. Yeas : Commissioner Gilliam

Elgin Restaurant, 219 East Chicago Avenue
Members of the Sakolari family, owners of Elgin Restaurant, and
their attorney, Allen Anderson, appeared before the Commission
to discuss problems which have occurred at Elgin Restaurant, and
specifically one involving Chrysanti Sakolari . Manager Patrick
Sakolari advised that the incident occurred as a result of a
lack of communication between this father and the police
officer. The Commission was also advised that a security firm
has recently been hired to assist on Friday and Saturday
nights . Chairman VanDeVoorde commended them on taking positive
steps to try to avoid problems, and admonished them to be very
diligent in their efforts to avoid future problems .
Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to approve the application for renewal of the Elgin
Restaurant Class AA liquor license. Yeas : Commissioner Gilliam
and Chairman VanDeVoorde. Nays : None.
Charlie's Place, 959 Villa Street
Rosalio Perez, one of the owners of Charlie's Place, Christine
Perez, and their attorney, Bob Smith, had a discussion with the
Liquor Commission concerning police reports regarding the sale
of drugs at Charlie's Place. Angel Ramos, who was the manager
of the bar at the time, was arrested in October 1992 for the
unlawful possession of a controlled substance with intent to
deliver. The Commission was advised that Mr. Ramos has been
permanently barred from the establishment, and that Mr. Perez,
who recently retired, will be taking a more active role in the
management of the business and will be spending more time there.
Douglas Dunham has also recently been hired as manager, and a
number of things are being done to try to avoid future problems .
The Perers are also having difficulty renewing their lease,
because landlord Richard Lang has been contacted by the Cook
County State' s Attorney's Office and informed that there is a
possibility that a nuisance abatement suit may be filed because
of the drug sale arrests which have occurred on the premises.
Attorney Smith, on behalf of the owners, requested that if the
Perers are able to negotiate a lease with Mr. Lang, and if they
acknowledge that the Ramos did incident occur and that licensees
are responsible for the actions of their employees, the
Commission give them another chance and renew their liquor
license. The Commission advised that it will confer with the
Legal Department and determine what action should be taken.

Discussion Regarding Dunning's Auction
Assistant Corporation Counsel Gehrman reported on the status of
the request for establishment of a liquor license for an auction
service selling collector bottles and rare wines .
Mr. Gehrman will meet with the attorney for Dunning' s Auction,
he will prepare a proposed ordinance, and will bring it back to
the Commission. An event-by-event license may be proposed,
similar to the Class G and I licenses for special events held by
churches, schools, and not-for-profit organizatons .

The special meeting was called to order at 12 : 18 p.m. in the
Council Conference Room by Commission Chairman George
VanDeVoorde. Members present: Commissioner Gilliam and
Chairman VanDeVoorde. Absent: Commissioner Yearman.
Public hearing regarding Avina Bros. Inc. , d/b/a Charlie's
Place, 959 Villa Street, Class AA Liquor License No. 2230;
violations of Elgin Municipal Code and Illinois Revised Statutes
- licensee's agent and employee's unlawful possession of a
controlled substance with intent to deliver and unlawful
possession of a controlled substance
Rosalio Perez, 50 percent shareholder of the licensee, Avina
Bros . , Inc. , Christine Perez, treasurer, and Douglas Dunham,
manager, appeared pursuant to the Notice of Hearing with
reference to the aforementioned violations . Said licensee was
also represented by Robert Smith.
Mr. Perez stipulated that what is contained in Elgin Police
Report 92-10-0522 is what would be testified to by police
officers and that Angel Ramos was an employee of Charlie's Place
at the time of the incident.
The Liquor Commission found the aforesaid licensee guilty of the
allegations set forth in the Notice of Hearing and Complaint.
Commissioner Gilliam made a motion, seconded by Chairman
VanDeVoorde, to approve the application of Avina Bros . Inc. ,
d/b/a Charlie ' s Place, for renewal of liquor license for the
period from May i 1993 through April 30, 1994, and to
simultaneously suspend said license for 30 days beginning May 1,
1993, by reason of the aforesaid violation.

