PURSUANT TO THE OPEN MEETINGS ACT, notice is hereby
given that the reconvened Advisory Ad Hoc Committee for the
BASSETT Training Program will conduct a special meeting on
January 15, 1991, at 4 p.m in the Council Conference Room of
the Elgin Municipal Building, 150 Dexter Court, Elgin,
Illinois .
The purpose of this meeting is to consider possible
amendments to the ordinance pertaining to the BASSET training
requirements .

MINUTES OF SPECIAL MEETING
JANUARY 15, 1991
The meeting was called to order at 4 : 05 p.m. in the Council
Conference Room by Chairperson Cheryl Popple.
ROLL CALL
Roll call was answered by Committeemembers Thomas S.
.LoCascio, Richard Wicknick, George Arsonidis, Kevin McCarty,
Warren Danielson, Loni Mecum, Michael Gehrman, and Len
Didier. Absent: Joseph D. Rosenfeld. Attending as guests
were Maria Costas, instructor with the T. I .P.S. program,
Detective Sean Beane of the Hanover Park Police Department
and instructor of the BASSET course at William Rainey Harper
Community College and Jerry Mowinski, an Elgin liquor
licensee.
INTRODUCTORY REMARKS
Chairperson Popple told the group that when the BASSET
training ordinance (No. G59-88) was passed in 1988 it was
believed by members of the BASSET Advisory Committee that all
liquor servers would undergo training at either Harper or
Elgin Community College. In the last few years it has come
to the Commission' s attention that there are many state
certified BASSET programs with various curricula, etc.
SPEAKER - THOMAS LO CASCIO
Mr. LoCascio, a BASSET instructor at Harper and Elgin
Community College, addressed the group telling them that he
is currently working with Illinois Department of Alcohol and
Substance Abuse to develop a model curriculum for all BASSET
programs by June, 1991. By June, 1992, it is the state's
intent that all programs in Illinois be uniform. Mr.
LoCascio recognizes that the diversity of businesses make it
difficult economically to send staff to four sessions, three
hours each, but feels that the curriculum cannot be altered
without losing vital information. He makes the following
recommendations for training various personnel in different
businesses :
Type A - 12 hour program for businesses where 40% or
more of sales are derived from the sale of alcohol . The
license holder and high management should have this type
of training. At least one person with this Type A
training must be on duty at all times the establishment
is open. Businesses of this type, (example, bars

.package liquor stores) historically have a higher number
of police incident reports .
Type B - 8 hour program for businesses where under 40%
of sales are derived from the sale of alcohol . This
would apply to business such as Pizza Hut, which are
considered low risk in terms of police incidents .
Type C - 3 hour program for businesses where 10% or less
of their sales are derived from the sale of alcohol.
This category would include off-premise consumption
establishments such as large grocery chains like Eagles .
Mr. Wicknick questioned the need for underage checkers at the
Eagle Store to undergo BASSET training. Mr. LoCascio told
the group that selling liquor to people who are carrying out
liquor is very difficult because you have to make an instant
determination as to the extent of intoxication. At a
restaurant or bar, an employee can see the problem develop.
Chairperson Popple remarked that any changes in the BASSET
ordinance would need to be uniform for all businesses in
every regard. Eagles, or establishments who have employees
under 21 years of age, could not be exempted.
Members of the committee also stated that on-premise training
would be very helpful to many businesses . Mr. LoCascio
stated that he felt the classroom was a better place to train
and encourages better retention of the materials presented.
Mr. LoCascio tests students before the course, and they
average scores between 55 and 100; after the course test
scores average 80 to 100. Rarely does someone fail the
course, and when they do, it is almost always a language
problem. His BASSET course is available in Spanish, and
interpretation is also available for other languages. Since
the inception of this course at ECC, 600-700 people have been
trained there, and close to 2,000 at Harper.
SPEAKER- DETECTIVE SEAN BEANE - HANOVER PARK POLICE
Detective Beane spoke regarding enforcement of the BASSET
program. In Hanover Park the same two specially trained
officers are consistently used to check bars. Employees who
have completed BASSET training are issued a card. The
employee must have the BASSET card and one other piece of
identification at all times when he/she is working. A chart
is kept for each business and shows the date, time and
officers names who were at the place of business . The
employees of the establishment are also listed. Officers are
in plain clothes and do walk-throughs, looking for sales of
liquor to minors or other infractions in addition to BASSET
enforcement. A licensee requiring Type A training in Hanover

