Attorney Dan Blondin appeared on behalf of the City of Elgin, and Attorney Bill Weir appeared on behalf of the liquor license holder, Jerome Mowinski, d/b/a Price Rite Liquors . Testimony was given by Jerome Vonner, Mary Colen, Preston Hinton, Officer Jesus Padron and Detective Brad Entler. (A complete transcript of this hearing is available ) Councilman Fox made a motion, seconded by Councilman Walters , having heard all the testimony given , concluded that Jerome Vonner, a minor, did in fact purchase alcoholic beverages in the subject establishment . Board Member Walters made a motion, seconded by Board Member Fox to approve the above license subject to receipt of recorded Articles of Incorporation, Certificate of Liquor Liability Insurance expiring April 30 , 1991, and Certificates reflecting completion of the Bassett Program, or State Approved Training Course for Liquor handlers . Board Chairman VanDeVoorde stated that in view of the fact that this is the third violation by the Corporation, f and that because of a previous violation there was a fatality and serious injury to minors , he would suggest closing the subject establishment for a period of two weeks . First Stop Liquors - 920 Villa Street The Owner of the First Stop Liquors establishment did not submit a renewal application, payment of fees , or evidence of insurance coverage within the designated period of time . Board Member Walters made a motion, seconded by Board Member Fox to direct the police to close this establishment . Yeas : Board Member Fox, Walters and VanDeVoorde. Nays : None . Pizza Hut - 816 East Chicago Street and 985 North McLean Blvd. The City Clerk advised the Commission notice had been filed with her office that the licenses for these two establishments was not being renewed. The restaurant operation is to cease and they will become carry-out facilities only. Board Member Fox made a motion, seconded by Board Member Walters to notice the following license holders in for Elgin Liquor Commission Meeting May 2 , 1990 "` Page 4 a hearing on May 21, 1990 at 5 : 00 p.m. , to discuss the number of police calls to their establishments . Nays : None: Sport ' s Pub Elgin Restaurant & Lounge Barley & Hops Eaton 's Redwood Inn Carleton Lodge The Commission directed that the Legal staff review a request from the Carleton Motel to serve two complimentary cocktails to guests staying overnight and bring back an opinion regarding same. Jerry Mowinski complained that the following establishments are selling beer and wine coolers separately from their original package: Osco - Larkin Avenue Liquorland - Manor Court Villa Liquors Town Liquors The Police Department will investigate this matter. Members present : Board Members Fox, Walters and VanDeVoorde. Absent : None . Consideration of 1990-1991 Liquor License for Sports Pub, 302 South McLean Blvd. The Commission advised Mr. Turner, owner of the subject license , that they would like to see the number of incidents occuring at said location reduced and the property surrounding the premises kept clean of broken glass . Mr. Turner stated he would cooperate and pay closer attention to the parking lot . Board Member Fox made a motion, seconded by Board Member Walters to approve the subject license. Yeas : Board Members Fox, Walters and VanDeVoorde. Consideration of 1990-91 Liquor License for Barley & Hops , 15 North State St . The Commission advised Mr. Fradelos of the number of incidents at his place of business . Mr. Fradelos stated most of these problems are related to the street people and bums who cover this whole area. Board President VanDeVoorde asked if a patrolman to cover this area would help this situation, and Mr. Fradelos stated he thought it would eliminate most of the problems . Board President VanDeVoorde stated the Commission would see if the Police Department could provide a patrolman and Mr. Fradelos assured the Commission of his cooperation. Board Member Fox made a motion, seconded by Board Member Walters to approve this subject license. Yeas : Board Members Fox, Walters and VanDeVoorde. Consideration of 1990-1991 Liquor License for Eaton ' s Redwood Inn, 118 West Chicago Street . Mr. Eaton stated that many of his problems are the same as occur at Barley & Hops , and he too felt that a patrolman covering this area would eliminate the problems . Board Member Walters made a motion, seconded by Board Member Fox to approve the subject license . Yeas : Board Members Fox, Walters and Mayor VanDeVoorde. Nays : None. Elgin Liquor Commission Meeting May 21, 1990 '' Page 2 Consideration of 1990-91 Liquor License for Elgin Restaurant & Lounge, 219 East Chicago Street . . The Commission advised Mr. Sakalori that many of the incidents occurring in his establishment had commenced with the use of the exit door to the alley, and they would like to see this door used only for a fire exit . Since there is no place for customers to park in the alley, the Commission felt this should not be used for customers entering or exiting the lounge . Board Member Walters stated he would approve the license for this establishment , subject to the installation of a fire alarm on the exit rear door, and the placement of