They believe that restaurant patrons will park on the street

restaurant parking. They are also considered about noise and
possible violence.
Manuel Barbosa, attorney for the applicant, stated that the
parking lot is adequate. ivir. Torres operates a small, family
restaurant, and the nature of the business would not change
substantially if he were permi.cted to sell beer and wine.

Geraldson, represented the Elgin Liquor Commission.
The testimony of various Elgin police officers was heard as well
as the testimony of Mr. Tsiftilis .

owner of Shadow, Inc. , d/b/a The Hilltop Pub, based on the

Discussion regarding amending the Elgin Municipal Code to allow
licensees to serve alcoholic beverages outdoors during special
activities
Serve liquor licensees have contacted the City Clerk concerning
serving alcoholic liquor outdoors on their property during a
horseshoe tournament, pig roast, Octoberfest, and similar
activities. The current Code prohibits the sale or service in
any exterior sales area without first obtaining a permit.
Churches, schools, and not-for-profit fraternal organizations or
corporations qualify for Class G license which permits the sale
of alcoholic liquor on the licensee' s premises, which includes
any adjoining open area utilized in conjunction with the
licensee's principal establishment.
The only exterior sales permit available to other establishments
is for a beer garden, patio area, etc. which requires payment of
rft. an annual fee in the amount of $500 .
Jim Samborski, owner of City Limits Cafe and Bar, advised the
Commission that he was one of the licensees who has inquired

about obtaining a permit for the sale of alcoholic liquor for an
outdoor function. Chairman VanDeVoorde requested that Mr.
Samborski submit a written request to the Commission to consider
an amendment to the Code to provide for a special permit or
license for the aforementioned type of activities.
Chairman VanDeVoorde also requested input from the Police
Department and other communities regarding this matter.
Discussion regarding amendment to Class I liquor license
A Class I license is for retail sale of alcoholic liquor during
a special event sponsored by a not-for-profit corporation or
association and conducted by such association or corporation in
conjunction with a vendor . . . who holds a current and valid
Class A or AA liquor license in the city. In that some larger
restaurants, hotels, small restaurants with service bars, etc.
have licenses that are not Class A or AA, it was suggested that
the Commission consider recommending an amendment to the City
Council which would allow the vendor to be any entity which
holds a current and valid liquor license in the city.
The Commission requested that Assistant Corporation Counsel
Gehrman examine this issue and determine whether there is any
reason why the vendor for a Class I license shouldn't be
expanded to include holders of other license classes .
Discussion regarding fine for purchase of liquor by minor
Assistant Corporation Counsel Gehrman advised the Commission
that a discrepancy currently exists in the Municipal Code.
Section 6 . 06 . 127 of the Code requires all licensed premises to
display a sign which states that minors are subject to a fine up
to $1,000 for attempting to purchase alcoholic liquor or
misrepresent their age. However, the actual penalty for a
violation of this provision is $500 .
Either the provision which sets forth the language required on
the warning sign to minors OR the amount of the fine for a
violation needs to be amended to eliminate this discrepancy.
Commissioner Gilliam made a motion, seconded by Commissioner
Popple, to recommend to the City Council that Chapter 6 . 06 of
the Municipal Code be amended to provide that a fine up to
$1,000 may be imposed for purchase of liquor by a minor. Yeas :