Park ,would have a check of this nature two or three times a
month. Other establishments with less problems would have
fewer checks . The officers attempt to blend in and do not
call attention to themselves . If they have checked an
employee' s BASSET status in the past, they remember and do
not need to repeat this action. When an employee is found
without BASSET certification, a warning is issued. If
several warnings are given and the situation persists a
report is made by the police and the information given to
the Local Liquor Control Commission.
Mr. Didier questioned what we gain by that much checking of
liquor establishments? Deputy Chief Danielson responded that
the police achieve visibility as well as employee awareness
when these types of checks are done. Members of the
Committee questioned how BASSET certification is currently
enforced. Deputy Chief Danielson responded that the police
do not at the current time have a systematic enforcement
procedure for the liquor establishments . Loni Mecum stated
that when liquor licenses are renewed, BASSET certification
is routinely checked.
Loni Mecum mentioned that in the past owners of liquor
establishments in Elgin have complained about cancelled
classes at ECC and Harper because of insufficient
enrollment. If the City of Elgin is going to mandate this
training, it must be available. Mr. LoCascio and Detective
Bean both responded that the community colleges have both
been working to correct this problem and that now every month
there is a class at either Harper or ECC or both.
Chairperson Popple questioned whether informative
newsletters, etc. regarding this field would be helpful to
the liquor license holders and members of the Local Liquor
Control Commission. Mr. LoCascio said there are none
presently available through the community colleges .
SPEAKER - MARIA COSTAS - T. I .P.S.
Ms . Costas, an instructor for TIPS, a BASSET DASA approved
program, told the group that this program is available in
every state of the United States and ten other countries .
Over 10,000 people have been trained by TIPS staff. TIPS
offers a six hour program which can be done at one time or
in increments of three hours and three hours back to back.
There are programs available for parents, social hosts and
concessionaires . The cost is $30.00 per person.

people at any time that is convenient. She has also trained
people at Moose Lodges and other sites of this nature.
Mr. Arsonidis remarked that a flexible and convenient program
with availability and ease of attendance, such as TIPS, is a
great asset for employees and employers.
Chairperson Popple remarked that although the original BASSET
Advisory Committee had intended that the ordinance pertaining
to BASSET training require that all liquor establishment
employees go through the training at Elgin Community College
or Harper College, the ordinance which was passed provided
that any state-certified BASSET program qualified. In that
there are now a number of programs available, of varying
lengths and content, this would be a good time to do
additional research on the matter.
Chairperson Popple surveyed the committee members with
reference to their views on having different levels of
training. The majority felt that there is a definite need
for various levels of training for different types of
establishments and different employees, but that it needs to
be looked at carefully and thoroughly.
Note:
1) Concern was shown over using percent of sales as the
only criteria for training. (Example: gasoline
combination - liquor stores may fall below 40%. )
2) Clarification was requested by members as to the age of
clerks being able to sell liquor for off-premise
consumption. Further, can an under-age clerk by-pass
the ordinance by having a customer push the merchandise
key or "scan" the liquor? This needs to be clarified.
3) A once-a-year meeting between license holders, the
Liquor Commission and the Police Department was
suggested. It was also suggested that this meeting be
held separately for off-premise and on-premise license
holders.
4) A suggestion was made to extend the time to complete
BASSET training from 60 days to 90 days .

SPECIAL MEETING
The special meeting of the Liquor Control Commission was
called to order at 3 :57 p.m. in the Mayor' s Office, South
Tower, Elgin City Hall, by Commission Chairman George
VanDeVoorde. Members present: Commissioners Fox, Moylan and
Chairman VanDeVoorde. Absent: None.
Consideration of request to amend Elgin Municipal Code to
extend hours of sale on Sundays for state or national
conventions
Commissioner Fox made a motion, seconded by Commissioner
Moylan, as follows :
1 . To recommend to the City Council passage of an
ordinance amending Chapter 6 . 06, entitled "Alcoholic Liquor
Dealers, " of the Elgin Municipal Code, 1976, as Amended, by
amending Section 6 . 06 . 140B as follows :
a. Changing the term "late-hour" sales and service
e'` to "expanded-hour" sales and service.
b. Changing the closing time on January 1 of each
year from 5 p.m. to 3 p.m.
2 . Granting the request of Elgin Lanes, who will be
hosting part of the 62nd Annual Illinois Women' s Bowling
Tournament, involving approximately 12,000 bowlers, to begin
serving alcoholic liquor at 9 a.m. on the following Sundays :
February 3, 10, 17 and 24 ; March 3, 10, 17 and 24; April 7,
14 and 28; and May 5, 12 and 19, 1991 .

