Adjournment ELGIN LIQUOR CONTROL COMMISSION MEETING FEBRUARY 5, 1992 The meeting was called to order at 12 :00 p.m. in the Council Conference Room by Commission Chairman George VanDeVoorde. Members present: Commissioner Yearman and Chairman VanDeVoorde. Absent: Commissioner Moylan. Approval of Minutes - November 6, 1991 Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to approve the minutes of the November 6, 1991, meeting. Yeas : Commissioner Yearman and Chairman VanDeVoorde. Nays : None. Consideration of Application of Elgin Community College for Class G liquor license for Visiting Chef Dinner on February 24, 1992, at 1700 Spartan Drive Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to approve the aforementioned application. Yeas : Commissioner Yearman and Chairman VanDeVoorde. Nays : None. Consideration of Application of St. Joseph Catholic Church for Class G liquor license for dance social on February 15, 1992, at 272 Division Street Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to approve the aforementioned application. Yeas : Commissioner Yearman and Chairman VanDeVoorde. Nays: None. Discussion regarding Police Department Reporting to Liquor Commission Police Chief Gruber and Deputy Police Chief Isom requested direction from the Liquor Commission with reference to what police reports should be submitted to the Liquor Commission. Chairman VanDeVoorde stated that the Commission does not want copies of traffic reports regarding traffic incidents which occur at or near liquor license establishments . Commissioner Yearman stated that the Commission should receive copies of all police reports with reference to any incidents and/or arrests that occur inside and outside the licensed establishment, including the parking lot of the establishment. The police reports are to be furnished to the City Clerk as soon as they are available, a copy furnished to each Commission member, and a copy retained in the individual licensee's file. The police department is currently in the process of developing a policy regarding bar checks and is training the officers on how to perform these checks . Liquor Commission Meeting February 5, 1992 Page 2 Complaint regarding Barley and Hops Donna Beard of 316 Center Street, Elgin, Illinois, addressed the Commission regarding complaints about Barley and Hops . She stated that the owner of Barley and Hops grabbed her and spoke vulgarly to her following an altercation between her and another woman. The other woman filed a complaint against Ms . Beard. However, she was not allowed to file a complaint against the bar owner. Further, she and Linda Lara, also of the above address, stated that the bar sells alcoholic liquor to minors and intoxicated persons, and prostitutes solicit customers in the bar. The Commission asked that the Police Department investigate these allegations and report back to the Commission. Discussion regarding reports of liquor ordinance violations concerning the following licensees: a. Memories/Bookbinders Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to have Memories owner, Mr. Toth appear before the Commission at the next regular meeting to discuss the incident em(` described in Police Report No. 91-11-0010 . Yeas : Commissioner Yearman and Chairman VanDeVoorde. Nays : None. The Commission also requested that Assistant Corporation Counsel, Michael Gehrman, review Section 6 .03 . 130(A) of the Elgin Municipal Code and make a recommendation regarding whether the term "reasonable" should be eliminated in the last clause of said section, which currently is as follows : . . it shall be the duty of the licensee or the person in charge of the premises to be inspected to admit thereto for the purpose of making the inspection, any officer or employee of the City of Elgin who is authorized or directed to make such inspection at any reasonable(emphasis added) time that admission is requested. " b. Hilltop Pub Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to have the owners appear before the Commission at the next regular meeting to discuss the incident described in Police Report No. 91-11-0460 . Chicago Pizza Authority Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to have the owner appear before the Commission at the next regular meeting to discuss the incident described in Police Report No. 91-12-0904 . Elgin Restaurant and Lounge Commissioner Yearman made a motion, seconded by Chairman VanDeVoorde, to hold a public hearing in eight weeks to consider alleged liquor ordinance violations . Discussion regarding Bubba McDuffy' s Tavern A discussion was held concerning letters sent to Bubba McDuffy' s with reference to its failure to complete certain site work. Chairman VanDeVoorde requested that the Bureau of Inspection Services follow up