Miscellaneous
Commissioner Popple commented on statements contained in several
police reports . She requested that a letter be sent to John's
Place, Redwood Inn, Barley & Hops, and Leitners warning them
that it is a violation to serve intoxicated persons and that
proof of completion of a BASSET course must be maintained on the
premises or the person of all employees serving liquor.
She also requested that the Police Department be reminded that
when they go to a licensed establishment, particularly when
"highly intoxicated" persons are observed, that they check for
proof of completion of BASSET training.
She also requested that a handbook entitled "Local Officials
Guide to Drunk Driving Prevention" be ordered from the National
League of Cities .
Jerry Mowinski, owner of several licensed establishments,
addressed the Commission regarding his concern about grocery
stores which have cashiers who are only 16 years old. He stated
that these 16-year olds are being relied upon to call a
supervisor over when someone brings alcoholic liquor to the
counter to purchase. He believes that this is putting them in a
very difficult position when their friends come through the
checkout line. He believes that the Municipal Code should be
amended to prohibit employment of cashiers under the age of 18
years in a licensed establishment.
Chairman VanDeVoorde directed that this matter be scheduled for
discussion at the October meeting and that all liquor licensees
be notified that a discussion will be held concerning the
employment of underage cashiers .
Mr. Mowinski also asked whether the Police Department could
advise retailers when they receive complaints of a certain
establishment selling to minors, so that the retailer has an
opportunity to try to correct the situation rather than being
punished by a "sting" operation.

At the August meeting, a discussion was held concerning inviting

It was decided that this topic should be expanded to include the
entire issue of controlling sale of liquor to minors, that all
liquor licensees should be invited, and the discussion should be
rescheduled for the November meeting. Commissioner Popple will
prepare a list of specific topics to be discussed and forwarded
to the licensees .

October 6, 1993
The meeting was called to order at 12 : 00 p.m. in the Council
Conference Room by Commission Chairman George VanDeVoorde.
Members present: Commissioners Gilliam (arrived at 12 : 10
p.m. ) , Popple and Chairman VanDeVoorde. Absent: None.
Approval of Minutes
Commissioner Popple made a motion, seconded by Chairman
VanDeVoorde, to approve the minutes of the September 13, 1993,
regular meeting. Yeas : Commissioner Popple and Chairman
VanDeVoorde. Nays : None.
Application of Elgin Symphony League for Class I Liquor License
for dinner/auction to be held October 30, 1993, at Safety-Kleen
Corp. , 1000 North Randall Road; liquor vendor is C.S.P.
Enterprises
Commissioner Popple made a motion, seconded by Chairman
VanDeVoorde, to approve the aforementioned application. Yeas :
Commissioner Popple and Chairman VanDeVoorde. Nays : None.
Commissioner Gilliam arrived at 12 : 10 p.m.
Discussion of memorandum from Deputy Chief Isom in response to
Commission' s request for police department input concerning
special activity liquor permits
Deputy Chief Isom stated the police department has no real
objections to the special activities, but that parking and
security should be addressed.
Commissioner Popple said that with larger than normal crowds
outside until 1 : 00 a.m. , the effect these special events will
have on the neighborhoods needs to be considered.
Following further discussion, the Commission stated that at this
time they are not ruling out the issuance of special activity
liquor permits, but that more information and further discussion
is needed.
Jim Samborski, City Limits Cafe and Bar, reported he has been
meeting with other licensees and foresees a number of requests
forthcoming. They are presently discussing the problems of
parking and security and will provide the commission with more
information.