The meeting was called to order at 4 p.m. in the Council
Conference Room by Commission Chairman, George VanDeVoorde.
Members present: Commissioner Fox and Chairman VanDeVoorde.
Absent: Commissioner Moylan.
Approval of Minutes
Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, to approve the minutes of the Liquor Commission
for the period from June through December 1990, and to
approve the minutes of the special Liquor Commission meeting
on January 16, 1991 . Yeas : Commissioner Fox and Chairman
VanDeVoorde. Nays : None.
Continued consideration of Application for Class A liquor
license by Mattie M. Jones for 15 North State Street (Barley
& Hops, Ltd. )
For the record, Commission Chairman VanDeVoorde informed the
applicant that the City is interested in purchasing the
property on which Barley & Hops, Ltd. is located. The
recommendation to purchase the entire block may be part of
the Center City Plan to be adopted. It is possible that the
liquor license might not be renewed for this location--if the
City does purchase the property.
Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, to approve the subject application.
Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, to amend the main motion by making approval of
the application subject to compliance with all code

Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, to approve the aforementioned application, to
correct the title of the proposed ordinance, to change the
placement of the phrase, "on a not-for-profit basis, " to set
the license fee for this class at $850, and to recommend
approval of the ordinance by the City Council . Yeas :

Public hearing regarding Southland Corporation d/b/a
7-Eleven Store No. 13408, at 975 North McLean Boulevard,
Class B Liquor License No. 2032 - Violation of Elgin
Municipal Code 6 . 06 . 140(L) - Sale of Liquor to a Minor
Howard Aubert, Southland Corporation Field Representative,
appeared on behalf of the licensee, and pled guilty to the
charge alleged. Chairman VanDeVoorde made a motion, seconded
by Commissioner Fox, that 7-Eleven Store No. 13048 be found
guilty of the aforementioned violation. Yeas : Commissioner
Fox and Chairman VanDeVoorde. Nays : None.
Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, to impose a fine of $750, plus costs . Yeas :

Consideration of Application for Class AA Liquor License by
Mary Ann Bollman, d/b/a MAB, Inc . , for restaurant/bar at 297
South McLean Boulevard ( f/k/a Thomas ' Boulevard Tap)
Kevin McCarty, attorney for applicant, informed the
Commission that the above application simply involves a paper
transfer. Mary Ann Bollman is the 100 percent shareholder of
Thomas ' Boulevard Tap, Inc. , which will transfer the stock
into a new corporation known as MAB, Inc . Ms . Bollman will
also be the 100 percent shareholder of the new corporation.
The building is being remodeled, and the business will
operate primarily as a restaurant.
Chairman VanDeVoorde made a motion, seconded by Commissioner
Fox, to approve the above application, to waive payment of a
new fee, and to change the name of the owner/licensee to MAB,
Inc. Yeas : Commissioner Fox and Chairman VanDeVoorde.

Consideration of application for Class G (temporary) liquor
license for sale on church premises by St. Thomas More
Church, 215 Thomas More Drive, on March 16, 1991, for St.
Patrick' s Day Party
Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, to approve the aforementioned application.

Mr. Siete, appearing on behalf of St. Thomas More Church,
asked whether it is possible, once a year, to furnish the
City Clerk with a certificate of insurance to cover all the
special events at which liquor is served. He was advised
that this could be done as long as the certificate of
insurance covered all the dates for the church' s special
events at which liquor is served. He was also informed,

however, that it will still be necessary to appear before the
Liquor Commission for each of the temporary licenses, unless
they apply for all the temporary licenses at one time.
Memorandum regarding Red Fox Restaurant
Notice has been received by the City Clerk of a change in
stock ownership of Elamco, Inc. , d/b/a Red Fox Restaurant,
1575 Dundee Avenue, adjacent to Howard Johnson Motel . No
action is necessary on the part of the Commission.
Consideration of Application of Espo's Country Lanes for
expanded-hour sales of alcoholic liquor during Illinois
Women' s Bowling Association State Tournament
Chairman VanDeVoorde made a motion, seconded by Commissioner
Fox, to approve the aforementioned application. Yeas :