on this matter and initiate legal action if the required work is not completed within the near future. Consideration of Application of Linstrom' s Ltd. for Class A !w Liquor License for 105 South Grove Avenue (Lindstrom' s Ltd. Buffet, Bakery & Catering) Commissioner Moylan made a motion, seconded by Commissioner Yearman, to approve the aforementioned application, subject to Bureau of Inspection Services approval and liquor liability certificate of insurance being furnished to the City Clerk. Meeting with Owner of Memories/Bookbinders Jeno Toth appeared before the Commission with reference to allowing persons to remain on the premises after the hours during which liquor may be served and not allowing police officers, who were investigating the incident, to come into the premises . He apologized to the Commission and told them it would not happen again. He requested and the Commission granted him permission to have carpeting installed after service hours, providing he notifies the Police Department in advance of the night that this will be accomplished. Meeting with Owner of #1 Soul Restaurant rft Henry Greer appeared before the Commission with reference to the fact that the Police Department had reported that there were frequent disturbances at his bar/restaurant. He advised the Liquor Commission Meeting March 3, 1992 Page 2 Commission that he has now employed more security guards . Deputy Chief Isom informed the Commission that the Police Department has been monitoring this establishment, and there has been a definite improvement since November 1991, which was the date of the police reports which were the reason for this meeting. The Bureau of Inspection Services reported that only four of the 34 code violations set forth in their letter dated January 21, 1992, remain uncorrected. The Bureau will follow up to make sure the remaining items are corrected. Meeting with Owner of Elgin Pizza, Inc. , d/b/a Chicago Pizza Authority Fredic Rosati appeared before the Commission with reference to a police report about persons being on the premises after hours during which liquor may be served. He told the Commission he had been unaware of this incident until he received the letter requesting that he appear today. He told the Commission that he also does not want anyone on the premises after hours, he has talked to all his managers, and taken steps to make sure that it does not happen again. Consideration of form for Application for Renewal of Alcoholic Liquor License form Commissioner Yearman made a motion, seconded by Commissioner Moylan, to approve the proposed Application for Renewal of Alcoholic Liquor License form. Miscellaneous Chairman VanDeVoorde requested that Assistant Corporation Counsel Gehrman determine whether Neighborhood Liquors, located near Walnut and Wilcox, was in compliance with the Elgin Municipal Code with reference to change of ownership. Chairman VanDeVoorde requested that the record reflect that the Commission received a letter from Karen Pizzo listing seven objections to the aforementioned application. A petition in opposition to the application signed by approximately 12 people was also presented to the Commission. Because a site plan had not yet been considered by the Planning Department, Commissioner Moylan made a motion, seconded by Commissioner Yearman, to table consideration of the above application. Miscellaneous Jerry Mowinski addressed the Liquor Commission regarding the concern he and Ann Castle, owner of South Side Annie ' s, have with reference to parties being held at a private residence located at 424 Bluff City Boulevard. A large number of young people have been attending these parties, and an admission fee is being charged. Deputy Chief Isom stated that the Police Department and Bureau of Inspection Services are aware of and have been investigating the situation to determine whether illegal activities are involved, and they have been trying to work with the individual who resides at 424 Bluff City Boulevard and has been hosting the parties . Liquor Commission Meeting April 15, 1992 Page 2 Commissioner Moylan made a motion, seconded by Commissioner Yearman, to approve conditionally the renewal application of Leitner's Restaurant, subject to the result of the public hearing on May 6, 1992 . Yeas : Commissioners Moylan, Yearman, and Chairman VanDeVoorde. Nays : None. Chairman VanDeVoorde stated for the record that because of continuing problems at #1 Soul Restaurant, the Commission will be watching this establishment. He requested that the owners of #1 Soul Restaurant be advised in writing that if the disturbances continue, this license may be subject to further action by this Commission. Consideration of the application for renewal of the Elgin Restaurant, Inc. will be