Discussion regarding nonsale service of liquor at Hemmens
Auditorium
Pursuant to a request by the Liquor Commission, Assistant
Corporation Counsel Gehrman reviewed the contract with C.S.P.
Enterprises and determined that C.S.P. Enterprises has the
exclusive right to sell alcoholic beverages in the Hemmens
Memorial Building, and that the dispensing of free alcohol is
not encompassed by the exclusivity clause of the agreement.
Public hearing regarding Charlie' s Place, 959 Villa Street,
holder of a Class AA Liquor License - violation of the Elgin
Municipal Code and the Illinois Liquor Control Act - ongoing
pattern of drug sales and arrests at the premises
Rosalio Perez, owner of Charlie's Place and Christine Perez,
Treasurer of Charlie ' s Place, along with their attorney,
Frederick Cohn, appeared before the commission pursuant to the
Notice of Hearing regarding the charges of an ongoing pattern of
drug sales and arrests at the establishment. Assistant
Corporation Counsel Michael Gehrman appeared on behalf of the
City of Elgin, and Attorney Robert J. Smith, Jr. of the law firm
of Seyfarth, Shaw, Fairweather & Geraldson, represented the
Elgin Liquor Commission.
Sherie L. Weisberg, Cook County Assistant State' s Attorney,
informed the commission that the county is pursuing charges
against Charlie' s Place in an effort to shut down the
establishment for one year.
Commissioner Popple inquired what affirmative action is being
taken to resolve the issue of drugs on the premises .
The Perezes stated they have made efforts by posting signs
stating that no drugs are allowed, that they have called the
police when they noticed any suspicious activity, and have been
checking the washrooms at 30 minute intervals .
Commissioner Popple stated it is the responsibility of licensees
to police their establishments . Commission members requested
that Mr. Perez hire a uniformed security guard for the premises
in an effort to send a strong message to potential offenders .
Chairman VanDeVoorde stressed the importance of the licensee to
have hands-on-control and stated they must provide security.

Chairman VanDeVoorde made a motion, seconded by Commissioner
Gilliam, to approve the Findings and Order which provides as
follows :
1 . Licensee shall be fined $1, 000 payable
within 60 days .
2 . Licensee shall pay all costs of the hearing,
including court reporting fees and the
commission' s attorney fees .
Yeas : Commissioner Gilliam and Chairman VanDeVoorde. Nays :
Commissioner Popple.
Commissioner Popple said she objected to the stipulation that
the city will not to use two police reports of arrests made on
January 29, 1993 and April 27, 1993 for potential future
disciplinary action.

Consideration of amendments to Elgin Municipal Code
( 1) Prohibition of Class A, AA and B licenses on
Fountain Square Plaza (EMC 6 . 06 . 090(D)
Assistant Corporation Counsel Gehrman was directed to prepare a
proposed ordinance which would allow restaurants on Fountain
Square Mall to have liquor licenses . However, the ordinance is
to prohibit the issuance of liquor licenses to establishments on
the Mall which are bars only.
(2) Prohibition of dancing on premises other than
incorporated clubs, restaurant, bowling alley, hotel,
or motel (EMC 6 . 06 . 140(E)

Assistant Corporation Counsel Gehrman was directed to prepare a
proposed ordinance repealing the aforementioned prohibition of
dancing in establishments other than those set forth in
6 . 06 . 140(E) . However, Commissioner Popple directed that the
proposed ordinance include a prohibition against "strip tease"
type dancing.
( 3) Requirement for license to conduct public dances
(EMC 6 .48)
The Clerk was directed to place consideration of repealing
Chapter 6 .48 on the November 17, 1993, Committee of the Whole
agenda.
(4) Limitation on number of allowable Class A and AA
licenses .
Assistant Corporation Counsel Gehrman was directed to prepare a
proposed ordinance eliminating the aforementioned limitation on
number of Class A and AA licenses and to place this matter on
the November 17, 1993, Committee of the Whole agenda.
(5) Amount of liquor license application fee
r The liquor license application fee is currently $25 . 00. City
Clerk Mecum stated that in checking with other municipalities,
the application fees range from "no fee" to $500 . The
Commission directed that the staff ascertain what the actual
administrative costs are and prepare a proposed ordinance. A
question was raised as to whether the application fee for Class
B license should be increased in that there is already an
additional $10,000 fee imposed on that license class . The
Commission directed that fees for food licenses also be reviewed
to determine whether an increase is warranted.
Scheduling special meeting to consider application for liquor
license for River East Ballroom
Chairman VanDeVoorde made a motion, seconded by Commissioner
Popple, to schedule a special meeting for November 15, 1993, at
4 : 00 p.m. to consider the aforementioned application. Yeas :
Commissioner Popple and Chairman VanDeVoorde. Nays: None.
Miscellaneous Business
Commissioner Popple stated that she wanted to discuss the
shooting which had occurred at Charlie' s Place, 959 Villa
Street, several weeks ago. Rosalio Perez, owner of Charlie' s
Place, Christine Perez, Treasurer, and Doug Dunham, manager,
responded to Commissioner Popple' s inquiry. They stated that
elk the incident occurred outside their establishment after closing
hours .