Consideration of Application of Elgin Community College for
Class G (temporary) liquor license for visiting chef
recognition dinner on March 5, 1991
Commissioner Fox made a motion, seconded by Chairman

Consideration of Wherehouse, Inc. and Hector's Hideout, 215
Lawrence Avenue, operating under one liquor license
It was brought to the attention of the Liquor Commission that
there might be two separate businesses operating at the above
address under one liquor license. During an inspection of
the premises, Steve Bone of BIS, was informed by Hector
Hernandez that he was subleasing the north building and
operating under the name of Hector's Hideout.
Chairman VanDeVoorde directed that a Notice to Appear be
issued requiring representative of the above businesses to
appear before the Commission at the March 6, 1991, meeting to
explain their business operations .
Star Gas Station Update
Marcy Brun, of 310 Park, appeared before the Liquor
Commission with reference to the complaints previously
brought to the attention of the City Council regarding the
Star Gas Station at 223 Dundee Avenue. Steve Bone of BIS
reported that almost all of the violations have been
corrected.

Chairman VanDeVoorde requested that the City Clerk follow up
on determining whether there has been a change in ownership.
Ms . Brun requested that careful consideration be given prior
to renewal of a liquor license for this establishment.

Commissioner Moylan made a motion, seconded by Commissioner
Fox, to approve the aforesaid application, subject to
compliance with all Elgin Municipal Code requirements.

Public Hearing regarding Wherehouse, Inc . (a/k/a Grocery
Store Pub) , 216 Lawrence Avenue, various violations of Elgin
Municipal Code 6 . 06
Thomas Merwin, owner and manager of the Wherehouse, Inc .
appeared pursuant to the Notice of Hearing. He informed the
Commission that on January 23, 1991, no liquor was sold after
1 a.m. , although several employees and one friend of an
employee were on the premises and were drinking alcoholic
liquor until 3 a.m.
Commissioner Fox made a motion, seconded by Chairman
VanDeVoorde, that the Wherehouse, Inc . be found guilty of
violating the Elgin Municipal Code by serving liquor and
allowing persons to remain on the premises "after hours . "
Yeas : Commissioners Fox, Moylan and Chairman VanDeVoorde.
Nays : None.
Commissioner Moylan made a motion, seconded by Commissioner
Fox, to impose a fine of $50, plus costs . Yeas :

Public Hearing regarding Hector' s Hideout, 216 Lawrence
Avenue, violation of Elgin Municipal Code 6 . 06 - Failure to
first obtain liquor license to sell, barter, transport,
deliver, solicit, or receive orders for, keep or expose for
sale, keep with intent to sell or furnish any alcoholic
liquor for beverage purposes for sale at retail
Thomas Merwin also appeared pursuant to the Notice of
Hearing sent to Hector' s Hideout. He advised the Commission
that Hector' s Hideout is part of the Wherehouse, Inc.
establishment owned by him. He stated that he hired Hector
Hernandez, as an independent contractor, to manage the bar
area known as Hector' s Hideout, and paid Hector 25 percent of
the proceeds from that bar. He also stated that Mr.
Hernandez had invested approximately $8,000-$10,000 in
remodeling this area.
The Commission stated that it believed that the Wherehouse
and Hector' s Hideout were really two separate bars and should
have separate liquor licenses .
The Commission warned Mr. Merwin that he would have
difficulty renewing his liquor license unless this matter was
cleared up as well as the code violations set forth in the
Bureau of Inspection Services ' report and the holding of
questionable raffles and fashion shows .

Consideration of BIS Proposal Regarding Inspections
Gordon Burkart, BIS Superintendent, addressed the Commission
with reference to its recommendation that all liquor
licensees be inspected and that the inspection reports be
part of the criteria used to consider liquor licensee
renewals in 1992 . Superintendent Burkart advised the
Commissioner that certain inspections are already conducted
each year, including fire and health inspections . He
provided a sample of a report that could be furnished to the
Commission, prior to consideration of license renewals,
indicating when inspections had been made and whether there
were any uncorrected violations . The Commission stated that
this type of report would be satisfactory.