the lock on the inside of the door. Board Member Fox seconded said motion. Yeas : Board Member Fox, Walters and VanDeVoorde. Consideration of request for the issuance of a Class A Liquor License to James S . Lyle , d/b/a Bubba McDuffy' s , 1151 Bluff City Blvd. , formerly Max & Marges . Steve Bone (BIS ) stated that Mr. Lyle has been working on the subject premises and you would not believe it was the same place. Mr. Lyle stated that they are still working to comply with all the code violations . Tom Armstrong stated Mr. Lyle has submitted a site plan, which meets with his approval. Board Member Walters made a motion, seconded by Board Member Fox to approve the subject license, subject to completion of all health related violations . Members present: Board Members Fox, Moylan and VanDeVoorde. Absent: None. Consideration of Application for a Class B Liquor License by RVL Corporation for 950 East Chicago Street. Board Member Fox made a motion, seconded by Board Member Moylan, to approve the subject application, subject to final inspection by BIS. Yeas: Board Members Fox, Moylan and VanDeVoorde. Nays: None. Consideration of Service of Alocholic Liquor to Hotel Guests. Board Member Moylan made a motion, seconded by Board Member Fox, directing the legal staff to ascertain from the Focus Groups, Inc., specifically what their needs are with reference to providing complimentary cocktails, and to draft an ordinance creating a liquor license class to cover this kind of liquor service. Yeas: Board Members Fox, Moylan, and VanDeVoorde. Nays: None. Consideration of Application for Class B. Liquor License by Lee Womack for the Southeast Corner of Hickory Street and Dundee Avenue. Dhillon ) for 282 Dundee Avenue ( See C [ 1 ] attached ) ( 2 ) Consideration of Memorandum Regarding Exterior Sales Permits ( See C[2 ] attached ) ( 3 ) Consideration of Proposed Ordinance Amending Elgin Municipal Code , 1976 , Chapter 6 .06 Entitled "Alcoholic Liquor Dealers " ( See C[3 ] attached) ( D) Adjournment ELGIN LIQUOR COMMISSION MEETING July 18, 1990 The meeting was called to order at 4 : 10 p.m. by Commission Chairman VanDeVoorde. Members present : Commissioners Fox, Moylan, and Chairman VanDeVoorde . Absent : None. Consideration of Application for a Class B Liquor License by K. B. Enterprises ( Sawarnjit S . Dhillon ) for 282 Dundee Avenue The applicant presented reasons for applying for a liquor license at his service station/mini mart and answered questions directed to him by Attorney Kathleen Carlson. The following people, some of whom were neighborhood residents , stated their objections to issuance of a liquor license to the subject facility (as well as objections to liquor being sold by service stations in general ) : Dennis Kosinski, 203 North Street , Elgin, Illinois ; Frederick Fletcher, 350 Park Street , Elgin, Illinois ; Jonathan Cohen, 164 North Gifford, Elgin, Illinois ; Vera VanWombeke , 315 College Street , Elgin, ILlinois ; Arthur Allen, 400 E . Chicago, Elgin, Illinois ; Steve Olds , 414 North Spring, Elgin, Illinois ; Deborah Allen, 400 East Chicago, Elgin, Illinois . Comments were also made by Jerry Mowinski, owner of the service station and package liquor store at the corner of Kimball and Spring, Elgin, Tom Armstrong, Senior Planner for the City of Elgin, and members of the Liquor Commission. After input by the above parties , Attorney Carlson, on behalf of the City of Elgin, requested that the public hearing be continued. Commissioner Moylan made a motion, seconded by Commissioner Fox, to table this application until the next Liquor Commission meeting. Yeas : Commissioners Fox, Moylan, and Chairman VanDeVoorde. Consideration of Rescheduling of August Liquor Commission Meeting Commissioner Fox made a motion, seconded by Commissioner Moylan, to reschedule the August Liquor Commission meeting to August 22 , 1990 , at 12 p.m. in that one of the commissioners will be on vacation on the regular meeting date. Consideration of Memorandum Regarding Exterior Sales Permits Commissioner Fox made a motion, seconded by Commissioner Moylan, to recommend reinstatement into the Elgin Municipal Code the provision establishing exterior sales permits ( for beer gardens ) , which provision had previously been deleted inadvertently. Elgin Liquor Commission Meeting July 18 , 1990 Page 2 Consideration of Proposed Ordinance Amending Elgin Municipal Code 1976 , Chapter 6 . 06 , Entitled "Alcoholic Liquor Dealers" Commissioner Moylan made a motion, seconded by Commissioner Fox, to recommend that Chapter 6 .06 . 170 of the Elgin Municipal Code be repealed and the state statute followed regarding powers to assess fines . Yeas : Commissioners Fox, Moylan, and Chairman VanDeVoorde. Nays : None. Commissioner Fox made a motion, seconded by Commissioner Moylan, to recommend amending Chapter 6 . 06 by adding 6 . 06 . 126 to provide for assessment of costs of hearings to any licensee determined by the Local Liquor Control Commission to have violated any of the provisions of Chapter 6 .06 . 120( C ) . The Code requires that applicants for all licenses must appear before the Liquor Control Commission, and licenses may only be issued after approval by the Commission. Consideration of Proposed Ordinance Amending Chapter 6. 