held until after the conclusion of the public hearing. Public hearing regarding Elgin Restaurant, 219 East Chicago Street, Class AA Liquor License No. 2153 - violations of Elgin Municipal Code and Illinois Revised Statutes Gani and Chrysanthi Sakolari, shareholders and officers of the licensee, Elgin Restaurant, Inc. , appeared pursuant to the Notice of Hearing with reference to violations of the Elgin Municipal Code and Illinois Revised Statutes . They were also represented by Attorney Allen Anderson. After hearing the testimony of witnesses, arguments of counsel, having considered the evidence, including exhibits, due consideration having been given, and being otherwise fully advised, the Liquor Commission finds that the violations set forth in Items 2, 3, 4, and 8 in the Notice of Hearing and Complaint have been proven. Commissioner Moylan made a motion, seconded by Commissioner Yearman, to find the aforesaid licensee, Elgin Restaurant, Inc. , guilty of the violations hereinafter set forth, that the liquor license be suspended for two days, May 1 and 2, 1992, and that all costs of this proceeding be paid by licensee: Unlawful discharge of a firearm on February 13, 1992, by Petritt (a/k/a Patrick) Sakolari, an employee or agent of licensee, in violation of Elgin Municipal Code Section 10 . 88 .010 . Waller, sole shareholder of the applicant, Neighborhood Package Liquors, Inc. , to waive the initial $10,000 fee required for issuance of a Class B liquor license. Mr. Waller owned the subject package liquor store prior to selling it on an installment contract basis to Dor-Jes Corporation. The purchaser subsequently defaulted in its obligations with regard to the installment purchase. Mr. Waller filed suit and regained possession of the business . BASSET procedures update by Tom LoCascio Mr. LoCascio reported that the Illinois Department of Alcoholism and Substance Abuse has determined that the three-level BASSET program which had been considered would be too difficult to administer. Therefore, an amendment has been proposed on the state level that all BASSET programs include a minimum of six hours of classroom instruction. Mr. LoCascio also reported that Elgin Community College and Harper College will now be issuing identification badges rather than certificates . The Commission directed Assistant Corporation Counsel Michael Gehrman to review the Elgin Municipal Code to determine whether amendments should be made regarding Elgin' s BASSET provisions . Discussion regarding sale of single cans/bottles of beer Assistant Corporation Counsel Gehrman recently issued a memorandum, in response to an inquiry from a liquor licensee, advising that the provision in the state statute and Elgin elk ordinance stating alcoholic liquor may only be sole "in the original package" refers to the material immediately surrounding the beer (or wine) as opposed to extensions of that container such as 6-packs, cases, and semi-loads . Accordingly, the sale of single cans/bottles or beer or wine is not prohibited, as had previously been believed and enforced. The Commission discussed whether to recommend to the City Council that an ordinance be passed prohibiting this practice. However, it was felt that the sale of single cans or bottles was not really a problem, and there was no need to change the local ordinance in this regard at this time. Accordingly, Commissioner Gilliam made a motion, seconded by Chairman Pro Tem Yearman, to assess a fine against said licensee in the amount of $750 plus cost of the court reporter' s attendance fee. Liquor Commission Meeting July 1, 1992 Page 2 Chairman Pro Tem Yearman issued a strong reprimand to the licensee, stressed the seriousness of the violation, and asked whether steps had been taken to prevent problems of this nature in the future. Store Manager Gregory Maass assured the Commission that he had discussed this matter with each of his employees who are involved in the sale of alcoholic beverages . Miscellaneous Business Jerry Mowinski advised the Commission that Mr. Evans, the resident at 424 Bluff City Boulevard, continues to have parties at his residence and approximately 150 people are in attendance. Mr. Mowinski stated that because of security concerns, he has had to close his service station/convenient store business three times recently because of these parties, and this is causing him economic damage. He is also concerned about someone leaving the party, purchasing liquor at his establishment and then serving it to a minor, which he knows would cause him serious difficulty with the Liquor Commission. Deputy Chief Isom reported that he has personally talked to Mr. Evans, and also the USA Team has been assigned to resolve this problem. Pantries, Inc. , which had previously been