E`er Consideration of Elgin Police Department Report of Sale of
Liquor to Minor by Liquor Mart, Ltd.
Commission members were furnished with a copy of the
aforementioned report. They instructed the City Clerk to
schedule the matter for Public Hearing at the Commission's
next regular meeting on May 1, 1991 .
Consideration of Memorandum with Reference to Amendment to
Municipal Code Regarding Sale of Liquor by 18-Year Olds
A copy of the aforementioned memorandum from Assistant
Corporation Counsel, Barbara Okiesen, was distributed to
the Commission members . Confusion currently exists with
reference to employment in liquor establishments of persons
under the age of 21 years. Chairman VanDeVoorde suggests
that Elgin adopt the state statute in this regard. He
requested that corporation counsel determine what the age
requirements are in other area municipalities . The proposed
amendment will be discussed at the May meeting.
Consideration of Application for Grant to Conduct a Pilot
A, B, C Level BASSET Program
The City Clerk advised the Commission that she had been
contacted by Tom LoCascio, BASSET instructor at ECC and Vice
President of Advance Design & Concepts, which is the agency
contracted by DASA to revise the BASSET curriculum
guidelines . Mr. LoCascio informed the clerk that he has laid
the groundwork for Elgin to obtain a grant from IDOT, if
Elgin is willing to conduct the pilot three-level program.
They would like to have this program started by July 1 .
Commission members suggested that the Clerk discuss this
proposal with BASSET Task Force Chairman, Cheryl Popple.

Announcements
Ponderosa Restaurant, 1568 Larkin Avenue - the City Clerk
received a letter from Ponderosa advising that it would not
be renewing its liquor license and therefore would not be
serving liquor after April 30, 1991 .
Star Mart, 223 Dundee Avenue - the application received by
the City Clerk was from Kwick Mart, Inc. The applicant was
advised that since the prior license holder was Atlantic
Western Corporation, this application would have to be
treated as an application for a new license. This would
require posting the public hearing sign, appearing before the
Liquor Commission, and paying the $10, 000 fee required for a
new Class B liquor license. Jim Brown, President of Kwick
Mart, Inc. , advised the City Clerk that he only had ten
months remaining on his lease for these premises, and
therefore he would not be submitting an application for a new
license at this time.
The Police Department will be advised that the Star Mart will
not have a liquor license after April 30, 1991, and will be
requested to monitor this facility.

purchased a twelve-pack of beer from Liquor Mart, after showing
the sales clerk two forms of identification which indicated that
he was 21 years old.
Commissioner Moylan made a motion, seconded by Chairman
VanDeVoorde, that the aforementioned charge be dropped, that
Mr. Patel be warned that every one of his employees has to
complete a BASSET program, and to make more prudent judgments in

Consideration of proposal to conduct three-tiered BASSET pilot
program
Thomas LoCascio presented a written report setting forth the
purpose, requirements, and program outline regarding the
proposal to have the City of Elgin pilot a three-tiered BASSET
program. One of the requirements is that three members of the
City Council attend the Elgin Community College 12-hour BASSET
course and then determine what should be included in the
curriculum for the three and six-hour programs . Three members
of the law enforcement agency would also be required to attend
the aforesaid course.
George Arsonidis, one of the owners of Alexander' s Restaurant
and a member of the BASSET Task Force, stated that he found the
TIPS provider of the BASSET course to be more convenient because
the course can be taught in one day at the licensee' s place of
business .
Mr. LoCascio stated that the curriculum for all the
state-approved BASSET courses is not the same or comparable to
the ECC and Harper courses . The state licensees for all BASSET
providers will expire June 1, 1992, by which time DASA expects
to have standardized curriculum requirements .
The Liquor Commission members advised Mr. LoCascio that they
would like to have an opportunity to review the proposal and to
discuss it with Cheryl Popple, Chairman of the BASSET Task
Force, prior to making a decision.
Rescheduling Liquor Commission Meetings
Commissioner Yearman made a motion, seconded by Commissioner
Moylan, to change the time of future Liquor Commission meetings
to 12 : 00 noon on the first Wednesday of each month. Yeas :