06 of the Elgin Municipal Code Regarding Exterior Sales Permits Commissioner Moylan made a motion, seconded by Commissioner Fox, to recommend approval to the City Council of the aforementioned proposed Ordinance regarding exterior sales permits. Consideration of Procedures for Record Keeping and Enforcement of BASSET Program. Thomas S. LoCascio, an instructor of the BASSET course, gave a short presentation, which included comments, concerns, and ideas gained through his experience and that of Detective Sean Beane, of the Hanover Park Police Department, an instructor of the program at William Rainey Harper College. Mr. LoCascio presented, for the Commissioner' s review, written considerations with reference to possible amendment to the present ordinance. The intent of these considerations is to make governing bodies aware that differences exist between approved BASSET programs, and since liquor licenses differ as to type of establishment, perhaps different types of programs would be better suited for different types of establishments and their employees . The suggestions are also aimed at facilitating enforcement by the police department. Chairman VanDeVoorde stated that the Commission will review the material, and directed that this matter be placed on the agenda for the November regular meeting. The City Clerk was instructed to notify all liquor license holders that at its November 7 , 1990, meeting, the Liquor Control Commission will be considering possible changes to the BASSET provision of the ordinance. Consideration of Inquiry Regarding Sale of Liquor by Minors at Package Liquor, Grocery, and Drug Stores A short discussion was had regarding Memorandum from Dan Blondin, Assistant Corporation Counsel, regarding the above as well as service of alcoholic liquor by minors employed as restaurant waitresses . Public Hearing regarding Hunan Garden Restaurant, Inc. , Class J (service bar in restaurants) Liquor License No. 2102 - Violation of Elgin Municipal Code 6 .06 . 115 BASSET training requirements Hsiu Teng Morefield appeared on behalf of licensee, Hunan Garden. Commissioner Fox made a motion, seconded by Commissioner Moylan, to admit the following documents directed to Hunan Garden as exhibits : letter dated September 24, 1990, Notice of Hearing and Notice to Produce documents sent to licensee on October 23, 1990 . Morefield informed the Commission that she and Ching Perny Tang are presently enrolled in the BASSET course at Elgin Community College, and she produced copies of the enrollment documents. The Commission concluded that there may have been a lack of understanding on the part of the licensee regarding the BASSET requirements. They issued a warning to Ms . Morefield and stressed the fact that the current ordinance requires all employees who serve liquor to have completed a BASSET course and to furnish the City Clerk with a copy of the the certificates of completion. Liquor Control Commission Meeting Minutes November 7, 1990 Page 2 Consideration of inquiry regarding sale of liquor by minors at package liquor, grocery, and drug stores In response to the above inquiry received by the City Clerk Assistant Corporation Counsel, Dan Blondin, informed the Commission that Section 6 . 06 . 137 of the Elgin Municipal Code currently provides that "It is unlawful for a licensee to employ or permit the employment of any minor in his place of business except in connection with activities not related to the sale or delivery of alcoholic liquors . " Based upon the foregoing, it is unlawful to employ a minor at a sales counter. In contrast, Section 6 . 06 . 137 of the Code makes it unlawful for anyone under 21 years of age to " . . .dispense, draw, pour or mix alcoholic liquor. " Attorney Blondin explained that it was the intent of this section to exempt from its provisions those individuals who would be involved only in the service of alcoholic liquor, such as restaurant waitresses . Attorney Blondin recommends that in the future these two sections be combined so that employment of minors is addressed in a single section of the Municipal Code. rik For purposes of clarification at this time, the Liquor Commission stated that a person under 21 years of age may serve liquor. However, a person must be at least 21 years of age to sell liquor in Elgin. Consideration of possible amendments to BASSET training requirements Commissioner Moylan made a motion, seconded by Commissioner Fox, to reconvene the BASSET Advisory Ad Hoc Committee chaired by Councilwoman Cheryl Popple, for the purpose of reviewing the suggestions made by Thomas S. LoCascio, BASSET course instructor at Elgin Community College, and Hanover Park Police Detective Sean Beane, instructor at Harper College, and to determine whether amendments should be made to the BASSET training requirements section of the Elgin Municipal Code. The committee will be asked to consider whether the ordinance should be amended to provide for different types of programs for different types of establishments and their employees. Representatives from two Eagle Food Stores stated that the current BASSET requirements do