Deputy Chief Isom stated that the articles which had appeared in
the newspaper were incorrect in that the person charged with the
shooting was never inside the bar. Deputy Chief Isom also
stated that the individuals involved in an argument inside
Charlie 's Place prior to the shooting were asked to leave, and
it was his opinion that this is an indication that the
owner/manager of Charlie' s Place are trying to prevent problems .
In response to the question about hiring security, Rosalio Perez
stated that he and his son, along with Doug Dunham, provided
security. They have checked into hiring security. However, the
business is so slow that it doesn't justify hiring an outside
firm.
Mayor VanDeVoorde stated that the Liquor Commission could
suspend or revoke a liquor license if it could be shown that the
public ' s health, safety, and welfare are endangered.
Commissioner Popple requested that a report and recommendation
of what should be done be furnished to the Commission by the
December 1, 1993, meeting. Deputy Chief Isom stated that he
would have the police officers prepare a chronology of the
events surrounding this incident. She also requested a legal
opinion on whether the owners of Charlie' s Place are culpable
eft regarding the shooting.

Assistant Corporation Counsel Gehrman asked for additional
direction from the Commission regarding their instruction to him
to prepare an ordinance repealing the prohibition against
dancing but to include a prohibition against "strip tease" type
dancing. A discussion was held concerning what restrictions are
allowable by law, and Chairman VanDeVoorde informed Mr. Gehrman
that the City Council has in the past made it clear that it does
not want to allow lingerie shows, nudity, and strip shows, etc.
A brief discussion was also held concerning the possibility of a
complete revision of the liquor portion of the Elgin Municipal
Code.

Commissioner Popple made a motion, seconded by Chairman
VanDeVoorde, to approve the minutes of the November 3, 1993,
regular meeting, and the November 15 and 22, 1993, special

A discussion was held concerning Mr. Villanueva ' s intended hours
of operation, which are Wednesday through Saturday or Sunday
from 8 p.m. to closing, and possible parking problems . The
Planning Department will evaluate the parking required by the
existing tenants in this area and determine whether parking is
adequate for this proposed business .
Commissioner Popple made a motion, seconded by Commissioner
Schock, to continue consideration of this application to
December 6, 1993, at 4 :25 p.m. Yeas : Commissioners Popple and
Schock, and Chairman VanDeVoorde. Nays : None.
Transfer of Corporate Stock of Leonard F. Didier, Inc. , d/b/a
Town Liquors, 300 South McLean Boulevard, to Roger A. Riebock
A discussion was held concerning whether the $10,000 initial fee
for Class B licenses would be required under these circumstances
in that it the licensee will remain the same and it is simply a
transfer of the stock. It was the consensus of the Commission
that this fee is payable when 50 percent or more of the stock is
transferred. Assistant Corporation Counsel Gehrman suggested
that the municipal code be amended to clarify this position.
Commissioner Schock made a motion, seconded by Commissioner
Popple, that an ordinance be prepared clarifying the requirement
for payment of the $10, 000 fee for Class B liquor licenses when
50 percent or more of the stock of a licensee corporation is

Schock, to approve the aforementioned transfer, subject to

Pizzeria. No action is required.
Miscellaneous Business
Jerry Mowinski again requested that a discussion be held
regarding 17-year olds being allowed to be employed as cashiers
at stores where liquor is sold.

sufficient parking for this use in that there is an agreement
between Tyler Creek Plaza and Tyler Creek Shopping Center
allowing patrons of Tyler Creek Plaza businesses to park in the
main shopping center lot.