It is the intent of the aforesaid amendment to allow an 18-year
old person to be employed as a waitress serving alcoholic
liquor, sales clerk in liquor, grocery, and convenient stores,
hotel employee making room service deliveries of alcoholic
liquor, etc. A person pouring, mixing, or drawing alcohlic
liquor, with or without compensation, must be at least 21 years
of age.
Consideration of this Liquor Control Commission recommendation
is to be placed on the Committee of the Whole agenda for
June 12, 1991 .
Consideration of proposal to pilot three-tiered BASSET program
Members of the Liquor Control Commission agree with the concept
of the three-tiered BASSET program. However, they have some
concerns regarding the proposed requirements for conducting a
pilot program. One of the requirements is that three members of
the City Council attend the BASSET course at ECC and then assist
in determining the criteria to be included in the three various
levels . They do not believe that they have the expertise to
establish curriculum and believe there are other people more
qualified. They requested that the City Clerk advise Tom
LoCascio of their concerns .
Consideration of reinstating issuance of new Class AA liquor
licenses
Several Class A license holders have requested that
consideration be given to issuance of a license which would
allow them to sell liquor for off-premise consumption, as well
as on-premise consumption.
Commissioner Moylan made a motion, seconded by Commissioner
Yearman, to have the City Council consider establishing a new
license class which would permit a bar or restaurant to sell
beer and wine only, for off-premise consumption. Yeas :
Commissioners Moylan, Yearman, and Chairman VanDeVoorde. Nays :
None.
An ordinance had previously been passed which eliminated
issuance of any new Class AA licenses (on-premises and
off-premise consumption) after August 1, 1989 . Commissioner
Moylan requested that the Council be furnished with any
available background material which would explain the reasons
for passage of the aforesaid ordinance.

Commissioner Yearman made a motion, seconded by Commissioner
Moylan, to approve the aforementioned application, subject to

Consideration of Sunday Hours of Operation for Liquor Licensees
It had been brought to the attention of the Liquor Commission,
that various service organizations have been selling and serving
alcoholic liquor before noon on Sundays for a number of years.
In that complaints regarding this violation have been received,
Commission Chairman VanDeVoorde stated that it will be necessary
to either enforce the current ordinance, which prohibits the
sale of alcoholic liquor before noon on Sundays, or amend the
ordinance.
Representatives from a number of the clubs were present and
addressed the Commission. Don Johnson, Secretary of the Moose
Lodge and representative for the Elgin United Civic Association,
stated that the clubs have enjoyed the Sunday morning opening
during the years, and it has been beneficial to them. The clubs
are requesting that the opening hour for Sunday be changed from
noon to 9 a.m. , and they believe this should apply to all
license classes--not just the Class C licensees .
Commissioner Moylan stated that she believes the ordinance
prohibiting the sale of liquor before noon on Sundays may be an
antiquated law which was enacted many years ago, and it should
be looked at again.

Commissioner Yearman stated that the service clubs have always
supported the City with their many activities and drives. She
believes it would be unfair for them not to be allowed to open
before noon.
Commissioner Yearman made a motion, seconded by Commissioner
Moylan, to recommend to the City Council that an ordinance be
passed changing the time at which liquor sales and service may
commence on Sunday from 12 p.m. to 9 a.m. and to bring this
recommendation to the July 10, 1991, Committee of the Whole
meeting for consideration by the City Council . Yeas :
Commissioners Moylan, Yearman, and Chairman VanDeVoorde. Nays:
None.
The City Clerk requested that the proposed ordinance to amend
Chapter 6 . 06 entitled "Alcoholic Liquor Dealers" also add a
section entitled "Hours of Service. " Chairman VanDeVoorde
requested that the Legal Department be advised to include that
provision in the proposed ordinance to be prepared for
consideration.

Ray Papas, part owner and manager of Leitner' s Hamburgers,
appeared pursuant to the Notice of Hearing with reference to the
aforementioned allegations .
Chairman VanDeVoorde made a motion, seconded by Commissioner
Moylan, that Leitner's Hamburgers be found guilty of item one
above -- violating the Elgin Municipal Code by allowing patrons
to consume alcohol on the premises after 1 a.m. Yeas :

With reference to item two, Mr. Papas was cautioned by Chairman
VanDeVoorde to remember that it is important to recognize that
there is a point when a bartender has to stop serving liquor to
a customer who may be intoxicated.

Yearman, to impose a fine of $250, plus costs, payable within 30

complying with the BASSET requirements .