cause considerable hardship and expense due to the labor force shortage and high turnover of employees . The Commission directed that Councilwoman Popple contact the people who originally served on the committee to determine whether they would be willing to be on the committee again. Liquor Control Commission Meeting Minutes November 7, 1990 Page 3 In addition, Chairman VanDeVoorde stated that Thomas LoCascio and the City Clerk should also be on the committee. The following additional people volunteered to serve: Thomas Bahl, Tyler Creek Plaza Eagle Food store manager; Richard Wick of South McLean Eagle Food store; Jerry Mowinski, of Kalm Inc. ; and Dan Fox. Chairman VanDeVoorde directed that all liquor licensees be notified of advisory committee meetings . Consideration of attendance of applicants for Class G and I liquor licenses at meetings of Liquor Commission The Elgin Municipal Code does not require that applicants for a Class G or I (temporary) liquor license be present when their application is considered by the Liquor Commission. Assistant Corporation Counsel, Dan Blondin, recommended that as a matter of policy the Commission require that a representative of a Class G or I liquor license applicant attend the meeting when their application is considered. In the past, Elgin Community College has periodically applied for temporary liquor licenses to be able to serve wine at special dinners held at its gourmet restaurant, which is Liquor Control Commission Meeting Minutes November 7, 1990 Page 4 operated by students in connection with the culinary arts program. In a letter from Dr. Eric Larson to Mayor VanDeVoorde, a request was made that ECC be able to apply once a year for temporary licenses for each of the special functions to be held during that year rather than having to appear before the Liquor Commission prior to each individual function. After discussion, the Liquor Commission determined that a more appropriate solution might be to establish an additional license class . The Commission directed Assistant Corporation Counsel, Dan Blondin, to draft a proposed ordinance establishing a new license class specifically for Elgin Community College in conjunction with its culinary arts program. Members present: Commissioners Fox and Moylan. Absent: Chairman VanDeVoorde. Consideration of Application for Class A Liquor License by Mattie M. Jones for 15 North State Street (Barley & Hops, Ltd. ) The Commission was informed that the applicant had contacted the City Clerk and requested a continuance to the next meeting on consideration of her application. Commissioner Fox made a motion, seconded by Commissioner Moylan, to set the next meeting of the Liquor Commission on January 9, 1991, at a time to be determined, and to continue consideration of the aforementioned application until the next scheduled meeting. Consideration of Marriott Corporation request for liquor license for special functions at 2500 Westfield Drive - First Chicago Corporation (FCC) The Marriott Corporation has been contracted to provide food service at the aforementioned facility. They are requesting a liquor license for private special functions to be held on said premises . The current Elgin Municipal Code does not have a license class for this type of operation. Commissioner Fox made a motion, seconded by Commissioner Moylan, directing the staff to draft an ordinance establishing a new license class for service of liquor for private special events . Consideration of Ordinance adding Class K liquor license for community colleges Commissioner Fox made a motion, seconded by Commissioner Moylan, to recommend for approval by the City Council, the proposed ordinance amending Chapter 6 . 06 of the Elgin Municipal Code regarding the sale of liquor by community colleges during special events . Liquor Control Commission Meeting Minutes December 5, 1990 Page 2 eft Consideration of Ordinance adding liquor license class for delivery of liquor on a complimentary basis by motel or hotel The Commission had previously received a request from Focus Group, Inc . , on behalf of Carlton Lodge, for establishment of a liquor license class for the aforementioned purpose. In view of the fact that the Carlton Lodge has no plans at this time to build a hotel or motel in Elgin, Commissioner Fox made a motion, seconded by Commissioner Moylan, to table discussion and implementation of the proposed ordinance, and direct the staff to send a letter to the Carlton Lodge advising them that a proposed ordinance has been prepared, and the Commission will proceed with consideration at such time as Carlton Lodge' s development plans have been finalized. Consideration of Procedure Regarding Liquor Commission Minutes A short discussion was held regarding the past practice of not having the Liquor Commission minutes approved by the Commission, although they are approved by the Council . Dan Blondin stated that the Liquor Commission should approve the minutes of its meetings prior to submission to the City Council . Sue directed that the Commission members be furnished with copies of the minutes for approximately the last six months to be considered for approval at its January meeting.