approved for a Class B liquor license for a convenient store to be known as Red Rooster Pantry at the corner of South McLean Boulevard and Fleetwood Drive, had been unable to secure a lease for the premises. The check for the proposed liquor license was returned. Memorandum regarding Sherlock Holmes Pub Ltd. The State Liquor Control Commission served notice on and closed Sherlock Holmes Pub, Ltd. for failure to pay delinquent sales tax. The City Clerk was advised by telephone today that the Liquor Commission Meeting August 5, 1992 Page 2 em sales tax has now been paid and the liquor license has been reinstated. Miscellaneous The City Clerk advised the Liquor Commission that it appears that Elgin Community College has been overcharged for liquor license fees for Class G licenses for special events . Commencing October 10, 1989, Elgin Community College began paying a $50 license fee for each special event. The Elgin Municipal Code provides that the license fee for each event is $25 . The Liquor Commission directed the City Clerk to closely examine our records and all of Elgin Community College' s applications for liquor license for special events . If the college has been overcharged, this matter is to be brought before the Liquor Commission at its next meeting for action. Brian Wallace, one of the shareholders of CPS Enterprises, the Hemmens liquor concessionaire, advised the Liquor Commission that the Blue Knights organization had contacted him about serving liquor at its annual dinner/dance to be held in February or March. They want to hold it in the Armory Building, and Mr. Wallace wanted to know whether a special events license could be issued to the Blue Knights and CPS Enterprises under the current Code. He was informed that the currently the Code provides that a special event license may be issued to a not-for-profit organization in conjunction with a vendor who holds a current and valid Class A or AA license. The license held by CPS Enterprises is Class L. Further, Mayor VanDeVoorde informed Mr. Wallace that he doubted that the State of Illinois, which owns the Armory, would allow the sale of liquor on the premises . The Commission suggested that Mr. Wallace inform the Blue Knights that it might be easier to hold the event elsewhere. The owner was advised these incidents will be considered at liquor license renewal time. Liquor Commission Meeting October 7, 1992 Page 3 r Letter from Deputy Chief Isom to residents and merchants regarding 424 Bluff City Boulevard Deputy Chief Isom gave the Commission a status report regarding charges brought against the persons responsible for large parties held at the aforementioned address, which has been the subject of discussion at prior Liquor Commission meetings . The defendants were sentenced to serve 50 hours each of community restitution work to be performed in the neighborhood where the parties had been held. The Bureau of Inspection Services informed the Commission that it had also issued citations for various code violations to the owner of the above property. Miscellaneous Commissioner VanDeVoorde stated that he had met with Police Chief Gruber and Councilman Walters to discuss alleged payoffs for games played on video poker machines being operated within the City. Consideration of various police reports The Commissioner directed Assistant Corporation Counsel Gehrman to set a public hearing for the December meeting with reference to the alleged sale of liquor to a minor by an employee of Town Liquor. A discussion was held concerning the police report with reference to the charges filed against an employee of Charlie' s Place for unlawful possession of a controlled substance with intent to deliver. The discussion concerned whether to schedule the public hearing before or after the disposition of the criminal case. Assistant Corporation Counsel Gehrman was directed to set the public hearing for the December meeting if he was able to prepare the case by that date. Miscellaneous Chairman VanDeVoorde reported that he had had a discussion with Lieutenant Governor Kustra with reference to the local liquor commissions ' inability to function effectively, and he cited the difficulty encountered in closing the Douglas Tap. The Lieutenant Governor requested that Elgin furnish him with specific examples and suggestions for changes . Chairman VanDeVoorde stated that we will proceed in that direction. A discussion was also held concerning poker machines in Elgin. Deputy Chief Isom reported that it is very difficult to ascertain whether payoffs are being made. He also stated that the franchisee for the machines is paying for the permits . Chairman VanDeVoorde stated that he is concerned about the City issuing permits for machines if they are being used illegally.
